1. peatükk ÜLDSÄTTED
§ 1. Seaduse reguleerimisala
Käesolev seadus reguleerib loodusliku, põllumajandusliku, käsitööndusliku või tööstusliku päritoluga kaupade ja teenuste tähistamiseks kasutatavate geograafiliste tähiste õiguskaitset, välja arvatud Euroopa Liidu tasandil kaitstavate põllumajandustoodete, toiduainete ja alkohoolsete jookide geograafilisi tähiseid ja päritolunimetusi.
Euroopa Parlamendi ja nõukogu määruses (EL) nr 1151/2012 põllumajandustoodete ja toidu kvaliteedikavade kohta (ELT L 343, 14.12.2012, lk 1–29) sätestatud siseriiklikke toiminguid ning Euroopa Liidu tasandil kaitstavate alkohoolsete jookide geograafiliste tähiste ja päritolunimetuste osas ettenähtud siseriiklikke toiminguid teeb Regionaal- ja Põllumajandusministeerium.
§ 1. Scope of application of Act
(1) This Act regulates the legal protection of geographical indications used to designate goods and services of natural, agricultural, handicraft or industrial origin, except the geographical indications and designations of origin for agricultural products, foodstuffs and alcoholic beverages protected at European Union level.
(2) The Ministry of Regional Affairs and Agriculture performs the national operations provided in Regulation (EU) No 1151/2012 of the European Parliament and of the Council on quality schemes for agricultural products and foodstuffs (OJ L 343, 14.12.2012, pp 1–29) and the operations prescribed with regard to the geographical indications and designations of origin of alcoholic beverages protected at European Union level.
§ 2. Eesti Vabariigi ja välisriigi isiku õiguste ja kohustuste võrdsus
Geograafilise tähise õiguskaitset käsitlevates õigusaktides ettenähtud õigused ja kohustused kehtivad, arvestades käesolevas seaduses sätestatud piiranguid, võrdselt Eesti Vabariigi ja välisriigi isiku (edaspidi isik) suhtes.
§ 2. Equality of rights and obligations of natural and legal persons of the Republic of Estonia and of foreign states
The rights and obligations prescribed in legislation regulating the legal protection of geographical indications apply equally to natural and legal persons of the Republic of Estonia and of foreign states (hereinafter person), considering restrictions provided for in this Act.
§ 3. Geograafiline tähis ja geograafiline ala
Geograafiline tähis on:
geograafilise ala nimi või vihje sellele alale, mis näitab kauba või teenuse kindlat geograafilist päritolu, kui selliselt tähistatud kauba või teenuse konkreetne omadus, maine või muu tunnus on olulisel määral seostatav geograafilise alaga, kus kaupa toodetakse, töödeldakse või müügiks ette valmistatakse või kus teenust osutatakse;
muu sõna, sõnaühend või sümbol, mis on pikaajalise ja pideva kasutamise tulemusena muutunud olulisel määral seotuks geograafilise alaga, kus kaupa toodetakse, töödeldakse või müügiks ette valmistatakse või kus teenust osutatakse.
Geograafiline ala käesoleva seaduse tähenduses on riigi territoorium, selle teatud piirkond või koht. Geograafiline ala ei pea kokku langema samanimelise haldusüksuse või asustusüksusega. Geograafilise ala nimi geograafilise tähisena ei pea vastama selle geograafilise ala praegusele ametlikule nimele.
§ 3. Geographical indication and geographical area
(1) Geographical indication means:
1) the name of or a reference to a geographical area which indicates the specific geographical origin of a good or service if the given quality, reputation or other characteristic of the good or service so identified is essentially attributable to the geographical area where the good is produced, processed or prepared for sales or where the service is rendered;
2) another word, phrase or symbol that, resulting from long-term and consistent use, has become essentially attributable to the geographical area where the good is produced, processed or prepared for sales or where the service is rendered.
(2) For the purposes of this Act, a geographical area means the territory of a state, or a particular region or locality in that territory. A geographical area does not have to coincide with an administrative unit or settlement unit bearing the same name. The name of a geographical area serving as a geographical indication does not have to coincide with the current official name of that geographical area.
§ 4. Geograafilise tähise vorm
Geograafiline tähis võib vormilt olla sõnaline või kujunduslik.
Sõnalises vormis geograafiline tähis võib olla sõna või sõnaühend, mis on geograafilise ala nimi, sisaldab seda nime või viitab sellele.
Kujunduslikus vormis geograafiline tähis võib olla geograafilise ala kartograafiline kujund või sümbol, mis viitab kindlale geograafilisele alale.
§ 4. Form of geographical indication
(1) A geographical indication may be in word form or in figurative form.
(2) A geographical indication in word form may be a word or phrase that is the name of a geographical area, includes it or refers to it.
(3) A geographical indication in figurative form may be a cartographic representation or symbol of a geographical area referring to a particular geographical area.

§ 5. Geograafilise tähise õiguskaitse tagamine
Geograafilise tähise õiguskaitse antakse geograafilise tähise registreerimisega riiklikus geograafiliste tähiste registris (edaspidi register) käesolevas seaduses sätestatud korras.
Geograafilise tähise õiguskaitse tagatakse riikliku järelevalvega (edaspidi järelevalve) ja riikliku sunni kohaldamisega käesolevas seaduses ettenähtud alustel ja korras.
§ 5. Provision of legal protection of geographical indication
(1) Geographical indications shall be granted legal protection by registration in the state register of geographical indications (hereinafter register) pursuant to the procedure provided for in this Act.
(2) Legal protection to geographical indications shall be ensured by exercising state supervision (hereinafter supervision) and applying the enforcement powers of the state on the bases and pursuant to the procedure provided for in this Act.
§ 6. Geograafilise tähise õiguskaitse ulatus
Geograafilise tähise õiguskaitse ulatus määratakse geograafilise tähise registreeringu (edaspidi registreering) andmetega.
§ 6. Extent of legal protection of geographical indications
The extent of legal protection of a geographical indication shall be specified on the basis of the geographical indication registration (hereinafter registration) data.
§ 7. Geograafilise tähise õiguskaitse kestus
Geograafilise tähise õiguskaitse on tähtajatu.
§ 7. Term of legal protection of geographical indications
Legal protection of geographical indications does not have a term.
§ 8. Geograafilise tähisena mittekaitstav tähis
Õiguskaitset ei tagata tähisele, mis:
eksitab avalikkust kauba või teenuse geograafilise päritolu suhtes;
tähistab kaupa või teenust, mille konkreetne omadus, maine või muu iseloomulik tunnus ei ole olulisel määral seostatav kauba või teenuse geograafilise päritoluga;
vaatamata kauba või teenuse tegeliku geograafilise päritolu tõepärasele kajastamisele võib tekitada avalikkuses vale arusaama, et kaup või teenus pärineb teiselt geograafiliselt alalt;
on vastuolus avaliku korra või heade tavadega;
on algse geograafilise päritolu tähenduse kaotanud ja muutunud kauba või teenuse üldnimeks ja on kasutusel kauba või teenuse liigi, kvaliteedi, sordi või muude omaduste või tunnuste tähistamiseks;
sisaldab loomatõu või taimesordi nime või on sellega eksitavalt sarnane;
ei ole saanud õiguskaitset oma päritoluriigis või mille õiguskaitse on seal lõpetatud või mille kasutamisest on seal loobutud.
§ 8. Indications not protected as geographical indications
Legal protection is not granted to an indication that:
1) misleads the public as to the geographical origin of the good or service;
2) designates a good or service where the given quality, reputation or other characteristic of the good or service is not essentially attributable to the geographical origin of the good or service;
3) although literally true as to the geographical origin of the good or service, may falsely represent to the public that the good or service originates in another geographical area;
4) is contrary to public order or accepted principles of morality;
5) has lost its original meaning of geographical origin and has become the common name of a good or service and is being used to designate the kind, quality, variety or other properties or characteristics of a good or service;
6) includes the name of an animal breed or a plant variety or is misleadingly similar to it;
7) has not been granted legal protection in the country of origin or the legal protection of which has been terminated in the country of origin, or which has fallen into disuse in that country.
§ 9. Õigus taotleda geograafilise tähise registreerimist
Geograafilise tähise registreerimise taotlemise õigus on:
isikul, kes tegutseb tähisega tähistatava kauba tootjana, töötlejana või müügiks ettevalmistajana või teenuse osutajana tähises näidatud geograafilisel alal;
tarbijate või käesoleva lõike punktis 1 nimetatud isikute ühendusel, sõltumata selle asukohast ja juriidilisest vormist;
kauba või teenuse päritoluriigi pädeval ametiasutusel.
Käesoleva paragrahvi lõikes 1 nimetatud isik võib taotleda ainult sellise tähise registreerimist, mis vastab geograafilisele tähisele esitatud nõuetele ja on kooskõlas käesoleva seaduse §-s 4 sätestatuga ega ole §-s 8 sätestatu järgi mittekaitstav.
Geograafilise tähise registreerimise taotlemiseks pädevate Eesti ametiasutuste loetelu kinnitab Vabariigi Valitsus .
§ 9. Right to apply for registration of geographical indication
(1) The right to apply for the registration of a geographical indication is vested in:
1) a person who acts as the producer, processor or preparer for sales of the good designated with the indication, or as the renderer of the service in the geographical area specified in the indication;
2) an association of consumers or persons referred to in clause 1 of this subsection, regardless of its seat or legal form;
3) a competent authority of the country of origin of the good or service.
(2) The person referred to in subsection 1 of this section may only apply for the registration of an indication which meets the requirements prescribed for geographical indications and complies with the provisions of § 4 of this Act and which is not excluded from protection under § 8 of this Act.
(3) The list of Estonian administrative agencies competent for applying for the registration of geographical indications shall be approved by the Government of the Republic.
§ 10. Geograafilise tähise kasutaja
Registreeritud geograafilist tähist võib kauba või teenuse tähistamiseks kasutada isik, kes tegutseb registreeringus märgitud kauba tootja, töötleja või müügiks ettevalmistajana või teenuse osutajana registreeringus märgitud geograafilisel alal ja kelle kaubal või teenusel on kõik registreeringus märgitud omadused, maine või muud iseloomulikud tunnused.
§ 10. User of geographical indication
A registered geographical indication may be used for designating goods or services by a person who acts as the producer, processor or preparer for sales of the good specified in the registration or as the renderer of the service in the geographical area specified in the registration, and whose good or service has all the qualities, reputation or other characteristics specified in the registration.
§ 11. Geograafilise tähise õigusvastane kasutamine
Keelatud on:
geograafilise tähise või sellega eksitavalt sarnase tähise kasutamine kauba või teenuse tähistamiseks isikul, kes ei tegutse registreeringus märgitud kauba tootja, töötleja või müügiks ettevalmistajana ega teenuse osutajana registreeringus märgitud geograafilisel alal;
geograafilise tähise või sellega eksitavalt sarnase tähise kasutamine kauba või teenuse tähistamiseks, kui kaubal või teenusel puudub kas või üks registreeringus märgitud omadus, maine või muu iseloomulik tunnus;
geograafilise tähise või sellega eksitavalt sarnase tähise kasutamine kauba või teenuse tähistamiseks, mida registreering ei hõlma, kuid mis on registreeringuga hõlmatud kauba või teenusega samaliigiline;
geograafilise tähise või sellega eksitavalt sarnase tähise kasutamine muu kauba või teenuse tähistamiseks, kui see võib kaasa tuua kaitstud geograafilise tähise maine pahauskse ärakasutamise;
eksitava teabe kasutamine kauba või teenuse päritolu, olemuse või põhiomaduste kohta kauba või teenuse sise- või välispakendil, reklaammaterjalis või sellega seotud dokumentides;
sellise tähise kasutamine, mis, vaatamata kauba või teenuse tegeliku geograafilise päritolu tõepärasele kajastamisele, võib tekitada avalikkuses vale arusaama, et kaup või teenus pärineb teiselt alalt, isegi juhul, kui tegelik päritolu on näidatud;
teised toimingud, mis võivad avalikkust kauba või teenuse tegeliku päritolu suhtes eksitada.
Käesoleva paragrahvi lõikes 1 sätestatud keeld ei laiene oma ärinime kasutamisele äritegevuses, välja arvatud juhud, kui seda nime kasutatakse avalikkust eksitaval viisil.
Kauplemine kaubaga, mis on õigusvastaselt tähistatud registreeritud geograafilise tähisega, on keelatud, sõltumata sellest, kas vahendajat, müüjat või tarbijat kauba vastavast eripärast teavitatakse. See ei mõjuta kauba võõrandamiseks tehtud tehingu kehtivust.
§ 11. Unlawful use of geographical indication
(1) The following shall be prohibited:
1) the use of a geographical indication or a misleadingly similar indication for designating goods or services by a person who does not act as the producer, processor or preparer for sales of the good specified in the registration or as the renderer of the service in the geographical area specified in the registration;
2) the use of a geographical indication or a misleadingly similar indication for designating goods or services if the good or service lacks any quality, reputation or other characteristic specified in the registration;
3) the use of a geographical indication or a misleadingly similar indication for designating goods or services that are not covered by the registration but which are of the same kind as the goods and services covered by the registration;
4) the use of a geographical indication or a misleadingly similar indication for designating other goods or services where it may constitute the use of the reputation of the protected geographical indication in bad faith;
5) the use of any misleading information about the origin, nature or basic characteristics of the good or service on the inner or outer packaging, in advertising materials or relevant documents of the good or service;
6) the use of an indication which, although literally true as to the geographical origin of the good or service, may falsely represent to the public that the good or service originates in another area, even if the true origin is indicated;
7) other transactions which may mislead the public as to the true origin of the good or service.
(2) The prohibition provided for in subsection 1 of this section shall not extend to the use,
in the course of trade, of a person’s trade name, except where such name is used in such a manner as to mislead the public.
(3) Trading with a good which is unlawfully designated with a registered geographical indication shall be prohibited, regardless of whether the distributor, vendor or consumer has been notified of the relevant specific character of the good. This does not affect the validity of the transaction entered into for the transfer of the good.
§ 12. Geograafilist tähist sisaldava kaubamärgi varemkasutamisõigus
Kaubamärki, mis on heauskselt registreerimiseks esitatud või heauskselt registreeritud kas enne käesoleva seaduse jõustumise kuupäeva või enne, kui geograafiline tähis on oma päritoluriigis kaitse saanud, ei saa kehtetuks tunnistada, selle registreerimisest ei saa keelduda või selle kasutamist keelata põhjusel, et kaubamärk sisaldab registreeritud geograafilist tähist või on sellega eksitavalt sarnane, kui käesolev seadus ei sätesta teisiti.
Kaubamärgi registreerimiseks esitamine või registreerimine on heauskne, kui seda teinud isik ei teadnud ega pidanudki teadma, et tegemist on tähisega, mis näitab, et kaup või teenus on pärit kindlalt geograafiliselt alalt, kui kauba või teenuse konkreetne omadus, maine või muu iseloomulik tunnus on olulisel määral seostatav kauba või teenuse geograafilise päritoluga.
§ 12. Right of prior use of trade mark containing geographical indication
(1) A trade mark which has been filed for registration or registered in good faith before the date of entry into force of this Act or before the geographical indication becomes subject to legal protection in its country of origin shall not be declared invalid, shall not be refused registration or its use shall not be prohibited for the reason that the trade mark contains a registered geographical indication or is misleadingly similar to it, unless otherwise provided in this Act.
(2) A trade mark is filed for registration or registered in good faith if the person who filed for registration or registered the trade mark did not know nor should have known that the indication in question designates the good or service as originating in a specific geographical area and a given quality, reputation or other characteristic is essentially attributable to the geographical origin of the good or service.
§ 13. Hoiatustähis
Registreeritud geograafilise tähise kasutaja võib sellele lisada hoiatustähise «Registreeritud geograafiline tähis» või lühendi «G».
§ 13. Warning notice
The user of a registered geographical indication may add the warning notice " Registreeritud geograafiline tähis " (“Registered geographical indication”) or the abbreviation “ G ” to the indication.
3. peatükk ALKOHOOLSE JOOGI GEOGRAAFILISTE TÄHISTE ÕIGUSKAITSE ERISUSED
§ 14. Veinide homonüümsed geograafilised tähised
Veinide homonüümsed geograafilised tähised (edaspidi homonüümsed tähised) käesoleva seaduse tähenduses on identsed või eksitavalt sarnased sõnalised või kujunduslikud tähised, mida kasutatakse erinevate veinide tähistamiseks.
Sõnalises vormis homonüümsetel tähistel võib olla:
sama hääldus ja sama kirjapilt;
sama hääldus, kuid erinev kirjapilt;
erinev hääldus, kuid sama kirjapilt.
§ 14. Homonymous geographical indications for wines
(1) For the purposes of this Act, homonymous geographical indications for wines (hereinafter homonymous indications) mean the identical or misleadingly similar word or figurative indications which are used for identifying different wines.
(2) Homonymous indications in word form may have:
1) the same pronunciation and spelling;
2) the same pronunciation but different spelling;
3) different pronunciation but the same spelling.
§ 15. Homonüümsete tähiste eristamise kriteeriumid
Homonüümsete tähiste üksteisest eristamisel arvestatakse vaidlustamise korral:
eristava teabe olemasolu ja piisavust homonüümse tähisega veini etiketil;
homonüümse tähise ametlikku tunnustamist selle päritoluriigis;
homonüümse tähise kasutamise kestust;
homonüümse tähise kasutamise heausksust.
§ 15. Criteria for differentiating homonymous indications
Upon contestation, the following shall be taken into account in differentiating homonymous indications from each other:
1) the existence of differentiating information and its adequacy on the wine label with a homonymous indication;
2) the official recognition of the homonymous indication in its country of origin;
3) the duration of use of the homonymous indication;
4) the good faith of the use of the homonymous indication.
§ 16. Homonüümsete tähiste õiguskaitse tagamine
Õiguskaitse antakse igale homonüümsele tähisele eraldi.
§ 16. Provision of legal protection of homonymous indications
Legal protection shall be accorded to each homonymous indication independently.
§ 17. Homonüümse tähise kasutamise eritingimus
Homonüümse tähise kasutaja on kohustatud kandma veinietiketile teabe, mis on piisav ühe homonüümse tähise eristamiseks teisest eesmärgiga mitte eksitada tarbijat.
§ 17. Stipulation upon using homonymous indications
The user of a homonymous indication shall be obliged to provide the wine label with information sufficient to differentiate one homonymous indication from another with the purpose of avoiding misleading consumers.
§ 18. Registreeritud geograafilise tähise õigusvastane kasutamine alkohoolse joogi tähistamisel
Lisaks käesoleva seaduse § 11 lõigetes 1 ja 3 sätestatule on keelatud kasutada registreeritud geograafilist tähist sellise alkohoolse joogi tähistamiseks, mis ei pärine selle geograafilise tähisega osutatud geograafiliselt alalt, kaasa arvatud juhud, kui alkohoolse joogi tegelik päritolu on näidatud, kui geograafilist tähist kasutatakse tõlgitult või kui sellega kaasnevad väljendid «liik», «tüüp», «stiil», «imitatsioon» või muu seesugune.
§ 18. Unlawful use of registered geographical indication for designating alcoholic beverage
In addition to the provisions of subsection 1 and 3 of § 11 of this Act, a registered geographical indication shall not be used for designating an alcoholic beverage not originating in the geographical area indicated by the geographical indication in question, including cases where the true origin of the alcoholic beverage is indicated or the geographical indication is used in translation or accompanied by expressions such as “kind”, “type”, “style”, “imitation” or the like.
§ 19. Alkohoolse joogi geograafilise päritolu suhtes eksitav geograafiline tähis registreeritud kaubamärgi koosseisus
Asjast huvitatud isik võib nõuda alkohoolse joogi tähistamiseks enne käesoleva seaduse jõustumise kuupäeva registreeritud kaubamärgi kehtetuks tunnistamist, kui kaubamärk sisaldab registreeritud geograafilist tähist või on sellega eksitavalt sarnane ja sellega tähistatav alkohoolne jook ei pärine selle geograafilise tähisega osutatud geograafiliselt alalt.
§ 19. Trade mark containing geographical indication misleading as to geographical origin of alcoholic beverage
Any interested person may request that a trade mark registered for designating an alcoholic beverage be declared invalid before the date of entry into force of this Act if the trade mark contains a registered geographical indication or is misleadingly similar to it and the alcoholic beverage designated by the trade mark in question does not originate in the geographical area indicated by the geographical indication.
§ 20. Alkohoolse joogi geograafilise tähise varemkasutamisõigus
Eesti kodanik või isik, kelle alaline elu- või asukoht on Eestis ja kes on alkohoolse joogi tähistamiseks registreeritud geograafilist tähist kasutanud kas pidevalt ja heauskselt enne 1994. aasta 15. aprilli või pidevalt vähemalt 10 aasta jooksul enne seda kuupäeva, võib pärast tähise registreerimist jätkata tähise kasutamist identsete või samaliigiliste kaupade või teenuste tähistamiseks endises mahus.
§ 20. Right of prior use of geographical indications of alcoholic beverage
A citizen of Estonia or any person who has permanent residence or a permanent seat in Estonia and who has consistently and in good faith used a geographical indication registered for designating an alcoholic beverage before 15 April 1994 or used it consistently for not less than 10 years before the said date may continue, after registration of the indication, to use the indication in the same extent for goods or services which are identical or of the same kind.
4. peatükk GEOGRAAFILISE TÄHISE REGISTREERIMINE
§ 21. Register
Registri asutab ja registri pidamise põhimääruse kinnitab Vabariigi Valitsus .
Registri vastutav töötleja on Patendiamet.
Geograafilise tähise registreerimise taotlust (edaspidi registreerimistaotlus) menetleb ning otsuseid ja registrikandeid teeb Patendiamet.
Registrit peetakse eesti keeles. Võõrkeelsed dokumendid esitatakse registrile koos eestikeelse tõlkega.
§ 21. Register
(1) The register is established and the statutes for maintenance of the register are approved by the Government of the Republic.
(2) the Patent Office is the controller of the register.
(3) The Patent Office processes applications for registration of a geographical indication (hereinafter registration application), and makes decisions and entries in the register.
(4) The register shall be maintained in Estonian. Foreign-language documents shall be submitted to the register together with an Estonian translation.
§ 22. Registrikanne
Registrikanded on registreerimistaotluse menetluse kanne, registreeringu andmete kanne, registreeringu andmete muutmise kanne ja registreeringu kustutamise kanne.
Registrikanne jõustub selle tegemise päeval.
Registreeringu andmete kande, registreeringu andmete muutmise kande ja registreeringu kustutamise kande kohta avaldatakse teade Patendiameti ametlikus väljaandes.
Registreeringu andmete muutmise kande eest tasutakse riigilõivu.
§ 22. Register entry
(1) A register entry is an entry of registration application processing, an entry of registration data, an entry to amend a registration data entry and a deletion of a registration entry.
(2) A register entry shall enter into force on the date of making the entry.
(3) Notices of entries of registration data, entries to amend a registration data entry and deletions of a registration entry shall be published in the official gazette of the Patent Office.
(4) A state fee is payable for an entry to amend a registration data entry.
§ 23. Registreering
Registreering tehakse geograafilise tähise registreerimise otsuse alusel.
Registreeringud nummerdatakse geograafiliste tähiste registreerimise järjekorras.
Registreering hakkab tagasiulatuvalt kehtima registreerimistaotluse esitamise kuupäevast.
Registreeringu andmed on:
registreeringu number;
registreeringu andmete kande tegemise kuupäev;
geograafilise tähise reproduktsioon;
kaupade ja teenuste loetelu, mille tähistamiseks geograafilist tähist kasutatakse;
geograafilise ala määratlus;
kirjeldus, mis näitab kauba või teenuse konkreetse omaduse, maine või muu iseloomuliku tunnuse seost kauba või teenuse geograafilise päritoluga ja määratleb geograafilise ala (edaspidi kirjeldus);
kirjelduse lühikokkuvõte;
andmed geograafilise tähise kaitstuse kohta selle päritoluriigis või andmed päritoluriigi pädeva ametiasutuse kohta, kes on tõendanud kauba või teenuse konkreetse omaduse, maine või muu iseloomuliku tunnuse seost kauba või teenuse geograafilise päritoluga, ning andmed päritoluriigi pädeva ametiasutuse kohta, kes on tõendanud geograafilise tähise registreerimise taotleja (edaspidi taotleja) õigust taotleda geograafilise tähise registreerimist käesoleva seaduse § 9 lõikes 1 sätestatu järgi;
taotleja nimi, tema elu- või asukoha aadress;
taotleja esindaja nimi, kui taotlejal on esindaja;
registreerimistaotluse number;
registreerimistaotluse esitamise kuupäev.
§ 23. Registration
(1) A registration shall be made on the basis of a decision to register a geographical indication.
(2) Registrations are numbered in the order in which geographical indications are registered.
(3) A registration enters into force retroactively from the filing date of the registration application.
(4) Registration data are:
1) the registration number;
2) the date of making the entry of registration data;
3) the representation of the geographical indication;
4) the list of goods and services designated with the geographical indication;
5) the identification of the geographical area;
6) the description showing the link of a given quality, reputation or other characteristic of a good or service with the geographical origin of the good or service and identifying the geographical area (hereinafter description);
7) the short summary of the description;
8) the data of the protection of the geographical indication in its country of origin or the data of the competent agency of the country of origin that has certified the link of a given quality, reputation or other characteristic of a good or service with the geographical origin of the good or service, and the data of the competent agency of the country of origin that has certified the right of the applicant for registration of a geographical indication (hereinafter applicant) to apply for registration of the geographical indication pursuant to the provisions of subsection 1 of § 9 of this Act;
9) the name and address of residence or seat of the applicant;
10) the name of the representative of the applicant, if the applicant has a representative;
11) the registration application number;
12) the filing date of the registration application.
§ 24. Registreerimistaotlus
Taotleja võib ühes registreerimistaotluses taotleda ainult ühe geograafilise tähise registreerimist.
Registreerimistaotlus peab koosnema järgmistest dokumentidest:
geograafilise tähise registreerimise avaldus;
kirjeldus;
tõend geograafilise tähise kaitstuse kohta selle päritoluriigis või päritoluriigi pädeva ametiasutuse tõend, mis kinnitab kauba või teenuse konkreetse omaduse, maine või muu iseloomuliku tunnuse seost kauba või teenuse geograafilise päritoluga, ning päritoluriigi pädeva ametiasutuse tõend taotleja õiguse kohta taotleda geograafilise tähise registreerimist käesoleva seaduse § 9 lõikes 1 sätestatu järgi;

§ 24. Registration application
(1) In one registration application, the applicant may apply for the registration of only one geographical indication.
(2) A registration application shall comprise the following documents:
1) a request for the registration of a geographical indication;
2) a description;
3) a certificate of the protection of the geographical indication in its country of origin, or a certificate issued by the competent agency of the country of origin certifying the link of the given quality, reputation or other characteristic of the good or service with the geographical origin of the good or service, and a certificate issued by the competent agency of the country of origin of the right of the applicant to apply for registration of a geographical indication pursuant to the provisions of subsection 1 of § 9 of this Act;
5) a power of attorney if the applicants have a joint representative and the request for the registration of a geographical indication has not been signed by all the applicants.
(3) The list of Estonian agencies competent to issue a certificate specified in clause 3 of subsection 2 of this section and the procedure for issuing certificates is approved by the Government of the Republic.
(4) The formal requirements for and the procedure for submission of registration application documents are established by the minister in charge of the policy sector.
§ 25. Geograafilise tähise registreerimise avaldus
Geograafilise tähise registreerimise avalduses peab sisalduma:
geograafilise tähise registreerimise sooviavaldus;
geograafilise tähise reproduktsioon;
taotleja nimi, elu- või asukoha aadress ja muud kontaktandmed;
teave geograafilise tähise registreerimise taotlemise õiguse kohta käesoleva seaduse § 9 lõikes 1 sätestatu järgi;
kirjelduse lühikokkuvõte, mis peab vastama kirjelduse sisule;
taotleja esindaja nimi, kui taotlejal on esindaja;
taotleja või tema esindaja allkiri.
§ 25. Request for registration of geographical indication
(1) A request for the registration of a geographical indication shall set out:
1) a statement requesting the registration of a geographical indication;
2) a representation of the geographical indication;
3) the name and address of residence or seat of the applicant and other contact data;
4) information about the possession of the right to apply for the registration of the geographical indication pursuant to the provisions of subsection 1 of § 9 of this Act;
5) a short summary of the description which shall comply with the content of the description;
6) the name of the representative, if the applicant has a representative;
7) the signature of the applicant or the representative of the applicant.
§ 26. Kirjeldus
Kirjelduses peab sisalduma:
kauba või teenuse nimi;
kaupa iseloomustavad tunnused (füüsikaliste, keemiliste, mikrobioloogiliste, organoleptiliste või muude omaduste loetelu vastavalt kaubale);
kauba valmistamise meetodit või teenust iseloomustavad tunnused;
geograafilise ala määratlus;
andmed, mis näitavad kauba või teenuse konkreetse omaduse, maine või muu iseloomuliku tunnuse seost geograafilise päritoluga.
Kirjelduses võivad sisalduda toorainet iseloomustavad tunnused, hoiatustähise kasutamise andmed ja muud andmed, mida taotleja peab vajalikuks esitada.
Kirjeldus peab andma täieliku ja täpse ettekujutuse kauba või teenuse konkreetse omaduse, maine või muu iseloomuliku tunnuse seosest kauba või teenuse geograafilise päritoluga.
Kui ühe ja sama geograafilise tähisega tähistatakse erinevate omadustega kaupu või teenuseid, esitatakse kirjeldus iga kauba või teenuse kohta eraldi.
§ 26. Description
(1) A description shall set out:
1) the name of the good or service;
2) the features characterising the good (a list of physical, chemical, microbiological, organoleptic or other qualities according to the particular good);
3) the features characterising the service or the method of producing the good;
4) the identification of the geographical area;
5) the particulars certifying the link of a given quality, reputation or other characteristic of the good or service with the geographical origin.
(2) The description may contain features characterising the raw material, the data about the use of a warning notice and other data which the applicant considers necessary to submit.
(3) The description shall give a complete and exact idea of the link of the given quality, reputation or other characteristic of the good or service with the geographical origin of the good or service.
(4) If the same geographical indication is used to designate goods or services with different features, the description shall be submitted for each good or service separately.
§ 27. Registreerimistaotluse esitamine
Registreerimistaotlus esitatakse Patendiametile.

§ 27. Filing of registration application
(1) Registration applications are filed with the Patent Office.
(3) The state fee is paid within one month after the date of receipt of the registration application.
(4) The power of attorney granted to a joint representative of the applicants is submitted within two months after the date of receipt of the registration application.
§ 28. Taotleja esindamine
Geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toiminguid teostab taotleja või tema volitatud patendivolinik.
Kui taotleja elu- või asukoht on väljaspool Eesti Vabariiki, esitab registreerimistaotluse taotleja või patendivolinik. Registreerimistaotluse esitamisele järgnevaid geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toiminguid teostab ainult taotleja volitatud patendivolinik.
Kui registreerimistaotluse esitavad ühiselt mitu taotlejat, peavad nad volitama järgnevate geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toimingute teostamiseks patendivoliniku või valima enda hulgast esindaja (edaspidi ühine esindaja), kelle elu- või asukoht on Eesti Vabariigis.
Volikirjas peab sisalduma:
taotleja nimi ja elu- või asukoha aadress;
patendivoliniku korral tema ees- ja perekonnanimi;
ühise esindaja korral tema nimi ja elu- või asukoha aadress;
volituse ulatus;
edasivolitamise õigus, kui esindatav selle õiguse esindajale annab;
volituse kehtivusaeg;
esindatava allkiri;
volikirja väljaandmise koht ja kuupäev.
Patendivoliniku puhul, kes esindajana teeb geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toiminguid, eeldatakse esindusõiguse olemasolu. Esindusõiguse olemasolus kahtlemise korral on Patendiametil või tööstusomandi apellatsioonikomisjonil õigus nõuda patendivolinikult volikirja esitamist. Volikiri tuleb esitada kahe kuu jooksul nõude esitamisest arvates. Põhjendatud taotluse alusel võib Patendiamet pikendada volikirja esitamise tähtaega üks kord ühe kuu võrra.
Taotleja isiklikku osavõttu geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toiminguga seotud menetlusest ei loeta esindajast loobumiseks, kui esindatav ei ole Patendiametile kirjalikult teatanud teisiti.
§ 28. Representation of applicant
(1) The procedures related to the registration of a geographical indication and to the continued validity of the registration shall be performed by an applicant or a patent attorney authorised by the applicant.
(2) If the residence or seat of the applicant is outside the Republic of Estonia, the registration application shall be filed by the applicant or the patent attorney. After the filing of the registration application, procedures related to the registration and to the continued validity of the geographical indication shall be performed only by a patent attorney authorised by the applicant.
(3) If several applicants file a registration application jointly, they shall authorise a patent attorney or choose a representative from among themselves (hereinafter joint representative), whose residence or seat is in the Republic of Estonia, to perform any procedures related to the registration or to the continued validity of the geographical indication.
(4) A power of attorney shall set out the following:
1) the name and address of the residence or seat of the applicant;
2) in case of a patent attorney, the given name and surname of the patent attorney;
3) in case of a joint representative, the name and address of the residence or seat of the representative;
4) the scope of the authorisation;
5) the right to delegate authorisation, if the principal grants such right to the representative;
6) the term of validity of the authorisation;
7) the signature of the principal;
8) the place and date of issue of the power of attorney.
(5) A patent attorney performing procedures related to the registration of a geographical indication and to the continued validity of the registration as a representative is presumed to have the right of representation. In case of doubt as to the existence of the right of representation, the Patent Office or the Industrial Property Board of Appeal has the right to require the patent attorney to submit a power of attorney. The power of attorney must be submitted within two months after the request is presented. In case of a reasoned application, the Patent Office may extend the term for submission of the power of attorney once by one month.
(6) The personal participation by an applicant in the processing concerning procedures related to the registration of a geographical indication and to the continued validity of the registration is not deemed to constitute renouncement of a representative, unless the principal informs the Patent Office otherwise in writing.
§ 28¹. Patendiameti teadete edastamine
Patendiamet edastab geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toimingutega seonduvad teated taotleja või muu toimingu tegemist taotleva isiku esindajale, kui esindatav ei ole Patendiametile kirjalikult teatanud teisiti, ning esindaja puudumise korral isikule endale.
Käesoleva paragrahvi lõike 1 tähenduses loetakse esindajaks isik, kes on taotleja või muu toimingu tegemist taotleva isiku esindajana esitanud taotluse või avalduse või teinud Patendiameti menetluses muu toimingu või kes on kantud taotleja esindajana registrisse, kui esindatav ei ole Patendiametile kirjalikult teatanud teisiti.
Kui isikul on käesoleva paragrahvi lõike 2 tähenduses mitu esindajat, edastatakse teated viimati teatatud esindajale, eelistades samal kuupäeval teatatud esindajate korral patendivolinikust esindajat. Kui toiminguid ühiselt tegevatel isikutel on erinevad esindajad, edastatakse teated kõigile esindajatele.
Taotleja või muu isiku puhul, kes on taotluses või avalduses märkinud e-posti aadressi, ning patendivoliniku puhul eeldatakse nõusolekut sellega, et talle edastatakse geograafilise tähise registreerimise ja registreeringu jõushoidmisega seotud toiminguga seonduvad teated elektrooniliselt, kui isik ei ole Patendiametile kirjalikult teatanud teisiti.
§ 28¹. Forwarding of notices from Patent Office
(1) The Patent Office forwards the notices relating to an act concerning the registration of a geographical indication and continued validity of the registration to the representative of the applicant or of any other person requesting the act to be performed, unless the principal has informed the Patent Office otherwise in writing, and, in the absence of a representative, to the person themselves.
(2) For the purposes of subsection 1 of this section, a representative is a person who has filed an application or a request as a representative of the applicant or of any other person requesting the act to be performed, or who has performed other acts in the proceedings of the Patent Office, or who is entered in the register as a representative of the applicant, unless the principal has informed the Patent Office otherwise in writing.
(3) Where a person has several representatives for the purposes of subsection 2 of this section, the notices are forwarded to the most recently communicated representative, and if several representatives were communicated on the same date, the representative who is a patent attorney is preferred. If persons performing acts together have different representatives, the notices are forwarded to all the representatives.
(4) In the case of an applicant or any other person who has indicated an e-mail address in the application or in the request, and in the case of a patent attorney, the consent is presumed to be given by transmission to them of notices relating to an act concerning the registration of the geographical indication and continued validity of the registration by electronic means, unless the person has informed the Patent Office otherwise in writing.
§ 29. Saabumismärge
Registreerimistaotluse igale dokumendile tehakse saabumismärge, milles sisaldub registreerimistaotluse saabumise kuupäev ja registreerimistaotluse järjekorranumber (edaspidi registreerimistaotluse number).

§ 29. Notation of receipt
(1) Every document of the registration application shall be marked with a notation of receipt which shall contain the date of receipt of the registration application and the sequence number of receipt of the registration application (hereinafter registrationapplication number).

Registreerimistaotluse esitamise kuupäevaks loetakse selle saabumise kuupäev, kui esitatud on:
geograafilise tähise registreerimise sooviavaldus;
geograafilise tähise reproduktsioon;
kaupade ja teenuste loetelu, mille tähistamiseks geograafilist tähist kasutatakse;
geograafilise ala määratlus;
taotleja nimi, elu- või asukoha aadress ja muud kontaktandmed.
Esitatud registreerimistaotlus võetakse menetlusse, kui tasutud on riigilõiv ja esitatud volikiri, kui see on nõutav.
§ 30. Acceptance of registration application for processing
(1) The filing date of a registration application shall be deemed the date of receipt of the registration application if the following documents are filed:
1) a statement requesting the registration of a geographical indication;
2) a representation of the geographical indication;
3) a list of goods and services which are designated by the geographical indication;
4) the identification of the geographical area;
5) the name and address of the residence or seat of the applicant and other contact information.
(2) A filed registration application is accepted for processing if the state fee has been paid and a power of attorney, where it is required, has been submitted.
§ 31. Registreerimistaotluse menetlusse võtmisest keeldumine
Registreerimistaotluse menetlusse võtmisest keeldumise otsus tehakse ning registreerimistaotlus ja riigilõiv tagastatakse, kui:
riigilõiv ei ole tasutud ühe kuu jooksul registreerimistaotluse saabumise kuupäevast arvates;
volikiri on nõutav ja seda ei ole esitatud kahe kuu jooksul registreerimistaotluse saabumise kuupäevast või Patendiameti poolt vastava nõude esitamisest arvates.

§ 31. Refusal to accept registration application for processing
A decision shall be made to refuse to accept a registration application for processing and the state fee shall be refunded if:
1) the state fee has not been paid within one month after the date of receipt of the registration application;
2) a power of attorney is required and it is not filed within two months after the date of receipt of the registration application or after presentation of a respective request by the Patent Office;
§ 32. Registreerimistaotluse kontrollimine
Menetluse käigus ei kontrollita geograafilise tähise vastavust käesoleva seaduse § 8 punktides 1–3 ja 5–7 sätestatule ega registreerimistaotluses esitatud faktide õigsust.
Registreerimistaotluse dokumentide vormi ja sisu puuduste või muude menetlust takistavate asjaolude ilmnemisel teatatakse nendest taotlejale kirjalikult ning määratakse puuduste kõrvaldamiseks või asjakohaste selgituste andmiseks kahekuuline tähtaeg.
Taotleja avalduse alusel pikendatakse registreerimistaotluse puuduste kõrvaldamise või selgituste andmise tähtaega kuue kuuni käesoleva paragrahvi lõikes 2 nimetatud tähtaja algusest arvates. Avaldus peab olema esitatud ja riigilõiv tasutud enne käesoleva paragrahvi lõikes 2 määratud tähtaja lõppemist.
§ 32. Examination of registration application
(1) During processing, the compliance of the geographical indication with the provisions of clauses 1–3 and 5–7 of § 8 of this Act and the correctness of the facts presented in the registration application shall not be examined.
(2) The applicant shall be notified in writing of formal or substantive deficiencies of the registration application or if any other circumstances are revealed which hinder the processing and a term of two months shall be set for elimination of the deficiencies or provision of relevant explanations.
(3) On the basis of a request from the applicant, the term for elimination of deficiencies in a registration application or for provision of explanations is extended by up to six months from the beginning of the term specified in subsection 2 of this section. The request must be filed and the state fee must be paid before the end of the term set in subsection 2 of this section.
§ 33. Registreerimistaotluse parandamine ja täiendamine
Taotleja võib menetluse jooksul teha registreerimistaotluses parandusi ja täiendusi, mis ei muuda registreerimistaotluse esitamise kuupäeval selles esitatud geograafilise tähise reproduktsiooni ega laienda selles antud geograafilise piirkonna määratlust, kaupade ega teenuste loetelu.
§ 33. Correction and supplementation of registration application
An applicant may correct and supplement a registration application during processing provided that no alterations are made to the representation of the geographical indication which was presented in the registration application on the filing date of the registration application and the identification of the geographic area or the given list of goods or services is not extended.
§ 34. Registreerimistaotluse tagasivõtmine
Taotleja võib registreerimistaotluse menetluse jooksul tagasi võtta, esitades sellekohase kirjaliku avalduse. Registreerimistaotlus loetakse tagasivõetuks avalduse Patendiametisse saabumisel.
Registreerimistaotlus loetakse tagasivõetuks, kui taotleja ei ole käesoleva seaduse § 32 lõigete 2 ja 3 kohaselt määratud tähtaja lõpuks kõrvaldanud registreerimistaotluse puudusi või andnud asjakohaseid selgitusi.
§ 34. Withdrawal of registration application
(1) An applicant may withdraw a registration application during processing by filing a corresponding written request. A registration application is deemed withdrawn upon receipt of such request by the Patent Office.
(2) A registration application is deemed withdrawn if the applicant has failed to eliminate deficiencies in the registration application or to provide relevant explanations by the end of the term established pursuant to subsections 2 and 3 of § 32 of this Act.
§ 35. Menetluse lõpetamine
Kui registreerimistaotlus on tagasi võetud või tagasivõetuks loetud, tehakse menetluse lõpetamise otsus.
§ 35. Termination of processing
If a registration application is withdrawn or deemed withdrawn, a decision is made on the termination of processing.
§ 36. Menetluse taastamine
Lõpetatud menetlus taastatakse tööstusomandi apellatsioonikomisjoni (edaspidi apellatsioonikomisjon) otsuse või kohtuotsuse alusel.
§ 36. Resumption of processing
Terminated processing shall be resumed on the basis of a decision of the Industrial Property Board of Appeal (hereinafter Board of Appeal) or court order.
§ 37. Geograafilise tähise registreerimise otsus
Kui registreerimistaotlus vastab käesoleva seaduse §-des 4, 24 ja 25 ning § 26 lõigetes 1 ja 4 sätestatud nõuetele ega ole vastuolus avaliku korra või heade tavadega, tehakse viivitamata geograafilise tähise registreerimise otsus.
§ 37. Decision to register geographical indication
If a registration application complies with the requirements provided for in §§ 4, 24, 25 and subsections 1 and 4 of § 26 of this Act and is not contrary to public order or accepted principles of morality, a decision shall be made without delay to register the geographical indication.
§ 38. Geograafilise tähise registreerimisest keeldumise otsus
Kui registreerimistaotlus ei vasta kas või ühele käesoleva seaduse §-des 4, 24 ja 25 ning § 26 lõigetes 1 ja 4 sätestatud nõuetest või on vastuolus avaliku korra või heade tavadega, tehakse viivitamata geograafilise tähise registreerimisest keeldumise otsus.
§ 38. Decision to refuse registration of geographical indication
If a registration application does not comply with at least one of the requirements provided for in §§ 4, 24, 25 and subsections 1 and 4 of § 26 of this Act or is contrary to public order or accepted principles of morality, a decision shall be made without delay to refuse registration of the geographical indication.
§ 39. Otsus ja selle vaidlustamine
Käesoleva seaduse §-des 31, 35, 37 ja 38 nimetatud otsustes peab sisalduma:
otsuse tegemise kuupäev;
otsuse põhjendus;
resolutsioon;
selgitus otsuse vaidlustamise korra ja tähtaja kohta;
otsuse teinud ametniku nimi ja allkiri.
Käesoleva seaduse §-des 31, 35, 37 ja 38 nimetatud otsused jõustuvad nende tegemise päeval.
Käesoleva seaduse §-des 31, 35, 37 ja 38 nimetatud otsustest teatatakse taotlejale kirjalikult.
Käesoleva seaduse §-des 31, 35, 37 ja 38 nimetatud otsuseid võib taotleja vaidlustada apellatsioonikomisjonis kahe kuu jooksul otsuse tegemise päevast arvates.
§ 39. Decision and appealing decision
(1) Decisions referred to in §§ 31, 35, 37 and 38 of this Act shall set out:
1) the date of the decision;
2) the grounds for the decision;
3) the conclusion;
4) information on the procedure and term for appealing the decision;
5) the name and signature of the official who makes the decision.
(2) Decisions referred to in §§ 31, 35, 37 and 38 of this Act enter into force on the date on which they are made.
(3) The applicant shall be notified in writing of the decisions referred to in §§ 31, 35, 37 and 38 of this Act.
(4) An applicant may appeal the decisions referred to in §§ 31, 35, 37 and 38 of this Act in the Board of Appeal within two months as of the date of making the decision.
§ 40. Registri avalikkus ja teabe väljastamine
Menetluse käigus on lubatud väljastada teavet ainult registreerimistaotluse numbri, esitamise kuupäeva, geograafilise tähise reproduktsiooni, geograafilise ala määratluse, kaupade või teenuste loetelu, taotleja nime ja taotleja esindaja nime kohta.
Pärast geograafilise tähise registreerimise otsuse tegemist on geograafilise tähise kohta registris olevad andmed ja dokumendid avalikud.
Registrist teabe väljastamise eest tasutakse riigilõivu, välja arvatud teabe väljastamine järelevalveasutusele, apellatsioonikomisjonile või kohtule.
§ 40. Access to and release of data from register
(1) During processing, only the following information shall be released: the registration application number, the filing date, the representation of the geographical indication, the identification of the geographical area, the list of goods or services, the name of the applicant and the name of the representative of the applicant.
(2) After a decision is made on the registration of a geographical indication, the information and documents pertaining to the geographical indication in the register shall be public.
(3) A state fee is paid for the release of information from the register with the exception of releasing information to supervisory agencies, the Board of Appeal or to a court.
§ 41. Geograafilise tähise registreerimise tunnistus
Geograafilise tähise registreerimise tunnistus (edaspidi tunnistus) on dokument, mis tõendab registreeringut.
Tunnistus antakse välja Eesti Vabariigi nimel.
Tunnistuse numbriks on registreeringu number.
Tunnistuse vorminõuded ja vormistamise korra kehtestab valdkonna eest vastutav minister .
§ 41. Certificate of registration of geographical indication
(1) A certificate of registration of a geographical indication (hereinafter certificate) is a document which certifies the registration.
(2) Certificates are issued in the name of the Republic of Estonia.
(3) The registration number is also the certificate number.
(4) The formal requirements and the procedure for completing of certificates are established by the minister in charge of the policy sector.
§ 42. Tunnistuse väljaandmine
Pärast registreeringu tegemist annab Patendiamet 10 tööpäeva jooksul taotlejale välja tunnistuse.

§ 42. Issue of certificate
(1) After making a registration, the Patent Office shall issue a certificate to the applicant within ten working days.
(3) On the basis of a request of the applicant, a paper copy of the electronic certificate is issued to them. A state fee must be paid for the issue of the copy. The copy is issued within one month from the date of filing of the request, but not before payment of the required state fee.
(4) A duplicate of the certificate may be issued on the basis of a request from the applicant. A state fee must be paid for the issue of a duplicate. A duplicate is issued within one month from the date of submission of the request, but not before payment of the required state fee.

Asjast huvitatud isik või järelevalveasutus, kes leiab, et taotlejal ei olnud käesoleva seaduse § 9 lõikes 1 sätestatu järgi õigust esitada registreerimistaotlust, võib esitada apellatsioonikomisjonile registreeringu õigusvastaseks tunnistamise avalduse taotleja, tema pärija või õigusjärglase vastu.
Käesoleva paragrahvi lõikes 1 nimetatud avalduse saab esitada ühe aasta jooksul registreeringu andmete kande teate avaldamise kuupäevast arvates.
Asjast huvitatud isik või järelevalveasutus, kes leiab, et taotlejal ei olnud käesoleva seaduse § 9 lõikes 2 sätestatu järgi õigust esitada registreerimistaotlust, võib esitada apellatsioonikomisjonile registreeringu õigusvastaseks tunnistamise avalduse taotleja, tema pärija või õigusjärglase vastu.
Käesoleva paragrahvi lõikes 3 nimetatud avalduse saab esitada registreeringu kehtivusaja jooksul.
Asjast huvitatud isik, kes leiab, et registreering on vastuolus käesoleva seaduse §-s 4, 24 või 25 või § 26 lõikes 1 või 4 sätestatud nõuetega, avaliku korra või heade tavadega, võib esitada apellatsioonikomisjonile avalduse nõudega tunnistada registreering õigusvastaseks ning kohustada Patendiametit menetlust taastama ja uut otsust tegema.
Käesoleva paragrahvi lõikes 5 nimetatud avalduse saab esitada kolme kuu jooksul registreeringu andmete kande teate avaldamise kuupäevast arvates.
Käesoleva paragrahvi lõikes 1, 3 või 5 nimetatud avalduse menetlusosaline, keda apellatsioonikomisjoni otsus ei rahulda, võib esitada tööstusomandi õiguskorralduse aluste seaduse § 64 lõikes 1 sätestatud tähtaja jooksul hagi teise menetlusosalise vastu registreeringu õigusvastaseks tunnistamiseks või selle aluseks oleva asjaolu puudumise kindlakstegemiseks.
Patendiamet teeb jõustunud apellatsioonikomisjoni või kohtu otsuse põhjal kande registrisse, kui käesoleva paragrahvi lõikes 1, 3 või 5 nimetatud isik esitab Patendiametile avalduse, millele on lisatud teave jõustunud otsuse kohta.
§ 43. Contestation of registration
(1) Any interested person or supervisory authority finding that the applicant had no right to file a registration application pursuant to subsection 1 of § 9 of this Act, may file a request with the Board of Appeal against the applicant, his or her successor or legal successor to declare the registration unlawful.
(2) The request specified in subsection 1 of this section may be filed within one year from the publication date of the notice of entry of registration data.
(3) Any interested person or supervisory authority finding that the applicant had no right to file a registration application pursuant to subsection 2 of § 9 of this Act, may file a request with the Board of Appeal against the applicant, his successor or legal successor to declare the registration unlawful.
(4) The request specified in subsection 3 of this section may be filed during the validity period of the registration.
(5) Any interested person who considers that a registration is contrary to the requirements of § 4, 24, 25 or subsection 1 or 4 of § 26 of this Act, or to public order or accepted principles of morality, may file a request with the Board of Appeal to declare the registration unlawful and require that the Patent Office restore the processing and make a new decision.
(6) The request specified in subsection 5 of this section may be filed within three months from the publication date of the notice of entry of registration data.
(6¹) A participant in a processing concerning the request specified in subsection 1, 3 or 5 of this section who is not satisfied with a decision of the Board of Appeal, may file an action against another participant in the processing within the term specified in subsection 1 of § 64 of the Principles of Legal Regulation of Industrial Property Act to declare the registration unlawful or to ascertain the non-existence of the circumstances providing grounds therefor.
(7) The Patent Office shall make an entry in the register on the basis of the decision of the Board of Appeal or court judgment which has entered into force if the person specified in subsection 1, 3 or 5 of this section submits a request including information on the decision or judgment which has entered into force, to the Patent Office.
§ 44. Registreeringu vaidlustamine registreeringu andmete muutmiseks
Asjast huvitatud isik või järelevalveasutus, kes leiab, et registreeringus olev kaupade või teenuste loetelu, geograafilise ala määratlus või kirjeldus on ebatäpne või ei ole piisav, võib esitada apellatsioonikomisjonile registreeringu andmete muutmise avalduse taotleja, tema pärija või õigusjärglase vastu.
Käesoleva paragrahvi lõikes 1 nimetatud avalduse saab esitada registreeringu kehtivusaja jooksul.
Käesoleva paragrahvi lõikes 1 nimetatud avalduse menetlusosaline, keda apellatsioonikomisjoni otsus ei rahulda, võib esitada tööstusomandi õiguskorralduse aluste seaduse § 64 lõikes 1 sätestatud tähtaja jooksul hagi teise menetlusosalise vastu registreeringu andmete muutmiseks või selle aluseks oleva asjaolu puudumise kindlakstegemiseks.
Patendiamet teeb jõustunud apellatsioonikomisjoni või kohtu otsuse põhjal kande registrisse, kui käesoleva paragrahvi lõikes 1 nimetatud isik esitab Patendiametile avalduse, millele on lisatud teave jõustunud otsuse kohta.
§ 44. Contestation of registration for amending registration data
(1) Any interested person or supervisory authority finding that the list of goods or services, identification or description of the geographical area in the registration are inaccurate or insufficient, may file a request with the Board of Appeal against the applicant, his or her successor or legal successor for amending registration data.
(2) The request specified in subsection 1 of this section may be filed during the validity period of the registration.
(2¹) A participant in a processing concerning the request specified in subsection 1 of this section who is not satisfied with a decision of the Board of Appeal, may file an action against another participant in the processing within the term specified in subsection 1 of § 64 of the Principles of Legal Regulation of Industrial Property Act to change the registration data or to ascertain the non-existence of the circumstances providing grounds therefor.
(3) The Patent Office shall make an entry in the register on the basis of the decision of the Board of Appeal or court judgment which has entered into force if the person specified in subsection 1 of this section submits a request including information on the decision or judgment which has entered into force, to the Patent Office.
§ 45. Õiguskaitsevahendid registreeritud geograafilise tähise õigusvastase kasutamise korral
Asjast huvitatud isik võib registreeritud geograafilise tähise õigusvastase kasutamise korral nõuda:
registreeritud geograafilise tähise õigusvastase kasutamisega tekitatud kahju hüvitamist vastavalt võlaõigusseaduse §-le 1043;
registreeritud geograafilise tähise õigusvastase kasutamise lõpetamist ja edasisest rikkumisest hoidumist vastavalt võlaõigusseaduse §-le 1055;
registreeritud geograafilise tähise õigusvastase kasutamise teel saadu väljaandmist vastavalt võlaõigusseaduse §-dele 1037 ja 1039.
§ 45. Legal remedies in case of unlawful use of registered geographical indication
In case of unlawful use of a registered geographical indication, an interested person may demand:
1) compensation for the damage caused by the unlawful use of a registered geographical indication pursuant to § 1043 of the Law of Obligations Act;
2) termination of the unlawful use of a registered geographical indication and that the person refrains from further violation pursuant to § 1055 of the Law of Obligations Act;
3) transfer of that which is received from the person by means of the unlawful use of a registered geographical indication pursuant to §§ 1037 and 1039 of the Law of Obligations Act.
§ 46. Geograafilise tähise alase vaidluse lahendamise erisused
Geograafilise tähise registreerimise, registreeringu kehtivuse ja registreeritud geograafilise tähise õigusvastase kasutamisega seotud kaebusi ja hagisid, hagi tagamise ja esialgse õiguskaitse taotlusi ning muid käesolevas seaduses nimetatud kaebusi ja hagisid vaatab läbi Harju Maakohus.

Käesoleva seaduse § 43 lõigetes 1 ja 3 ning § 44 lõikes 1 nimetatud avalduse esitamisest teatab kohus ametlikus väljaandes Ametlikud Teadaanded ning määrab tähtaja, mille jooksul geograafilise tähise kasutajad võivad esitada kohtule avalduse protsessi astumiseks hageja või kostja poolel, kusjuures tähtaeg ei või olla lühem kui kaks kuud teate avaldamise kuupäevast arvates.
Kohus saadab Patendiametile teadmiseks geograafilise tähise kaitse alases vaidluses tehtud lahendi ärakirja ka siis, kui Patendiamet ei ole protsessis osalenud.
Isikul, kelle vastu on esitatud hagi käesoleva seaduse § 45 alusel, on õigus esitada vastuhagi § 43 lõikes 1, 3 või 5 või § 44 lõikes 1 nimetatud nõudes.
§ 46. Specifications for resolution of disputes relating to geographical indications
(1) Appeals and actions related to the registration of geographical indications, validity of a registration and unlawful use of registered geographical indications, petitions for the securing of an action and petitions for provisional legal protection, as well as other appeals and actions specified in this Act shall be heard by Harju County Court.
(2) The court shall notify of the submission of the requests specified in subsections 1 and 3 of § 43 and subsection 1 of § 44 of this Act in the official gazette Ametlikud Teadaanded and establishes a term during which the users of a geographical indication may file a petition with a court to intervene in the proceedings in support of the plaintiff or the defendant, whereby the term shall be no less than two months from the publication date of the notice.
(3) The court shall send a transcript of the resolution, made in a dispute relating to the protection of a geographical indication, to the Patent Office for information even if the Patent Office has not participated in the proceedings.
(4) A person against whom an action has been filed pursuant to § 45 of this Act, is entitled to file a counterclaim with a claim specified in subsection 1, 3 or 5 of § 43 or subsection 1 of § 44.
§ 47. Esindaja geograafilise tähise alases kohtuvaidluses
Patendivolinik võib olla geograafilise tähise alases vaidluses esindajaks maakohtus ja ringkonnakohtus. Riigikohtus võib patendivolinik olla esindajaks koos vandeadvokaadiga.

§ 47. Representatives in court disputes relating to geographical indications
(1) Patent attorneys may act as representatives in a county court and in a circuit court in disputes relating to geographical indications. In Supreme Court, patent attorneys may act as representatives together with a sworn advocate.
(3) Upon protection of rights, a lawful user of a geographical indication may be represented by a representative organisation with passive legal capacity of which the user is a member.

§ 47¹. Riigilõiv
Käesolevas seaduses ettenähtud juhtudel tasutakse registreerimistaotluse läbivaatamise, teabe väljastamise ja muude toimingute tegemise eest riigilõivu riigilõivuseaduses sätestatud määras.
§ 47¹. State fee
In the cases provided for in this Act, a state fee must be paid for the review of a registration application for registration, issue of information and performance of other acts at the rate provided in the State Fees Act.
§ 47². Unikaalse viitenumbri teatamine
Pärast registreerimistaotluse menetlusse võtmist või avalduse esitamist teatab Patendiamet taotlejale või avalduse esitajale unikaalse viitenumbri riigilõivu tasumiseks. Unikaalset viitenumbrit ei teatata, kui isik on riigilõivu juba tasunud.
§ 47². Notification of unique reference number
After accepting the registration application for processing or after the filing of the request, the Patent Office notifies the applicant or the person submitting the request of the unique reference number for payment of the state fee. The unique reference number is not communicated if the person has already paid the state fee.
§ 47³. Riigilõivu tasumine
Riigilõiv tasutakse Rahandusministeeriumi kontole.
Kui riigilõiv tasutakse unikaalse viitenumbriga, märgitakse maksedokumendile unikaalne viitenumber, mis on seotud toiminguga, mille eest riigilõiv tasutakse.
Riigilõiv loetakse tasutuks, kui see on unikaalse viitenumbri alusel laekunud ettenähtud kontole või kui Patendiametile on esitatud käesoleva seaduse § 47⁴ lõikes 1 nimetatud andmed riigilõivu tasumise kohta.
§ 47³. Payment of state fee
(1) The state fee is paid to the account of the Ministry of Finance.
(2) Where the state fee is paid by means of a unique reference number, the payment document must indicate the unique reference number which relates to the act for which the state fee is paid.
(3) The state fee is deemed to have been paid if it has been credited to the prescribed account on the basis of a unique reference number, or if the data specified in subsection 1 of § 47⁴ of this Act have been submitted to the Patent Office concerning the payment of the state fee.
§ 47⁴. Riigilõivu tasumise kohta andmete esitamine
Kui riigilõiv tasutakse ilma unikaalse viitenumbrita, esitab taotleja või muu geograafilise tähise alase toimingu tegemist taotlev isik Patendiametile riigilõivu tasumise tähtpäevaks riigilõivu tasumise kohta järgmised andmed:
maksedokumendi number;
makse kuupäev;
maksja nimi;
tasutud summa suurus;
selle toimingu nimetus, mille eest riigilõiv tasutakse, või riigilõivuseaduse asjakohase paragrahvi number;
registreerimistaotluse number, geograafilise tähise registreeringu number või nende puudumise korral muud andmed, mis võimaldavad geograafilise tähise tuvastada.
Andmed riigilõivu tasumise kohta esitatakse iga registreerimistaotluse või registreeringu ja iga toimingu või tegevuse kohta eraldi. Kui riigilõiv tasutakse korraga mitme toimingu tegemise eest, esitatakse loetelu tasutud summa registreerimistaotluste või registreeringute ja toimingute vahel jaotumise kohta.
§ 47⁴. Submission of data concerning payment of state fee
(1) Where the state fee is paid without a unique reference number, the applicant or any other person requesting an act to be performed in relation to a geographical indication submits to the Patent Office, by the due date for payment of the state fee, the following information concerning the payment of the state fee:
1) number of the payment document;
2) date of payment;
3) name of the payer;
4) amount paid;
5) name of the act for which the state fee is paid, or the number of the relevant section of the State Fees Act;
6) registration application number, the registration number of the geographical indication or, in their absence, any other data enabling the geographical indication to be identified.
(2) The data on the payment of the state fee are to be provided separately for each registration application or registration and for each act or activity. Where the state fee is paid for more than one act at a time, a list is to be submitted with the breakdown of the paid amount between the registration applications or registrations and acts.
§ 47⁵. Riigilõivu tasumise kontrollimise kord
Kui andmed riigilõivu tasumise kohta on esitatud tähtpäevaks, kuid riigilõiv ei ole nõutavas summas Rahandusministeeriumi kontole laekunud, võib Patendiamet tasumise kontrollimiseks nõuda andmed esitanud isikult pangaasutuse kinnitatud riigilõivu tasumist tõendava dokumendi esitamist.
Kui riigilõiv tuleb tasuda kindlaks tähtpäevaks, loetakse see tähtaegselt tasutuks ka juhul, kui ettenähtud summas riigilõiv on unikaalse viitenumbri alusel laekunud ettenähtud kontole kolme pangapäeva jooksul Patendiameti poolt unikaalse viitenumbri väljastamisest arvates.
§ 47⁵. Procedure for verification of payment of state fee
(1) Where the information on the payment of the state fee has been submitted by the due date for payment, but the state fee has not been credited to the account of the Ministry of Finance in the required amount, the Patent Office may, in order to verify the payment, request the person submitting the information to submit a document certified by a banking institution as proof of payment of the state fee.
(2) Where the state fee is payable by a specified due date, it is also deemed to have been paid on time if the state fee in the prescribed amount has been credited to the prescribed account on the basis of a unique reference number within three banking days of the issuance of the unique reference number by the Patent Office.

§ 49. Riiklik järelevalve
Käesolevas seaduses sätestatud nõuete täitmise üle teostavad riiklikku järelevalvet:
Tarbijakaitse ja Tehnilise Järelevalve Amet;
Põllumajandus- ja Toiduamet registreeritud geograafilise tähise nimetuse nõuetekohase kasutamise ning registreeritud geograafilise tähise kirjelduses sätestatud nõuetele vastavuse üle.
§ 49. State supervision
State supervision over fulfillment of the requirements provided for in this Act is exercised by:
1) Consumer Protection and Technical Regulatory Authority;
2) the Agriculture and Food Board over proper use of the names of registered geographical indications, and conformity with the requirements provided for in the descriptions of registered geographical indications.
§ 50. Riikliku järelevalve erimeetmed
Korrakaitseorgan võib käesolevas seaduses sätestatud riikliku järelevalve teostamiseks kohaldada korrakaitseseaduse §-des 30, 49, 50 ja 52 sätestatud riikliku järelevalve erimeetmeid korrakaitseseaduses sätestatud alusel ja korras.
§ 50. Special state supervision measures
A law enforcement agency may apply special state supervision measures provided for in §§ 30, 49, 50 and 52 of the Law Enforcement Act on the bases and according to the procedure provided for in the Law Enforcement Act for the purpose of exercising the state supervision provided for in this Act.

§ 56¹. Enne 2019. aasta 1. aprilli kohtule esitatud kaebuse, avalduse ja hagi menetlemine
Enne 2019. aasta 1. aprilli käesoleva seaduse alusel kohtule esitatud avaldust menetletakse kohtus ka juhul, kui alates nimetatud kuupäevast on asjaomase vaidluse lahendamiseks ette nähtud kohustuslik kohtueelne menetlus apellatsioonikomisjonis.
Enne 2019. aasta 1. aprilli käesoleva seaduse alusel kohtule esitatud kaebust, avaldust või hagi menetletakse muus maakohtus peale Harju Maakohtu ka juhul, kui alates nimetatud kuupäevast on asjaomase kaebuse, avalduse või hagi lahendamiseks ainupädevus Harju Maakohtul.
§ 56¹. Proceedings concerning appeals, petitions and actions filed with court before 1 April 2019
(1) Proceedings concerning a petition filed with a court pursuant to this Act before 1 April 2019 shall be conducted by a court even in case mandatory pre-trial procedure in the Board of Appeal is prescribed for the settlement of the respective dispute starting from said date.
(2) Proceedings concerning an appeal, petition or action filed with a court pursuant to this Act before 1 April 2019 shall be conducted by a county court other than Harju County Court even in case Harju County Court has exclusive jurisdiction over adjudication of the respective appeal, petition or action starting from said date.
