§ 1. Reguleerimisala

Määrus sätestab nõuded biokütuse tarbimisse lubamise kohustuse täitmise aruande (edaspidi aruanne) andmete koosseisule ja aruande esitamise korra.

§ 1. Scope of application

This Regulation provides the requirements for the composition of data in the report on fulfilment of the obligation concerning the release of biofuel for consumption (hereinafter, ‘report’) and the rules for submission of the report.

§ 2. Aruande esitamise kord

Tarnija esitab aruande hiljemalt iga kuu 15. kuupäeval Keskkonnaameti e-posti aadressile.

Aruanne esitatakse aruande vormil ning selle allkirjastab tarnija volitatud esindaja digitaalselt.

Aruande vorm on avaldatud Keskkonnaministeeriumi veebilehel.

Tarnija lisab aruandele aktsiisilaopidaja kinnituse selle kohta, et tarbimisse lubatud kütuse kogus vastab aktsiisilaopidaja andmetele.

§ 2. Rules for submission of the report

(1) The supplier submits the report at the latest on the 15th day of each month to the email address of the Environment Board.

(2) The report is drawn up using the relevant form and is digitally signed by the authorized representative of the supplier.

(3) The form for the report has been published on the website of the Ministry of the Environment.

(4) The supplier attaches to the report a certificate from the keeper of the excise warehouse to the effect that the quantity of the fuel released for consumption corresponds to the information possessed by that keeper.

§ 3. Aruandes esitatavate andmete koosseis

Aruandes esitab tarnija eelmise kuu jooksul tarbimisse lubatud bensiini, diislikütuse ja biokütuse kohta järgmised andmed:

kütuse ja biokütuse nimetus;

biokütuse lähteaine nimetus ja selle kogus megadžaulides;

kütuse ja biokütuse alumine kütteväärtus megadžaulides liitri kohta;

kütuse ja biokütuse tarbimisse lubamise aeg (kuupõhiselt);

kütuse ja biokütuse kogus temperatuuri 15 kraadi Celsiuse juures liitrites ja megadžaulides;

märge selle kohta, kas tarbimisse lubatud biokütust saab vedelkütuse seaduse § 2¹ lõikes 1 nimetatud kohustuse täitmisel võtta arvesse kahekordselt;

säästlikkuse kriteeriumeid tõendav dokument ja meetodi nimetus.

Kui Vabariigi Valitsus on vedelkütusevaru seaduse § 7 lõike 2 alusel võtnud kasutusele kütusevaru, märgib tarnija aruandes Vabariigi Valitsuse korralduse alusel tarbimisse lubatud kütuse koguse.

Kui tarnija on sõlminud vedelkütuse seaduse § 2² nimetatud tarnijate vahelise kokkuleppe, esitab tarnija aruandes taastuvenergia statistika koguse, mida aruandeperioodil teiselt tarnijalt või tarnijale üle kanti.

Lõikes 3 nimetatud koguse osas peab statistikat üle kandnud tarnija aruandele lisama tõendi selle kohta, et statistika pärineb kütusest, mis on toodetud vastavalt säästlikkuse kriteeriumitele.

§ 3. Composition of data to be submitted in the report

(1) In the report, the supplier presents the following particulars concerning the petrol, diesel and biofuel released for consumption during the previous month:

1) the name of the fuel and of the biofuel;

2) the name of the feedstock of the biofuel and its quantity in megajoules;

3) the lower calorific value of the fuel and of the biofuel in megajoules per litre;

4) the time (month-based) of release for consumption of the fuel and of the biofuel;

5) the quantity, at the temperature of 15 degrees Celsius, in litres and in megajoules, of the fuel and of the biofuel;

6) an indication on whether the biofuel released for consumption qualifies for double counting for the purposes of fulfilling the obligation set out in subsection 1 of § 2¹ of the Liquid Fuel Act;

7) the document certifying sustainability criteria and the name of the method.

(2) Where, under subsection 2 of § 7 of the Liquid Fuel Stocks Act, the Government of the Republic has released stocks of liquid fuel, the supplier indicates in the report the quantity of the fuel released for consumption on the basis of the order of the Government of the Republic.

(3) Where the supplier has concluded, with another supplier or with other suppliers, the agreement mentioned in § 2² of the Liquid Fuel Act, they present, in the report, the quantity of statistics for renewable energy which, during the reporting period, was transferred from or to another supplier.

(4) Concerning the quantity referred to in subsection 3, the supplier that transferred the statistics must annex to the report a certificate to the effect that the statistics originate from fuel that has been produced in accordance with sustainability criteria.

§ 4. Rakendussätted

Perioodil 2018. aasta 1. november kuni 2019. aasta 31. märts ei pea aruandes kajastama tarbimisse lubatud diislikütuse andmeid.

Paragrahvi 2 lõikes 3 nimetatud aruande vormi on kohustuslik kasutada Maksu- ja Tolliameti hallatava kütuse käitlemise andmekogu rakendumiseni.

§ 4. Implementing provisions

(1) Particulars concerning the diesel released for consumption are not required to be reflected in the report during the period of 1 November 2018 through 31 March 2019.

(2) Use of the form for the report mentioned in subsection 3 of § 2 is obligatory until the database of fuel handling operations administered by the Tax and Customs Board becomes operational.

§ 5. Määruse jõustumine

Paragrahvi 3 lõiked 3 ja 4 jõustuvad 2019. aasta 1. jaanuaril.

§ 5. Entry into force of this Regulation

Subsections 3 and 4 of § 3 enter into force on 1 January 2019.
