1. peatükk Üldsätted
§ 1. Seaduse reguleerimisala
Käesolev seadus sätestab riigi ja kohaliku omavalitsuse üksuste ametiasutuste ning nende ametiisikute, avalik-õiguslike ja eraõiguslike juriidiliste isikute ning füüsiliste isikute kohustused ja ülesanded laste õiguste ja heaolu tagamisel, lastekaitse korralduse, lastega töötavatele isikutele seatud keelud ja piirangud, lapse kohtlemise põhimõtted, abivajava lapse, hädaohus oleva lapse ja perekonnast eraldatud lapse kohtlemise põhimõtted, riikliku järelevalve seaduse täitmise üle ja vastutuse seaduse rikkumise eest.
Lapse õiguste ja heaolu tagamise põhimõtete ja lastekaitsemeetmete kohaldamisel eriseaduse alusel lähtutakse eriseaduses sätestatud nõuetest, järgides käesoleva seaduse 2. peatükis sätestatut. Eriseaduses reguleerimata juhtumi korral lähtutakse käesolevas seaduses sätestatust.
Käesolevas seaduses sätestatud haldusmenetlusele kohaldatakse haldusmenetluse seaduse sätteid, arvestades käesoleva seaduse erisusi.

§ 1. Scope of regulation of Act
(1) This Act provides for the obligations and functions of state and local government agencies and the officials thereof, legal persons in public and private law and natural persons upon ensuring the rights and well-being of children, the organisation of child protection, the prohibitions and restrictions established for persons working with children, the principles of treatment of children, the principles of treatment of children in need of assistance, children in danger and children separated from family, the state supervision over compliance with this Act and the liability for violation of the Act.
(2) The application of the principles for ensuring the rights and well-being of children and the application of child protection measures on the basis of a specific Act shall be based on the requirements provided for in the specific Act, complying with the provisions of Chapter 2 of this Act. In case of issues unregulated by a specific Act, the provisions of this Act shall apply.
(3) The provisions of the Administrative Procedure Act apply to administrative proceedings prescribed in this Act, taking account of the specifications provided for in this Act.
§ 2. Seaduse eesmärk
Käesolev seadus kehtestatakse last väärtustava ning lapse arengut soodustava käitumise ja elulaadi kujundamiseks ühiskonnas, last toetava keskkonna loomiseks, lapse huvide esikohale seadmiseks, lapse elukvaliteedi parendamiseks, lapse igakülgse arengu toetamiseks ning tervist ja heaolu ohustavates tingimustes olevale lapsele õigeaegse ja asjakohase abi ja hoolduse tagamiseks kooskõlas Ühinenud Rahvaste Organisatsiooni lapse õiguste konventsiooni ja selle lisaprotokollidega (edaspidi konventsioon) ning Euroopa Liidu põhiõiguste harta ja teiste asjakohaste õigusaktidega.

§ 2. Purpose of Act
This Act shall be established in order to form behaviour and way of life which value and promote the development of children in the society, to create a supporting environment for children, to set the best interests of children as primary consideration, to improve the quality of life of children, to support the comprehensive development of children and to ensure the necessary assistance and care in a timely manner for children whose health and well-being is in danger in conformity with the United Nations Convention on the Rights of the Child and the optional protocols thereto (hereinafter the convention) and the EU Charter of Fundamental Rights and other relevant legislation.
§ 3. Seaduse kohaldamisala
Käesolevas seaduses sätestatut kohaldatakse riigi ja kohaliku omavalitsuse üksuste ametiasutustele ning nende ametiisikutele, avalik-õiguslikele ja eraõiguslikele juriidilistele isikutele ning füüsilistele isikutele, kes oma tegevuses puutuvad kokku laste ja lastekaitsega.
Käesolev seadus peab lapseks iga alla 18-aastast isikut. Kui isiku vanus ei ole teada ja on põhjust arvata, et ta on alla 18-aastane, käsitatakse isikut lapsena, kuni ei ole tõendatud vastupidist.

§ 3. Scope of application of Act
(1) The provisions of this Act shall be applied to state and local government agencies and the officials thereof, legal persons in public and private law and natural persons who are in contact with children and child protection in their activities.
(2) For the purposes of this Act, a child means every human being below the age of eighteen years. If the age of a person is unknown and there is reason to believe that the person is below the age of eighteen years, the person shall be deemed to be a child until proven otherwise.

Lapse heaolu on lapse arengut toetav seisund, milles lapse füüsilised, tervislikud, psühholoogilised, emotsionaalsed, sotsiaalsed, kognitiivsed, hariduslikud ja majanduslikud vajadused on rahuldatud.

§ 4. Well-being of child
Child’s well-being means the condition supporting the development of the child in which the physical, medical, psychological, emotional, social, cognitive, educational and economic needs of the child are satisfied.
§ 5. Lapse õiguste ja heaolu tagamise põhimõtted
Lapse õiguste ja heaolu tagamisel tuleb lähtuda järgmistest konventsioonis sätestatud põhimõtetest:
igal lapsel on sünnipärane õigus elule, ellujäämisele ja arengule;
igal lapsel on õigus võrdsele kohtlemisele ilma igasuguse diskrimineerimiseta;
kõigis lapsi puudutavates ettevõtmistes tuleb esikohale seada lapse huvid;
igal lapsel on õigus iseseisvaks seisukohavõtuks kõigis teda puudutavates küsimustes ning õigus väljendada oma vaateid.

§ 5. Principles of ensuring rights and well-being of children
Upon ensuring the rights and well-being of children, the following principles provided for in the convention shall be based on:
1) every child has the inherent right to life, survival and development;
2) every child has the right to equal treatment without any discrimination;
3) in all action concerning children, the best interests of the child shall be a primary consideration;
4) every child has the right to independent opinion in all matters affecting the child and the right to express his or her views.
§ 6. Ennetamine
Lapse õiguste ja heaolu tagamiseks tuleb ennetada lapse heaolu ja arengut ohustavaid riske. Ennetamine hõlmab last ohustavate olukordade ja sündmuste võimalikult varast märkamist ja neile reageerimist, sealhulgas lapse arengu- ja käitumisprobleemide, kasvukeskkonnas esinevate probleemide ja väärkohtlemise tuvastamist ning lapse heaolu ja arengut soodustavate kaitsetegurite suurendamist.
Riigi ja kohaliku omavalitsuse üksuste ametiasutused peavad vastavalt võimalustele arendama välja meetmed lapse abivajaduse ennetamiseks ning olemasolevate probleemide vähendamiseks. Meetmed peavad lähtuma lapse vajadustest, toetama lapse ja teda kasvatavate isikute suhteid ja sotsiaalset toimetulekut ning olema kättesaadavad, õigeaegsed, tulemuslikud ja pikaajalise positiivse mõjuga.

§ 6. Prevention
(1) In order to ensure the rights and well-being of the child, the risks threatening the well-being and development of the child must be prevented. Prevention includes the perception of situations and events which threaten the child as early as possible and the reaction thereto, including the identification of the child’s development and behaviour problems, problems occurring in the family environment, identification of abuse and the increase of protective measures promoting the child’s well-being and development.
(2) State and local government agencies shall, according to their possibilities, develop measures in order to prevent the child’s need for assistance and to decrease the existing problems. The measures must be based on the child’s needs, support the relations between the child and the persons raising the child, support the social performance skills and they must be accessible, timely, effective and have a long-term positive effect.
§ 7. Lapsevanema ja last kasvatava isiku vastutus
Lapse arengu ja kasvu loomulikuks keskkonnaks on perekond. Esmane vastutus lapse õiguste ja heaolu tagamise eest on lapsevanemal või last kasvataval isikul.
Riigi ja kohaliku omavalitsuse üksuste ametiasutused ja nende ametiisikud ning avalik-õiguslikud ja eraõiguslikud juriidilised isikud peavad vastavalt oma pädevusele toetama lapsevanemat või last kasvatavat isikut lapse õiguste ja heaolu tagamisel.

§ 7. Liability of parents and persons raising children
(1) The natural environment for the development and growth of the child is the family. The primary liability for ensuring the child’s rights and well-being lies with the parent or with the person raising the child.
(2) State and local government agencies and the officials thereof, legal persons in public and private law shall, according to their competence, support the parent or the person raising the child upon ensuring the child’s rights and well-being.
§ 8. Koostöö
Lapse õiguste ja heaolu tagamiseks peavad riigi ja kohaliku omavalitsuse üksuste ametiasutused ja nende ametiisikud ning avalik-õiguslikud ja eraõiguslikud juriidilised isikud tegema omavahel valdkondadeüleselt koostööd kõigi lastele suunatud meetmete planeerimisel, rahastamisel ja rakendamisel, kaasates sellesse lapsi, lapsevanemaid, last kasvatavaid isikuid, huvirühmi ja avalikkust.
Välislepingu, Euroopa Liidu õigusakti või muu õigusakti alusel peavad riigi ja kohaliku omavalitsuse üksuste ametiasutused ja nende ametiisikud ning avalik-õiguslikud ja eraõiguslikud juriidilised isikud lapse õiguste ja heaolu tagamiseks tegema koostööd ja vajaduse korral kaasama teise riigi pädeva asutuse või selleks volitatud isiku.

§ 8. Cooperation
(1) In order to ensure the child’s rights and well-being, state and local government agencies and the officials thereof, legal persons in public and private law shall cooperate with each other upon the planning, financing and application of all measures targeted to children by involving the children, parents, persons raising children, interest groups and the public therein.
(2) Based on an international agreement, EU legislation or other legislation, state and local government agencies and the officials thereof, legal persons in public and private law shall cooperate with each other in order to ensure the rights and well-being of children and involve a competent authority of another state or a person authorised therefor, if necessary.
§ 9. Teavitamine
Riigi ja kohaliku omavalitsuse üksuste ametiasutused ja nende ametiisikud ning avalik-õiguslikud ja eraõiguslikud juriidilised isikud peavad tagama elanikkonna teavitamise lastekaitsemeetmetest, pöörates erilist tähelepanu abivajava või hädaohus oleva lapse abistamiseks vajaliku teabe avalikustamisele.

§ 9. Notification
State and local government agencies and the officials thereof, legal persons in public and private law shall ensure the notification of the public of child protection measures, paying special attention to the disclosure of information necessary for assisting children in need or in danger.

Lastekaitse on lapse õiguste ja heaolu tagamiseks käesolevas seaduses sätestatud põhimõtteid järgivate tegevuste, toetuste, teenuste ja muu abi (edaspidi koos meetmed) kogum.

§ 10. Child protection
Child protection means the aggregate of activities, supports, services and other assistance following the principles provided for in this Act to ensure the rights and well-being of children (hereinafter the measures).

Lastekaitset korraldavad Vabariigi Valitsus, ennetusnõukogu, Sotsiaalministeerium, Sotsiaalkindlustusamet ja kohaliku omavalitsuse üksused käesolevas seaduses sätestatud ülesannete alusel.

§ 11. Organisation of child protection
Child protection shall be organised by the Government of the Republic, prevention council, Ministry of Social Affairs, Social Insurance Board and local authorities based on the functions provided for in this Act.

Vabariigi Valitsuse ülesanne lastekaitse korraldamisel on asjakohaste õigusaktide eelnõude ja riiklike strateegiate väljatöötamine ja kinnitamine ning jätkusuutliku rahastamise tagamine.

§ 12. Function of Government of the Republic
The function of the Government of the Republic upon the organisation of child protection shall be the development and approval of relevant draft legislation and national strategies and ensuring sustainable financing.
§ 13. Ennetusnõukogu ülesanded
Ennetusnõukogu on valitsuskomisjon, mille ülesanded lastekaitsepoliitika korraldamisel on:
strateegiliste eesmärkide ja prioriteetide seadmine ning valdkonnaüleste tegevuste koordineerimine;
lapse heaolu tagamist ja lapse õiguste kaitset puudutavate ettepanekute esitamine Vabariigi Valitsusele ja teistele asjaomastele institutsioonidele;
Ühinenud Rahvaste Organisatsiooni lapse õiguste komitee esitatud riigipõhiste soovituste ülevaatamine ja sellega seonduvate tegevuste koordineerimine.
Ennetusnõukogu koosseisu, juhtimise ja töökorra kehtestab Vabariigi Valitsus määrusega.

§ 13. Functions of prevention council
(1) The prevention council is a government committee, the functions of which in the organisation of child protection policy are:
1) to establish the strategic objectives and priorities and co-ordinate cross-sectoral activities;
2) to submit proposals concerning the protection of children’s rights and ensuring the well-being of children to the Government of the Republic and other relevant institutions;
3) to review the recommendations to the state submitted by the UN Committee on the Rights of the Child and to co-ordinate the activities related therewith.
(2) The membership, management and the rules of procedure of the prevention council shall be established by a regulation of the Government of the Republic.

lastekaitsepoliitika väljatöötamine ja selle rakendamise koordineerimine;

lastekaitse ja selle järelevalve riiklik koordineerimine;
rahvusvahelises lastekaitsepoliitika kujundamises ja koostöös osalemine;
lastekaitsealaste uuringute ja analüüside tegemise korraldamine ning lastekaitsemeetmete planeerimine ja arendamine;
lapse õiguste kaitseks ja heaolu tagamiseks juhiste, rakendussuuniste ja muude teabematerjalide väljatöötamine ning nendest avalikkuse teavitamine.

§ 14. Functions of Ministry of Social Affairs
(1) The functions of the Ministry of Social Affairs upon the organisation of child protection are:
1) to develop the child protection policy and to coordinate the implementation thereof;
2) to submit reports to the Government of the Republic concerning the situation of children and families;
3) the national coordination of child protection and supervision thereof;
4) to participate in the formation of international child protection policy and cooperation;
5) to organise the performance of child protection studies and analyses and to plan and develop child protection measures;
6) to develop instructions, implementing guidelines and other informative materials for the protection of children’s rights and ensuring children’s well-being and notification of the public thereof;
(3) The performance of functions specified in clauses 5 and 6 of subsection 1 of this section may be assigned to a person in private law with an administrative contract.

Sotsiaalkindlustusameti ülesanded lastekaitse korraldamisel on riikliku lastekaitsepoliitika elluviimine, riiklike strateegiate rakendamine ning valdkondadeülese lastekaitsealase koostöö ja ennetuse koordineerimine.
Sotsiaalkindlustusamet rakendab kohaliku omavalitsuse üksuse taotluse alusel järgmisi lapsi ja peresid toetavaid riiklikke meetmeid:
kohaliku omavalitsuse üksuse nõustamine lapse heaolu toetavate arengukavade koostamisel;
rahvusvaheliste lastekaitse üksikjuhtumite vahendamine kohaliku omavalitsuse üksusele ja sellealane kohaliku omavalitsuse üksuse nõustamine;
kohaliku omavalitsuse üksuse abistamine lastekaitse juhtumite lahendamisel;
kohaliku omavalitsuse üksuse toetamine lapsele või perele sobivate meetmete leidmisel olemasolevate riiklike meetmete hulgast.
Sotsiaalkindlustusamet rakendab järgmisi lapsi ja peresid toetavaid riiklikke meetmeid:
riigisisese ja rahvusvahelise lapsendamise korraldamine ning rahvusvahelise lapsendamise komisjoni teenindamine;
hooldusperede leidmine, nende sobivuse hindamine ja hooldusperede ettevalmistamisega seotud toimingute tegemine;
lastekaitsealase statistika kogumine;
riigi ja kohaliku omavalitsuse üksuse ametiasutuste ja nende ametiisikute ning juriidiliste ja füüsiliste isikute ööpäevaringne nõustamine abivajava või hädaohus oleva lapse abistamiseks;
lastekaitsealase teavitustegevuse korraldamine;
lastekaitsetöötajate täienduskoolituse korraldamine;
vanemlike oskuste arendamine, sellega seotud täienduskoolituste ja ennetustegevuste korraldamine;

lasteabitelefoni 116 111 pidamine ja selle kaudu või muul viisil lasteabile saabunud teabe vastuvõtmine, lapse abivajaduse väljaselgitamine ja hädaohus oleva lapse ajutine perekonnast eraldamine käesoleva seaduse § 33 alusel;
seksuaalselt väärkoheldud lapse ja seksuaalselt väärkohtlevalt käituva lapse abistamiseks käesoleva seaduse §-s 29¹ sätestatud meetmete pakkumine;
riikliku ja haldusjärelevalve teostamine käesolevas seaduses sätestatud alustel.
Käesoleva paragrahvi lõike 3 punktis 4¹ nimetatud lastekaitsetöötajate täienduskoolituse tingimused ja korra kehtestab valdkonna eest vastutav minister määrusega.
Käesoleva paragrahvi lõike 3 punktis 4 loetletud ülesannete täitmise võib halduslepinguga anda üle eraõiguslikule isikule.
Sotsiaalkindlustusamet täidab keskasutusena nõukogu määruse (EL) 2019/1111, mis käsitleb kohtualluvust, abieluasjade ja vanemliku vastutusega seotud kohtuasjades tehtud lahendite tunnustamist ja täitmist ning rahvusvahelisi lapserööve (uuesti sõnastatud) (ELT L 178, 02.07.2019, lk 1–115), artikli 79 punktides a, b, f ja g ning artiklites 80 ja 82 ette nähtud ülesandeid.

§ 15. Functions of Social Insurance Board
(1) The functions of the Social Insurance Board upon the organisation of child protection are the implementation of state child protection policy, application of national strategies and coordination of cross-sectoral cooperation and prevention concerning child protection.
(2) Based on the request of the local government, the Social Insurance Board shall apply the following state measures supporting children and families:
1) provision of counselling to the local governments upon the preparation of development plans supporting the well-being of children;
2) mediation of individual international child protection cases to the local government and provision of counselling to the local government thereon;
3) provision of assistance to the local governments upon resolving child protection cases;
4) supporting the local governments upon the establishment of suitable measures for children or families from amongst the existing state measures.
(3) The Social Insurance Board shall apply the following state measures supporting children and families:
1) organisation of national and international adoption and servicing the international adoption committee;
1¹) finding foster families, assessment of their suitability and performance of acts relating to the preparation of foster families;
2) collection of child protection statistics;
3) 24-hour counselling of state and local authorities, the officials thereof and legal and natural persons for the assistance of children in need of assistance or children in danger;
4) organisation of notification related to child protection;
4¹) to organise the further training of child protection officials;
4²) to develop parenting skills, organise the further training and preventive activities connected therewith;
6) maintenance of child helpline service 116 111 and receipt of information transmitted to the child help via thereof or other means, ascertaining the child’s need for assistance and temporary separation of a child in danger from family on the basis of § 33 of this Act;
6¹) provision of measures provided for in § 291 of this Act for assisting sexually abused children or children behaving in a sexually abusive manner;
7) exercise of state and administrative supervision on the bases provided for in this Act.
(3¹) The conditions of and procedure for the organisation of further training of child protection officials specified in clause 4¹ of subsection 3 of this section shall be established by a regulation of the minister in charge of the policy sector.
(4) The performance of functions specified in clause 4 of subsection 3 of this section may be assigned to a person in private law with an administrative contract.
(5) The Social Insurance Board as the Central Authority shall perform the functions prescribed for in points (a), (b), (f) and (g) of Article 79 and in Articles 80 and 82 of Council Regulation (EU) 2019/1111 on jurisdiction, the recognition and enforcement of decisions in matrimonial matters and the matters of parental responsibility, and on international child abduction (recast) (OJ L 178, 02.07.2019, p. 1–115).
§ 17. Kohaliku omavalitsuse üksuse ülesandedизменится 01.01.2027
Kohaliku omavalitsuse üksuse ülesanded lastekaitse korraldamisel on:
lapse õiguste ja heaolu tagavate põhimõtete järgimine kohaliku omavalitsuse arengukavas;
lapse õigusi ja heaolu tagavate programmide ja projektide väljatöötamine ning nende rakendamine oma haldusterritooriumil last ohustavate riskide ennetamiseks ja vähendamiseks;
abivajavast lapsest teada saamisel viivitamata lapse abivajaduse hindamine ja lapse abistamiseks meetmete pakkumine;
perekonnast eraldatud lapsele ja tema perekonnale meetmete pakkumine;
kohaliku omavalitsuse üksuse hallatavate lasteasutuste sisehindamise üle teenistusliku järelevalve korraldamine;
lapse arengut toetava keskkonna loomiseks ning laste, lastega perede ja lapsi kasvatavate isikute toimetuleku parandamiseks oma haldusterritooriumil vajaliku teabe kogumine laste ja perede olukorra ning vajaduste kohta;

§ 17. Functions of local government
(1) The functions of a local government upon the organisation of child protection are:
1) to follow the principles ensuring the rights and well-being of children in the local government development plan;
2) to develop programmes and projects ensuring the rights and well-being of children and the application thereof in its administrative territory to prevent and decrease the risks that endanger children;
3) upon becoming aware of a child in need of assistance, to immediately assess the child’s need for assistance and to provide measures for assisting the child;
4) to provide measures to a child separated from family and to his or her family;
5) to organise supervisory control over the internal evaluation of child care institutions administered by the local government;
6) to collect necessary information concerning the situation and needs of children and families in order to create an environment supporting the child’s development and to improve the coping of children, families with children and persons raising children in its administrative territory;
7) to exercise state supervision on the bases provided for in this Act.
(2) The local government shall create conditions for the performance of child protection work with the purpose of ensuring the performance of functions listed in subsection 1 of this section. The committee of children and families shall be established at local governments as an advisory body, if necessary.

§ 18. Child protection officials and persons working with children
(1) A child protection official is an official of the Social Insurance Board or a local authority who performs the functions provided for in this Act or other legislation upon ensuring the rights and well-being of children.
(2) A person working with children is a person in direct contact with children in the course of his or her work or professional activities and also a person in direct contact with children in the course of voluntary activities, serving in alternative service, participating in employment services or practicing as a trainee.
§ 19. Lastekaitsetöötajale esitatavad nõuded
Lastekaitsetöötajal peab olema erialane ettevalmistus ja kõrgharidus.
Lastekaitsetöötaja peab hiljemalt kahe aasta möödumisel alates lastekaitsetöötajana teenistusse asumisest omandama sotsiaaltöötaja kutse spetsialiseerumisega lastekaitsele.
Välisriigis omandatud kutsekvalifikatsiooni vastavuse käesoleva seaduse nõuetele otsustab Sotsiaalkindlustusamet välisriigi kutsekvalifikatsiooni tunnustamise seaduse alusel, arvestades käesolevast seadusest tulenevaid erisusi.

§ 19. Requirements for child protection officials
(1) Child protection officials must have professional qualification and higher education.
(2) Child protection officials shall acquire the profession of a social worker with specialisation in child protection no later than within two years after starting service as a child protection official.
(3) The compliance of professional qualifications acquired abroad with the requirements of this Act shall be decided by the Social Insurance Board on the basis of the Recognition of Foreign Professional Qualifications Act, taking into account of the specifications arising from this Act.

Lapsega töötamist võimaldav isik või vastava tegevusloa väljastaja on kohustatud kontrollima käesoleva paragrahvi lõigetes 1–2 sätestatud piirangutest kinnipidamist isiku töölevõtmisel või tegevusloa väljastamisel. Lapsega töötamist võimaldav isik on kohustatud kontrollima lapsega töötava isiku vastavust käesoleva paragrahvi lõigetele 1–2 vähemalt kord 12 kuu jooksul, kui teavitust isiku karistusandmete muutumise kohta ei edastata automaatselt. Juriidilise isiku puhul on käesolevas lõikes sätestatud nõuete täitmise kohustatud korraldama juriidilise isiku seaduslik esindaja, kes võib selle kohustuse edasi delegeerida. Kui nõuete täitmise korraldamine on juriidilise isiku seadusliku esindaja poolt edasi delegeeritud, vastutab nõuete täitmise korraldamise eest isik, kellele see kohustus on delegeeritud.
Kui lapsega töötamist võimaldav isik või vastava tegevusloa väljastaja ei saa käesoleva paragrahvi lõigetes 1–2 sätestatud piirangutest kinnipidamist enne isiku töölevõtmist või tegevusloa väljastamist kriisiolukorra tõttu kontrollida ning kui isiku töölevõtmisega või tegevusloa väljastamisega viivitamine takistaks otseselt kriisiolukorra lahendamist või inimeste elu ja tervise kaitsmist vahetu ohu korral, võib isiku tööle võtta või tegevusloa väljastada, kui isik on andnud kirjalikku taasesitamist võimaldavas vormis kinnituse selle kohta, et tal puuduvad lõigetes 1–2 nimetatud piirangud lastega töötamiseks. Sellisel juhul on lapsega töötamist võimaldav isik või vastava tegevusloa väljastaja kohustatud kontrollima käesoleva paragrahvi lõigetes 1–2 sätestatud piirangutest kinnipidamist viivitamata pärast seda takistanud asjaolude äralangemist või vahetu ohu tõrjumist.
Kriisiolukord käesoleva seaduse tähenduses on kriisiolukord kriisiolukorra ja riigikaitse seaduse tähenduses.
Isik, keda on karistatud kriminaalkoodeksi § 118 lõike 2 või § 202 alusel või karistusseadustiku § 175, 175¹, 178 või 179 alusel, võib esitada Sotsiaalkindlustusametile taotluse lapsega töötamise piirangu ümberhindamiseks, kui piirangu aluseks olev tegu ei ole kehtiva õiguse kohaselt karistatav või on üle viidud teise süüteokoosseisu alla.
Käesoleva paragrahvi lõikes 4 nimetatud taotluses esitatakse põhjendused piirangu ümberhindamise aluse ja vajaduse kohta ning taotlusele lisatakse isiku suhtes jõustunud süüdimõistva kohtuotsuse koopia.
Sotsiaalkindlustusamet lahendab taotluse 60 päeva jooksul ning tunnistab isikule kehtiva lapsega töötamise piirangu kehtetuks, kui taotluse esitamise ajal kehtiva õiguse alusel:
ei ole kohtuotsuse kohaselt toime pandud tegu karistatav;
ei ole kohtuotsuse kohaselt toime pandud tegu karistatav käesoleva paragrahvi lõigetes 1 ja 2 nimetatud süüteona või
oleks kohtuotsuse kohaselt toime pandud tegu karistatav käesoleva paragrahvi lõikes 2 nimetatud süüteona ning isiku karistusandmed on karistusregistrist kustutatud ja kantud karistusregistri arhiivi.
Sotsiaalkindlustusamet võib kaasata taotluse lahendamise menetlusse Justiits- ja Digiministeeriumi arvamuse andmiseks taotleja toime pandud teo karistatavuse kohta vastavalt käesoleva paragrahvi lõike 6 punktidele 1–3.
Sotsiaalkindlustusamet edastab otsuse lapsega töötamise piirangu kehtetuks tunnistamise kohta karistusregistri volitatud töötlejale, kes eemaldab isiku karistusandmed karistusregistri seaduse § 20 lõike 1 punkti 9 alusel tehtava päringu vastusest.

§ 20. Restrictions for working as child protection officials and persons working with children
(1) A person who has been punished or to whom coercive treatment has been imposed for a criminal offence provided for in §§ 89–93, 95–112, 113, 114, 116, 118¹, 133–133³, 141–145¹, 175–179 or 187 of the Penal Code, the information concerning punishment of which has not been deleted from the criminal records database according to the Criminal Records Database Act or the information concerning punishment of which has been deleted from the criminal records database and entered in the archives of the criminal records database, may not act as a child protection official or as a person working with children.
(1¹) The restriction provided for in subsection 1 of this section shall also be applied to persons who have been punished before entry into force of the Penal Code for acts qualified under §§ 100–102, 115–117, subsection 2 of § 118, § 200, 200³, 202, 202², 202⁴ or clause 1 or 2 of subsection 3 of § 202⁶ of the Criminal Code and also to persons who have been punished for equal criminal offences committed in a foreign state.
(2) A person who has been punished or to whom coercive treatment has been imposed for a criminal offence provided for in §§ 118, 119¹, 121, 122, 125, clause 2 of subsection 2 of § 134, § 135, subsection 2 of § 136, clause 2 of subsection 2 of § 138¹, subsection 2 of § 140, §§ 153¹, 171–174, 180–182, 182¹, 185, clause of subsection 2 of § 195, §§ 200, 214, subsection 3 of § 215, §§ 237–237³, 244, 246, clause 3 of subsection 3 of § 251, § 263, clause of subsection 2 of § 266, §§ 274, 290¹, 291, 302, 303, 312, 322, 323, subsection 3 of § 327, §§ 403–405 or 435 of the Penal Code, the information concerning punishment of which has not been deleted from the criminal records database according to the Criminal Records Database Act, may not act as a child protection official or as a person working with children.
(3) A person who enables working with children or the issuer of a relevant activity licence is required to verify compliance with the restrictions provided for in subsections 1–2 of this section upon the employment of a person or issue of an activity licence. A person who enables working with children is required to verify the compliance of the person working with children with subsections 1–2 of this section at least once in 12 months, unless a notification on the change in the person’s punishment data is transmitted automatically. In case of a legal person, compliance with the requirements provided for in this subsection shall be organised by the legal representative of the legal person who may also re-delegate this obligation. If the organisation of compliance with the requirements has been re-delegated by the legal representative of the legal person, the person to whom the obligation has been delegated shall be liable for the organisation of compliance with the requirements.
(4) A person who has been punished on the basis of subsection 2 of § 118 or § 202 of the Criminal Code or on the basis of § 175, 175¹, 178 or 179 of the Penal Code may submit an application to the Social Insurance Board for the re-assessment of the restriction on working with children if the act being the basis of the restriction is not punishable according to the applicable law or has been transferred under the elements of another offence.
(5) The application specified in subsection 4 of this section must set out the justifications on the basis and need for re-assessment of the restriction and a copy of a judgment of conviction having entered into force with regard to the person must be appended to the application.
(6) The Social Insurance Board shall resolve the application within 60 days and revoke the restriction on working with children applicable to the person if on the basis of the law applicable at the time of submitting the application:
1) the act committed according to the court judgment is not pubishable;
2) the act committed according to the court judgment is not pubishable as an offence specified in clauses 1 and 2 of this section or
3) the act committed according to the court judgment would be pubishable as an offence specified in subsection 2 of this section and the person’s punishment data have been deleted from the criminal records database and entered in the archives of the criminal records database.
(7) The Social Insurance Board may involve the Ministry of Justice and Digital Affairs in the procedure for resolving the application to give an opinion on the punishability of the act committed by the applicant according to clauses 1–3 of subsection 6 of this section.
(8) The Social Insurance Board shall send the decision on the revocation of the restriction on working with children to the processor of the criminal records database who shall delete the person’s punishment data from the response to an enquiry made on the basis of clause 9 of subsection 1 of § 20 of the Criminal Records Database Act.

Kõigi last mõjutavate otsuste vastuvõtmisel, vastu võtmata jätmisel ning otsuse kavandamisel eri võimaluste vahel valimisel (edaspidi koos otsuste tegemine) tuleb selgitada välja lapse huvid ning lähtuda otsuse tegemisel nendest kui esmatähtsast kaalutlusest.
Lapse huvide väljaselgitamiseks tuleb:
selgitada välja kõik asjassepuutuvad lapse olukorra ja isikuga seonduvad asjaolud ning muu informatsioon, mis on vajalik, et hinnata otsuse mõju lapse õigustele ja heaolule;
selgitada lapsele kavandatava otsuse sisu ja põhjuseid, kuulata laps ära tema vanust ja arengutaset arvestades sobival viisil ning võtta lähtuvalt lapse vanusest ja arengutasemest tema arvamus arvesse ühe asjaoluna huvide väljaselgitamisel;
kõiki asjassepuutuvaid asjaolusid kogumis hinnates kujundada põhjendatud seisukoht lapse huvide kohta seoses kavandatava otsusega.
Kui lapse huvid erinevad lapse arvamusest või muul põhjusel tehakse otsus, mis ei ühti lapse arvamusega, tuleb selgitada lapsele tema arvamuse arvestamata jätmise põhjuseid.

§ 21. Setting best interests of child as primary consideration
(1) Upon the adoption of or deciding not to adopt decisions affecting a child and choosing between different options upon planning a decision (hereinafter deciding together), the best interests of the child shall be ascertained and they shall be based on as the primary consideration upon the making of decisions.
(2) In order to ascertain the best interests of the child, it is necessary:
1) to ascertain all the relevant circumstances concerning the situation and person of the child and other information which is necessary to evaluate the effect of the decision on the child’s rights and well-being;
2) to explain the content and reasons of the planned decision to the child, to hear the child in a manner taking account of his or her age and development and to account for his or her opinion based on the child’s age and development as one of the circumstances upon ascertaining the best interests of the child;
3) assessing all the relevant circumstances in aggregate, to form a reasoned opinion concerning the best interests of the child with regard to the planned decision.
(3) If the best interests of a child differ from the child’s opinion or if a decision which does not coincide with the child’s opinion is made on other grounds, the reasons for not taking the child’s opinion into account must be explained to the child.
§ 22. Last kasvatava isiku ja lapsega töötava isiku kohustused
Last kasvatav isik on lapsevanem või last tegelikult kasvatav isik.
Lapse eest hoolitsemisel ja lapse kasvatamisel peavad last kasvatav isik ja lapsega töötav isik lapse vanust ja arengutaset arvestades:
arutama lapsega hooldus- ja kasvatusküsimusi, arvestades lapse võimete ja vajaduste suurenemisega iseseisvalt ja vastutusvõimeliselt tegutseda;
juhendama ja suunama last iseseisvalt tegutsema;
selgitama lapsele, kuidas hoida oma tervist ja ennast arendada ning kuidas vähendada riske ja ennetada ohtu.
Last kasvatav isik ja lapsega töötav isik on kohustatud lapse abivajaduse ilmnemisel otsima abi ja vajaduse korral tegema koostööd lastekaitsetöötaja või teiste lapsega töötavate isikutega.
Lapse abivajaduse ilmnemisel või selle kohta teate saamisel peab lapsega töötav isik viivitamata teavitama sellest last kasvatavat isikut.

§ 22. Obligations of persons raising children and persons working with children
(1) A person raising a child is the parent or a person actually raising the child.
(2) Upon caring for and raising a child, the person raising a child and the person working with a child shall, taking into account the age and development of the child:
1) discuss the care and educational issues with the child, taking into account the abilities and increase of the child’s need to act independently and responsibly;
2) to provide instruction and guidance to the child to act independently;
3) to explain to the child how to look after his or her health, to develop his- or herself, to reduce risks and to prevent danger.
(3) Upon occurrence of the child’s need for assistance, the person raising a child and the person working with a child shall seek assistance and cooperate with child protection officials and other persons working with children, if necessary.
(4) Upon occurrence of the child’s need for assistance or receipt of a notification thereon, the person working with a child shall immediately notify the person raising the child thereof.
§ 23. Alaealise avalikus kohas viibimise piirang
Alla 16-aastasel alaealisel on keelatud viibida ilma täiskasvanud saatjata avalikus kohas kell 23.00–6.00. 1. juunist kuni 31. augustini on alla 16-aastasel alaealisel keelatud viibida ilma täiskasvanud saatjata avalikus kohas kell 24.00–5.00.
Kohaliku omavalitsuse üksusel on õigus käesolevas paragrahvis sätestatud öist liikumispiirangut ajutiselt lühendada.

§ 23. Restriction for minors to be in public places
(1) It is prohibited for a minor under sixteen years of age to be in a public place from 23.00 to 06.00 without being accompanied by an adult. During the period from 1 June to 31 August, it is prohibited for a minor under sixteen years of age to be in a public place from 00.00 to 05.00 without being accompanied by an adult.
(2) Local governments have the right to temporarily shorten the night-time restriction of movement provided for in this section.
§ 24. Lapse väärkohtlemise keeld
Lapse hooletusse jätmine, lapse vaimne, emotsionaalne, kehaline ja seksuaalne väärkohtlemine, sealhulgas lapse alavääristamine, hirmutamine ja kehaline karistamine, samuti lapse karistamine mis tahes muul viisil, mis ohustab tema vaimset, emotsionaalset või füüsilist tervist, on keelatud.
Lapse väärkohtlemise ennetamiseks on lapse seaduslikul esindajal karistusregistri seaduse alusel õigus saada teavet teise isiku karistatuse kohta.

§ 24. Prohibition of child abuse
(1) Neglect of a child, mental, emotional, physical and sexual abuse of a child, including humiliation, frightening and physical punishment of a child, also punishment of a child in any other manner which endangers his or her mental, emotional or physical health is prohibited.
(2) In order to prevent child abuse, the legal representative of a child has the right to receive information on the punishment records of another person on the basis of the Criminal Records Database Act.
(3) It is not a case of child abuse for the purposes of this Act if the child’s behaviour poses a direct and immediate threat to the life or health of the child or to the life or health of other people and the threat cannot be prevented, including by way of conversation, convincing or verbal reassurance and due to that the person raising the child, the person working with the child and child protection official must apply physical strength to an extent which does not cause physical, mental or emotional damage to the child and inflicts the rights and freedoms of the child the least.
(4) Physical strength for the purposes of this Act may only be applied to restrict the child’s moving or movements to an extent proportional to and the least necessary for the elimination of the risk threatening the child or originating from the child. Physical strength may not be used for the purpose of punishment.

§ 25. Prohibition of dissemination of objects with pornographic content and promoting violence
(1) It is prohibited to manufacture, show and disseminate to children printed matter, films, audio and video recordings and objects that promote violence or cruelty.
(2) It is prohibited to manufacture, show and disseminate to children objects, printed matter and films of pornographic content.

§ 26. Child in need of assistance
A child in need of assistance is a child whose well-being is threatened or in the case of whom doubt has arisen concerning his or her abuse, neglect or any other situation violating the rights of the child and a child whose behaviour threatens his or her well-being or the well-being of other persons.
§ 27. Abivajavast lapsest teatamineсудебная практика
Kohustus abivajavast lapsest teatada on kõigil isikutel, kellel on olemas teave abivajavast lapsest.
Abivajavast lapsest tuleb viivitamata teatada kohaliku omavalitsuse üksusele või lasteabitelefonil 116 111.
Abivajava lapse kohta teate vastu võtnud asutus või ametiisik, välja arvatud lapse rahvastikuregistrisse kantud elukoha järgne kohaliku omavalitsuse üksus või selle lastekaitsetöötaja, on kohustatud teate viivitamata edastama lapse rahvastikuregistrisse kantud elukoha järgsele kohaliku omavalitsuse üksusele.
Kui lapse rahvastikuregistrisse kantud elukoha järgne kohaliku omavalitsuse üksus ei ole teada või seda ei ole võimalik välja selgitada, tuleb teade abivajavast lapsest viivitamata edastada selle kohaliku omavalitsuse üksusele, kus laps viibib.
Abivajavast lapsest teatanud isikut ega teatamise fakti ei avalikustata, välja arvatud süüteomenetluses. Abivajavast lapsest teavitaval isikul on enda või oma perekonna kaitseks õigus jätta teavitamisel enda kohta andmed avaldamata.

§ 27. Notification of child in need of assistance
(1) All persons who have knowledge of a child in need of assistance are required to notify of the child in need of assistance
(2) A child in need of assistance must be immediately notified of to the local government or to child helpline service 116 111.
(3) The authority or official having received the notice of a child in need of assistance, except for the local government of the child’s residence entered in the population register or the child protection official thereof, shall be required to forward the notice immediately to the local government of the child’s residence entered in the population register.
(4) If the local government of the child’s residence entered in the population register is unknown or it cannot be ascertained, the notice of a child in need of assistance shall be immediately forwarded to the local government where the child is staying.
(5) The identity of the person having notified of a child in need of assistance or the fact of notification shall not be disclosed, except for in proceedings of an offence. The person notifying of a child in need of assistance shall have the right not to disclose his or her data upon notification for his or her own protection or the protection of his or her family.
§ 27¹. Lapsega töötava isiku teade abivajavast lapsest
Alus-, põhi-, kesk-, kutse- ja huvihariduse ning lastehoiu õpetaja või tugispetsialist, lastehoius töötav lapsehoidja, laste hoolekandeasutuse töötaja, noorsootöötaja või lapsega töötav treener, huviringi juhendaja, tervishoiutöötaja, politseiametnik või ohvriabitöötaja teatab töös või kutsetegevuses märgatud abivajavast lapsest käesoleva seaduse § 27 kohaselt, edastades vähimas vajalikus ulatuses temale teadaolevad § 34² lõigetes 3 ja 4 nimetatud andmed. Teatada võib ka asutuses selleks määratud kontaktisiku kaudu.
Lastekaitsetöötaja võib anda käesoleva paragrahvi lõike 1 alusel abivajavast lapsest teatanud isikule teavet juhtumi menetluse alustamise kohta, kui see on vajalik lapse heaolu toetamiseks.

§ 27¹. Notification of child in need of assistance by person working with children
(1) Pre-school, basic, secondary, vocational and hobby education teacher and daycare teacher or support specialist, childminder working in daycare, child welfare institution employee, youth worker or coach working with children, hobby group instructor, health care professional, police official or victim support worker shall notify of a child in need of assistance whom they have noticed in the course of their work or professional activity in accordance with § 27 of this Act, forwarding the data known to them specified in subsections 3 and 4 of § 34² to the minimum necessary extent. It is also possible to notify through a contact person assigned therefor in an institution.
(2) A child protection official may give information on the commencement of proceedings in the case to the person having notified of a child in need of assistance on the basis of subsection 1 of this section, if it is necessary for supporting the child’s welfare.
§ 27². Abivajava lapse väljaselgitamine
Lapse rahvastikuregistrisse kantud elukoha järgsel kohaliku omavalitsuse üksusel on õigus abivajava lapse väljaselgitamise eesmärgil töödelda sotsiaalteenuste ja -toetuste andmeregistris järgmiste laste andmeid:
lapsed, kelle puhul on Sotsiaalkindlustusametile esitatud puude raskusastme tuvastamise taotlus või kelle kohta on Sotsiaalkindlustusametile käesoleva paragrahvi lõike 4 alusel edastatud andmed puude raskusastme tuvastamiseks puuetega inimeste sotsiaaltoetuste seaduse kohaselt;
lapsed, kellel on puuetega inimeste sotsiaaltoetuste seaduse § 2⁶ lõike 2 alusel sätestatud terviseseisundist tingitud püsiv toevajadus, mille kohta on kantud andmed tervise infosüsteemi.
Käesoleva paragrahvi lõike 1 punktis 1 nimetatud laste puhul töötleb kohaliku omavalitsuse üksus järgmisi isikuandmeid:
lapse üldandmed;
info puude raskusastme tuvastamise või mittetuvastamise kohta;
info harvikhaigusega lapsele puudega lapse sotsiaaltoetuse määramise kohta;
puude raskusastme tuvastamise korral puude raskusaste, kestus ja funktsiooni kõrvalekalle;
vanema või eestkostja nimi ja isikukood või juriidilise isiku registrikood ja kontaktandmed;
vanema või eestkostja rahvastikuregistrijärgne elukoht ja viibimiskoht;
lapse surmakuupäev.
Käesoleva paragrahvi lõike 1 punktis 2 nimetatud laste puhul töötleb kohaliku omavalitsuse üksus järgmisi isikuandmeid:
lapse üldandmed;
vanema või eestkostja nimi ja isikukood või juriidilise isiku registrikood ja kontaktandmed;
vanema või eestkostja rahvastikuregistrijärgne elukoht ja viibimiskoht;
lapse surmakuupäev.
Kohaliku omavalitsuse üksus edastab vanema või eestkostja nõusolekul andmed käesoleva paragrahvi lõike 1 punktis 2 nimetatud lapse kohta Sotsiaalkindlustusametile puude raskusastme tuvastamiseks.

§ 27². Ascertaining child in need of assistance
(1) The local government of the child’s residence entered in the population register shall have the right, for the purposes of ascertaining children in need of assistance, process in the register of social services and benefits, the data on the following children:
1) children in case of whom an application for the determination of the degree of severity of disability has been forwarded to the Social Insurance Board or for whom data has been forwarded to the Social Insurance Board on the basis of subsection 4 of this section for the determination of the degree of severity of disability pursuant to the Social Benefits for Disabled Persons Act;
2) children who have a permanent need for support arising from state of health on the basis of subsection 2 of § 2⁶ of the Social Benefits for Disabled Persons Act with regard to which data have been entered in the health information system.
(2) In case of children specified in clause 1 of subsection 1 of this section the local authority shall process the following personal data:
1) general data of the child;
2) information on whether or not a degree of disability has been established;
3) information on the grant of disabled child allowance to a child with rare disease disability;
4) if a degree of disability has been established, the degree and duration of the disability and functional deviation;
5) name and personal identification code of the parent or guardian or the registry code and contact details of a legal person;
6) place of residence and whereabouts of the parent or guardian according to the population register;
7) date of death of the child.
(3) In case of children specified in clause 2 of subsection 1 of this section the local authority shall process the following personal data:
1) general data of the child;
2) name and personal identification code of the parent or guardian or the registry code and contact details of a legal person;
3) place of residence and whereabouts of the parent or guardian according to the population register;
4) date of death of the child.
(4) The local authority shall send, with the consent of a parent or guardian, the data on a child specified in clause 2 of subsection 1 of this section to the Social Insurance Board for the determination of degree of severity of a disability.

Enne abivajavale lapsele sobiva meetme kohaldamist tuleb hinnata lapse abivajadust. Lapse abivajadust hindab lastekaitsetöötaja või lapsega töötav isik, välja arvatud vabatahtlikus tegevuses, asendusteenistuses teenides, tööturuteenustel osaledes või praktikandina lapsega vahetult kokku puutuv isik, kaasates selleks vajaduse korral asjaomase spetsialisti.
Lapse abivajadust hinnates peab lastekaitsetöötaja või lapsega töötav isik andma hinnangu:
lapse füüsilisele, tervislikule, psühholoogilisele, emotsionaalsele, sotsiaalsele, kognitiivsele, hariduslikule ja majanduslikule seisundile;
last kasvatava isiku vanemlikele oskustele.
Lastekaitsetöötaja või lapsega töötav isik peab lapse abivajaduse hindamisse kaasama lapse ja last kasvatava isiku või lasteasutuse, kus laps viibib.
Sellise kriisiolukorra ajal, mis mõjutab oluliselt lastekaitsetööd kohaliku omavalitsuse üksuses, hindab lastekaitsetöötaja lapse abivajadust käesoleva paragrahvi alusel, lähtudes nendest meetmetest, mida on kriisiolukorraga kaasnevaid asjaolusid arvestades võimalik lapse abistamiseks kohaldada.

§ 28. Assessment of need for assistance
(1) Before the application of a suitable measure to a child in need of assistance, the child’s need for assistance must be assessed. The child’s need for assistance shall be assessed by a child protection official or a person working with a child, except for a person in direct contact with a child in the course of voluntary activity, serving in alternative service, participating in employment services or practicing as a trainee, by involving a relevant specialist therefor, if necessary.
(2) Upon assessing the child’s need for assistance, the child protection official or a person working with a child shall give an assessment to:
1) the physical, medical, psychological, emotional, social, cognitive, educational and economic situation of the child;
2) the parenting skills of the person raising the child.
(3) A child protection official shall involve the child and the person raising the child or the child care institution where the child is staying in the assessment of the need for assistance.

Abivajavale lapsele abi osutamine on lapse heaolu toetava meetme kohaldamine viisil, mis parandab lapse ja last kasvatava isiku vahelisi suhteid.
Abi osutamisel tuleb rakendada võrgustikutööd, järgides juhtumikorralduse põhimõtteid sotsiaalhoolekande seaduses sätestatud korras.
Kohaliku omavalitsuse üksus peab kümne päeva möödumisel abivajavast lapsest teada saamisest tegema otsuse juhtumikorralduse algatamiseks või algatamata jätmiseks või juhtumi edastamiseks pädevale ametiisikule.
Kui kohaliku omavalitsuse üksus saab teada lapsest, keda kasvatav isik on hädaohus olev täisealine perevägivalla ohver ohvriabi seaduse § 9 lõike 2 tähenduses, peab kohaliku omavalitsuse üksus algatama juhtumikorralduse lapsele abi osutamiseks ning tegema koostööd Sotsiaalkindlustusameti ja teiste täisealist ohvrit abistavate asutustega.

§ 29. Provision of assistance for child in need of assistance
(1) Provision of assistance for a child in need of assistance means the application of measures supporting the child’s well-being in a manner which improves the relations between the child and the person raising the child.
(2) Networking shall be applied upon the provision of assistance, following the principles of case management pursuant to the procedure provided for in the Social Welfare Act.
(3) The local government shall, within ten days after becoming aware of a child in need of assistance, make a decision on whether or not to commence case management or to forward the case to a competent official.
(3¹) Where the local government becomes aware of a child raised by a person who is an adult victim of domestic violence who is in danger for the purposes of subsection 2 of § 9 of the Victim Support Act, the local government must commence case management for the provision of assistance to the child and cooperate with the Social Insurance Board and other agencies assisting adult victims.
(4) Case management may not be commenced only in case the child’s need for assistance can be satisfied by a non-recurring measure.
(5) Upon assessing the child’s need for assistance and provision of assistance, the local government shall establish and document the opinion of the child and attach it to the mandatory case plan related with the child, unless provided otherwise by a specific Act.
§ 29¹. Sotsiaalkindlustusameti meetmed seksuaalselt väärkoheldud lapse ja seksuaalselt väärkohtlevalt käituva lapse abistamiseks
Kohaliku omavalitsuse üksus teavitab abivajavast lapsest teada saades kohe Sotsiaalkindlustusametit, juhul kui laps:
on seksuaalselt väärkoheldud või on selline kahtlus;
on kahtlustatav või menetlusalune isik seksuaalsüüteos või lapse seksuaalkäitumine ohustab teiste isikute või tema enda heaolu.
Sotsiaalkindlustusamet asub käesolevas paragrahvis sätestatud ülesandeid täitma ka muu asutuse või isiku pöördumise või lasteabitelefonile tulnud info alusel. Sellisel juhul teavitab Sotsiaalkindlustusamet sellest lapse juhtumikorralduse eest vastutavat kohaliku omavalitsuse üksust, kriminaalmenetluse korral arvestades kriminaalmenetluse seadustiku §-s 214 kohtueelse menetluse andmete avaldamise kohta sätestatuga.
Käesoleva paragrahvi lõikes 1 nimetatud lapse heaolu toetamiseks Sotsiaalkindlustusamet:
pakub lapsesõbralikku keskkonda lapse suhtes lastekaitse- ja süüteomenetluse toimingute tegemiseks ning lapse taastumist toetavate teenuste osutamiseks;
kuulab vajaduse korral lapse ära väärkohtlemise väljaselgitamiseks ja videosalvestab ärakuulamise kasutamiseks tõendina süüteomenetluses;
hindab lapse väärkohtlemisest tulenevat või väärkohtleva käitumisega seotud abivajadust, samuti lapse väärkohtleva käitumisega seotud riske, kaasates selleks vajaduse korral asjakohase spetsialisti;
toetab ja nõustab last ning tema lähedasi;
jälgib lapse abistamiseks rakendatud meetmete tulemuslikkust.
Käesoleva paragrahvi lõike 3 punktis 2 nimetatud lapse ärakuulamise videosalvestist säilitab Sotsiaalkindlustusamet kuni kuus kuud videosalvestamise kuupäevast arvates. Salvestise säilitamise ja väljastamise tingimused ja kord sätestatakse käesoleva paragrahvi lõike 5 alusel kehtestatud määruses.
Käesoleva paragrahvi lõikes 3 nimetatud ülesannete täitmise täpsemad tingimused ja korra kehtestab valdkonna eest vastutav minister määrusega.

§ 29¹. Measures of Social Insurance Board for assisting sexually abused children or children behaving in sexually abusive manner
(1) A local government agency shall notify the Social Insurance Board immediately after becoming aware of a child in need of assistance if the child:
1) has been sexually abused or in case of suspicion thereof;
2) is a suspect or a person subject to proceedings in a sexual offence or the sexual behaviour of the child threatens the wellbeing of other persons or the child.
(2) The Social Insurance Board starts to perform the functions provided for in this section also based on the inquiry of another agency or person or based on the information received through the child helpline. In such case the Social Insurance Board shall notify the local government agency responsible for the child’s case management, and in case of criminal proceedings, taking into account the provisions of § 214 of the Code of Criminal Procedure on the disclosure of data in pre-trial procedure.
(3) To support the wellbeing of a child specified in subsection 1 of this section, the Social Insurance Board shall:
1) provide a child-friendly environment for making child protection and offence proceedings acts with regard to the child and providing services supporting the rehabilitation of the child;
2) hear the child, if necessary, to ascertain the abuse and shall video record the hearing to use it as evidence in offence proceedings;
3) assess the need for assistance resulting from the abuse of the child or associated with the abusive behaviour and also the risks associated with the abusive behaviour of the child, by involving a relevant specialist therefor, if necessary;
4) support and counsel the child and persons close to the child;
5) monitor the performance of measures applied for assisting the child.
(4) The video recording of hearing a child specified in clause 2 of subsection 3 of this section shall be preserved by the Social Insurance Board for up to six months following the date of the video recording. The conditions of and procedure for preserving the recording shall be provided for in the regulation established under subsection 5 of this section.
(5) The specific conditions of and procedure for the performance of functions specified in subsection 3 of this section shall be established by a regulation of the minister in charge of the policy sector.

§ 30. Child in danger
A child in danger means a child who is in a situation which endangers his or her life or health and a child who endangers his or her life or health or that of the others through his or her behaviour.

§ 31. Notification of child in danger
(1) All persons who have knowledge of a child in danger shall be required to notify of the child in danger.
(2) A child in danger shall be immediately notified of through the emergency call number 112.
§ 32. Hädaohus oleva lapse toimetamine ohututesse tingimustesse
Hädaohus olevat last tuleb viivitamata abistada ning likvideerida selleks lapse elu või tervist ohtu seadnud olukord. Vajaduse korral võib hädaohus oleva lapse toimetada ohututesse tingimustesse kuni ohu möödumiseni, küsimata selleks lapse hooldusõigust teostava isiku nõusolekut.
Kui lapse ohtu sattumine ei olnud põhjustatud lapse hooldusõigust teostava isiku tegevusest või tegevusetusest või temast tulenev oht on lõppenud, antakse hädaohus olev laps üle lapse hooldusõigust teostavale isikule.
Hädaohus oleva lapse toimetab ohututesse tingimustesse lapse viibimiskoha järgse kohaliku omavalitsuse üksuse lastekaitsetöötaja või politsei korrakaitseseaduse § 46 lõike 1 punktis 8 sätestatud alusel.
Hädaohus olev laps paigutatakse ohututesse tingimustesse selleks sobivat teenust osutava sotsiaal-, tervishoiu- või haridusasutuse või isiku (edaspidi teenuseosutaja) või lapse jaoks turvalise isiku juurde sõltuvalt lapse olukorrast ja vajadustest.
Kui hädaohus olevat last ei ole võimalik üle anda lapse hooldusõigust teostavale isikule, võib lapse ajutiselt paigutada teenuseosutaja juurde sobiva teenuse saamiseks või lapse jaoks turvalise isiku juurde järgmistel juhtudel:
lapse hooldusõigust teostava isiku nõusolekul;
kohaliku omavalitsuse üksuse lastekaitsetöötaja otsusel, kui lapse hooldusõigust teostav isik ei ole kättesaadav, või
Sotsiaalkindlustusameti lastekaitsetöötaja otsusel, kui lapse hooldusõigust teostav isik ei ole kättesaadav.

§ 32. Placement of child in danger in safety
(1) A child in danger shall be assisted immediately and the situation having endangered the life or health of the child shall be eliminated. If necessary, a child in danger may be placed in safety until such a time as the danger passes, without request of the consent of the person exercising legal custody of the child.
(2) If the child was not endangered due to the activity or inactivity of the person exercising legal custody of the child or the danger arising from him or her has ceased, the child in danger shall be delivered to the person exercising legal custody of the child.
(3) A child in danger shall be placed in safety by the child protection official of the local government of the child’s location or by the police on the basis provided for in clause 8 of subsection 1 of § 46 of the Law Enforcement Act.
(4) A child in danger shall be placed in safety at a social, health care or educational institution or person providing such service (hereinafter service provider) or at a person who is safe for the child depending on the child’s needs and the situation.
(5) If the child in danger cannot be delivered to the person exercising legal custody of the child, the child may be temporarily placed with the service provider for the provision of a suitable service or with a person who is safe for the child in the following cases:
1) with the consent of the person exercising legal custody of the child;
2) with the decision of the child protection official of a local government if the person exercising legal custody of the child cannot be accessed, or
3) with the decision of the child protection official of the Social Insurance Board if the person exercising legal custody of the child cannot be accessed.
§ 33. Hädaohus oleva lapse ajutine perekonnast eraldamine
Kohaliku omavalitsuse üksus või Sotsiaalkindlustusamet võib eraldada lapse perekonnast ja vajaduse korral määrata lapse ja vanema suhtluskorra enne hooldusõiguse piiramise kohtumäärust, kui lapse jätmine perekonda või vanema ja lapse vaheline suhtlus ohustab lapse tervist või elu. Kohaliku omavalitsuse üksus või Sotsiaalkindlustusamet teeb otsuse hädaohus oleva lapse ajutiseks perekonnast eraldamiseks järgmistel juhtudel:
lapse ohtu sattumise on põhjustanud lapse hooldusõigust teostav isik oma tegevuse või tegevusetusega;
lapse hooldusõigust teostav isik keeldub lapse ajutisest paigutamisest teenuseosutaja juurde sobiva teenuse saamiseks.
Käesoleva paragrahvi lõikes 1 nimetatud otsusega eraldatakse hädaohus olev laps perekonnast ja määratakse tema viibimiskoht ning vajaduse korral lapse ja vanema suhtluskord kuni 72 tunniks alates lapse perekonnast eraldamisest.
Käesoleva paragrahvi lõikes 1 nimetatud otsuse resolutiivosa edastatakse ka teenuseosutajale või muule isikule, kelle juurde perekonnast eraldatud laps ajutiselt paigutatakse.
Kohaliku omavalitsuse üksus või Sotsiaalkindlustusamet peab hindama lapse olukorda ja abivajadust ning käesoleva paragrahvi lõikes 2 sätestatud tähtaega arvestades pöörduma kohtusse hooldusõiguse ja vajaduse korral suhtlusõiguse piiramiseks perekonnaseaduses sätestatud alustel.
Isik või asutus, kellel on hädaohus oleva lapse olukorra ja abivajaduse hindamiseks või käesoleva paragrahvi lõikes 1 nimetatud otsuse tegemiseks vajalikku teavet ja andmeid, vastab viivitamata lastekaitsetöötaja nõudele saada asjakohast teavet ja andmeid.
Kui hädaohus olev laps tuleb ise või satub muul viisil teenuseosutaja juurde, peab teenuseosutaja viivitamata taotlema käesoleva paragrahvi lõikes 1 nimetatud otsust lapse ajutise perekonnast eraldamise kohta, kui talle on saanud teatavaks või tal on alust arvata, et lapse hooldusõigust teostav isik on põhjustanud lapse hädaohtu sattumise.

§ 33. Temporary separation of child in danger from family
(1) The local government or the Social Insurance Board may separate a child from family and, if necessary, determine the procedure of communication of the parent and child before the ruling on restriction of legal custody if leaving the child in the family or the communication between the parent and child endangers the life or health of the child. The local government or the Social Insurance Board shall make a decision on temporary separation of a child in danger from family in the following cases:
1) the child has been endangered due to the activity or inactivity of the person exercising legal custody of the child;
2) the person exercising legal custody of the child refuses the temporary placement of a child with a service provider for the provision of a suitable service.
(2) With the decision specified in subsection 1 of this section, a child in danger shall be separated from family and his or her place of stay shall be determined and, if necessary, the procedure of communication of the parent and child shall be determined for up to 72 hours starting from separation of the child from family.
(2¹) The conclusion of the decision specified in subsection 1 of this section shall also be sent to the service provider or other person with whom the child separated from family is temporarily placed.
(3) The local government or the Social Insurance Board shall evaluate the situation of the child and his or her need for assistance and, taking into account of the term provided for in subsection 2 of this section, turn to court in order to restrict legal custody and, if necessary, the right of access on the bases provided for in the Family Law Act.
(3¹) A person or authority who holds information and data necessary for assessing the situation and need for assistance of a child in danger or making a decision specified in subsection 1 of this section shall promptly reply to a child protection official’s request for relevant information and data.
(4) If a child in danger comes to the service provider by him- or herself or in another manner, the service provider shall immediately apply for a decision specified in subsection 1 of this section concerning the temporary separation of the child from family if it has become known to the service provider or he or she has reason to believe that the child has been endangered due to the person exercising legal custody of the child.

§ 34. Perekonnast eraldatud lapse kaitse
Kohaliku omavalitsuse üksus peab perekonnast eraldatud lapsele eestkostja valimisel, lapsendamiseks nõusoleku andmisel, kasuperekonna sobivuse hindamisel ja lapse asendushooldusele paigutamisel lähtuma lapse üleskasvatamise järjepidevusest, arvestades lapse etnilist, usulist, kultuurilist ja keelelist päritolu.
Kohaliku omavalitsuse üksuse lastekaitsetöötaja koostöös last kasvatava isiku või lasteasutusega, kus perekonnast eraldatud laps viibib, on kohustatud andma lapsele teavet tema päritolu, perekonnast eraldamise põhjuste ja teda puudutavate edasiste hooldusküsimuste kohta ning võimaluse korral säilitama ja toetama perekonnast eemal viibiva lapse ja tema perekonna vahelisi suhteid.
Õdede ja vendade lahutamine pärast perekonnast eraldamist võib olla vaid äärmuslik abinõu olukorras, kus nende kokkujäämine ohustab oluliselt nende heaolu või õigusi.
Kohaliku omavalitsuse üksuse lastekaitsetöötaja koostab perekonnast eraldatud lapsele käesolevas seaduses nimetatud juhtumiplaani ning tagab selle perioodilise ülevaatamise ja vajaduse korral muutmise koostöös lapse ja last kasvatava isikuga.

§ 34. Protection of child separated from family
(1) Upon choosing a guardian for a child separated from family, granting consent for adoption, evaluating the suitability of foster family and placement of a child in substitute care, the local government shall proceed from the continuity of raising the child, taking into account the ethnic, religious, cultural and linguistic origin of the child.
(2) The child protection official of a local government shall, in cooperation with the person raising the child or with the child care institution in which the child separated from family is staying, be required to provide information to the child concerning his or her origin, the reasons for separation from family and subsequent care issues regarding him or her and to maintain and support the relations between the child separated from family and his or her family, if possible.
(3) Siblings may be separated from each other after their separation from family only as an extreme measure in a situation where their staying together would considerably endanger their rights or well-being.
(4) The child protection official of a local government shall prepare a case plan specified in this Act for a child separated from family and shall ensure the periodic overview and amendment thereof, if necessary, in cooperation with the child and the person raising the child.
§ 34¹. Lapse paigutamine teisest Euroopa Liidu liikmesriigist Eestisse
Sotsiaalkindlustusamet menetleb nõukogu määruse (EL) 2019/1111 alusel taotlusi, mis on seotud lapse paigutamisega teisest Euroopa Liidu liikmesriigist (edaspidi liikmesriik) Eestisse.
Lapse paigutamise taotluse andmete loetelu kehtestab valdkonna eest vastutav minister määrusega.
Kohaliku omavalitsuse üksus ja pädevad asutused on kohustatud Sotsiaalkindlustusameti taotlusel koguma ja esitama teavet, mis on seotud lapse teisest liikmesriigist Eestisse paigutamise menetlusega.
Teise liikmesriigi eestkoste seadmise menetluste puhul kontrollib Sotsiaalkindlustusamet lapse Eestisse paigutamise korral võimaliku eestkostja vastavust perekonnaseaduses sätestatud eestkostjale esitatavatele nõuetele.
Lapse Eestisse paigutamisega seotud muu menetluse puhul kontrollib Sotsiaalkindlustusamet, kas taotluses nimetatud isik vastab sotsiaalhoolekande seaduse § 45¹³ lõike 1 punktides 1–7 sätestatule.
Sotsiaalkindlustusamet arvestab lapse teisest liikmesriigist Eestisse paigutamise otsuse tegemisel kõiki lapsesse puutuvaid asjaolusid ning hindab paigutamise võimalikku mõju lapse õigustele ja heaolule.
Eestisse võib lapse teisest liikmesriigist ilma Sotsiaalkindlustusameti eelneva nõusolekuta paigutada üksnes tema vanema juurde.

§ 34¹. Placement of child from another Member State in Estonia
(1) The Social Insurance Board processes, on the basis of Council Regulation (EU) 2019/1111, the requests related with the placement of a child from another Member State of the European Union (hereinafter Member State) in Estonia.
(2) The list of information on the request for placement of a child shall be established by a regulation of the minister in charge of the policy sector.
(3) The local authority and competent authorities shall be required, upon request of the Social Insurance Board, collect and submit information connected with the proceedings of placement of a child from another Member State in Estonia.
(4) In case of establishment of guardianship proceedings concerning another Member State, the Social Insurance Board shall verify, in case of placement of a child in Estonia, whether the potential guardian complies with the requirements for a guardian provided for in the Family Law Act.
(5) In case of other proceedings related with the placement of a child in Estonia, the Social Insurance Board shall verify whether the person specified in the application complies with the provisions of clauses 1–7 of subsection 1 of § 45¹³ of the Social Welfare Act.
(6) Upon making a decision on the placement of a child from another Member State in Estonia, the Social Insurance Board shall account for all the circumstances pertaining to the child and assess the potential effect of placement on the child’s rights and wellbeing.
(7) A child from another Member State may be placed in Estonia without the previous consent of the Social Insurance Board only with the child’s parent.

§ 34². Isikuandmete töötlemine kohaliku omavalitsuse üksuses ja Sotsiaalkindlustusametisизменится 01.01.2027
Kohaliku omavalitsuse üksusel on käesoleva seaduse § 17 lõike 1 punktis 3 nimetatud ülesande täitmiseks õigus töödelda lapse, lapsevanema ja last kasvatava isiku ning lapse pereliikme isikuandmeid, sealhulgas eriliiki isikuandmeid, samuti lapse sotsiaalsesse võrgustikku kuuluva isiku isikuandmeid, mis on vajalikud lapse abivajaduse hindamiseks ja sobiva abi osutamiseks. Isikuandmeid töödeldakse menetluse eesmärgi saavutamiseks vajalikul määral ja viisil, lähtudes esmajoones lapse huvidest.
Lapse pereliikmeteks käesoleva paragrahvi lõike 1 tähenduses loetakse lapse õdesid ja vendi, poolõdesid ja poolvendi, vanavanemaid ning muid lapsega ajutiselt või püsivalt koos elavaid isikuid.
Käesoleva paragrahvi lõike 1 alusel töödeldavad lapse isikuandmed on:
üldandmed;
andmed lapse perekonna ja leibkonna koosseisu, suhete ja sotsiaalse võrgustiku kohta;
andmed lapse elutingimuste ning majandusliku ja sotsiaalse toimetuleku kohta;
terviseandmed, mis annavad teavet lapse võimaliku abivajaduse kohta, eelkõige lapse arengu, terviseseisundi ja -käitumise, trauma ja vigastuse, lapsele määratud ravi ja selle järgimise ning ambulatoorsel vastuvõtul käimise andmed;
andmed lapsele osutatava sotsiaal-, tervishoiu- ja ohvriabiteenuse kohta koos teenuse liigi, kestuse ja teenuseosutaja nimega;
andmed hariduse omandamise, õpikeskkonnas toimetuleku, haridusliku erivajaduse ja tugiteenuse saamise kohta;
huvihariduses ja -tegevuses osalemise andmed;
puude raskusaste, liik, kestus ja funktsiooni kõrvalekalle;
andmed töövõime ja tööga hõivatuse kohta;
andmed lapse ennast või teisi kahjustava käitumise kohta;
karistusregistrisse kantud karistusandmed;
lapse suhtes käimas oleva kriminaal- või väärteomenetluse andmed koos selle esemeks oleva süüteo liigi ja toimepanemise asjaoludega ning lapse suhtes kohaldatud tõkendi, karistuse, mõjutusvahendi ja kriminaalhoolduse andmed;
andmed lapse suhtes toime pandud või lapsega seotud vägivallajuhtumi kohta koos vägivalla liigi, toimepanemise aja ja asjaoludega ning lapse osalemise viisiga, samuti andmed juhtumi uurimiseks kriminaalmenetluse alustamise kohta ja lapse menetlusseisund;
andmed lapse kinnipidamise ja hädaohus oleva lapse ohututesse tingimustesse toimetamise kohta seaduses sätestatud korrakaitseorgani poolt koos korrakaitseseaduse § 46 lõike 6 kohaselt dokumenteeritud andmetega.
Käesoleva paragrahvi lõike 1 alusel töödeldavad lapsevanema ja last kasvatava isiku isikuandmed on:
üldandmed;
andmed vanemluse, hooldusõiguse ja eestkoste kohta;
andmed majandusliku ja sotsiaalse toimetuleku kohta;
vanemlike oskuste hindamiseks vajalikud andmed;
sotsiaal- või tervishoiutöötaja tehtud koduvisiidil kogutud andmed lapsevanema seisundi, toimetuleku ja toetusvajaduse kohta;
terviseandmed, mis annavad teavet lapse heaolu ohustamise ja isiku vanemliku suutlikkuse kohta, eelkõige isiku terviseseisundi ja -käitumise, raseduse, trauma ja vigastuse, isikule määratud ravi ja selle järgimise andmed;
andmed isikule tema toimetuleku või vanemliku suutlikkuse toetamiseks osutatava sotsiaal-, tervishoiu- ja ohvriabiteenuse kohta koos teenuse liigi, kestuse ja vajaduse korral teenuseosutaja nimega;
andmed hariduse omandamise kohta;
puude raskusaste, liik, kestus ja funktsiooni kõrvalekalle;
andmed töövõime ja tööga hõivatuse kohta;
andmed isikut ennast või lapse heaolu kahjustava käitumise kohta;
karistusregistrisse kantud karistusandmed;
isiku suhtes käimas oleva kriminaal- või väärteomenetluse andmed koos selle esemeks oleva süüteo liigi ja toimepanemise asjaoludega ning isiku suhtes kohaldatud tõkendi, karistuse, mõjutusvahendi ja kriminaalhoolduse andmed;
andmed isiku suhtes toime pandud vägivallajuhtumi kohta koos vägivalla liigi ja toimepanemise ajaga ning juhtumi uurimiseks kriminaalmenetluse alustamise kohta.
Käesoleva paragrahvi lõike 1 alusel töödeldavad lapse pereliikme isikuandmed on:
üldandmed;
andmed vanemluse ja eestkoste kohta;
andmed isiku terviseseisundi ja -käitumise ning isikule määratud ravi ja selle järgimise kohta ulatuses, milles tema terviseseisund ja -käitumine võib mõjutada lapse heaolu;
andmed isikule tema toimetuleku toetamiseks osutatava sotsiaal-, tervishoiu- ja ohvriabiteenuse kohta koos teenuse liigi, kestuse ja vajaduse korral teenuseosutaja nimega ulatuses, milles isiku toimetulek võib mõjutada lapse heaolu;
andmed hariduse omandamise ja tööga hõivatuse kohta;
puude raskusaste, liik, kestus ja funktsiooni kõrvalekalle, kui isiku puue võib mõjutada lapse heaolu;
karistusregistrisse kantud karistusandmed, kui isiku karistatus võib mõjutada lapse heaolu;
isiku suhtes käimas oleva kriminaal- või väärteomenetluse andmed koos selle esemeks oleva süüteo liigi ja toimepanemise asjaoludega ning isiku suhtes kohaldatud tõkendi, karistuse, mõjutusvahendi ja kriminaalhoolduse andmed, kui isiku arvatav tegu või tema suhtes kohaldatud meede võib mõjutada lapse heaolu;
andmed isiku suhtes toime pandud vägivallajuhtumi kohta koos vägivalla liigi ja toimepanemise ajaga ning juhtumi uurimiseks kriminaalmenetluse alustamise kohta, kui juhtum võib mõjutada lapse heaolu.
Käesoleva paragrahvi lõike 1 alusel töödeldavad lõike 3 punktis 2 nimetatud lapse sotsiaalsesse võrgustikku kuuluva isiku isikuandmed on:
üldandmed;
seos ja suhted lapsega.
Sotsiaalkindlustusametil on õigus töödelda käesoleva paragrahvi lõigetes 3–6 nimetatud isikuandmeid käesoleva seaduse § 15 lõike 2 punktides 2–4 ja lõike 3 punktides 6–7 nimetatud ülesannete täitmiseks.
Kohaliku omavalitsuse üksus ning käesoleva seaduse §-des 29¹ ja 33 sätestatud juhtudel Sotsiaalkindlustusamet võivad lapse abivajaduse hindamiseks ja sobiva abi osutamiseks kaasata selle lapsega töötavaid isikuid ning teisi asjaomaseid spetsialiste ja asutusi. Käesoleva lõike esimeses lauses nimetatud eesmärkide täitmiseks on ka menetlusse kaasatud osapooltel õigus töödelda käesoleva paragrahvi lõigetes 3–6 nimetatud andmeid.

§ 34². Processing personal data in local authorities and Social Insurance Board
(1) In order to perform the function specified in clause 3 of subsection 1 of § 17 of this Act the local authority shall have the right to process the personal data of a child, parent and person raising a child and child’s family member, including personal data of special categories, also the personal data of a person belonging into the child’s social network, which are necessary for assessing the child’s need for assistance and providing suitable assistance. Personal data are processed to the extent and in a manner necessary for achieving the objective of proceedings based on, above all, the interests of the child.
(2) For the purposes of subsection 1 of this section the child’s family members are deemed to be the child’s brothers and sisters, half-brothers and -sisters, grandparents and other persons temporarily or permanently residing with the child.
(3) The personal data of a child processed on the basis of subsection 1 of this section are:
1) general data;
2) data on the composition of the child’s family and household, relations and social network;
3) data on the child’s living conditions and economic and social coping;
4) health data that provide information on the child’s potential need for assistance, above all data on the child’s development, health behaviour and state of health, trauma and injuries, prescribed treatment for the child and adherence thereto and data on outpatient visits;
5) data on social, health and victim support service provided to a child together with the type and duration of service and the name of service provider;
6) data on acquisition of education, coping in a learning environment, special educational needs and support services;
7) data on participation in hobby education and activities;
8) degree of severity of disability, type, duration and abnormality in a function;
9) data on work ability and employment;
10) data on child’s behaviour that damages the child or others;
11) data on punishment entered in the criminal records database;
12) data on criminal or misdemeanour proceedings pending with regard to the child together with the category of offence being the object of proceedings and circumstances of commission and data on preventive measure, punishment, sanction and probation supervision imposed on the child;
13) data on an act of violence committed towards a child or connected with a child together with the type, time of commission and circumstances of an act of violence and the manner of participation of a child, also data on the commencement of criminal proceedings for investigation of the case and procedural status of the child;
14) data on detention of a child and taking a child in danger to safety by a law enforcement agency provided for in the law together with the data documented according to subsection 6 of § 46 of the Law Enforcement Act.
(4) The personal data of a parent and person raising a child processed on the basis of subsection 1 of this section are:
1) general data;
2) data on parentage, custody and guardianship;
3) data on economic and social coping;
4) data necessary for assessing parenting skills;
5) data collected in a home visit by a social worker or health care professional on the condition, coping and need for assistance of a parent;
6) health data that provide information on threatening the well-being of a child and parental capability of a person, above all data on the health behaviour and state of health, pregnancy, trauma and injuries of a person and data on prescribed treatment for a person and adherence thereto;
7) data on social, health care and victim support service provided to a person to support their coping or parental capability together with the type and duration of the service and name of the service provider, where necessary;
8) data on acquisition of education;
9) degree of severity of disability, type, duration and abnormality in a function;
10) data on work ability and employment;
11) data on behaviour that damages the person or child’s well-being;
12) data on punishment entered in the criminal records database;
13) data on criminal or misdemeanour proceedings pending with regard to the person together with the category of offence being the object of proceedings and circumstances of commission and data on preventive measure, punishment, sanction and probation supervision imposed on the person;
14) data on an act of violence committed towards a person together with the type and time of commission of an act of violence and data on the commencement of criminal proceedings for investigation of the case.
(5) The personal data of a child’s family member processed on the basis of subsection 1 of this section are:
1) general data;
2) data on parentage and guardianship;
3) data on person’s health behaviour and state of health and prescribed treatment for the person and adherence thereto to the extent their health behaviour or state of health may affect the child’s well-being;
4) data on social, health care and victim support service provided to a person to support their coping or parental capability together with the type and duration of the service and name of the service provider, where necessary, to the extent the person’s coping may affect the child’s well-being;
5) data on acquisition of education and employment;
6) degree of severity of disability, type, duration and abnormality in a function if the person’s disability may affect the child’s well-being;
7) data on punishment entered in the criminal records database if the person’s punishment may affect the child’s well-being;
8) data on criminal or misdemeanour proceedings pending with regard to the person together with the category of offence being the object of proceedings and circumstances of commission and data on preventive measure, punishment, sanction and probation supervision imposed on the person if the person’s supposed act or a measure imposed thereto may affect the child’s well-being;
9) data on an act of violence committed towards a person together with the type and time of commission of an act of violence and data on the commencement of criminal proceedings for investigation of the case if the case may affect the child’s well-being.
(6) The personal data of a person belonging into the social network of a child specified in clause 2 of subsection 3 processed under subsection 1 of this section are:
1) general data;
2) connection and relations with the child.
(7) The Social Insurance Board shall have the right to process the personal data specified in subsections 3–6 of this Act for the performance of functions specified in clauses 2–4 of subsection 2 and clauses 6–7 of subsection 3 of § 15 of this Act.
(8) A local authority and, in the cases provided for in §§ 29¹ and 33 of this Act, the Social Insurance Board may, in order to assess the child’s need for assistance and provision of suitable assistance, involve persons working with the child and other relevant specialists and authorities. For the performance of objectives specified in the first sentence of this subsection, the parties involved in proceedings have also the right to process the data specified in subsections 3–6 of this section.
§ 34³. Konfidentsiaalsuskohustus
Käesoleva seaduse § 34² lõike 8 alusel infot saanud isikud peavad hoidma konfidentsiaalsena neile lastekaitsejuhtumi menetlemise käigus teatavaks saanud isikuandmeid, kui seaduses või kokkuleppel asjaomase isikuga ei ole ette nähtud teisiti.

§ 34³. Confidentiality obligation
The person having received information on the basis of subsection 8 of § 34² of this Act shall maintain the confidentiality of personal data having become known to them in the course of processing a child protection case, unless provided otherwise in this Act or by an agreement with a relevant person.
§ 34⁴. Terviseandmete töötlemine
Kohaliku omavalitsuse üksusel ja Sotsiaalkindlustusametil on õigus saada tervishoiuteenuse osutajalt lapse, lapsevanema ja last kasvatava isiku ning lapse pereliikme terviseandmeid käesoleva seaduse § 34² lõike 3 punktides 4 ja 5, lõike 4 punktides 5–7 ning lõike 5 punktides 3 ja 4 määratud ulatuses lapse abivajaduse hindamiseks ja sobiva abi osutamiseks.

§ 34⁴. Processing health data
Local authorities and the Social Insurance Board shall have the right to receive health data from a health care provider concerning a child, parent and person raising a child and a child’s family member to the extent provided for in clauses 4 and 5 of subsection 3, clauses 5–7 of subsection 4 and clauses 3 and 4 of subsection 5 of § 34² of this Act in order to assess the child’s need for assistance and provide suitable assistance.
§ 34⁵. Lasteabitelefonile tehtud kõnede salvestamine ning salvestiste säilitamine ja väljastamine
Lasteabitelefonile tehtud kõned salvestatakse lapse abivajaduse väljaselgitamiseks ja abi paremaks osutamiseks, salvestise kasutamiseks tõendina süüteomenetluses ja nõustamise kvaliteedi tagamiseks.
Sotsiaalkindlustusamet väljastab kõne salvestise Politsei- ja Piirivalveametile, prokuratuurile või kohtule tema nõudmise korral.
Kõne salvestist säilitatakse digitaalsel andmekandjal kuus kuud salvestamise kuupäevast arvates. Nimetatud tähtaja möödumisel salvestis kustutatakse.

§ 34⁵. Recording of calls made to child helpline and preservation and issue of recordings
(1) The calls made to child helpline shall be recorded in order to ascertain the child’s need for assistance and to improve the provision of assistance, to use the recording as evidence in offence proceedings and to ensure the quality of counselling.
(2) The Social Insurance Board shall issue a call recording to the Police and Border Guard Board, Prosecutor’s Office or a court upon their request.
(3) The call recordings shall be preserved on a digital data carrier for six months starting from the date of recording. After the aforesaid time the recording shall be deleted.

Lasteasutus on riigi või kohaliku omavalitsuse üksuse asutus, avalik-õiguslik või eraõiguslik juriidiline isik või füüsiline isik, kes seaduse või muude õigusaktide alusel osutab lastele sotsiaal-, haridus- või statsionaarseid tervishoiuteenuseid.

§ 35. Child care institution
A child care institution is a state or local government agency, a legal person in public or private law or a natural person who provides social, educational or in-patient health services for children on the basis of the law or other legislation.
§ 36. Lasteasutuses viibiva lapse arvamuse ja kaebuse esitamise õigusизменится 01.01.2027
Lasteasutuses viibival lapsel on õigus kellestki sõltumata võtta ühendust last kasvatava isiku, rahvastikuregistrisse kantud lapse elukoha järgse kohaliku omavalitsuse üksuse lastekaitsetöötaja ja õiguskantsleriga ning esitada neile lasteasutuse tegevuse kohta arvamusi ja kaebusi.
Lasteasutus peab looma tingimused, mis aitavad tagada lapse käesoleva paragrahvi lõikes 1 sätestatud õigust.
Lasteasutus peab tagama lapsele iseseisva ja sõltumatu võimaluse esitada lasteasutuse tegevuse kohta arvamusi ja kaebusi. Lasteasutus peab lapse arvamused ja kaebused registreerima ning andma lapsele nende kohta viivitamata asjakohast tagasisidet. Vajaduse korral tuleb ette näha muudatused lasteasutuse igapäevaelu korralduses või muus lapsele olulises eluvaldkonnas.
Lasteasutus ei avalda lasteasutuse kohta arvamuse või kaebuse esitanud lapse isikut ega arvamuse või kaebuse esitamise fakti, välja arvatud süüteomenetluses.

§ 36. Right of child staying in child care institution to submit opinions and complaints
(1) A child staying in a child care institution shall have the right, independent of anyone, to contact the person raising the child, the child protection official of the local government of the child’s residence entered in the population register, and the Chancellor of Justice and to submit opinions and complaints thereto concerning the activity of the child care institution.
(2) A child care institution shall create conditions which help to ensure the right of the child provided for in subsection 1 of this section.
(3) A child care institution shall ensure the independent opportunity for the child to submit opinions and complaints concerning the activity of the child care institution. The child care institution shall record the opinions and complaints of the child and provide immediate feedback to the child thereon. If necessary, changes in the organisation of the everyday life of the child care institution or another important sphere of life of the child shall be prescribed.
(4) A child care institution shall not disclose the identity of the child having submitted an opinion or complaint about the child care institution or the fact of submission of complaint, except for in proceedings of an offence.
§ 37. Lasteasutuse sisehindamine
Lasteasutuse sisehindamine on tegevus, mille käigus hinnatakse lasteasutuse töökorraldust ja töökeskkonda ning tegevuste tulemuslikkust lapse õiguste ja heaolu tagamisel. Sisehindamise käigus selgitatakse välja lasteasutuse eesmärkide täitmist toetavad ja takistavad asjaolud ning analüüsitakse lasteasutuse tegevuse vastavust õigusaktidele.
Lasteasutus peab viivitamata kõrvaldama sisehindamisel selgunud asjaolud, mis takistavad lapse õiguste ja heaolu tagamist.
Lasteasutuse sisehindamist korraldab lasteasutuse juht.

§ 37. Internal evaluation of child care institution
(1) The internal evaluation of a child care institution means the activity in the course of which the organisation of work and the working environment of the child care institution as well as the efficiency of activities upon ensuring the child’s rights and well-being are evaluated. The internal evaluation establishes the circumstances supporting and hindering the achievement of objectives of the child care institution and analyses the compliance of activities of the child care institution with legislation.
(2) The child care institution shall immediately eliminate the circumstances established upon the internal evaluation which hinder the ensuring of the child’s rights and well-being.
(3) The internal evaluation of a child care institution shall be organised by the head of the child care institution.

Riiklikku järelevalvet käesoleva seaduse ja selle alusel kehtestatud õigusaktide nõuete täitmise üle teostavad Sotsiaalkindlustusamet, Tarbijakaitse ja Tehnilise Järelevalve Amet ja kohaliku omavalitsuse üksus (edaspidi korrakaitseorgan).
Sotsiaalkindlustusamet teostab riiklikku järelevalvet käesoleva seaduse §-des 19–21, § 22 lõigetes 2–4, § 24 lõikes 3, §-des 27 ja 28, § 29 lõigetes 2–5, §-s 31, § 32 lõigetes 1–4 ja lõike 5 punktides 1 ja 2 ning §-des 33, 34, 36 ja 37 sätestatud nõuete täitmise üle.

Kohaliku omavalitsuse üksus teostab riiklikku järelevalvet käesoleva seaduse §-des 21 ja 22, § 23 lõikes 1 ning §-des 24, 27 ja 31 sätestatud nõuete täitmise üle.
Haldusjärelevalvet käesolevas seaduses ja selle alusel kehtestatud õigusaktides sätestatud kohaliku omavalitsuse üksuse ülesannete täitmise üle teostab Sotsiaalkindlustusamet.

§ 38. Exercise of state and administrative supervision
(1) State supervision over compliance with the requirements provided for in this Act and in the legislation established on the basis thereof shall be exercised by the Social Insurance Board, Consumer Protection and Technical Regulatory Authority and local authority (hereinafter law enforcement agency).
(2) The Social Insurance Board shall exercise state supervision over compliance with the requirements provided for in §§ 19–21, subsections 2–4 of § 22, subsection 3 of § 24, §§ 27 and 28, subsections 2–5 of § 29, § 31, subsections 1–4 and clauses 1 and 2 of subsection 5 of § 32 and §§ 33, 34, 36 and 37 of this Act.
(4) The Consumer Protection and Technical Regulatory Authority shall exercise state supervision over compliance with the requirements provided for in § 25 of this Act.
(5) The local government shall exercise state supervision over compliance with the requirements provided for in §§ 21 and 22, subsection 1 of § 23 and §§ 24, 27 and 31 of this Act.
(6) Administrative supervision over the performance of functions of local authority provided for in this Act and in the legislation established on the basis thereof shall be exercised by the Social Insurance Board.
§ 39. Riikliku järelevalve teostamiseks lubatud erimeetmed
Korrakaitseorgan võib käesolevas seaduses sätestatud riikliku järelevalve teostamiseks kohaldada korrakaitseseaduse §-des 30–32 ja 49–52 sätestatud riikliku järelevalve erimeetmeid korrakaitseseaduses sätestatud alusel ja korras.
Kohaliku omavalitsuse üksus võib lisaks käesoleva paragrahvi lõikes 1 nimetatud erimeetmetele käesolevas seaduses sätestatud riikliku järelevalve teostamiseks kohaldada korrakaitseseaduse § 46 lõike 1 punktides 6 ja 8 sätestatud riikliku järelevalve erimeedet korrakaitseseaduses sätestatud alusel ja korras.

§ 39. Special state supervision measures
(1) For the exercise of state supervision provided for in this Act, the law enforcement agency may apply the special state supervision measures provided for in §§ 30–32 and 49–52 of the Law Enforcement Act on the basis of and pursuant to the procedure provided for in the Law Enforcement Act.
(2) In addition to the special measures specified in subsection 1 of this section, the local government may, for the exercise of state supervision provided for in this Act, apply the special state supervision measure provided for in clauses 6 and 8 of subsection 1 of § 46 of the Law Enforcement Act on the basis of and pursuant to the procedure provided for in the Law Enforcement Act.
§ 40. Riikliku järelevalve teostamise erisused
Kohaliku omavalitsuse üksuse või Sotsiaalkindlustusameti lastekaitsetöötajal on õigus valdusesse sisenemiseks ohukahtluse korral ohu väljaselgitamiseks.
Kohaliku omavalitsuse üksuse lastekaitsetöötajal või muul kohaliku omavalitsuse üksuse nimetatud ametnikul on õigus teha last kasvatavale isikule ettekirjutusi abivajava lapse kaitseks ja kohustada last kasvatavat isikut tegema koostööd lastekaitsetöötajaga.

§ 40. Specifications for exercise of state supervision
(1) A child protection official of a local government or the Social Insurance Board shall have the right to enter a property in order to ascertain danger in case of suspicion of danger.
(2) A child protection official of a local government or other official appointed by a local government shall have the right to issue precepts to a person raising a child for the protection of a child in need of assistance and to require the person raising a child to cooperate with the child protection official.

Sotsiaalkindlustusametil on haldusjärelevalve teostamisel õigus:
külastada lasteasutust, vajaduse korral ka ette teatamata, et kontrollida käesolevas seaduses ja selle alusel lasteasutuse tegevusele kehtestatud nõuete täitmist;
teavitada avalikkust ja vanemaid lasteasutuses tuvastatud rikkumistest;
rakendada muid Vabariigi Valitsuse seaduses sätestatud haldusjärelevalve meetmeid.

§ 40¹. Measures of administrative supervision
Upon the exercise of administrative supervision the Social Insurance Board shall have the right to:
1) visit a child care institution, if necessary without an advance notification, to verify compliance with the requirements established in this Act and on the basis thereof for the activity of child care institutions;
2) notify the public and parents of any violations identified in a child care institution;
3) apply other administrative supervision measures established in the Government of the Republic Act.

§ 41. Paragrahvide 19 ja 20 rakendamine
Enne käesoleva seaduse jõustumist tööle asunud lastekaitsetöötaja peab käesoleva seaduse § 19 lõigetes 1 ja 2 sätestatud nõuded täitma hiljemalt 2022. aasta 1. jaanuariks.
Enne käesoleva seaduse jõustumist tööle asunud lastekaitsetöötaja ja lapsega töötava isiku suhtes peavad käesoleva seaduse § 20 lõigetes 1–3 sätestatud nõuded olema täidetud 2017. aasta 1. jaanuariks, välja arvatud käesoleva paragrahvi lõikes 3 sätestatud juhul.
Enne käesoleva lõike jõustumist tööle asunud lastekaitsetöötaja ja lapsega töötava isiku suhtes, keda on karistatud enne karistusseadustiku jõustumist tegude eest, mis on kvalifitseeritud kriminaalkoodeksi §-de 100–102 järgi, peavad käesoleva seaduse § 20 lõikes 1¹ sätestatud nõuded olema täidetud 2019. aasta 1. jaanuariks.

§ 41. Implementation of §§ 19 and 20
(1) Child protection officials who have commenced employment before the entry into force of this Act shall comply with the requirements provided for in subsections 1 and 2 of § 19 of this Act no later than by 1 January 2022.
(2) Child protection officials and persons working with children who have commenced employment before the entry into force of this Act shall comply with the requirements provided for in subsections 1–3 of § 20 of this Act by 1 January 2017, except in the case provided for in subsection 3 of this section.
(3) Child protection officials and persons working with children who have commenced employment before the entry into force of this Act and who have been punished, before entry into force of the Penal Code, for acts qualified under §§ 100–102 of the Penal Code shall comply with the requirements provided for in subsection 1¹ of § 20 of this Act by 1 January 2019.
§ 41¹. Paragrahvi 27¹ rakendamine
Käesoleva seaduse §-s 27¹ sätestatud abivajava lapse esmakordsel väljaselgitamisel teeb kohaliku omavalitsuse üksus otsuse juhtumikorralduse algatamiseks või algatamata jätmiseks 30 päeva jooksul abivajavast lapsest teadasaamisest arvates.

§ 41¹. Application of § 27¹
Upon ascertaining a child in need of assistance provided for in § 27¹ of this Act for the first time, the local government shall, within 30 days after becoming aware of a child in need of assistance, make a decision on whether or not to commence case management.

Käesoleva seaduse § 20 lõikes 3 nimetatud lapsega töötava isiku käesoleva seaduse nõuetele vastavuse regulaarse kontrollimise tähtaja kulgemist arvestatakse alates 2023. aasta 1. jaanuarist.

(1) The start of the term for regular verification of compliance with the requirements of this Act of a person working with children specified in subsection 3 of § 20 of this Act shall be calculated from 1 January 2023.
