§ 1. Seaduse reguleerimisala
Käesolev seadus sätestab ettevõtluse ja elamumajanduse riikliku toetamise ning ettevõtlus- ja elamumajanduslaenude riikliku tagamise alused, põhimõtted ja korraldamise.
Laenude riiklikul tagamisel kohaldatakse võlaõigusseadust, arvestades käesoleva seaduse erisusi.
Laenude riiklikule tagamisele ei kohaldata kindlustustegevuse seadust.

§ 1. Scope of application of Act
(1) This Act sets out the bases, principles and organisation of the state support of enterprise and housing and the grant of state guarantees for business loans and housing loans.
(2) The Law of Obligations Act applies to the grant of state guarantees for loans, taking account of the specifications provided for in this Act.
(3) The Insurance Activities Act does not apply to the grant of state guarantees for loans.
2. peatükk ETTEVÕTLUSE JA ELAMUMAJANDUSE RIIKLIK TOETAMINE
§ 2. Ettevõtluse ja elamumajanduse riikliku toetamise rahalised allikad
Toetuste allikateks on:
eraldised riigieelarvest;
ettevõtluse tugisüsteemi kuuluvate sihtasutuste omatulu;
muud vahendid.
Käesolevas seaduses ettevõtluse riiklikuks toetamiseks ettenähtud raha eraldatakse riigieelarves Majandus- ja Kommunikatsiooniministeeriumile ning elamumajanduse riiklikuks toetamiseks ettenähtud raha eraldatakse riigieelarves Kliimaministeeriumile.
Riigieelarves ettevõtluse ja elamumajanduse riiklikuks toetamiseks ettenähtud rahasummat ning poliitika põhialuseid, valdkonna arengukavasid ja programme arvestades otsustab valdkonna eest vastutav minister, millist liiki toetusi eelarveaastal antakse.

§ 2. Financial resources of state support of enterprise and housing
(1) The following are the sources of support:
1) allocations from the state budget;
2) the own revenue of foundations belonging to the enterprise support system;
3) other resources.
(2) Funds for the grant of state support of enterprise prescribed by this Act shall be allocated in the state budget to the Ministry of Economic Affairs and Communications and funds for the grant of state support of housing prescribed by this Act shall be allocated in the state budget to the Ministry of Climate.
(3) The minister in charge of the policy sector shall decide which types of support are to be granted during the financial year, taking account of the amounts allocated in the state budget for the grant of state support of enterprise and housing and the basic principles of the policies, development plans and programmes of the area.
§ 3. Ettevõtluse ja elamumajanduse riikliku toetamise liigid
Ettevõtluse ja elamumajanduse riikliku toetamise liigid käesoleva seaduse tähenduses on:
toetused;
tagatised;
laenud;
ettevõtluse riiklikul toetamisel investeeringud äriühingu omakapitali investeerimisfondi kaudu (edaspidi omakapitali investeeringud).

§ 3. Types of state support of enterprise and housing
For the purposes of this Act, the following are the types of state support of enterprise and housing:
1) support;
2) guarantees;
3) loans;
4) investments through the equity investment fund of the company (hereinafter equity investments) upon state support of enterprise.
§ 4. Ettevõtluse ja elamumajanduse riikliku toetamise korraldamine
Riik toetab ettevõtlust ja elamumajandust ettevõtluse arendamiseks või ettevõtluse ja elamumajanduse arendamiseks loodud sihtasutuste kaudu, mille asutajaõigusi teostab valdkonna eest vastutav minister.
Ettevõtluslaenu andmise tingimused kehtestab valdkonna eest vastutav minister määrusega.
Elamumajanduslaenude andmise tingimused kehtestab valdkonna eest vastutav minister määrusega.

Toetuste sihipärase kasutamise üle teostavad järelevalvet sihtasutused.
Ettevõtluse ja elamumajanduse riiklik toetamine peab kaasa aitama poliitika põhialuste, vastava valdkonna arengukavade ja programmide eesmärkide saavutamisele ning vastama riigiabi andmise reeglistikule.
Euroopa Liidu abiprogrammide ja fondide poolt finantseeritav riiklik toetamine peab olema kooskõlas vastavate abiprogrammide ja fondide toetamise põhimõtetega.
Eesmärgiga tagada ettevõtluslaenu kaitse ja laenulepingust tulenevate kohustuste nõuetekohane täitmine laenusaaja poolt, võib ettevõtluslaenu andev sihtasutus omandada ja võõrandada osaluse ettevõtluslaenu saanud äriühingus. Käesolevas lõikes nimetatud eesmärgil äriühingus osaluse omandamisele ja võõrandamisele ei kohaldata riigivaraseadust.
Sihtasutuselt ettevõtluslaenu saanud äriühingus osaluse omandamise ja võõrandamise tingimused kehtestab valdkonna eest vastutav minister määrusega.

§ 4. Organisation of state support of enterprise and housing
(1) The state supports enterprise and housing through foundations established for the development of enterprise or for the development of enterprise and housing, whose founder’s rights shall be exercised by the minister in charge of the policy sector.
(2) The conditions for the grant of business loans shall be established by the minister in charge of the policy sector.
(2¹) The conditions for the grant of housing loans shall be established by the regulation of the minister in charge of the policy sector.
(4) Supervision over the use of support for its intended purpose shall be exercised by the foundations.
(5) The state support of enterprise and housing shall contribute to the achievement of the objectives of the basic principles of policy, development plans and programmes in the respective area and programmes and comply with the rules on the grant of state aid.
(6) State support financed by the European Union aid programmes and funds shall be in compliance with the principles of the support of aid programmes and funds.
(7) With the purpose to ensure the protection of business loans and fulfilment of the liabilities arising from the loan agreement by the recipient of the loan as required the foundation granting business loans may acquire and transfer a holding in the company that received business loan. Acquisition and transfer of a holding in a company with the purpose specified in this section shall not be applied the State Assets Act.
(8) The conditions of acquisition and transfer of a holding in a company that received business loan from a foundation shall be established by a resolution of a minister in charge of the policy sector.
§ 4¹. Mittesihipäraselt kasutatud toetuse tagastamise kord
Toetuse saaja on kohustatud tagastama mittesihipäraselt kasutatud toetuse summa.
Toetuse saajaga sõlmitavas toetuse andmise lepingus määratletakse toetuse kasutamise sihtotstarve ning mittesihipäraselt kasutatud toetuse tagasinõudmise täpsemad alused ja tingimused.
Kui toetuse saaja majanduslik olukord on selliselt halvenenud, et toetuse sihipärane kasutamine on ohustatud, võib toetuse andmise lepingu enne toetuse üleandmist üles öelda.
Mittesihipäraselt kasutatud toetuse tagasinõudmine otsustatakse hiljemalt 30 kalendripäeva jooksul toetuse mittesihipärasest kasutamisest teadasaamisest arvates.
Mittesihipäraselt kasutatud toetus tuleb toetuse andjale tagastada toetuse tagasinõudmise otsuses ette nähtud perioodi jooksul toetuse tagasinõudmise otsuse kättesaamisest arvates.

§ 4¹. Procedure for refund of support used for other than intended purpose
(1) The recipient of support is required to refund the amount of support used for other than intended purpose.
(2) The contract of the grant of support entered into with the recipient of support shall set out the intended purpose of the use of support and the accurate bases and conditions of the refund of the support used for other than its intended purpose.
(3) If the economic situation of the recipient of support has deteriorated in such a way that the intended use of support may be endangered, the agreement on the grant of loan may be cancelled before the transfer of the loan.
(4) The refund of the support used for other than its intended purpose shall be decided at the latest within 30 days as of the getting to know of the use of support for other than its intended purpose.
(5) The support used for other than its intended purpose shall be refunded to the provider of support during the period, prescribed in the decision on the recovery of support, as of the receipt of the decision on the recovery of support.
§ 5. Sihtgrupid
Ettevõtluse ja elamumajanduse riikliku toetamise iga liigi puhul määratakse rahastamislepinguga või valdkonna eest vastutava ministri käskkirja või määrusega sihtgrupid, kes nimetatud toetust võivad saada.

Muude võrdsete tingimuste puhul võib teha eelistusi ettevõtlustoetuste saajate valikul, eelistades prioriteetsuse järjekorras ettevõtjaid, kes:
on alustavad või mikroettevõtjad või
aitavad oma tegevusega kaasa tasakaalustatud regionaalsele arengule, luues töökohti piirkonnas, kus elatustase on madal ja tööpuudus kõrge või
on orienteerunud kaasaegsele ja tehnoloogiamahukale tootmisele või on orienteerunud ekspordivõimeliste teenuste või toodete pakkumisele.
Ettevõtlustoetuse võib jätta eraldamata isikule, keda või kelle seaduslikku esindajat on karistatud karistusseadustiku §-de 133–133³, 175 või 260¹ alusel ja kelle karistusandmed ei ole karistusregistrist karistusregistri seaduse kohaselt kustutatud.

§ 5. Target groups
(1) For each type of state support of enterprise and housing the target groups which are entitled to receive the specified support shall be determined by the financing contract or a directive or regulation of the minister in charge of the policy sector.
(3) If other conditions are equal, preference may be given to the following undertakings, in order of priority, upon selection of the recipients of enterprise support:
1) start-up companies or micro undertakings, or
2) undertakings whose activities contribute towards balanced regional development and create jobs in regions where the standard of living is low or where there is serious unemployment, or
3) undertakings which are oriented at contemporary and technology-intensive manufacturing or at offering services or goods with export potential.
(4) Enterprise support may be refused to a person who or whose legal representative has been punished on the basis of §§ 133-133³, 175 or 260¹ of the Penal Code and whose information concerning the punishment has not been deleted from the criminal records database pursuant to the Criminal Records Database Act.
§ 5¹. Omakapitali investeeringud
Omakapitali investeeringuid võib teha riigi poolt ettevõtlus- ja elamumajanduslaenude tagamiseks asutatud sihtasutuse (edaspidi sihtasutus) kaudu või äriühingu kaudu, milles sihtasutusel on osalus. Omakapitali investeeringute tegemiseks peab investeerimiskapitali paigutama asutatavasse või olemasolevasse investeerimisfondi, mis investeerib ise või teiste investeerimisfondide kaudu omakapitali investeeringu objektiks oleva äriühingu omakapitali.
Majandus- ja Kommunikatsiooniministeerium ning sihtasutus või Kliimaministeerium ning sihtasutus sõlmivad omakapitali investeeringute tarbeks riigieelarvest eraldatud vahendite (edaspidi investeerimiskapital) üleandmiseks sihtasutusele rahastamislepingu.
Käesoleva paragrahvi lõikes 2 nimetatud rahastamislepingus peavad sisalduma vähemalt:
sihtasutusele üleantava investeerimiskapitali summa ning üleandmise ja investeerimise tingimused;
nõusolek investeerimiskapitali üleandmiseks äriühingule, milles sihtasutusel on osalus, kui omakapitali investeering tehakse sellise äriühingu kaudu;
investeerimiskapitali investeerimisstrateegia ja investeeringute üle teostatava järelevalve põhimõtted;
valitsemistasu ja investeerimisfondi arvelt makstavate muude tasude piirmäär;
investeerimisfondi tulu jaotamise ja investeeringust väljumise tingimused;
investeerimisfondi poolt tagastatava investeerimiskapitali ja investeeringust saadud tulu kasutamise tingimused ja kord;
riigiabi korral selle tagasinõudmise alused ja kord, kui selgub, et abi anti ebaseaduslikult või abi on ühisturuga kokkusobimatu.
Käesoleva paragrahvi lõikes 2 nimetatud rahastamislepingu täitmise üle teostab järelevalvet Majandus- ja Kommunikatsiooniministeerium ning Kliimaministeerium.
Omakapitali investeeringute korraldamiseks võib valida ühe või mitu fondivalitsejat. Fondivalitseja valimisel peab olema tagatud valimisprotsessi läbipaistvus ja valimisprotseduuri kontrollitavus.
Omakapitali investeeringute tegemisel investeerimisfondidesse paigutatud investeerimiskapitali väärtusele vastavas osas saadud investeerimisfondi aktsiate, osakute või muude samaväärsete õiguste omanik on riik. Käesolevas lõikes nimetatud aktsiate, osakute või muude samaväärsete õiguste valitsejaks erisusena riigivaraseaduse § 5 lõikest 2 on Majandus- ja Kommunikatsiooniministeerium ning Kliimaministeerium.

§ 5¹. Equity capital investments
(1) Equity capital investments can be made through a foundation established by the state for ensuring the business and housing loans (hereinafter foundation) or through a company in which the foundation has a holding. In order to made equity investments investment capital shall be invested in the investment fund to be established or the existing investment fund which invests by itself or through other investment funds into equity capital of the company serving as the object of equity capital investment.
(2) The Ministry of Economic Affairs and Communications and the foundation or the Ministry of Climate and the foundation shall enter into the financing agreement for the transfer to the foundation of the resources allocated from the state budget for equity investments (hereinafter investment capital).
(3) The financing agreement specified in subsection 2 of this section shall include at least;
1) the amount of investment capital to be transferred to the foundation and the conditions of the transfer and investment;
2) the consent for the transfer of investment capital to a company in which the foundation has a holding if the equity investment is made through such company;
3) the principles of supervision exercised over the investment strategy and investments;
4) the limits on management fee and other fees paid on account of the investment fund;
5) the conditions of profit distribution of the investment fund and divestment:
6) the conditions and procedure of the use of investment capital to be refunded by the investment fund and the revenue on investment;
7) in the case of the state aid the bases and procedure for recovery thereof if it becomes evident that the aid was granted unlawfully or the aid was incompatible with the common market.
(4) Supervision over the compliance with the financing agreement specified in subsection 2 of this section shall be exercised by the Ministry of Economic Affiars and Communications and the Ministry of Climate.
(5) One or several management companies may be selected for arrangement of equity investments. The transparency of the selection process and controllability of the selection procedure shall be ensured upon selecting the management company.
(6) The state is the owner of the shares, units or other equivalent rights of the investment fund obtained to the extent corresponding to the value of the investment capital invested in investment funds upon making equity investments. As a specification for subsection 2 of § 5 of the State Assets Act the administrator of the shares, units and other equivalent rights, specified in this subsection, is the Ministry of Economic Affairs and Communications and the Ministry of Climate.
§ 5². Investeerimisfondi asutamine ja osalemine investeerimisfondis
Vabariigi Valitsuse volituse alusel võib valdkonna eest vastutav minister oma pädevuse piires otsustada investeerimisfondi asutamise ja selles osalemise.
Vabariigi Valitsuse volituse alusel võib valdkonna eest vastutav minister oma pädevuse piires otsustada omakapitali investeeringute tegemiseks sihtasutuse poolt sellise äriühingu asutamise, kelle ülesandeks on omakapitali investeeringute tegemiseks investeerimisfondi asutamine või selles osalemine ja riigieelarvest eraldatud sihtotstarbelise investeerimiskapitali paigutamine asutatavasse või olemasolevasse investeerimisfondi, või sellise äriühingu asutamisel osalemise.

§ 5². Establishment of and participation in investment fund
(1) On the basis of the authorization of the Government of the Republic the minister in charge of the policy sector may, within his or her competence, decide on the establishment of the investment fund and participation therein.
(2) On the basis of the authorization of the Government of the Republic the minister in charge of the policy sector may decide within his or her competence, for making equity investments, on the establishment of a company by the foundation whose task is to establish an investment fund for making equity investments or to participate therein and to invest investment capital allocated from the state budget for a specific purpose into the investment fund to be established or existing, or participate in the establishment of such company.
3. peatükk LAENUDE RIIKLIK TAGAMINE
§ 6. Mõisted
Käesolevas seaduses kasutatakse mõisteid järgmises tähenduses:
laen – krediidiasutuse vara või bilansiväline kohustus, mis tuleneb lepingust, mille kohaselt laenuandja annab või kohustub andma raha või muu vara laenusaajale või lepingust tulenevalt muule õigustatud isikule, laenusaaja aga kohustub laenuandjale raha või muu vara tagastama kindlaksmääratud tingimustel;
ettevõtluslaen – ettevõtjatele nende ettevõtlusega seotud kulutuste finantseerimiseks antav laen;
elamumajanduslaen – eluaseme soetamiseks või elamistingimuste parandamiseks, sealhulgas elamu ökonoomsuse, turvalisuse ja heakorra parandamiseks antav laen;
riiklik tagatis – käesolevas seaduses sätestatud riikliku tagatise andja ja tagatise saaja vahel sõlmitud ning käesoleva seaduse § 8 lõikes 4 sätestatud tingimustele vastavast kirjalikust tagatislepingust tulenev riigi poolt tagatud riikliku tagatise andja kohustus tasuda tagatise saajale finantseerimistehingust tulenev võlgniku võlakohustus, arvestades § 8 lõikes 4¹ sätestatut.

§ 6. Definitions
In this Act, the following definitions are used:
1) “loan” means the assets or off-balance sheet items of a credit institution arising from contracts under which the lender grants or undertakes to grant money or other assets to the recipient of the loan or another entitled person pursuant to the contract and the recipient of the loan undertakes to return the money or other assets to the lender under the prescribed conditions;
2) “business loan” means a loan which is granted to undertakings in order to finance their enterprise-related expenses;
3) “housing loan” means a loan granted in order to acquire housing or improve living conditions, including a loan granted in order to improve the economy, safety and maintenance of a residential building;
4) “state guarantee” means the state-guaranteed obligation of a grantor of state guarantees, which arises from the written guarantee contract entered into between the grantor of state guarantees and the beneficiary of the guarantee and complies with the conditions of subsection 4 of § 8 of this Act, to pay the debt of the debtor arising from a financing transaction to the guarantee holder, taking account of the provisions of subsection 4¹ of § 8.
§ 7. Ettevõtlus- ja elamumajanduslaenude riikliku tagamise subjektid
Käesolevas seaduses sätestatud riiklikke tagatisi võib anda sihtasutuse kaudu.
Riikliku tagatise saajaks võib olla Eestis või teises Euroopa Majanduspiirkonna lepinguriigis asutatud krediidiasutus või Eestis asutatud muu Finantsinspektsiooni tegevusluba omav krediidiandja, Euroopa Keskpank või Euroopa Liidu liikmesriigi keskpank või Euroopa Parlamendi ja nõukogu määruse (EL) nr 575/2013 krediidiasutuste ja investeerimisühingute suhtes kohaldatavate usaldatavusnõuete kohta ja määruse (EL) nr 648/2012 muutmise kohta (ELT L 176, 27.06.2013, lk 1–337) artiklis 117 nimetatud mitmepoolne arengupank. Kui tagatakse liisingulepingust tulenevat kohustust, võib riikliku tagatise saajaks olla ka Eesti või teise Euroopa Majanduspiirkonna lepinguriigi krediidiasutuse konsolideerimisgruppi kuuluv finantseerimisasutus, kes ise või kelle filiaal on asutatud Eestis. Käesolevas seaduses krediidiasutuse kohta sätestatut kohaldatakse ka eelnimetatud finantseerimisasutuse ja muu krediidiandja kohta. Riikliku tagatise saajaks loetakse ka isik, kellele tagatav nõue on käesoleva seaduse tingimuste kohaselt üle antud.
Käesoleva paragrahvi lõikes 2 nimetatud riikliku tagatise saaja pankroti-, likvideerimis-, tervendamis- või saneerimismenetluse korral, samuti tagatise saajaks oleva krediidiasutuse või selle filiaali suhtes moratooriumi, kriisilahendusmenetluse või varajase sekkumise meetmete rakendamise korral, kui nimetatud menetluste või meetmete käigus antakse tagatisega tagatav nõue üle kolmandale isikule, ei pea selline kolmas isik või selle filiaal olema kantud Eesti äriregistrisse, kuid peab vastama käesoleva paragrahvi lõikes 2 sätestatud teistele tingimustele.
Kui riikliku tagatise saaja suhtes rakendatakse kriisilahendusmenetlust või varajase sekkumise meedet, kohaldatakse käesoleva paragrahvi lõikes 2¹ sätestatut finantskriisi ennetamise ja lahendamise seaduses sätestatud erisustega.
Kui riikliku tagatisega tagatud nõue antakse tagatisena üle Euroopa Keskpangale või Euroopa Liidu liikmesriigi keskpangale, säilitab riiklik tagatis kehtivuse ka juhul, kui sellega tagatud nõue läheb üle nimetatud keskpanga omandisse või kui nimetatud keskpank võõrandab nõude kolmandale isikule.
Elamumajanduslaenusid võib sihtasutus käesolevas seaduses ettenähtud korras tagada, kui vähemalt üheks laenusaajaks on riiklikult tagatud elamumajanduslaenude sihtgruppi kuuluv isik, samuti korteri- või hooneühistu või korteriomanike ühisus. Riiklikult tagatud elamumajanduslaenude sihtgrupid ja laenutagatiste ülempiirid kehtestab Vabariigi Valitsus .

§ 7. Subjects of state guarantees for business loans and housing loans
(1) State guarantees provided for in this Act may be granted through a foundation.
(2) The beneficiary of a state guarantee may be a credit institution established in Estonia or another Contracting State of the European Economic Area or other creditor established in Estonia licensed by the Financial Supervision Authority, the European Central Bank or the central bank of a Member State of the European Union or a multilateral development bank specified in Article 117 of Regulation (EU) No 575/2013 of the European Parliament and of the Council on prudential requirements f or credit institutions and investment firms and amending Regulation (EU) No 648/2012 (OJ L 176, 27.6.2013, pp. 1-337). If a guarantee is granted for an obligation arising from a leasing contract, a financial institution which belongs to the consolidation group of a credit institution of Estonia or another Contracting State of the European Economic Area, which itself or whose branch is established in Estonia, may also be the beneficiary of a state guarantee. The provisions of this Act concerning credit institutions shall also apply to the abovementioned financial institution and other creditors. The beneficiary of a state guarantee is also deemed to be a person to whom the securable claim has been transferred in accordance with the conditions of this Act.
(2¹) In the case of the bankruptcy, liquidation, rehabilitation or reorganisation proceedings of the beneficiary of the state guarantee specified in subsection 2 of this section, as well as in the case of the establishment of a moratorium, application of the crisis resolution proceedings or early intervention measures with regard to the credit institution or a branch thereof being the beneficiary of a state guarantee, if in the course of the specified procedures or measures the ssecurable claim is transferred to the third party, such third party or the branch thereof need not be entered in the Estonian commercial register but it is required to be in compliance with other conditions provided for in subsection 2 of this section.
(2²) If a crisis resolution procedure or early intervention measure is applied to a beneficicary of a state guarantee, the provisions of subsection 2¹ of this section shall be applied with the specifications provided for in the Financial Crisis Prevention and Resolution Act.
(2³) Where a claim secured by a state guarantee is transferred as security to the European Central Bank or a national central bank of a Member State of the European Union, the state guarantee shall remain valid even if the claim secured by the state guarantee is transferred to the ownership of the specified central bank or the claim is transferred to a third party by the specified central bank.
(3) A foundation may grant a guarantee for a housing loan pursuant to the procedure prescribed in this Act if at least one of the recipients of the loan is a person belonging to the target group of state-guaranteed housing loans, or an apartment association or building association or a community of apartment owners. The target groups of state-guaranteed housing loans and the upper limits of loan guarantees shall be established by the Government of the Republic.
§ 8. Riiklik tagatis ja tagatislepingud
Tagatislepingust tulenev sihtasutuse vastutus kohaldub üksnes võlgniku põhikohustusele. Sihtasutus vastutab käendajana tagatise saaja ees vastavalt tagatislepingule. Kui tagatise saajal on õigus võlgniku kohustuse rikkumise korral esitada vastava kohustuse tasumise nõue sihtasutusele, teeb sihtasutus nõude täitmiseks õigeaegselt käenduskohustuse ettemakse, arvestades tagatislepingus sätestatud tingimusi. Eluaseme hüpoteeklaenu tagamise korral tehakse vastav ettemakse 24 kuu jooksul nõude saamisest arvates. Tagatise saaja arvestab ettemakse võlgniku kohustuse täitmiseks üksnes juhul, kui tagatise saaja ei saa nõuet võlgniku ja võlgniku kohustusi tagavate kolmandate isikute vastu rahuldada, ja ulatuses, milles ta ei saa seda teha. Võlgniku kohustusi tagavad kolmandad isikud ei omanda võlgniku kohustuse täitmisega nõudeõigust sihtasutuse vastu.
Võlgniku kohustuse täitmisel läheb võlausaldaja nõue täidetud ulatuses üle sihtasutusele.
Tagatislepingule kohaldatakse võlaõigusseaduses käenduslepingu kohta sätestatut, arvestades käesoleva seaduse erisusi.
Tagatislepingus peavad sisalduma vähemalt:
sihtasutuse vastutuse määr protsentides tagatava põhikohustuse jäägist;
riikliku tagatise maksimaalne summa;
tagatava kohustuse olulised tingimused;
tagatistasu suurus ja selle maksmise tingimused;
krediidiasutuse kohustus tasuda tagatistasu;
tagatise jõustumise aeg;
viide sellele, et tegemist on riikliku tagatisega käesoleva seaduse tähenduses.
Tagatislepingust tulenev sihtasutuse kohustus ei ole riiklik tagatis, kui tagatislepingus sisaldub tingimus, mille täitmine ei allu tagatise saaja otsesele kontrollile ja mis annab sihtasutusele õiguse:
lühendada tagatislepingu tähtaega;
tagatislepingut või selles sisalduvaid tingimusi muuta või tühistada;
suurendada tagatistasu võlgniku majandusliku olukorra halvenemise korral;
keelduda nõude täitmisest võlgniku makseraskuse korral.
Riikliku tagatise summa väljendatakse eurodes sõltumata sellest, kas võlgniku kohustus tekib eurodes või muus Eestis konverteeritavas valuutas, mida Euroopa Keskpank noteerib.
Riikliku tagatise saaja esitab tagatislepingust tuleneva nõude sihtasutuse vastu. Riiklikest tagatistest tulenevad sihtasutuse kohustused lähevad üle riigile, kui sihtasutus ei täida või ei ole võimeline täitma riikliku tagatise saaja nõuet.

§ 8. State guarantee and guarantee contracts
(1) The liability of a foundation arising from a guarantee contract shall only apply to the principal obligation of the debtor. The foundation shall be liable as a guarantor to the beneficiary of the guarantee in accordance with the guarantee contract. If the beneficiary of the guarantee has the right, in the case the debtor violates the obligation, to submit a claim for payment of the corresponding obligation to the foundation, the foundation shall make an advance payment of the surety obligation in time to meet the claim, taking into account the conditions provided in the guarantee contract. In the case of guaranteeing a housing mortgage loan, the corresponding advance payment is made within 24 months as of the receipt of the claim. The beneficiary of the guarantee shall calculate the advance payment for the performance of the debtor's obligation only if the beneficiary of the guarantee cannot satisfy the claim against the debtor and third parties who are securing the debtor's obligations, and to the extent that the beneficiary is unable to do it. Upon performance of the debtor’s obligations the third parties who are guaranteeing the obligations of the debtor shall not acquire the right of claim against the foundation.
(2) Upon performance of an obligation of a debtor, a claim of the creditor shall be transferred to the foundation to the extent the obligation is performed.
(3) The provisions of the Law of Obligations Act concerning contracts of suretyship apply to guarantee contracts, taking account of the specifications provided for in this Act.
(4) A guarantee contract shall set out at least the following:
1) the extent of the liability of the foundation as a percentage of the balance of the principal obligation being guaranteed;
2) the maximum amount of the state guarantee;
3) the essential conditions of the guaranteed obligation;
4) the size of the premium and the conditions for payment thereof;
5) the obligation of a credit institution to pay the premium;
6) the date on which the guarantee enters into force;
7) a reference to the fact that it is a state guarantee within the meaning of this Act.
(4¹) The obligation of a foundation arising from a guarantee contract is not a state guarantee if the guarantee contract contains a condition compliance with which cannot be directly controlled by the guarantee holder and which grants the foundation the right to:
1) shorten the term of the guarantee contract;
2) amend or cancel the guarantee contract or the conditions of the contract;
3) increase the premium if the economic situation of the debtor deteriorates;
4) refuse to satisfy the claim if the debtor experiences solvency problems.
(5) The amount of state guarantee shall be expressed in euros regardless of whether the obligation of the debtor arises in euros or in another currency convertible in Estonia which is quoted by the European Central Bank.
(6) The beneficiary of a state guarantee shall file a claim arising from the guarantee contract against the foundation. The obligations of the foundation arising from state guarantees shall be transferred to the state if the foundation fails to satisfy or is unable to satisfy the claim of the beneficiary of the state guarantee.
§ 9. Riikliku tagatise andmise üldised põhimõtted
Riikliku tagatise saajale tekkiv kahju hüvitatakse käenduslepingus sätestatud määras, arvestades riigiabi reeglitega lubatud protsenti ja laenukohustuse jääki ettevõtluslaenu- või elamumajanduslaenulepingu ülesütlemise hetke seisuga.
Sihtasutusel on alati õigus tagatislepingu sõlmimisest keelduda.
Sihtasutusel on kohustus tagatislepingu sõlmimisest keelduda, kui:
krediidiasutus ei ole esitanud nõuetekohast taotlust, nõutavaid dokumente või asjassepuutuvat informatsiooni;
on ilmnenud, et laenutaotleja on esitanud krediidiasutuselt laenu taotlemisel valeandmeid;
krediidiasutuse taotluses näidatud laenutaotleja ei vasta käesoleva seaduse nõuetele.
Kui krediidiasutus on taotluses või sihtasutusele esitatud muudes dokumentides esitanud teadlikult valeandmeid, on sihtasutusel õigus tagatisleping üles öelda, jättes tasutud tagatistasu krediidiasutusele tagastamata. Kui sellise tagatislepingu alusel on tagatis välja makstud, on krediidiasutus kohustatud selle summa koos intressiga sihtasutusele tagastama.

§ 9. General principles for grant of state guarantees
(1) The damage caused to the beneficiary of a state guarantee shall be compensated for at the rate provided for in the contract of suretyship, taking into account the percentage permitted by the state aid rules and the balance of loan obligation as at the moment of cancellation of the business loan or housing loan agreement.
(2) A foundation always has the right to refuse to enter into a guarantee contract.
(3) A foundation is required to refuse to enter into a guarantee contract if:
1) the credit institution has not submitted a valid application, the required documents or relevant information;
2) it becomes evident that the loan applicant has submitted false information when applying for a loan from the credit institution;
3) the loan applicant specified in the application by the credit institution does not meet the requirements of this Act.
(4) If a credit institution knowingly submits false information in an application or in other documents submitted to a foundation, the foundation has the right to cancel the guarantee contract and without refunding the paid premium to the credit institution. If a guarantee is paid on the basis of such a guarantee contract, the credit institution is required to refund the amount to the foundation together with interest.
§ 10. Sihtasutuse varad ja omavahendid
Sihtasutuse varad on vastavalt sihtasutuse tegevusaladele jaotatud ja eraldatud sihtfondideks. Sihtasutuse ettevõtluslaenude tagamise sihtfondi ja elamumajanduslaenude tagamise sihtfondi (edaspidi sihtfond) kuuluvad varad arvestatakse laenude tagamise omavahendite hulka.
Sihtasutus korraldab oma raamatupidamisarvestust selliselt, et oleks tagatud ettevõtlus- ja elamumajanduslaenude tagamisega seotud varade ja kohustuste eraldatus üksteisest ning sihtasutuse muudest varadest ja kohustustest.
Sihtasutuse laenude tagamise omavahendeid ei saa kasutada sihtasutuse muust tegevusest tulenevate kohustuste täitmiseks. Ühe sihtfondi varasid ei kasutata teise sihtfondi kohustuste täitmiseks.
Riikliku tagatise andja valuuta-, krediidi- ja likviidsusriskide ning muude rahaliste vahendite haldamisega seonduvate finantsriskide juhtimise põhimõtted ja üldised piirangud kehtestab Vabariigi Valitsus .

§ 10. Assets and own funds of foundation
(1) The assets of a foundation are divided and allocated into trust funds according to the areas of activity of the foundation. The assets belonging to the trust fund for the grant of guarantees for business loans and the trust fund for the grant of guarantees for housing loans (hereinafter trust fund) shall be included in the own funds for the guarantee of loans.
(2) A foundation shall organise its accounting such that it is ensured that the assets and obligations related to guaranteeing business loans and housing loans are separated from each other and from the foundation's other assets and obligations.
(3) The own funds of a foundation for the grant of loan guarantees cannot be used for the performance of obligations arising from other activities of the foundation. The own funds belonging to one trust fund shall not be used for the performance of obligations of another trust fund.
(4) The principles for and general restrictions on the management of foreign-exchange, credit and liquidity risks and other financial risks related to the management of the funds of a grantor of state guarantees shall be established by the Government of the Republic.
§ 11. Sihtasutuse laenude tagamise omavahendid
Sihtasutuse laenude tagamise omavahendite (edaspidi omavahendid) hulka kuuluvad:
laenude tagamiseks eraldatud kapital;
laenude tagamisega seotud eelmiste perioodide jaotamata kasum või kahjum vastavalt auditeeritud aastaaruannetele;
sihtotstarbelised annetused;
sihtotstarbelised eraldised riigieelarvest;
eraldised muudest allikatest.
Omavahenditest arvatakse maha immateriaalne põhivara ja jooksva aruandeperioodi kahjum.
Omavahendite hulka võib asutajaõiguste teostaja loal täiendavalt arvata allutatud ja sihtotstarbelised laenud ning muud sarnased kohustused (edaspidi koos allutatud laen), kui on täidetud järgmised tingimused:
laenulepingu järgi on võetud allutatud laenu tagastamise tähtaeg või tagastamise periood vähemalt viis aastat ning laenu puhul, mille tagastamise tähtaega ei ole kokku lepitud, peab lepingus olema sätestatud kohustus teatada allutatud laenu tagasinõudmisest vähemalt viis aastat ette;
laenulepingus ei ole ette nähtud allutatud laenu ennetähtaegse tagasimaksmise tingimust, välja arvatud sihtasutuse lõpetamise korral;
sihtasutus võib allutatud laenu enne tähtaega tagasi maksta ainult asutajaõiguste teostaja loal;
sihtasutuse pankroti korral toimub laenu tagasimaksmine pärast tähtajaks esitamata, kuid tunnustatud nõuete rahuldamist.
Käesoleva paragrahvi lõikes 3 nimetatud omavahenditena võetakse arvesse ainult reaalselt laekunud laenusumma, kuid mitte suuremas kui 50 protsendi ulatuses lõigete 1 ja 2 alusel arvestatud omavahendite summast.
Repealed
Allutatud laen, mille maksetähtpäevani on jäänud vähem kui viis aastat, arvatakse omavahendite hulka ulatuses, mille arvelt võetud kohustuste tähtpäev saabub enne laenutähtpäeva.
Eelisaktsiaid ja teisi käesolevas paragrahvis nimetamata finantsinstrumente võib sihtasutus omavahendite hulka arvata ainult asutajaõiguste teostaja igakordsel eelneval loal.

§ 11. Own funds of foundation for grant of loan guarantees
(1) The following belong to the own funds of a foundation for the grant of loan guarantees (hereinafter own funds):
1) capital allocated for the grant of loan guarantees;
2) profits or losses brought forward and related to the grant of loan guarantees, pursuant to the audited annual reports;
3) donations intended for specific purposes;
4) allocations from the state budget for a specific purpose;
5) allocations from other sources.
(2) Intangible assets and losses in the current accounting period shall be deducted from the own funds.
(3) Subordinated debts and loans for a specific purpose and other similar obligations (hereinafter jointly subordinated loan) may also be included in the own funds with the permission of the exerciser of the rights of the founder if the following conditions are met:
1) the term or period of repayment of the subordinated debt taken under a debt agreement is at least five years and, if the term of repayment of the debt is not fixed, the debt agreement shall provide that the subordinated debt is repayable only subject to at least five years' notice;
2) the debt agreement does not prescribe a condition that the subordinated debt will become repayable before the agreed due date, except in the case of the dissolution of the foundation;
3) the foundation may repay the subordinated debt before the agreed due dates only with the permission of the exerciser of the rights of the founder;
4) in the event of the bankruptcy of the foundation, the debt is repaid after accepted claims not filed by the due date are satisfied.
(4) Only amounts of debt actually received shall be taken into account as own funds specified in subsection 3 of this section, but in an amount of not more than 50 per cent of the amount of own funds calculated pursuant to subsections 1 and 2.
(6) A subordinated loan with less than five years remaining to the maturity date shall be included in the own funds to the extent that the commitments taken are due before the maturity of the loan.
(7) A foundation may include preferred shares and other financial instruments not specified in this section in its own funds only with the specific prior permission of the exerciser of the rights of the founder.

§ 15. Laenude tagamise isetasuvuse nõueamended 01.10.2026
Sihtasutus peab oma laenude tagamise alase tegevuse korraldamisel tagama:
laenude tagamisega seotud tulude ja kulude tasakaalu pikema perioodi vältel;
tagamislepingutest tulenevate kohustuste varadega kaetuse igal hetkel.
Tagatistasu käesoleva seaduse tähenduses on rahasumma, mille tagatise saaja tasub sihtasutusele tagatislepingus määratud suuruses ja tähtajal. Tagatistasu peab katma sihtasutuse laenude tagamisega seotud kulud ja võimaliku kahju pikema perioodi vältel, vastama tagatavatele riskidele ning tagatislepingust tulenevale tagatise summale ja tagatise saaja omavastutuse ulatusele.
Käesoleva paragrahvi lõike 1 punkti 1 ja lõike 2 teist lauset ei kohaldata, kui sihtasutuse laenude tagamise alane tegevus on ümber korraldatud kriisiolukorra ja riigikaitse seadusest tulenevatel alustel.

§ 15. Self-balancing requirement for grant of loan guarantees
(1) When organising the grant of loan guarantees, a foundation shall ensure:
1) that revenue and expenditure relating to the grant of the loan guarantees are balanced throughout a longer period;
2) that obligations arising from guarantee contracts are covered with assets at all times.
(2) For the purposes of this Act, a premium is a sum of money which is paid by the guarantee holder to the foundation in the amount and within the term specified in the guarantee contract. Premiums shall cover the costs relating to the grant of loan guarantees by the foundation and any possible damage for a longer period and correspond to the risks covered, the chargeable amount arising from the guarantee contract and the extent of the excess of the guarantee holder.
(2¹) Clause 1 of subsection 1 and the second sentence of subsection 2 of this section shall not be applied if the activities of the foundation in guaranteeing loans have been reorganized on the bases arising from the Emergency Act.
(3) The minister in charge of the policy sector shall establish the general rules for the grant of and the principles of calculation of premiums.
§ 16. Sihtasutuse riski hajutamine
Käesoleva seaduse alusel võetavate riskide vähendamiseks võib sihtasutus laenude tagamisest tulenevaid riske kindlustada või muul viisil edasi anda korras, mille kehtestamise õigus on valdkonna eest vastutaval ministril.

§ 16. Spreading risk of foundation
In order to reduce the exposures taken pursuant to this Act, the foundation may insure the risks arising from the grant of loan guarantees or transfer them in any other manner pursuant to the procedure which the minister in charge of the policy sector has the right to establish.
§ 17. Tehnilised eraldised
Sihtasutusel peab olema igal hetkel piisavalt vahendeid, et katta kehtivate tagatislepingute alusel tehtavaid väljamakseid. Sihtasutuse vahendite piisavuse näitajaks on omavahendid ja tehnilised eraldised.
Tehnilised eraldised on kehtivatest tagatislepingutest tulenevate ja tulevikus sihtasutuse poolt potentsiaalselt väljamaksmisele kuuluvate nõuete katteks arvestatud kohustuste summa.
Laenude riikliku tagamise tehniliste eraldiste moodustamise põhimõtted ja arvutamise korra kehtestab Vabariigi Valitsus .

§ 17. Technical reserves
(1) A foundation shall at all times have enough funds to cover payments made on the basis of valid guarantee contracts. The sufficiency of the funds of the foundation is indicated by own funds and the technical reserves.
(2) Technical reserves are the amount of obligations arising from valid guarantee contracts and calculated to cover the claims potentially payable by the foundation in the future.
(3) The principles for the formation and the procedure for the calculation of technical reserves for the grant of state loan guarantees shall be established by the Government of the Republic.
§ 18. Sihtasutuse laenude tagamise omavahendite normatiivid
Tagatiste andmisel võetud võimalike kahjude katmiseks peab sihtasutuse omavahendite minimaalne suurus (edaspidi omavahendite normatiiv) nii ettevõtlus- kui elamumajanduslaenude tagamise sihtfondis vastama käesolevas seaduses sätestatule.
Ettevõtluslaenude tagamisel on omavahendite normatiiviks 10 protsenti kehtivate tagatiste puhasväärtusest, kuid mitte vähem kui 2 miljonit eurot. Tagatiste puhasväärtuse arvestamiseks liidetakse kõikide kehtivate ettevõtluslaenude riiklike tagatiste summale sihtasutuse vastu esitatud kahjunõuete summa ning lahutatakse arvestatud tehniliste eraldiste summa. Kehtivate tagatiste hulka ei arvestata tagatisi, mille alusel on sihtasutuse vastu esitatud kahjunõue.
Elamumajanduslaenude tagamisel on omavahendite normatiiviks 8 protsenti kehtivate tagatiste puhasväärtusest, kuid mitte vähem kui 2 miljonit eurot. Tagatiste puhasväärtuse arvestamiseks liidetakse kõikide üheaegselt kehtivate elamumajanduslaenude riiklike tagatiste summale sihtasutuse vastu esitatud kahjunõuete summa ning lahutatakse arvestatud tehniliste eraldiste summa. Kehtivate tagatiste hulka ei arvestata tagatisi, mille kohta on esitatud kahjunõue.
Kui omavahendeid ühes sihtfondis on omavahendite normatiiviga ettenähtust vähem, ei või sihtasutus vastavast sihtfondist uusi tagatisi anda.
Kui omavahendeid on vähem käesoleva paragrahvi lõikes 2 või 3 sätestatud omavahendite normatiivist, otsustab Vabariigi Valitsus vastava sihtfondi omavahendite taastamise.
Omavahendite suurendamiseks vastavalt käesoleva paragrahvi lõikele 5 esitab asutajaõiguste teostaja taotluse Rahandusministeeriumile.
Kui omavahendeid on suurendatud allutatud laenuna, tagastab sihtasutus allutatud laenu vastavalt selle tingimustele, kuid mitte varem, kui omavahendite summa on ületanud suurema alljärgnevatest näitajatest:
15 protsenti üheaegselt kehtivate tagatiste puhasväärtusest;

§ 18. Minimum limit of own funds of foundation for grant of loan guarantees
(1) In order to cover possible damage incurred upon the grant of guarantees, the minimum size of the own funds of the foundation (hereinafter minimum limit of own funds) in the trust fund for the grant of guarantees for business loans and in the trust fund for the grant of guarantees for housing loans shall comply with the provisions of this Act.
(2) Upon the grant of guarantees for business loans, the minimum limit of own funds shall be 10 per cent of the net asset value of the valid guarantees, but not less than 2 million euros. In order to calculate the net asset value of the guarantees, the amount of claims filed against the foundation shall be added to the amount of all valid state guarantees for business loans and the calculated amount of technical reserves shall be deducted therefrom. Guarantees on the basis of which a claim has been filed against the foundation shall not be included in the valid guarantees.
(3) Upon the grant of guarantees for housing loans, the minimum limit of own funds shall be 8 per cent of the net asset value of the valid guarantees, but not less than 2 million euros. In order to calculate the net asset value of guarantees, the amount of claims filed against the foundation shall be added to the amount of all simultaneously valid state guarantees for housing loans and the calculated amount of technical reserves shall be deducted therefrom. Guarantees in respect of which a claim has been filed shall not be included in the valid guarantees.
(4) If there are less own funds in one trust fund than the prescribed minimum limit of own funds, the foundation shall not grant any new guarantees from the trust fund.
(5) If there are less own funds than the minimum limit of own funds provided for in subsection 2 or 3 of this section, the Government of the Republic shall decide on the restoration of the own funds of the corresponding trust fund.
(6) In order to increase own funds pursuant to subsection 5 of this section, the exerciser of the rights of the founder shall submit an application to the Ministry of Finance.
(7) If own funds are increased in the form of subordinated debt, the foundation shall repay the subordinated debt pursuant to the conditions thereof but not before the own funds have exceeded the larger of the following indicators:
1) 15 per cent of the net asset value of simultaneously valid guarantees;
2) 2,300,000 euros.
§ 19. Tagatiste piirsumma
Sihtasutuse poolt käesoleva seaduse alusel sõlmitud jõus olevate tagatislepingute kogusumma ei või ühelgi hetkel ületada ettevõtluslaenude puhul 3 miljardit eurot ja elamumajanduslaenude puhul 500 miljonit eurot. Vastavalt vajadusele on Vabariigi Valitsusel õigus otsustada elamumajanduslaenude tagatislepingute kogusumma ülempiiri vähendamise üle.
Sihtasutus võib omavahendeid laenude tagamise omavahendite normatiivi ületavas osas kasutada sihtasutuse põhiülesannete ja muude põhikirjaliste eesmärkide täitmisega seotud finantsteenuste pakkumiseks korras, mille kehtestamise õigus on valdkonna eest vastutaval ministril .

§ 19. Guarantee limit
(1) The total amount of guarantee contracts in force entered into by the foundation pursuant to this Act shall not at any time exceed 3 billion euros in the case of business loans and 500 million euros in the case of housing loans. Where necessary, the Government of the Republic shall have the right to make a decision regarding reduction of the upper limit of the total amount of guarantee contracts for housing loans.
(2) A foundation may use own funds within the extent exceeding the minimum limit of own funds for grant of loan guarantees for the provision of financial services related to the performance of the main functions of the foundation and achieving other objectives specified in its articles of association pursuant to the procedure which the minister in charge of the policy sector has the right to establish.
§ 20. Tagatiste arvestus ja kontroll
Sihtasutus esitab Rahandusministeeriumile igal aastal valdkonna eest vastutava ministri poolt määratud tähtajaks auditeeritud aruande käesoleva seaduse alusel antud tagatiste, tagatislepingute alusel väljamakstud summade ja tehniliste eraldiste kohta. Valdkonna eest vastutaval ministril on õigus sihtasutuselt saada täiendavalt informatsiooni nii arvestatud tehniliste eraldiste kui tõenäoliselt väljamaksmisele kuuluvate summade katteks olemasolevate varade kohta.
Kontrolli sihtasutuse tegevuse üle teostab asutajaõiguste teostaja.

§ 20. Accounting and auditing of guarantees
(1) A foundation shall submit an audited report on the guarantees granted pursuant to this Act, on the amounts paid on the basis of guarantee contracts and on the technical reserves to the Ministry of Finance each year within the term determined by the minister in charge of the policy sector. The minister in charge of the policy sector has the right to obtain additional information on the calculated technical reserves and on the assets used for covering amounts likely to be payable from the foundation.
(2) The exerciser of the rights of the founder shall audit the activities of the foundation.
§ 21. Turu mõjutamise välistamine
Ettevõtlustoetuste väljastamine ja laenude tagamine käesoleva seaduse alusel toimub eeldusel, et toetatav ettevõtja ei ole turgu valitsev ettevõtja konkurentsiseaduse tähenduses ja väljastatavad riiklikud toetused ei anna toetuse saajale olulist konkurentsieelist, võrreldes teiste turul tegutsejatega.

§ 21. Preclusion of effects on market
Enterprise support shall be provided and guarantees shall be granted for loans on the basis of this Act provided that the undertaking supported is not an undertaking in a dominant position within the meaning of the Competition Act and that the state support granted does not enable the beneficiary of the support to have a significant competitive advantage compared to other undertakings operating in the market.

§ 22. Rakendussätted
Muud võimalikud ettevõtluse riikliku toetamise viisid sätestatakse eraldi seaduste või vastava aasta riigieelarve seadusega.
Sihtasutuse poolt ettevõtluslaenudele antud tagatised, mille aluseks olevad tagatis- või garantiilepingud on sõlmitud alates 2001. aasta 1. jaanuarist ja mis vastavad käesolevas seaduses sätestatud tingimustele, loetakse riiklikeks tagatisteks käesoleva seaduse tähenduses.
Sihtasutuse poolt elamumajanduslaenudele antud tagatised, mille aluseks olevad tagatis- või garantiilepingud on sõlmitud alates 2000. aasta 1. jaanuarist ja mis vastavad käesolevas seaduses sätestatud tingimustele, loetakse riiklikeks tagatisteks käesoleva seaduse tähenduses.
Enne käesoleva seaduse 2020. aasta 15. aprillil vastu võetud redaktsiooni jõustumist sõlmitud tagatislepingud viiakse kooskõlla nimetatud redaktsiooni § 8 lõikes 1 sätestatuga 2020. aasta 1. detsembriks, kui tagatise saaja on selleks soovi avaldanud hiljemalt 2020. aasta 1. oktoobril.
Enne käesoleva lõike jõustumist Vabariigi Valitsuse antud riigigarantiiga tagatud sihtasutuse antud ettevõtluslaenude tagatised loetakse riiklikeks tagatisteks käesoleva seaduse tähenduses ja arvatakse käesoleva lõike jõustumisel käesoleva seaduse § 19 lõikes 1 sätestatud ettevõtluslaenude tagatislepingute kogusumma hulka.

§ 22. Implementing provisions
(1) Other possible methods of state support of enterprise shall be provided by separate Acts or by the State Budget Act of the corresponding year.
(2) Guarantees granted for business loans by a foundation, which are based on guarantee contracts entered into on or after 1 January 2001 and which meet the conditions provided for in this Act, are deemed to be state guarantees within the meaning of this Act.
(3) Guarantees granted for housing loans by a foundation, which are based on guarantee contracts entered into on or after 1 January 2000 and which meet the conditions provided for in this Act, are deemed to be state guarantees within the meaning of this Act.
(4) Guarantee contracts entered into before the entry into force of the wording of this Act adopted on 15 April 2020 shall be brought into conformity with the provisions of subsection 1 of § 8 of the specified by 1 December 2020 if the beneficiary of a guarantee has expressed a wish for that purpose at the latest by 1 October 2020.
(5) Guarantees for business loans granted by a state-guaranteed foundation provided by the Government of the Republic before the entry into force of this subsection shall be deemed to be state guarantees for the purposes of this Act and shall be included in the total amount of guarantee contracts of business loans provided for in subsection 1 of § 19 of this Act.
