§ 1. Kohaldamisala
Määrusega kehtestatakse tarbijale pakutava või müüdava jalatsi ning rõiva ja tekstiiltoote märgistamise täpsemad nõuded.
Määrust ei kohaldata:
kaitsejalatsile, millele kohaldub Euroopa Parlamendi ja nõukogu määrus (EL) 2016/425, mis käsitleb isikukaitsevahendeid ja millega tunnistatakse kehtetuks nõukogu direktiiv 89/686/EMÜ (ELT L 81, 31.3.2016, lk 51–98);
mänguasjajalatsile ja -rõivale ning -tekstiiltootele;
kantud jalatsile ja rõivale ning muule kasutatud tekstiiltootele, kui pakkuja või müüja neid sellistena määratleb.
§ 1. Scope of application
(1) The regulation lays down more specific requirements for the labelling of footwear, clothing and textile products offered or sold to the consumer.
(2) The regulation does not apply to:
1) protective footwear covered by Regulation (EU) 2016/425 of the European Parliament and of the Council on personal protective equipment and repealing Council Directive 89/686/EEC (OJ L 81, 31.3.2016, p. 51–98);
2) toy footwear, clothing and textile products;
3) worn footwear and clothing and other used textile products if identified as such by the supplier or seller.
§ 2. Jalats
Käesoleva määruse tähenduses loetakse jalatsiks iga tallaga toode ja selle toote määruse lisas 1 nimetatud eraldi turustatavaid peamised osised, mis on mõeldud jala katmiseks või kaitsmiseks.
§ 2. Footwear
For the purposes of this regulation, footwear is deemed to mean any product with soles as well as separately marketed main components of such product as specified in Annex 1 to the regulation that are intended to cover or protect the foot.
§ 3. Nõuded jalatsi märgistusele
Jalatsi peamiste osiste määratlused ja nende märgistamiseks kasutatavad piktogrammid ning kirjalikud märked on esitatud määruse lisas 1.
Jalatsi märgistus peab sisaldama teavet piktogrammide või kirjalike märgetena jalatsi peamistes osistes kasutatud materjalide kohta, mis moodustavad vähemalt 80 protsenti jalatsi pealse, voodri ning sisetalla välispinnast ja vähemalt 80 protsenti välistalla mahust. Jalatsis kasutatavate materjalide määratlused, vastavad piktogrammid ja kirjalikud märked on esitatud määruse lisas 2.
Jalatsi pealses kasutatud materjali märgistamisel ei arvestata selles kasutatud aksessuaare ja tugevdusi nagu pahkluu toestused, randid, ornamendid, pandlad, ehispaelad, paelaaugu toestused ja muud samalaadsed lisandid.
Kui jalatsi peamistes osistes kasutatud materjalide puhul on nende osatähtsus alla 80 protsendi, peab märgistus sisaldama teavet jalatsi valmistamisel kasutatud kahe põhilise materjali kohta.
Teave jalatsi peamistes osistes kasutatud materjalide kohta esitatakse iga jalatsipaari vähemalt ühel jalatsil või ühe jalatsi juures piktogrammina või eestikeelse kirjaliku märkena. Nimetatud teave võib olla jalatsile trükitud, kleebitud või pressitud või esitatud jalatsi külge kinnitatud etiketil. Määruse lisa 2 kohased piktogramm või kirjalik märge kasutatud materjalide kohta peab asetsema kõrvuti määruse lisa 1 kohase jalatsi vastavaid peamisi osiseid kujutava piktogrammi või kirjaliku märkega.
§ 3. Labelling requirements for footwear
(1) The definitions of the main components of footwear and the pictograms and written indications to be used for their labelling are set out in Annex 1 to the regulation.
(2) The labelling of footwear must include information in the form of pictograms or written indications of the materials used in the main components of footwear representing at least 80 per cent of the external surface of the upper, lining and sock and at least 80 per cent of the volume of the outer sole. The definitions, corresponding pictograms and written indications of the materials used in footwear are set out in Annex 2 to the regulation.
(3) For the purposes of labelling the material used in the upper of footwear, the accessories and reinforcements used in footwear, such as ankle supports, rims, ornaments, buckles, decorative straps, lacing hole supports and other similar accessories are not taken into account.
(4) Where the proportion of the materials used in the main components of footwear is less than 80 per cent, the labelling must contain information on the two main materials used in the manufacture of the footwear.
(5) Information on the materials used in the main components of footwear is presented on or with at least one article of footwear in each pair in the form of a pictogram or a written indication in Estonian. The specified information may be printed, sticked or embossed on the footwear or presented on a label attached to the footwear. The pictogram or written indication of the materials used in accordance with Annex 2 to the regulation must be adjacent to the pictogram or written indication representing the corresponding main components of footwear in accordance with Annex 1 to the regulation.
§ 4. Nõuded rõiva ja tekstiiltoote märgistusele
Käesolevas määruses kasutatakse mõistet tekstiiltoode vastavalt Euroopa Parlamendi ja nõukogu määruse (EL) nr 1007/2011 tekstiilkiudude nimetuste ja tekstiiltoodete kiukoostise märgistamise ja tähistamise kohta, millega tunnistatakse kehtetuks nõukogu direktiiv 73/44/EMÜ ning Euroopa Parlamendi ja nõukogu direktiivid 96/73/EÜ ja 2008/121/EÜ (ELT L 272, 18.10.2011, lk 1–64) artikli 3 punkti 1 alapunktides a ja b sätestatule.
Rõiva ja tekstiiltoote märgistusel esitatakse vähemalt järgmine teave:
tootenimetus, kui selle puudumine võib tarbijat eksitada;
teave toote suuruse kohta;
juhised toote hooldamiseks.
Lõike 2 punktides 2 ja 3 sätestatud teavet ei pea esitama Euroopa Parlamendi ja nõukogu määruse (EL) nr 1007/2011 lisas V nimetatud tekstiiltoote kohta.
Karusnahast ja nahast rõiva märgistamisel esitatakse lisaks lõikes 2 nimetatule vähemalt järgmine teave:
materjali liik;
naturaalse karusnaha puhul looma liik.
Rõiva ja tekstiiltoote hooldamise juhised märgitakse vahetult tootele, toote külge püsikinnitatud tekstiillindile, toote külge kinnitatud etiketile või toote müügipakendile.
Teabe andmisel toote suuruse kohta on soovitatav lähtuda Eesti standardist EVS-EN 13402 või muust samaväärsest standardist ning hooldusjuhiste andmisel on soovitatav lähtuda Eesti standardist EVS-EN ISO 3758 või muust samaväärsest standardist.
§ 4. Labelling requirements for clothing and textile products
(1) For the purposes of this regulation, the term ‘textile product’ is used in accordance with the provisions of Articles 3(1)(a) and (b) of Regulation (EU) No 1007/2011 of the European Parliament and of the Council on textile fibre names and related labelling and marking of the fibre composition of textile products and repealing Council Directive 73/44/EEC and Directives 96/73/EC and 2008/121/EC of the European Parliament and of the Council (OJ L 272, 18.10.2011, p. 1–64).
(2) At least the following information is presented on the labelling of clothing and textile products:
1) the product name, where its absence may mislead the consumer;
2) information about the size of the product;
3) instructions for the care of the product.
(3) The information specified in clauses 2 and 3 of subsection 2 need not be provided for a textile product specified in Annex V to Regulation (EU) No 1007/2011 of the European Parliament and of the Council.
(4) In addition to the information specified in subsection 2, at least the following information is presented on the labelling of fur and leather garments:
1) the type of material;
2) in the case of natural fur, the species of animal.
(5) Instructions for the care of clothing and textile products are indicated directly on the product, on a textile ribbon securely attached to the product, on a label attached to the product or on the sales packaging of the product.
(6) It is recommended to provide information on the size of the product on the basis of the Estonian standard EVS-EN 13402 or another equivalent standard and it is recommended to provide the instructions for care on the basis of the Estonian standard EVS-EN ISO 3758 or another equivalent standard.
