§ 1. Kohaldamisala
Määrust kohaldatakse nõukogu määruses (EMÜ) nr 2658/87 tariifi- ja statistikanomenklatuuri ning ühise tollitariifistiku kohta (EÜT L 256, 07.09.1987, lk 1–675) kehtestatud kaupade nomenklatuuri rubriigis 7013 loetletud kristallklaasist toodetele (edaspidi toode).
Määrust ei kohaldata eksporditavatele toodetele.
§ 1. Scope of application
(1) The regulation applies to the crystal glass products listed under heading No 7013 of the goods nomenclature established by Council Regulation (EEC) No 2658/87 on the tariff and statistical nomenclature and on the Common Customs Tariff (OJ L 256, 7.9.1987, p. 1–675) (hereinafter the product).
(2) The regulation does not apply to exported products.
§ 2. Toote märgistamine
Tootja või levitaja võib majandus- või kutsetegevuse käigus turustataval tootel kasutada lisas 1 esitatud kategooria kirjeldust ja sümbolit, kui toode vastab omadustelt lisas 1 esitatud vastava tootekategooria kirjeldusele.
Kui toote kaubamärgis, tootja või levitaja ärinimes või muus toote märgistuses sisaldub lisas 1 esitatud sümbol või sellega äravahetamiseni sarnane tähistus, on tootja või levitaja kohustatud selgelt teavitama:
toote omaduste kohta käivas tootega kaasas olevas selgituses või kirjelduses toote vastavusest lisas 1 kirjeldatud omadustele;
selgitavas aruandes toote täpsetest omadustest, kui toode ei vasta lisas 1 kirjeldatud omadustele.
Lisas 1 sätestatud toote omaduste kirjeldus ja sümbol võivad olla toote ühel sildil või muul tootega kaasas oleval selgitusmaterjalil.
§ 2. Product labelling
(1) A manufacturer or distributor may use the description and symbol of the category provided in Annex 1 on a product marketed in their economic or professional activities, provided that the product corresponds in its characteristics to the description of the relevant product category provided in Annex 1.
(2) Where the trade mark of a product, the business name of the manufacturer or distributor or other product labelling includes the symbol provided in Annex 1 or a designation confusingly similar to that symbol, the manufacturer or distributor is obliged to clearly provide information:
1) in the explanation or description of the characteristics of the product accompanying the product, about the conformity of the product with the characteristics described in Annex 1;
2) in the explanatory report, about the exact characteristics of the product if the product does not correspond to the characteristics described in Annex 1.
(3) The description of the characteristics of the product and the symbol set out in Annex 1 may be on a single label of the product or in other explanatory material accompanying the product.
§ 3. Toote omaduste määramise meetodid
Paragrahvi 2 lõikes 1 nimetatud toote kategooria kirjeldust ja sümbolit kandva toote vastavust lisas 1 kirjeldatud omadustele tõendatakse lisas 2 määratletud meetodeid kasutades.
§ 3. Methods for determining product characteristics
The conformity of a product bearing the description and symbol of the category of product specified in subsection 1 of § 2 with the characteristics described in Annex 1 is demonstrated by the use of methods defined in Annex 2.
