§ 1. Mõisted ja üldtingimused
Määruses kasutatakse mõisteid järgmises tähenduses:
nimimaht on mõõtemahutina kasutatavale pakendile (edaspidi mõõtemahuti) märgitud selles sisalduv lõikes 2 nimetatud temperatuuril ja mõõtemahuti tootja määratud viisil täidetud vedeliku maht;
kogumaht on vedeliku maht, mida ääreni täidetud mõõtemahuti sisaldab;
täitemaht on vedeliku maht, mida lõikes 2 nimetatud temperatuuril ja mõõtemahuti tootja määratud viisil täidetud mõõtemahuti tegelikult sisaldab;
nimimahu lubatud hälve on tootmisel juhuslikult tekkinud suurim positiivne või negatiivne täitemahu mittesüsteemne erinevus nimimahust temperatuuril +20 ºC;
tühimik on nimimahule vastava teoreetilise täitetaseme ja kogumahu taseme vaheline kaugus ning nimimahu ja kogumahu vahe, mis peab olema konstantne kõikide sama tarindi järgi valmistatud mõõtemahutite puhul.
Mõõtemahuti nimi-, kogu- ja täitemahu määramise temperatuur on +20 ºC.
Mõõtemahuti täitmisviisid on täitmine mõõtemahuti tootja määratud tasemeni või tühimikuni.
§ 1. Definitions and general provisions
(1) For the purposes of this Regulation, terms are used in the following meanings:
1) nominal capacity is the volume of liquid which is marked on a measuring container bottle (hereinafter measuring container bottle) and which the latter contains at the temperature specified in subsection (2) when it is filled in the manner determined by the manufacturer of the measuring container bottle;
2) brim capacity is the volume of liquid which the measuring container bottle contains when it is filled to the brim;
3) actual capacity is the volume of liquid which a measuring container bottle in fact contains at the temperature specified in subsection (2) when it is filled in the manner determined by the manufacturer of the measuring container bottle;
4) maximum permissible error is the greatest non-systemic difference (positive or negative) in the actual capacity of a measuring bottle container from its nominal capacity which has randomly occurred in manufacturing, at a temperature of +20 °C;
5) vacuity is the distance between the theoretical filling level for the nominal capacity and the brim level and the difference between the brim capacity and the nominal capacity which shall be constant for all measuring container bottles made to the same design.
(2) The nominal capacity, brim capacity and actual capacity of a measuring container bottle shall be determined at the temperature of +20 °C.
(3) The methods of filling a measuring container bottle are; to a level determined by the manufacturer of the measuring container bottle, or to vacuity.
§ 2. Mõõtemahuti märgistamine
Mõõtemahutile peab mõõtemahuti tootja märkima kustumatult, kergesti loetavalt ja nähtavalt järgnevad andmed:
mõõtemahuti küljele, põhjaäärisele või põhjale mõõtemahuti nimimahu liitrites, sentiliitrites või milliliitrites koos asjakohase kohustusliku mõõtühikuga;
mõõtemahuti küljele, põhjaäärisele või põhjale tootja identifitseerimistähise;
mõõtemahuti põhjale või põhjaäärisele lähtuvalt § 1 lõikes 3 sätestatud mõõtemahuti täitmisviisist mõõtemahuti kogumahu sentiliitrites ühiku tähiseta cl või kogumahu taseme ja nimimahule vastava teoreetilise täitetaseme vahelise kauguse millimeetrites koos ühikutähisega mm või mõlemad.
Mõõteseaduse § 17 lõikes 5 nimetatud eritähis „з” (pööratud epsilon) peab olema vähemalt 3 mm kõrgune ja märgitud mõõtemahuti küljel, põhjaäärisel või põhjal.
Mõõtemahutile märgitud numbrite ja tähtede väikseimad lubatud kõrgused on toodud tabelis 1.

Lõike 1 punktis 3 sätestatud tähised peavad olema selgelt eristatavad lõike 1 punktides 1 ja 2 ja lõikes 2 sätestatud tähistest.
Mõõtemahutil võib olla muid tähiseid ja märgistusi tingimusel, et need ei ole eksitavad käesolevas paragrahvis kehtestatud tähistuste suhtes.
§ 2. Marking of measuring container bottles
(1) The manufacturer of a measuring container bottle shall mark the following data on the measuring container bottle in an indelible, easily legible and visible manner:
1) on the side, on the bottom rim or on the bottom of the measuring container bottle an indication of its nominal capacity in litres, centilitres or millilitres followed by the relevant compulsory unit of measurement;
2) on the side, on the bottom rim or on the bottom of the measuring container bottle the manufacturer’s identifying mark;
3) on the bottom or on the bottom rim of the measuring container bottle, depending on the method of filling of the measuring container bottle specified in subsection 1 (3), an indication of the brim capacity expressed in centilitres and not followed by the symbol cl, or the an indication of the distance in millimetres from the brim level to the filling level corresponding to the nominal capacity, followed by the symbol mm, or both.
(2) The height of the special symbol ‘ē’ (reversed epsilon) set out in subsection 17 (5) of the Metrology Act shall be at least 3 mm, and it shall be indicated on the side, on the bottom rim or on the bottom of the measuring container bottle.
(3) The smallest permissible heights of numbers and letters marked on a measuring container bottle are specified in Table 1.

(4) The indications specified in clause (1) 3) shall be clearly distinguishable from the indications specified in clauses (1) 1) and 2) and in subsection (2).
(5) Other indications and marks may appear on the measuring container bottle provided they do not give rise to confusion with the compulsory indications provided for in this section.
§ 3. Nimimahu väärtused ja nende lubatud hälbed
Nimimahu suurimad lubatud hälbed on toodud tabelis 2.

Kogumahu kontrollimisel on suurim lubatud hälve võrdne vastava nimimahu suurima lubatud hälbe väärtusega.
§ 3. Values of nominal capacities and their maximum permissible errors
(1) The maximum permissible errors of nominal capacities are set out in Table 2.

(2) In verifying the brim capacity, the maximum permissible error shall be the same as the maximum permissible error in the corresponding nominal capacity.
§ 4. Mõõtemahuti mahu kontroll
Tarbijakaitse ja Tehnilise Järelevalve Amet viib läbi legaalmetroloogilise kontrolli mõõtemahuti mahu mõõteseadusele ja käesolevale määrusele vastavuse kontrollimiseks järgides kontrollimisel nõukogu direktiivi 75/107/EMÜ mõõtemahutitena kasutatavaid pakendeid käsitlevate liikmesriikide õigusaktide ühtlustamise kohta (EÜT L 42, 15.02.1975, lk 14–20) lisa II nõudeid. Kontrollimiseks võib kasutada mõlemat nõukogu direktiivi 75/107/EMÜ lisas II nimetatud meetodit.
Tarbijakaitse ja Tehnilise Järelevalve Amet võib mõõtemahuti mahu vastavuse kontrollimiseks kasutada pädevat mõõtjat.
Tarbijakaitse ja Tehnilise Järelevalve Amet moodustab juhuslikkuse põhimõttel kontrollitavate mõõtemahutite hulgast kontrollitavate mõõtemahutite valimi (edaspidi proov).
Proovi moodustamisel dokumenteerib Tarbijakaitse ja Tehnilise Järelevalve Amet vähemalt järgmised andmed:
mõõtemahutite valimise aeg ja koht;
kontrollimiseks võetud mõõtemahuteid identifitseerivad andmed;
mõõtemahutite nimimaht ja täitmisviisi kirjeldus;
kontrollimiseks võetud mõõtemahutite arv.
Kui mõõtemahuti vastavuse kontrollimine toimub väljaspool proovi võtmise kohta, korraldab Tarbijakaitse ja Tehnilise Järelevalve Amet kontrollimiseks võetud mõõtemahutite pakendamise ja transportimise, mis tagab mõõtemahutite omaduste säilitamise kuni proovi jõudmiseni pädeva mõõtja juurde.
Väljaspool proovi võtmise kohta kontrollimiseks võetud mõõtemahuteid sisaldav pakend suletakse kleebisega, millele märgitakse vähemalt proovi võtnud asutusena Tarbijakaitse ja Tehnilise Järelevalve Amet, proovi võtnud ametniku nimi ja allkiri ning proovivõtu kuupäev. Kleebis kinnitatakse pakendile nii, et seda rikkumata ei ole võimalik pakendit avada.
Pädev mõõtja kontrollib saabumisel proovi sisaldavat pakendit sulgevate kleebiste korrasolekut ning säilitab mõõtemahutid tingimustes, mis tagab nende omaduste säilimise kontrollimiseni või käitlejale tagastamiseni.
Tarbijakaitse ja Tehnilise Järelevalve Amet teavitab mõõtemahutite käitlejat kontrolli tulemustest kirjalikult kahe nädala jooksul arvates kontrolli algusest.
§ 4. Checking capacity of measuring container bottles
(1) The Consumer Protection and Technical Regulatory Authority carries out legal metrological control to check the compliance of the capacity of measuring container bottles with the Metrology Act and this Regulation in accordance with the requirements of Annex II to Council Directive 75/107/EEC on the approximation of the laws of the Member States relating to bottles used as measuring containers (OJ L 42, 15.2.1975, p. 14–20). Both methods specified in Annex II to Council Directive 75/107/EEC can be used.
(2) The Consumer Protection and Technical Regulatory Authority may use a competent measurer for checking the compliance of the capacity of measuring container bottles.
(3) The Consumer Protection and Technical Regulatory Authority forms a random sample of measuring container bottles from among the measuring container bottles which are being checked (hereinafter sample).
(4) The Consumer Protection and Technical Regulatory Authority shall document at least the following data while forming a sample:
1) time and place of selecting the measuring container bottles;
2) data identifying the measuring container bottles taken for checking;
3) nominal capacity of the measuring container bottles and description of the method of filling;
4) number of measuring container bottles taken for checking.
(5) If the compliance of a measuring container bottle is checked outside the place of sampling, the Consumer Protection and Technical Regulatory Authority shall organise the packing and transport of the measuring container bottles taken for checking in such manner as to ensure that the properties of the measuring container bottles are maintained until the sample arrives at the competent measurer.
(6) A package containing measuring container bottles taken for checking outside the place of sampling shall be closed with a sticker indicating at least the Consumer Protection and Technical Supervisory Authority as the sampling authority, the name and signature of the official who took the sample, and the sampling date. The sticker shall be attached onto the packaging in such manner that it will not be possible to open the package without damaging the sticker.
(7) A competent measurer shall check the intactness of a package’s closing stickers upon arrival thereof, and shall maintain the measuring container bottles in conditions which ensure that their properties are maintained until they are checked or returned to the person handling the measuring container bottles.
(8) The Consumer Protection and Technical Supervisory Authority shall inform the person handling the measuring container bottles about the results of the check in writing within two weeks after the start of the check.
