Terms of use

1. Provider

LegalWise is provided by ESTERN TECH OÜ, registry code 17478852 (Estonian Commercial Register), Visase tn 12, 11415 Tallinn, Estonia, e-mail maikovernest@gmail.com.

2. The service

LegalWise provides general legal information based on Estonian and European Union law in force: answers to questions, a law database, document review and drafting, the law as of a chosen date and alerts when laws change. Sources are Riigi Teataja (including summaries of Supreme Court and EU Court of Justice decisions, and local government regulations), EUR-Lex, explanatory memoranda of the Riigikogu, the published decisions of the Public Procurement Review Committee and the Industrial Property Board of Appeal, and opinions of the Chancellor of Justice. Answers are produced automatically (with artificial intelligence) and checked against the sources before they are shown.

3. What the service is not

LegalWise is not a law firm and does not provide an attorney's legal services; using it creates no attorney–client relationship. Automated answers may contain errors and the law changes. Verify important conclusions in the original source and consult an attorney where deadlines, court proceedings, large sums or other high risks are involved.

4. Account

You must be at least 18 or act with your legal representative's consent. Keep your password secret and do not share your account; every user has their own account.

5. Plans, prices and payment

The plan, its limits and price are listed on the /hinnad page. The provider is not registered for VAT; no VAT is added to the prices. A paid plan is a monthly subscription paid in advance that renews automatically until you cancel it. Cancellation takes effect at the end of the current period. The plan has a monthly usage limit (the fair-use limit; about 400 questions a month on the price list; document review, drafting and research memos use the same limit); you see the share used as a percentage. When the limit is reached, new questions and documents can be submitted from the start of the next calendar month. To prevent abuse, the number of requests per hour is limited too. An unused limit does not carry over. With a promo code or access given by the provider, the plan is valid until the date stated in the code or notice; after that the plan's features end, and the account and its data are kept.

6. Consumer right of withdrawal

A consumer may withdraw from a distance contract within 14 days of the day the contract was concluded, without giving a reason (Law of Obligations Act § 56 subs. 1 and 1²). If you asked for the service to start within that period, on withdrawal you pay for the service already provided in proportion (Law of Obligations Act § 56² subs. 5). To withdraw, send an unequivocal statement to maikovernest@gmail.com; you may also use the model withdrawal form below (Law of Obligations Act § 56 subs. 2²). On withdrawal we refund the fee received from you (in the case described in the previous sentence, less the value of the service already provided) without undue delay and no later than 14 days after receiving the withdrawal statement (Law of Obligations Act § 56¹ subs. 1).

7. Your obligations

You will not use the service for unlawful purposes, overload it or harvest it automatically, try to bypass its checks, or upload documents you have no right to process.

8. Intellectual property

The software, design and database structure belong to the provider. Legislation and court decisions are public information. You may use the answers, reports and drafted documents for yourself and for your clients. A drafted document is a draft: check it and adapt it to your situation before use.

9. Liability

We do everything reasonable to keep answers accurate and the service available, but we are not liable for decisions made on the basis of the service or for indirect damage. Liability is not limited for intentional breach (Law of Obligations Act § 106 subs. 2) or to the extent that a limitation would be prohibited by law towards a consumer.

10. Changes to the service and the terms

We may develop and change the service. We announce material changes to the terms by e-mail at least 30 days in advance; if you do not agree, you may cancel your subscription.

11. Personal data

The privacy policy describes how personal data is processed.

12. Governing law and disputes

These terms are governed by Estonian law. Send complaints to maikovernest@gmail.com; we reply within 15 days. Consumers may also turn to the Consumer Disputes Committee (Consumer Protection and Technical Regulatory Authority, www.ttja.ee). Court disputes are heard by Harju County Court unless the law provides otherwise for a consumer.
