§ 1. Määruse reguleerimisala
Määrusega kehtestatakse ehitusmaterjalide ja -toodete (edaspidi koos ehitustoode) kohustuslike deklareeritavate omaduste loetelu ja vastavushindamise korra nõuded.
Käesolevat määrust ei kohaldata avalikult kasutataval teel tehtavatel teehoiutöödel kasutatavate tee ehitusmaterjalide ja -toodete suhtes.
Toimivuse püsivuse hindamis- ja tõendamissüsteemi all mõistetakse Euroopa Parlamendi ja nõukogu määruse (EL) 2024/3110, millega sätestatakse ehitustoodetele ühtlustatud turustusreeglid ning tunnistatakse kehtetuks määrus (EL) 305/2011 (ELT L, 2024/3110, 18.12.2024), lisas IX sätestatud hindamis- ja tõendamissüsteeme.
Toimivuse püsivuse hindamis- ja tõendamissüsteemides nimetatud teada antud asutuse ülesandeid võib ühtlustamata valdkonnas täita vastavaks tegevuseks akrediteeritud asutus.

§ 1. Scope of application
(1) The regulation establishes the requirements for the list of mandatory declared characteristics and conformity assessment procedure for building materials and construction products (hereinafter together referred to as construction product).
(2) This regulation will not apply to the road building materials and construction products used for road management works.
(3) System of assessment and verification of constancy of performance means the conformity assessment systems provided for in Annex 5 of the Regulation (EU) No 305/2011 of the European Parliament and of the Council laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (ELT L 88, 04.04.2011, p. 5‒43).
(4) An institution accredited for relevant activity can perform the tasks of the notified body indicated in the system of assessment and verification of the constancy of performance in the non-harmonized area.
§ 2. Ehitustoodete dokumentatsioon
Ehitustootega peab kaasas olema teave selle omaduste ning kasutusala ja -viiside kohta.
Käesoleva määruse § 1 lõikes 3 nimetatud Euroopa Parlamendi ja nõukogu määruse (EL) nr 2024/3110 artiklis 15 ja V lisas osutatud toimivus- ja vastavusdeklaratsioon ning IV lisas osutatud üldine tooteteave, kasutusjuhend ja ohutusteave esitatakse eesti keeles.

§ 2. Documentation of the construction products
(1) The construction product must be accompanied by information about its characteristics, area of application and use, e.g. user and installation manuals.
(2) Declaration of performance according to § 1 (3) of the specified Regulation (EU) No. 305/2011 of the European Parliament and of the Council and information enclosed with the construction product is provided in Estonian.
§ 2¹. Ehitustootest pärinev gammakiirgus
Ehitustoote võimet emiteerida gammakiirgust iseloomustab aktiivsuskontsentratsiooni indeks, mis arvutatakse valemiga I = CRa226/300 Bq/kg + CTh232/200 Bq/kg + CK40/3000 Bq/kg, mille komponendid on järgmised:
I – aktiivsuskontsentratsiooni indeks;
CRa226 – radionukliidi Ra-226 aktiivsuskontsentratsioon ehitustootes (ühik Bq/kg);
CTh232 – radionukliidi Th-232 aktiivsuskontsentratsioon ehitustootes (ühik Bq/kg);
CK40 – radionukliidi K-40 aktiivsuskontsentratsioon ehitustootes (ühik Bq/kg);
Bq – bekerell;
kg – kilogramm.
Ehitustoote aktiivsuskontsentratsiooni indeks peab olema väiksem kui 1, välja arvatud juhul, kui ehitustoote kavandatud kasutusotstarbest tulenevalt lubab Keskkonnaamet kõrgema kiirgustasemega toodet kasutada.
Tootjad ja importijad peavad Keskkonnaameti nõudmisel tagama aktiivsuskontsentratsiooni indeksi määramise eelkõige nende ehitustoodete puhul, mis sisaldavad järgmiseid materjale või komponente:
looduslik materjal aluniit;
vulkaanilise päritoluga looduslik ehitusmaterjal või lisaaine, nagu granitoid (näiteks graniidid, süeniit ja ortogneiss), porfüür, tuff, putsolaan (laavatuhk), laava;
loodusliku radioaktiivse materjali töötlemisjääkidest pärinev materjal, nagu lendtuhk, fosfokips, fosforiräbu, tinaräbu, vaseräbu, punamuda (alumiiniumitootmise jääk), terasetootmise või haruldaste muldmetallide tootmise jäägid.
Käesoleva paragrahvi lõike 3 kohaselt saadud mõõtmistulemused ja info muude asjakohaste tegurite kohta esitatakse Keskkonnaametile.

§ 2¹. Gamma radiation emitted from the construction product
(1) The construction product´s ability to emit gamma radiation is described by activity concentration index that is calculated by using the formula I = CRa226/300 Bq/kg + CTh232/200 Bq/kg + CK40/3000 Bq/kg, which includes the following components:
1) I – activity concentration index;
2) CRa226 – activity concentration of the radionuclide Ra-226 in the construction product (unit Bq/kg);
3) CTh232 – activity concentration of the radionuclide Th-232 in the construction product (unit Bq/kg);
4) CK40 – activity concentration of the radionuclide K-40 in the construction product (unit Bq/kg);
5) Bq – becquerel;
6) kg – kilogram.
(2) The activity concentration index of the construction product must be less than 1, except if the Environmental Board has approved the use of a product with a higher emission on account of the intended usage purpose of the construction product.
§ 3. Läbiviigumaterjal ja vuugitäitematerjal
Läbiviigumaterjali ja vuugitäitematerjali, mis peab vastama tulepüsivusnõuetele, vastavushindamine toimub toimivuse püsivuse hindamise ja kontrollimise süsteemi 1 kohaselt.

§ 3. Penetration seal and joint filler material
Conformity assessment of the penetration seal and joint filler material which must conform to the fire resistance requirements is conducted according to the system 1 of the assessment and verification of the constancy of performance.
§ 4. Tuletõkkeavatäide ja tuletõkkesein
Tuletõkkeavatäide on ehituskonstruktsioonis paiknevate alaliste avade sulgemiseks kasutatav tervikkomplekt koos lengide või juhtlattide, ukselehe või aknaraamiga, rulooga ja muu seesugusega, millele on ette nähtud tulepüsivusomadused.
Klaasitud mittekandev tuletõkkesein on vertikaalselt paigaldatav tuletõkkeelement, mis koosneb klaasingust, klaasimissüsteemist ja raamistikust.
Tuletõkkeavatäite tulepüsivuse vastavushindamine toimub toimivuse püsivuse hindamise ja kontrollimise süsteemi 1 kohaselt.
Klaasitud mittekandva tuletõkkeseina tulepüsivuse vastavushindamine toimub toimivuse püsivuse hindamise ja kontrollimise süsteemi 3 kohaselt.
Kui tuletõkkeavatäite ja klaasitud mittekandva tuletõkkeseina vastavushindamine on teostatud vastavalt käesoleva määruse lisale 1, siis eeldatakse, et nõuetele vastavus on tõendatud.

§ 4. Structural passive fire protection and fire wall
(1) Structural passive fire protection is a fire protection system consisting of various components including frames or tie bars, door leaf or window frame, roller shutters and other similar for closing of permanent openings in the structure for which the fire resistance characteristics are foreseen.
(2) Glazed non-load bearing fire wall is a vertically installed fire restraining element containing of glazing, glazing system and framework.
(3) Conformance assessment of the fire resistance of the structural passive fire protections conducted according to the system 1 of the assessment and verification of the constancy of performance.
(4) Conformance assessment of the fire resistance of the glazed non-load bearing fire wall is conducted according to the system 3 of the assessment and verification of the constancy of performance.
(5) If the conformance assessment of the structural passive fire protection and the glazed non-load bearing fire wall is conducted according to Annex 1 of this Regulation, it is presumed that the conformity is certified.
§ 5. Avatäide ja rippfassaad
Avatäited käesoleva määruse tähenduses on määruse lisa 2 punktides 1–4 toodud ehitustooted.
Kui avatäitel ja rippfassaadil on määratud ja deklareeritud käesoleva määruse lisas 2 nimetatud omadused, siis eeldatakse, et need vastavad nõuetele.

§ 5. Fillings of openings in the structure and curtain walling
(1) For the purpose of this Regulation, the doors, windows and shutters are the construction products indicated in clauses 1-4 of Annex 2.
(2) If the doors, windows, shutters and the curtain walling have the characteristics established and declared in Annex 2 of this Regulation, it is presumed that they conform to the requirements.
§ 6. Tuletõkkevärv, -võõp ja -mastiks
Tuletõkkevärvi, -võõba ja -mastiksi vastavushindamine toimub toimivuse püsivuse hindamise ja kontrollimise süsteemi 1 kohaselt.

§ 6. Fire retardant paint, varnish and mastic
Conformance assessment of the fire retardant paint, varnish and mastic is conducted according to the system 1 of the assessment and verification of the constancy of performance.
§ 7. Betoonisegu
Betoonisegu käesoleva määruse tähenduses on valmissegatud betoon, mida tarnib isik, kes ei ole betoonisegu kasutaja.
Betoonisegu vastavushindamine toimub toimivuse püsivuse hindamise ja kontrollimise süsteemi 2+ kohaselt.

§ 7. Concrete mix
(1) For the purpose of this regulation, concrete mix is a ready-mixed concrete supplied by the person who is not the user of the concrete mix.
(2) Conformity assessment of the concrete mix is conducted according to system 2+ of the assessment and verification of the constancy of performance.
§ 8. Täitematerjal
Kui täitematerjali, sealhulgas betooni või mördi täitematerjali, kasutusala ohutusnõuded on olulised, nagu näiteks kandekonstruktsioonide valmistamisel, toimub täitematerjali vastavushindamine toimivuse püsivuse hindamise ja kontrollimise süsteemi 2+ kohaselt.
Käesoleva paragrahvi lõikes 1 nimetamata juhtudel toimub täitematerjali vastavushindamine toimivuse püsivuse hindamise ja kontrollimise süsteemi 4 kohaselt.

§ 8. Filler
(1) If the safety requirements of the area of application of the filler, including concrete or mortar filler are significant, like in manufacturing of load bearing structures, the conformance assessment of the filling material is conducted according to system 2+ of the assessment and verification of the constancy of performance.
(2) In cases not indicated in subsection 1 of this chapter, the conformance assessment of the filler is conducted according to system 4 of the assessment and verification of the constancy of performance.
§ 9. Müürikivi
Kandekonstruktsioonides on lubatud kasutada ainult I kategooria müürikive.
Kui müürikivil on määratud ja deklareeritud käesoleva määruse lisa 2 punktis 6 toodud omadused, siis eeldatakse, et müürikivi vastab nõuetele.

§ 9. Masonry unit
(1) Only the category I masonry units can be used in load bearing structures.
(2) If the masonry unit has the characteristics established and declared in clause 6 of Annex 2 of this Regulation, it is presumed that the masonry unit conforms to the requirement.
§ 11. Turujärelevalveasutus
Riiklikku järelevalvet käesoleva määruse nõuete järgimise üle teostab Tarbijakaitse ja Tehnilise Järelevalve Amet, välja arvatud käesoleva määruse § 2¹ puhul, mille nõuete järgmise üle teostab riiklikku järelevalvet Keskkonnaamet.

§ 11. Market supervision authority
The state supervision over the compliance with the requirements of this regulation shall be conducted by the Technical Regulatory Authority, with an exception of § 2¹ of this regulation, in which case the state supervision over the compliance with its requirements shall be conducted by the Environmental Inspectorate.
§ 12. Rakendussäte
Käesoleva määruse lisa 3 kehtib kuni 31. detsembrini 2013. a.
Kuni 31. detsembrini 2013. a võib ehitustoote nõuetele vastavust tõendada ka käesoleva määruse lisa 3 kohaselt.

§ 12. Implementing provision
(1) Annex 3 of this Regulation shall be valid until 31 December 2013.
(2) Conformity of the construction product can also be attested according to Annex 3 of this Regulation until 31 December 2013.
