1. peatükk Üldsätted
§ 1. Seaduse reguleerimisala
Käesolev seadus sätestab otseste maksudega seotud maksukohustuse suuruse kindlaksmääramiseks vajalikud rahvusvahelise automaatse teabevahetusega seotud õigused ja kohustused.
Seaduse reguleerimisalasse jäävates, kuid käesolevas seaduses reguleerimata küsimustes kohaldatakse esmajärjekorras maksukorralduse seadust ja maksuseadusi.
Kui käesoleva seaduse regulatsioon erineb välislepingus sätestatust, kohaldatakse välislepingu sätteid.
§ 1. Scope of application of Act
(1) This Act provides the rights and obligations relating to international automatic exchange of information necessary for determination of the amount of tax liability related to direct taxes.
(2) The Taxation Act and Acts concerning a tax are primarily applied to the issues within the scope of application of this Act but not regulated in this Act.
(3) In case the regulation of this Act is different from the provisions of an international agreement, the provisions of the international agreement are applied.
§ 2. Terminid
Käesolevas seaduses kasutatakse termineid järgmises tähenduses:
maksuhaldur on Maksu- ja Tolliamet;
õiguslik moodustis on juriidilise isiku staatuseta isikuteühendus või varakogum ning isiku või juriidilise isiku staatuseta isikuteühenduse või varakogumi filiaal;
teabeandjale andmete esitaja on isik või õiguslik moodustis, kes käesoleva seaduse või muu õigusakti alusel esitab teabeandjale käesoleva seaduse täitmiseks kasutatavaid andmeid;
andmesubjekt on andmesubjekt isikuandmete kaitse seaduse tähenduses;
teabeandja on isik või õiguslik moodustis, kellele antakse käesoleva seadusega õigusi ja pannakse kohustusi; teabeandja ei ole maksuhaldur, teabeandjale andmete esitaja ega andmesubjekt;
välisriigi pädev ametiasutus on välisriigi isik või organ, kes on pädev ametiasutus välislepingu või Euroopa Liidu asjaomase õigusakti kohaselt;
teabevahetus on otseste maksudega seotud maksukohustuse suuruse kindlaksmääramiseks vajaliku teabe automaatne edastamine välislepingu alusel või Euroopa Liidu asjaomase õigusakti kohaselt maksuhaldurilt välisriigi pädevale ametiasutusele ja vastupidi;
teabe automaatne edastamine on teabe edastamine korrapäraselt, ilma taotluseta, kindlaksmääratud viisil ja mahus;
teabe kogumine on teabeandjalt teabevahetuseks vajaliku teabe saamine ja maksuhalduri poolt teabeandjalt teabevahetuseks vajaliku teabe nõudmine.
§ 2. Terms
In this Act the terms are used in the following meaning:
1) the tax authority is the Tax and Customs Board;
2) a legal arrangement is an association of persons or a pool of assets without the status of a legal person and a branch of an association of persons or a pool of assets without the status of a legal person;
3) an information source is a person or legal arrangement, which, on the basis of this Act or any other legislation, provides data to the information provider to be used for the compliance with this Act;
4) a data subject is the data subject for the purposes of the Personal Data Protection Act;
5) an information provider is a person or legal arrangement which is granted rights and imposed obligations by this Act; the information provider is not the tax authority, information source or data subject;
6) a competent authority of a foreign state is a foreign person or body that is a competent authority in accordance with an international agreement or the relevant legislation of the European Union;
7) the exchange of information is the automatic communication of information, needed to determine the amount of tax liability relating to direct taxes, on the basis of an international agreement or under the relevant legislation of the European Union, from the tax authority to a competent authority of a foreign state and the other way around;
8) the automatic communication of information is the communication of information on a regular basis, without request, in a specified manner and volume;
9) the collection of information is the obtaining of information necessary for the exchange of information from the information provider and the requesting by the tax authority of information, necessary for the exchange of information, from the information provider.
§ 3. Teabe kogumine
Käesoleva seaduse ning Eesti Vabariigi valitsuse ja Ameerika Ühendriikide valitsuse vahelise rahvusvahelise maksukuulekuse parandamise ja FATCA rakendamise kokkuleppe (edaspidi FATCA kokkulepe) täitmisega seotud maksuhalduri tegevustele kohaldatakse maksukorralduse seadust.
Käesoleva seaduse alusel kehtestatud deklaratsioonidele kohaldatakse maksukorralduse seaduses maksudeklaratsiooni kohta sätestatut, arvestades käesolevas seaduses sätestatut.
Maksuhaldur kogub teavet jooksva ja viie eelneva kalendriaasta kohta.
§ 3. Collection of information
(1) The Taxation Act is applied to the activities of the tax authority related to the compliance with this Act and the Agreement between the Government of the Republic of Estonia and the Government of the United States of America to Improve International Tax Compliance and to Implement FATCA (hereinafter the FATCA Agreement).
(2) The provisions concerning tax returns provided in the Taxation Act are applied to the declarations established based on this Act, taking into account the provisions of this Act.
(3) The tax authority collects information for the current year and five preceding calendar years.
§ 4. Teabevahetus
Maksuhalduril on teabevahetuse õigus.
Teabevahetus ei pea olema vastastikune.
Teabevahetusega võib olla hõlmatud jooksva ja viie eelneva kalendriaasta kohta maksuhalduri valduses olev kogu teave, mille vahetamist välisleping või asjaomane Euroopa Liidu õigusakt ette näeb, sealhulgas:
töösuhtest saadud tasu ning töövõtu- või käsunduslepingu või muu võlaõigusliku lepingu alusel makstud töö- või teenustasu;
juriidilise isiku juhtimis- või kontrollorgani liikmetele makstud tasu;
tulu elukindlustustoodetest, mille kohta ei vahetata teavet käesolevas seaduses sätestatud muul alusel;
makstud pension;
kinnisomand ja kinnisvaratulu;
litsentsitasu;
muu kui hoidmiskonto kaudu saadud dividenditulu, välja arvatud selline dividenditulu, mis on vabastatud äriühingu tulumaksust nõukogu direktiivi 2011/96/EL eri liikmesriikide ema- ja tütarettevõtjate suhtes kohaldatava ühise maksustamissüsteemi kohta (ELT L 345, 29.12.2011, lk 8–16) artikli 4, 5 või 6 kohaselt.
Maksuhaldur võib teabevahetuse toimimise täpsustamiseks sõlmida välisriigi pädeva ametiasutusega ametkondliku välislepingu.
§ 4. Exchange of information
(1) The tax authority has the right for the exchange of information.
(2) The exchange of information does not have to be mutual.
(3) The exchange of information may include all the information in the possession of the tax authority for the current year and five preceding calendar years, the exchange of which is prescribed by an international agreement or relevant legislation of the European Union, including:
1) remuneration from employment and remuneration or service fees paid on the basis of a contract for services or authorisation agreement or any other contract under the law of obligations;
2) remuneration paid to members of management or supervisory bodies of a legal person;
3) income from life insurance products in respect of which information is not exchanged on any other basis provided in this Act;
4) pension paid;
5) immovable property ownership and income from immovable property;
6) licence fee;
7) non-custodial dividend income, except such dividend income which is exempt from corporate income tax in accordance with Article 4, 5 or 6 of Council Directive 2011/96/EU on the common system of taxation applicable in the case of parent companies and subsidiaries of different Member States (OJ L 345, 29.12.2011, pp 8–16).
(4) The tax authority may enter into an administrative international agreement with a competent authority of a foreign state in order to specify the functioning of the exchange of information.
§ 4¹. Euroopa Liidu väline finantskontode alane ning riikidepõhise aruande alane teabevahetus
Käesoleva seaduse 1¹. peatükis sätestatut kohaldatakse ka Andorra Vürstiriigi, Liechtensteini Vürstiriigi, Monaco Vürstiriigi, San Marino Vabariigi ja Šveitsi Konföderatsiooniga sõlmitud Euroopa Liidu lepingute ning maksuasjades vastastikuse haldusabi konventsiooni (edaspidi konventsioon) artikli 6 alusel toimuvale finantskontode maksualasele automaatsele teabevahetusele.
Käesoleva seaduse 1., 2². ja 3. peatükis sätestatut kohaldatakse ka välislepingu kohasele ja konventsiooni artikli 6 alusel toimuvale riikidepõhise aruande alasele automaatsele teabevahetusele.
Käesoleva seaduse 2⁴. peatükis sätestatut kohaldatakse ka välislepingukohasele ja konventsiooni artikli 6 alusel toimuvale platvormialase teabe automaatsele vahetusele.
Käesoleva seaduse 1². peatükis sätestatut kohaldatakse ka välislepingukohasele ja konventsiooni artikli 6 alusel toimuvale krüptovara teabe automaatsele vahetusele.
Konventsiooni artikli 6 alusel toimuva finantskontode maksualase teabevahetusega seonduv teavitamis- ja järelevalvekohustus on maksuhalduril.
Käesoleva paragrahvi lõigetes 1 ja 1³ sätestatud välislepingukohase ning konventsiooni alusel toimuva automaatse teabevahetuse partnerriikide ja -jurisdiktsioonide nimekirjad avaldab Maksu- ja Tolliamet oma veebilehel.
§ 4¹. Non-European Union exchange of financial accounts and country-by-country report information
(1) The provisions of Chapter 1 of this Act are also applied to the automatic exchange of financial accounts information in the field of taxation based on the agreements concluded with the Principality of Andorra, the Principality of Liechtenstein, the Principality of Monaco, the Republic of San Marino and the Swiss Confederation as well as the Convention on Mutual Administrative Assistance in Tax Matters (hereinafter the Convention).
(1¹) The provisions of Chapters 1, 2² and 3 of this Act are also applied to the automatic exchange of country-by-country report information in accordance with an international agreement and based on Article 6 of the Convention.
(1²) The provisions of Chapter 2⁴ of this Act are also applied to the automatic exchange of platform-related information in accordance with international agreements and based on Article 6 of the Convention.
(1³) The provisions of Chapter 12 of this Act are also applied to the automatic exchange of information on crypto-assets under international agreements and based on Article 6 of the Convention.
(2) The tax authority has the information and supervision obligation related to the exchange of tax information of financial accounts based on Article 6 of the Convention.
(3) The Tax and Customs Board publishes on its website the lists of partner states and jurisdictions for the automatic exchange of information under international agreements and the Convention provided in subsections 1 and 1³ of this section.
§ 5. Teabe kasutamise piirang
Teabe kogumise ja teabevahetuse teel saadud teavet käsitatakse maksukorralduse seaduse tähenduses maksusaladusena.
Välislepingu alusel saadud teavet võib maksuhaldur avaldada maksukorralduse seaduse §-des 26–30 sätestatud tingimustel, arvestades välislepingus sätestatut.
Euroopa Liidu asjaomase õigusakti kohaselt saadud teavet võib maksuhaldur avaldada maksukorralduse seaduse §-des 26–30 sätestatud tingimustel, arvestades Euroopa Liidu asjaomases õigusaktis sätestatut.
§ 5. Restriction on use of information
(1) Information obtained by means of collection of information and exchange of information is regarded as tax secrecy for the purposes of the Taxation Act.
(2) Information obtained under an international agreement may be disclosed by the tax authority under the conditions provided in §§ 26–30 of the Taxation Act, taking into account the provisions of the international agreement.
(3) Information obtained in accordance with the relevant legislation of the European Union may be disclosed by the tax authority under the conditions provided in §§ 26–30 of the Taxation Act, taking into account the provisions of the relevant legislation of the European Union.
§ 6. Teabe kaitse ja töötlus
Käesoleva seaduse alusel toimuva andmete töötlemise eesmärk on:
võimaldada maksuhalduril ja välisriigi pädeval ametiasutusel õigesti ja kahtluseta kindlaks teha asjaomased maksukohustuslased, hallata ja jõustada maksualaseid õigusakte piiriülestes olukordades, hinnata maksudest kõrvalehoidumise toimepanemise tõenäosust ja vältida tarbetuid edasisi uurimisi;
täita FATCA kokkuleppega võetud käesoleva lõike punktis 1 nimetamata kohustusi.
Maksuhalduril ei ole lubatud kasutada riikidepõhise aruande alase teabevahetuse käigus saadavaid andmeid ainsa või peamise alusena tulumaksuseaduse § 8 lõikes 2 nimetatud siirdehinna korrigeerimisel.
Teabeandja teavitab kirjalikku taasesitamist võimaldavas vormis klienti ärisuhte loomisel rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses käesoleva seaduse alusel toimuvast teabe kogumisest, teabevahetusest ning teabe automaatsest edastamisest. Käesoleva lõike esimeses lauses sätestatut ei kohaldata teabeandja suhtes, kellel puudub teabevahetuseks kogutava teabe maksuhaldurile esitamise kohustus.
Lisaks isikuandmete kaitse seaduses sätestatud kohustustele peab maksuhaldur esitama andmesubjekti taotluse alusel väljavõtte jooksva ja viie eelneva kalendriaasta kohta teabe kogumise käigus saadud ning teabevahetuse käigus edastatud temaga seotud teabest ja seda teavet puudutavatest maksukorralduse seaduse § 51⁷ lõike 2 alusel antud lubadest.
Kui andmesubjekt tõendab, et jooksva või viie eelneva kalendriaasta kohta maksuhaldurile teabe kogumise käigus edastatud teave ei ole teabeandjast tingituna õige, esitab teabeandja esimesel võimalusel maksuhaldurile parandatud teabe.
Maksuhaldur edastab käesoleva paragrahvi lõike 4 kohaselt parandatud teabe asjaomasele välisriigi pädevale ametiasutusele ning taotleb eelnevalt edastatud teabe kustutamist.
Kui andmesubjekt tõendab, et maksuhaldur on jooksva või viie eelneva kalendriaasta kohta teabevahetuse käigus edastanud teavet sellise riigi pädevale ametiasutusele, mille maksuresident andmesubjekt ei olnud sellel perioodil, mille kohta teave käib, taotleb maksuhaldur asjaomase välisriigi pädevalt ametiasutuselt asjakohase teabe kustutamist.
§ 6. Information protection and processing
(1) The objective of the processing of information on the basis of this Act is:
1) to enable the tax authority and the competent authority of a foreign state to accurately and without doubt identify relevant taxable persons, to administer and enforce the legislation on taxes in cross-border situations, to evaluate the likelihood of tax evasions and to avoid further useless investigations;
2) to comply with obligations undertaken by the FATCA Agreement unspecified in clause 1 of this subsection.
(1¹) The tax authority is not permitted to use the data obtained during the automatic exchange of country-by-country report information as the sole or main basis for the transfer pricing adjustments specified in subsection 2 of § 8 of the Income Tax Act.
(2) Upon establishment of business relations, the information provider notifies the customer in a form reproducible in writing of the collection, exchange and automatic communication of information carried out based on this Act for the purposes of the Money Laundering and Terrorist Financing Prevention Act. The provisions of the first sentence of this subsection are not applied to an information provider who does not have an obligation to submit the information collected for exchange of information to the tax authority.
(3) In addition to the obligations provided in the Personal Data Protection Act, the tax authority must submit, at the request of the data subject, an extract of the information related thereto, obtained in the course of the collection of data for the current year and five previous calendar years and communicated in the course of the exchange of information, and of the authorisations granted on the basis of subsection 2 of § 51⁷ of the Taxation Act concerning this information.
(4) In case the data subject proves that information for the current year and five previous calendar years communicated to the tax authority during the collection of information is incorrect due to the information provider, the information provider submits the corrected information to the tax authority at the earliest opportunity.
(5) The tax authority communicates the information corrected in accordance with subsection 4 of this section to the competent authority of a foreign state and requests deletion of the information previously communicated.
(6) In case the data subject proves that the tax authority has, in the course of the exchange of information, communicated information for the current year and five previous calendar years to a competent authority of such a state where the data subject was not a tax resident during the period that the data concern, the tax authority requests the competent authority of a foreign state to delete the corresponding information.
§ 7. Kulude kandmine
Maksuhaldur ja teabeandja kannavad käesoleva seaduse täitmisega seonduvad oma kulud ise.
§ 7. Incurring costs
The tax authority and information provider bear their own costs relating to the compliance with this Act.
§ 7¹. Teabe kogumise vältimise eesmärgil tehtavad tehingud ja toimingud
Kui tehingu või toimingu sisust järeldub, et see on tehtud teabe kogumise vältimise eesmärgil, ei võeta seda käesoleva seaduse kohaldamisel arvesse.
§ 7¹. Transactions and acts performed to avoid collection of information
In case it follows from the content of a transaction or act that it has been performed to avoid collection of information, this is not taken into account upon application of this Act.
§ 8. Teabe kogumise ja teabevahetuse kohustuste täitmine
Teabeandjale andmete esitaja esitab nõude saamisel teabeandjale andmed, milleta ei ole teabeandjal võimalik käesolevat seadust täita. Andmed esitatakse 30 kalendripäeva jooksul, kui käesolevast seadusest tulenevalt ei ole ette nähtud lühemat tähtaega.
Kui müüja ei ole esitanud nõutud teavet platvormihaldurile vaatamata kahele meeldetuletusele, sulgeb platvormihaldur müüja konto ja takistab tal seda uuesti registreerida või jätab müüjale tasu üle andmata, kuni müüja esitab nõutud teabe. Neid meetmeid on lubatud rakendada pärast teise meeldetuletuse esitamist, kuid mitte enne 60 päeva möödumist teabe esmasest nõudmisest.
Kui krüptovara kasutajast klient ei ole esitanud krüptovarateenuse osutajale nõutud teavet vaatamata kahele meeldetuletusele, takistab krüptovarateenuse osutaja teha sellel kliendil tehinguid aruandekohustusega hõlmatud krüptovaraga seni, kuni klient esitab nõutud teabe. Neid meetmeid on lubatud rakendada pärast teise meeldetuletuse esitamist, kuid mitte enne 60 päeva möödumist teabe esmasest nõudmisest arvates.
Teabeandjale andmete esitaja tagab käesoleva seaduse täitmisel kasutatavate andmete õigsuse nende esitamisel teabeandjale.
Teabeandja säilitab käesolevast seadusest tulenevate kohustuste täitmist kinnitavaid tõendeid vähemalt jooksva ja kuue eelneva kalendriaasta kohta, kuid mitte rohkem kui kümme aastat, arvestades Euroopa Parlamendi ja nõukogu määruses (EL) 2016/679 füüsiliste isikute kaitse kohta isikuandmete töötlemisel ja selliste andmete vaba liikumise ning direktiivi 95/46/EÜ kehtetuks tunnistamise kohta (isikuandmete kaitse üldmäärus) (ELT L 119, 04.05.2016, lk 1–88) sätestatud eesmärgipärasuse põhimõtet.
Maksu- ja Tolliamet säilitab automaatse teabevahetuse teel saadud teavet maksukohustuslaste registris seitse aastat.
Kui teabeandja leiab, et jooksva või eelneva viie kalendriaasta kohta maksuhaldurile edastatud teave ei ole teabeandjast tingituna õige, esitab teabeandja esimesel võimalusel maksuhaldurile uuendatud teabe.
§ 8. Compliance with obligations of collection and exchange of information
(1) Upon receipt of the request the information source provides the information provider with the data without which the information provider is not able to comply with this Act. The data are submitted within 30 calendar days unless a shorter term is prescribed in accordance with this Act.
(1¹) Where the seller has not provided the required information to the platform manager despite two reminders, the platform manager closes the seller's account and prevents the seller from re-registering it or fails to hand over the payment to the seller until the seller provides the required information. The implementation of these measures is allowed after the second reminder is presented, but not before 60 days have passed since the initial request for information.
(1²) In case a client who is a crypto-asset user has not submitted the requested information to the crypto-asset service provider despite two reminders, the crypto-asset service provider prevents that client from making transactions with crypto-assets subject to the reporting obligation until the client submits the requested information. These measures may be applied after the presentation of the second reminder, but not before 60 days have passed as of the initial request for the information.
(2) The information source ensures the accuracy of data used for compliance with this Act upon the submission of the data to the information provider.
(3) The information provider retains evidence confirming the compliance with the obligations arising from this Act for at least the current year and six preceding calendar years, but not for more than ten years, taking into account the principle of expediency established in Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons upon the processing of personal data and on the free movement of such data, and on the repeal of Directive 95/46/EC (General Data Protection Regulation) (OJ L 119, 04.05.2016, pp 1–88).
(3¹) The Tax and Customs Board retains the information obtained through automatic exchange of information in the register of taxable persons for seven years.
(4) In case the information provider finds that the information for the current year or five preceding calendar years communicated to the tax authority is incorrect due to the information provider, the information provider submits the revised information to the tax authority at the earliest opportunity.
1¹. peatükk Finantskontode maksualase teabe automaatne vahetus Euroopa Liidus
§ 8¹. Finantskonto
Finantskonto käesoleva peatüki tähenduses on Eesti finantsasutuse peetav konto, mis vastab nõukogu direktiivi 2011/16/EL maksustamisalase halduskoostöö kohta ja direktiivi 77/799/EMÜ kehtetuks tunnistamise kohta (ELT L 64, 11.03.2011, lk 1–12) (edaspidi direktiiv) lisa 1 8. jao C jaotises sätestatud tingimustele.
Väärtpaberite keskdepositooriumi peetav finantskonto on konto, mis on avatud väärtpaberite registri pidamise seaduse § 6¹ või § 11 lõike 4 alusel või mille kontohaldur väärtpaberite registri pidamise seaduse tähenduses on mittearuandekohustuslik finantsasutus.
Käesoleva paragrahvi lõikes 2 nimetamata finantskonto loetakse väärtpaberite registri pidamise seaduse tähenduses kontohalduri peetavaks.
Teabevahetusest välistatud finantskonto käesoleva peatüki tähenduses on direktiivi lisa 1 8. jao C jaotise punktis 17 sätestatud tingimustele vastav konto, millele aruandlus- ja hoolsusmeetmeid ei kohaldata.
Direktiivi lisa 1 8. jao C jaotise punkti 17 alapunktis g sätestatud tingimustele vastav teabevahetusest välistatud muu kui direktiivis nimetatud finantskonto on:
pensionileping kogumispensionide seaduse § 45 lõike 1 tähenduses;
Repealed
väärtpaberikonto, kus ei ole registreeritud muid osakuid peale kogumispensionide seaduses nimetatud kohustusliku ja vabatahtliku pensionifondi osakute.
§ 8¹. Financial account
(1) For the purposes of this Chapter a financial account is an account kept by an Estonian financial institution, which satisfies all the requirements in accordance with the conditions provided in Division C of Subchapter 8 of Annex I of the Council Directive 2011/16/EU on administrative cooperation in the field of taxation and repealing Directive 77/799/EEC ( OJ L 64, 11.03.2011, pp 1–12) (hereinafter the Directive).
(2) The financial account kept by the Estonian Central Securities Depository is a financial account which is opened based on § 6¹ or subsection 4 of § 11 of the Securities Register Maintenance Act, or the account manager of which is, for the purposes of the Securities Register Maintenance Act, a non-reporting financial institution.
(3) A financial account not specified in subsection 2 of this section is deemed to be kept by the account manager for the purposes of the Securities Register Maintenance Act.
(4) A financial account excluded from the exchange of information for the purposes of this Chapter is an account complying with clause 17 of Division C of Subchapter 8 of Annex 1 of the Directive to which the reporting and due diligence measures are not applied.
(5) A financial account other than that specified in the Directive precluded from the exchange of information complying with subclause g of clause 17 of Division C of Subchapter 7 Annex 1 of the Directive is:
1) a pension contract for the purposes of subsection 1 of § 45 of the Funded Pensions Act;
3) a securities account where no other units are registered except for the units of mandatory and voluntary pension funds specified in the Funded Pensions Act.
§ 8². Finantskontode maksualane teave
Finantskontode maksualane teave käesoleva peatüki tähenduses on finantskonto pidamisega seonduv aruandekohustusliku Eesti finantsasutuse poolt maksuhaldurile esitatav direktiivi artikli 8 lõikes 3a nimetatud teave.
Aruandlus- ja hoolsusmeetmed käesoleva peatüki tähenduses on direktiivi lisades 1 ja 2 sätestatud finantskontode maksualase teabe väljaselgitamiseks kohaldatavad aruandlus- ja hoolsusmeetmed.
Finantskontode maksualane teave võib olla hõlmatud teabevahetusega.
Finantskontode maksualase teabe hulka kuuluva tulu liik määratakse kindlaks ja nimetatud tulu liigi, kontojäägi ja kontoväärtuse suurus leitakse eurodes, arvestades tulumaksuseaduses sätestatut.
Finantskontode maksualase teabe deklaratsioonide vormid ning deklaratsioonide esitamise ja täitmise korra kehtestab valdkonna eest vastutav minister määrusega.
§ 8². Tax information of financial accounts
(1) For the purposes of this Chapter tax information of financial accounts is the information specified in subsection 3a of Article 8 of the Directive related to the keeping of a financial account submitted to the tax authority by a reporting Estonian financial institution.
(2) Reporting and due diligence measures for the purposes of this Chapter are reporting and due diligence measures applicable to identification of tax information of financial accounts provided in Annexes 1 and 2 of the Directive.
(3) The exchange of information may include tax information of financial accounts.
(4) The type of income included in the tax information of financial accounts is determined and the type, balance or value of an account of the specified income are calculated in euros, taking account of the provisions of the Income Tax Act.
(5) The tax information declaration forms for financial accounts and the procedure for submission and fulfilling the declarations are established by a regulation of the minister in charge of the policy sector.
§ 8³. Teabeandja
Teabeandja käesoleva peatüki tähenduses on Eesti finantsasutus.
Aruandekohustuslik Eesti finantsasutus käesoleva peatüki tähenduses on direktiivi lisa 1 8. jao A jaotises sätestatud tingimustele vastav Eestis asutatud või moodustatud asutus või välisriigi asutuse Eesti filiaal.
Mittearuandekohustuslik Eesti finantsasutus käesoleva peatüki tähenduses on direktiivi lisa 1 8. jao B jaotises sätestatud tingimustele vastav Eesti finantsasutus, kes on vabastatud aruandlus- ja hoolsusmeetmete kohaldamisest.
Direktiivi lisa 1 8. jao B jaotise punkti 1 alapunktis c sätestatud tingimustele vastav muu kui direktiivis nimetatud mittearuandekohustuslik Eesti finantsasutus on kohustuslik pensionifond ja vabatahtlik pensionifond kogumispensionide seaduse § 3 tähenduses.
§ 8³. Information provider
(1) An information provider for the purposes of this Chapter is an Estonian financial institution.
(2) For the purposes of this Chapter a reporting Estonian financial institution is an institution established or formed in Estonia or an Estonian branch of a foreign institution which complies with the conditions provided in Division A of Subchapter 8 of Annex 1 of the Directive.
(3) For the purposes of this Chapter a non-reporting Estonian financial institution is an Estonian financial institution, complying with the conditions provided in Division B of Subchapter 8 of Annex 1 of the Directive, which is exempt from applying reporting and due diligence measures.
(4) For the purposes of § 3 of the Funded Pension Act the mandatory pension fund and the voluntary pension fund are non-reporting Estonian financial institutions, other than those specified in the Directive, complying with the conditions provided in subclause c of clause 1 of Division B of Subchapter 8 of Annex 1 of the Directive.
§ 8⁴. Kontrolliv isik
Ettevõtet kontrolliva isiku kindlakstegemisel käesoleva peatüki tähenduses lähtutakse tegeliku kasusaaja määratlusest rahapesu ja terrorismi rahastamise tõkestamise seaduses.
§ 8⁴. Controlling person
For the purposes of this Chapter the identification of the controlling person of a company is based on the definition of the beneficial owner in the Money Laundering and Terrorist Financing Prevention Act.
§ 8⁵. Kontoomaniku ja kontrolliva isiku kinnitus
Füüsilisest isikust kontoomaniku ja ettevõtet kontrolliva füüsilise isiku kinnitus on kirjalikus või kirjalikku taasesitamist võimaldavas vormis kinnitus isiku maksuresidentsuse kohta, mis sisaldab vähemalt järgmisi andmeid:
kontoomaniku või ettevõtet kontrolliva isiku nimi;
elukoha aadress;
maksuresidentsused;
maksukohustuslase identifitseerimisnumber või -numbrid;
sünniaeg;
sünnikoht riigi või jurisdiktsiooni täpsusega;
kinnituse esitamise aeg.
Ettevõtet kontrolliva füüsilise isiku eest võib kinnituse esitada kontoomanik.
§ 8⁵. Confirmation of account holder and controlling person
(1) The confirmation of an account holder that is a natural person and of the controlling person of the company that is a natural person is a confirmation of tax residency of the person in writing or in a form reproducible in writing, which includes at least the following data::
1) the name of the account holder or of a controlling person of the company;
2) address of the place of residence;
3) tax residences;
4) the identification number(s) of the taxable person;
5) the date of birth;
6) the place of birth to the accuracy of the state or jurisdiction;
7) the time of submitting the confirmation.
(2) The account holder may submit the confirmation on behalf of the controlling person of the company who is a natural person.
§ 8⁶. Teabeandja kohustused
Teabeandja hoidub tegevusest, mille eesmärk on finantskontode maksualase teabe kogumisest kõrvalehoidumine.
Aruandekohustuslik Eesti finantsasutus kohaldab käesoleva seaduse § 8² lõikes 2 nimetatud aruandlus- ja hoolsusmeetmeid ning tuvastab igal aastal enda peetavate finantskontode maksualase teabe. Aruandekohustuslik Eesti finantsasutus esitab mitteresidendist kontoomaniku andmed, samuti ettevõtte ja tema mitteresidendist kontrolliva isiku andmed, kui selline kontoomanik või kontrolliv isik on aruandekohustusega hõlmatud isik ning Maksu- ja Tolliameti veebilehel avaldatud loetelus oleva riigi või jurisdiktsiooni maksuresident.
Aruandekohustuslik Eesti finantsasutus esitab maksuhaldurile käesoleva paragrahvi lõike 2 kohaselt tuvastatud finantskontode maksualase teabe eelmise kalendriaasta kohta elektroonse deklaratsiooniga iga aasta 30. juuniks.
§ 8⁶. Obligations of information provider
(1) The information provider refrains from any action aimed at evasion of the collection of tax information of financial accounts.
(2) A reporting Estonian financial institution applies the reporting and due diligence measures specified in subsection 2 of § 8² of this Act and identifies annually the tax information of financial accounts maintained thereby. A reporting Estonian financial institution submits the data of a non-resident account holder, as well as the data of the company and its non-resident controlling person, in case such account holder or controlling person is a person subject to the reporting obligation and is a tax resident of a country or jurisdiction included in the list published on the website of the Tax and Customs Board.
(3) A reporting Estonian financial institution submits to the tax authority the tax information of financial accounts, identified in accordance with subsection 2 of this section, for the previous calendar year by 30 June annually by electronic declaration.
§ 8⁷. Kohustuste täitmine kolmanda isiku kaudu
Aruandekohustuslik Eesti finantsasutus võib käesolevas peatükis sätestatud kohustusi täita kolmanda isiku kaudu. Vastutus kohustuste täitmise eest lasub aruandekohustuslikul Eesti finantsasutusel.
§ 8⁷. Compliance with obligations through third party
A reporting Estonian financial institution may perform the obligations provided in this Chapter through a third party. The reporting Estonian financial institution bears liability for the compliance with the obligations.
1². peatükk Krüptovara teabe automaatne vahetus
§ 8⁹. Krüptovara
Aruandekohustusega hõlmatud krüptovara on Euroopa Parlamendi ja nõukogu määruse (EL) 2023/1114, mis käsitleb krüptovaraturge ning millega muudetakse määrusi (EL) nr 1093/2010 ja (EL) nr 1095/2010 ning direktiive 2013/36/EL ja (EL) 2019/1937 (ELT L 150, 09.06.2023, lk 40–205), artikli 3 lõike 1 punktis 5 määratletud krüptovara.
Aruandekohustusega ei ole hõlmatud:
direktiivi lisa 6 4. jao A jaotise punktis 5 nimetatud e-raha;
keskpanga või muu keskse rahaasutuse välja antud digitaalne usaldusraha;
krüptovara, mille puhul on krüptovarateenuse pakkuja usaldusväärselt kindlaks määranud, et seda ei saa kasutada maksevahendina ega investeerimiseks.
§ 8⁹. Crypto-assets
(1) Crypto-assets subject to the reporting obligation are crypto-assets as defined in clause 5 of subsection 1 of Article 3 of Regulation (EU) 2023/1114 of the European Parliament and of the Council on markets in crypto-assets and amending Regulations (EU) No 1093/2010 and (EU) No 1095/2010 and Directives 2013/36/EU and (EU) 2019/1937 (OJ L 150, 09.06.2023, pp 40–205).
(2) The reporting obligation does not cover:
1) e-money specified in clause 5 of Division A of Subchapter 4 of Annex 6 to the Directive;
2) digital fiat currency issued by a central bank or another central financial institution;
3) crypto-assets in respect of which the crypto-asset service provider has reliably determined that the crypto-assets cannot be used as a means of payment or for investment.
§ 8¹⁰. Krüptovara teave
Aruandekohustusega hõlmatud krüptovara teave käesoleva peatüki tähenduses on krüptovarateenuste osutamisega seotud aruandekohustusliku krüptovarateenuse osutaja direktiivi lisa 6 2. jaos sätestatud aruandlusnõuete kohaselt maksuhaldurile esitatav direktiivi artikli 8ad lõikes 3 nimetatud teave aruandekohustusega hõlmatud krüptovara kasutajate ja kontrollivate isikute ning aruandekohustusega hõlmatud krüptovara tehingute kohta.
Krüptovara tehingud on direktiivi lisa 6 4. jao C jaotises nimetatud aruandekohustusega hõlmatud krüptovara vahetamise ja ülekandmise tehingud ning kaupade ja teenuste eest krüptovaraga tasumise tehingud, mille väärtus ületab 50 000 USA dollarit.
Krüptovara teave võib olla hõlmatud teabevahetusega.
Krüptovara teabe deklaratsioonide vormid ning deklaratsioonide esitamise ja täitmise korra kehtestab valdkonna eest vastutav minister määrusega.
§ 8¹⁰. Crypto-asset information
(1) For the purposes of this Chapter, crypto-asset information subject to the reporting obligation means the information, specified in subsection 3 of Article 8ad of the Directive, about the users and controlling persons of crypto-assets subject to reporting obligation as well as transactions in crypto-assets subject to reporting obligation, to be submitted to the tax authority by a reporting crypto-asset service provider involved in the provision of crypto-asset services, in accordance with the reporting requirements set out in Subchapter 2 of Annex 6 to that Directive.
(2) Crypto-asset transactions are transactions for the exchange and transfer of crypto-assets subject to reporting obligation specified in Division C of Subchapter 4 of Annex 6 to this Directive as well as transactions for payment for goods and services with crypto-assets the value of which exceeds 50,000 US dollars.
(3) Crypto-asset information may be covered by information exchange.
(4) The forms for the declarations of crypto-asset information and the procedure for submitting and filling in the declarations is established by a regulation of the minister in charge of the policy sector.
§ 8¹¹. Teabeandja
Teabeandja käesoleva peatüki tähenduses on direktiivi lisa 6 1. jaos sätestatud tingimustele vastav Eesti krüptovarateenuse osutaja.
Aruandekohustuslik Eesti krüptovarateenuse osutaja käesoleva peatüki tähenduses on direktiivi lisa 6 1. jaos nimetatud isik või õiguslik moodustis, kes osutab krüptovarateenuseid, mis võimaldavad aruandekohustusega hõlmatud krüptovara kasutajatel teha aruandekohustusega hõlmatud tehinguid krüptovaraga.
Krüptovarateenus on Euroopa Parlamendi ja nõukogu määruse (EL) 2023/1114 artikli 3 lõike 1 punktis 16 nimetatud teenus, samuti krüptovara laenamine ja panustamine.
§ 8¹¹. Information provider
(1) For the purposes of this Chapter, an information provider is an Estonian crypto-asset service provider that meets the conditions provided in Subchapter 1 of Annex 6 to the Directive.
(2) For the purposes of this Chapter, a reporting Estonian crypto-asset service provider is a person or legal arrangement specified in Subchapter 1 of Annex 6 to the Directive that provides crypto-asset services enabling users of crypto-assets subject to reporting obligation to carry out transactions in crypto-assets subject to reporting obligation.
(3) Crypto-asset service is a service specified in clause 16 of subsection 1 of Article 3 of Regulation (EU) 2023/1114 of the European Parliament and of the Council, as well as crypto-asset lending and betting.
§ 8¹². Krüptovara kasutaja
Aruandekohustusega on hõlmatud direktiivi lisa 6 4. jao D jaotises nimetatud füüsilisest või juriidilisest isikust või õiguslikust moodustisest krüptovara kasutaja, kes on Eesti resident tulumaksuseaduse § 6 tähenduses või Euroopa Liidu liikmesriigi või muu teabevahetuse partnerriigi või -jurisdiktsiooni resident.
Aruandekohustusega ei ole hõlmatud direktiivi lisa 6 4. jao E jaotises nimetatud vabastatud isik.
Aruandekohustusega hõlmatud krüptovara kasutaja tuvastatakse direktiivi lisa 6 3. jaos sätestatud hoolsusmeetmeid kohaldades.
§ 8¹². Crypto-asset user
(1) The reporting obligation covers a crypto-asset user who is a natural or legal person or a legal arrangement specified in Division D of Subchapter 4 of Annex 6 to the Directive and who is a resident of Estonia for the purposes of § 6 of the Income Tax Act or a resident of a Member State of the European Union or another partner country or jurisdiction for the exchange of information.
(2) The reporting obligation does not cover the exempted person specified in Division E of Subchapter 4 of Annex 6 to the Directive.
(3) A crypto-asset user subject to the reporting obligation is identified by applying the due diligence measures provided in Division 3 of Annex 6 to the Directive.
§ 8¹³. Kontrolliv isik
Juriidilisest isikust või õiguslikust moodustisest aruandekohustusega hõlmatud krüptovara kasutaja kontrolliva isiku kindlakstegemise korral lähtutakse tegeliku kasusaaja määratlusest rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses.
§ 8¹³. Controlling person
The identification of the controlling person of a crypto-asset user who is a legal person or a legal arrangement subject to the reporting obligation is based on the definition of the beneficial owner for the purposes of the Money Laundering and Terrorist Financing Prevention Act.
§ 8¹⁴. Aruandekohustusega hõlmatud krüptovara kasutaja ja kontrolliva isiku residentsuse kinnitus
Teabeandja nõuab kliendilt hoolsusmeetmete kohaldamisel tema residentsuse kinnitust.
Aruandekohustusega hõlmatud krüptovara kasutaja ja kontrolliva isiku residentsuse kinnitus on kirjalikus või kirjalikku taasesitamist võimaldavas vormis kinnitus isiku residentsuse kohta, mis sisaldab vähemalt järgmisi andmeid:
füüsilise isiku ees- ja perekonnanimi või juriidilise isiku või õigusliku moodustise ärinimi;
füüsilise isiku elukoha aadress või juriidilise isiku aadress;
Euroopa Liidu liikmesriigid, mille resident isik on;
maksukohustuslasena registreerimise number igas Euroopa Liidu liikmesriigis;
füüsilise isiku sünniaeg;
juriidilist isikut või õiguslikku moodustist, kes ei ole aktiivne üksus ega vabastatud isik, kontrolliva isiku rollid, mille alusel ta on kontrolliv isik, kui see ei ole varem välja selgitatud;
asjakohasel juhul teave selle kohta, milliste kriteeriumide täitmise korral käsitatakse juriidilist isikut või õiguslikku moodustist aktiivse üksuse või vabastatud isikuna.
Kontrolliva isiku eest võib kinnituse esitada juriidiline isik või õiguslik moodustis.
Käesoleva seaduse tähenduses finantsasutuseks olev aruandekohustuslik krüptovarateenuse osutaja võib hoolsusmeetmete kohaldamise korral tugineda ka käesoleva seaduse 1¹. peatüki alusel kohaldatud hoolsusmeetmetele. Aruandekohustuslik krüptovarateenuse osutaja võib sellisel juhul tugineda ka muule samaväärsele kinnitusele, mis vastab käesolevas paragrahvis sätestatud tingimustele.
§ 8¹⁴. Confirmation of residency of user and controlling person of crypto-assets subject to reporting obligation
(1) Upon application of due diligence measures, the information provider requires the client to confirm their residency.
(2) The confirmation of residency of the user and controlling person of crypto-assets subject to the reporting obligation is the confirmation of residency of the person in writing or in a form reproducible in writing, which includes at least the following information:
1) the given name and surname of the natural person or the business name of the legal person or legal arrangement;
2) the address of residence of the natural person or the address of the legal person;
3) the Member States of the European Union of which the person is a resident;
4) the tax identification number in each Member State of the European Union;
5) the date of birth of the natural person;
6) the roles of the controlling person of a legal person or legal arrangement that is not an active entity nor an exempted person, the roles of the controlling person based on which they are a controlling person, unless this has been previously identified;
7) where applicable, information on the criteria under which the legal person or legal arrangement is considered to be an active entity or an exempted person.
(3) On behalf of the controlling person the confirmation may be submitted by a legal person or a legal arrangement.
(4) A reporting crypto-asset service provider that is a financial institution for the purposes of this Act may, in the case of the application of due diligence measures, also rely on the due diligence measures applied based on Chapter 1¹ of this Act. In such a case, a reporting crypto-asset service provider may also rely on other equivalent confirmation that complies with the conditions provided in this section.
§ 8¹⁵. Teabeandja kohustused
Teabeandja hoidub tegevusest, mille eesmärk on krüptovara teabe kogumisest ja esitamisest kõrvale hoida.
Teabeandja tuvastab teabe aruandekohustusega hõlmatud krüptovara tehingute kohta direktiivi lisa 6 2. jaos sätestatud aruandlusnõuete kohaselt ja aruandekohustusega hõlmatud krüptovara kasutajad direktiivi lisa 6 3. jaos sätestatud hoolsusmeetmete kohaselt.
Teabeandja esitab maksuhaldurile käesoleva paragrahvi lõike 2 kohaselt tuvastatud aruandekohustusega hõlmatud krüptovara teabe eelmise kalendriaasta kohta elektroonse deklaratsiooniga iga aasta 30. juuniks.
Teabeandja võib täita hoolsusmeetmete kohaldamisega seotud kohustusi kolmanda isiku kaudu. Vastutus kohustuste täitmise eest lasub teabeandjal.
§ 8¹⁵. Obligations of information provider
(1) An information provider refrains from activities aimed at evading the collection and submission of crypto-asset information.
(2) An information provider identifies the information on transactions in crypto-assets subject to the reporting obligation in accordance with the reporting requirements provided in Subchapter 2 of Annex 6 to the Directive and the users of crypto-assets subject to the reporting obligation in accordance with the due diligence measures provided in Subchapter 3 of Annex 6 to the Directive.
(3) The information provider submits to the tax authority the information on crypto-assets subject to the reporting obligation, identified in accordance with subsection 2 of this section, for the previous calendar year by means of an electronic return by 30 June of each year.
(4) The information provider may perform the obligations related to the application of due diligence measures through a third party. The responsibility for the performance of the obligations lies with the information provider.
§ 8¹⁶. Krüptovarateenuse osutaja registreerimine
Maksuhalduri juures on kohustatud end registreerima direktiivi lisa 6 1. jao A jaotise lõikes 2 ja B jaotises nimetatud krüptovarateenuse osutaja, kes ei tegutse Euroopa Parlamendi ja nõukogu määruse (EL) 2023/1114 reguleerimisalas, kuid kes võimaldab aruandekohustusega hõlmatud krüptovara kasutajal teha aruandekohustusega hõlmatud krüptovara tehinguid.
Krüptovarateenuse osutaja registreerib end maksuhalduri juures enne käesoleva seaduse § 8¹⁵ lõikes 3 nimetatud teabe esitamise tähtaja möödumist direktiivi lisa 6 5. jao F jaotise kohaselt.
Registreerimisriigi tuvastamise korral lähtub krüptovarateenuse osutaja direktiivi lisa 6 1. jao A jaotise lõikes 2 sätestatud kriteeriumidest.
Registreerimise korral esitab krüptovarateenuse osutaja maksuhaldurile järgmised andmed:
nimi;
postiaadress;
elektronposti aadress, sealhulgas veebiaadress;
maksukohustuslasena registreerimise numbrid;
Euroopa Liidu liikmesriigid, mille residendid tema kliendid on;
Euroopa Liidu välised jurisdiktsioonid, kellega krüptovarateenuse osutajal on direktiivi kohane puutumus ning kellel on sõlmitud käesoleva seaduse § 4¹ lõikes 1³ nimetatud leping kõigi asjaomaste Euroopa Liidu liikmesriikidega.
Krüptovarateenuse osutaja teavitab maksuhaldurit viivitamata käesoleva paragrahvi lõikes 4 loetletud andmete muutumisest.
Maksuhaldur annab krüptovarateenuse osutajale registreerimisnumbri ja teavitab sellest teisi Euroopa Liidu liikmesriikide pädevaid ametiasutusi.
Maksuhaldur tunnistab krüptovarateenuse osutaja registreeringu kehtetuks, kui:
krüptovarateenuse osutaja teavitab maksuhaldurit, et tema klientide hulgas ei ole enam aruandekohustusega hõlmatud krüptovara kasutajaid;
maksuhalduril on alust arvata, et krüptovarateenuse osutaja tegevus on lõppenud;
krüptovarateenuse osutaja ei vasta enam direktiivi lisa 6 4. jao B jaotise lõikes 2 sätestatud tingimustele;
krüptovarateenuse osutaja ei täida nõuetekohaselt maksuhaldurile teabe esitamise kohustust vaatamata korduvatele meeldetuletustele.
Käesoleva paragrahvi lõike 7 punktis 4 nimetatud juhul tunnistatakse registreering kehtetuks hiljemalt 90 päeva möödumisel arvates teabe esitamise tähtpäevast, kuid mitte enne 30 päeva möödumist arvates viimasest meeldetuletusest.
Maksuhaldur teavitab Euroopa Komisjoni sellisest krüptovarateenuse osutajast, kes jätab end nõuetekohaselt registreerimata.
Maksuhaldur teeb koostööd teiste Euroopa Liidu liikmesriikidega, et tagada krüptovarateenuse osutaja registreerimiskohustuse täitmine.
Käesoleva paragrahvi lõike 7 punktis 4 nimetatud juhul kehtetuks tunnistatud registreering taastatakse juhul, kui krüptovarateenuse osutaja esitab maksuhaldurile piisavad kinnitused käesolevast seadusest tulenevate kohustuste täitmise kohta ja esitab § 8¹⁵ lõikes 3 nimetatud teabe, mis oli jäänud tähtajaks esitamata.
§ 8¹⁶. Registration of crypto-asset service provider
(1) A crypto-asset service provider specified in subsection 2 of Division A and in Division B of Subchapter 1 of Annex 6 to the Directive, who does not operate within the scope of Regulation (EU) 2023/1114 of the European Parliament and of the Council, but who enables the user of crypto-assets subject to the reporting obligation to carry out transactions in the crypto-assets subject to the reporting obligation, is required to register with the tax authorities.
(2) A crypto-asset service provider registers with the tax authority before the expiry of the deadline for submission of the information specified in subsection 3 of § 8¹⁵ of this Act in accordance with Division F of Subchapter 5 of Annex 6 to the Directive.
(3) Upon identification of the country of registration, the crypto-asset service provider proceeds from the criteria provided in subsection 2 of Division A of Subchapter 1 of Annex 6 to the Directive.
(4) Upon registration, the crypto-asset service provider submits the following information to the tax authority:
1) name;
2) postal address;
3) e-mail address, including web address;
4) tax identification numbers;
5) the Member States of the European Union in which its clients are residents;
6) jurisdictions outside the European Union with which the crypto-asset service provider has a connection for the purposes of the Directive and which have entered into an agreement specified in subsection 1³ of § 4¹ of this Act with all relevant Member States of the European Union.
(5) A crypto-asset service provider immediately notifies the tax authority of any changes in the data listed in subsection 4 of this section.
(6) The tax authority issues a registration number to the crypto-asset service provider and notifies the competent authorities of other Member States of the European Union thereof.
(7) The tax authority revokes the registration of a crypto-asset service provider in case:
1) the crypto-asset service provider notifies the tax authority that its clients no longer include users of crypto-assets subject to the reporting obligation;
2) the tax authority has reason to believe that the activities of the crypto-asset service provider have ceased;
3) the crypto-asset service provider no longer complies with the conditions set out in subsection 2 of Division B of Subchapter 4 of Annex 6 to the Directive;
4) the crypto-asset service provider fails to duly comply with the obligation to submit information to the tax authority despite repeated reminders.
(8) In the case specified in clause 4 of subsection 7 of this section, the registration is declared invalid at the latest 90 days after the expiry of the due date for submission of the information, but not before 30 days have passed as of the last reminder.
(9) The tax authority notifies the European Commission of such a crypto-asset service provider that fails to register in accordance with the requirements.
(10) The tax authority cooperates with other Member States of the European Union in order to ensure compliance with the registration obligation by the crypto-asset service provider.
(11) A registration declared invalid in the case specified in clause 4 of subsection 7 of this section is restored in case the crypto-asset services provider submits sufficient evidence to the tax authority concerning the performance of the obligations arising from this Act and submits the information, specified in subsection 3 of § 8¹⁵, which had not been submitted by the due date.

§ 9. FATCA kokkuleppe kohaldamine
FATCA kokkuleppe täitmisel lähtutakse eelkõige FATCA kokkuleppest, arvestades käesolevas seaduses sätestatut.
§ 9. Application of FATCA Agreement
Implementation of the FATCA Agreement is based in particular on the FATCA Agreement, taking into account the provisions of this Act.
§ 10. Teabeandjachanges 31.03.2029
Teabeandja käesoleva peatüki tähenduses on Eesti finantsasutus.
Eesti finantsasutus on FATCA kokkuleppe artikli 1 lõike 1 punkti g tingimustele vastav Eestis asutatud või moodustatud asutus, sealhulgas:
krediidiasutus ja välisriigi krediidiasutuse Eesti filiaal;
hoiu-laenuühistu;
investeerimisühing ja välisriigi investeerimisühingu Eesti filiaal;
fondivalitseja ja välisriigi fondivalitseja Eesti filiaal;
investeerimisfond;
elukindlustusega tegelev kindlustusandja ja välisriigi kindlustusandja Eesti filiaal;
väärtpaberite keskdepositoorium.
Väärtpaberite keskdepositooriumi peetavad finantskontod on finantskontod, mis on avatud väärtpaberite registri pidamise seaduse § 11 lõike 4 alusel või mille kontohaldur väärtpaberite registri pidamise seaduse tähenduses on mitteosalev finantsasutus.
Käesoleva paragrahvi lõikes 3 nimetamata finantskontosid loetakse väärtpaberite registri pidamise seaduse tähenduses kontohalduri peetavateks.
§ 10. Information provider
(1) An information provider for the purposes of this Chapter is an Estonian financial institution.
(2) The Estonian financial institution is an institution established or constituted in Estonia in accordance with the conditions of clause g of subsection 1 of Article 1 of the FATCA Agreement, including:
1) a credit institution and the Estonian branch of a foreign credit institution;
2) a savings and loan association;
3) an investment firm and the Estonian branch of a foreign investment firm;
4) a management company and the Estonian branch of a foreign management company;
5) an investment fund;
6) an insurer engaged in life insurance and the Estonian branch of a foreign insurer;
7) a central securities depository.
(3) The financial accounts kept by a central securities depository are financial accounts which are opened on the basis of subsection 4 of § 11 the Securities Register Maintenance Act, or the account manager of which is, for the purposes of the Securities Register Maintenance Act, a non-participating financial institution.
(4) The financial accounts not specified in subsection 3 of this section are deemed to be kept by the account manager for the purposes of the Securities Register Maintenance Act.
§ 11. FATCA kokkuleppe täitmisega seotud täiendavad terminid
Eesti rahandusministri esindaja FATCA kokkuleppe artikli 1 lõike 1 punkti f alapunkti 2 tähenduses on maksuhaldur.
Kontrolliv isik FATCA kokkuleppe artikli 1 lõike 1 punkti mm tähenduses on tegelik kasusaaja rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses.
Füüsilisest isikust kontoomaniku ja ettevõtet kontrolliva füüsilise isiku kinnitus on kirjalikus või kirjalikku taasesitamist võimaldavas vormis kinnitus isiku maksuresidentsuse kohta, mis sisaldab vähemalt järgmisi andmeid:
kontoomaniku või ettevõtet kontrolliva isiku nimi;
elukoha aadress;
maksuresidentsused;
maksukohustuslase identifitseerimisnumber või -numbrid;
sünniaeg;
sünnikoht riigi või jurisdiktsiooni täpsusega;
kinnituse esitamise aeg.
Ettevõtet kontrolliva füüsilise isiku eest võib kinnituse esitada kontoomanik.
Hoolsusmeetmed on FATCA kokkuleppe I lisas kirjeldatud meetmed.
§ 11. Additional terms related to compliance with FATCA Agreement
(1) The representative of the Minister of Finance of Estonia is the tax authority for the purposes of subclause 2 of clause f of subsection 1 of Article 1 of the FATCA Agreement.
(2) The controlling person for the purposes of clause mm of subsection 1 of Article 1 of the FATCA Agreement is the beneficial owner for the purposes of the Money Laundering and Terrorist Financing Prevention Act.
(3) The confirmation of an account holder that is a natural person and of a controlling person of the company that is a natural person is a confirmation of the tax residency of the person in writing or in a form reproducible in writing, which includes at least the following data:
1) the name of the account holder or of a controlling person of the company;
2) address of the place of residence;
3) tax residences;
4) the identification number or numbers of the taxable person;
5) the date of birth;
6) the place of birth to the accuracy of the state or jurisdiction;
7) the time of submitting the confirmation.
(4) The account holder may submit confirmation on behalf of the natural person who is controlling the company.
(5) The due diligence measures are the measures described in Annex I to the FATCA Agreement.
§ 12. Kohustuste täitmine kolmanda isiku kaudu
Aruandekohustuslik Eesti finantsasutus võib käesolevas peatükis sätestatud kohustusi, sealhulgas deklaratsiooni esitamise kohustust, täita kolmanda isiku kaudu FATCA kokkuleppe I lisa VI osa punktis F nimetatud ulatuses. Kohustuste täitmisega seotud vastutus on aruandekohustuslikul Eesti finantsasutusel.
§ 12. Performance of obligations through third party
A reporting Estonian financial institution may perform the obligations provided in this Chapter through a third party, including the obligation to submit the declaration, to the extent specified in clause F of Part VI of Annex I of the FATCA Agreement. The responsibility related to the compliance with the obligations relies on the reporting Estonian financial institution.
§ 13. FATCA kokkuleppe kohaldamise erisus
Eesti finantsasutusel ei ole FATCA kokkuleppe artikli 4 lõikes 7 nimetatud õigust.
Perioodil 2014. aasta 1. juulist kuni 31. detsembrini avatud ettevõtte kontosid võib Eesti finantsasutus käsitada ettevõtte olemasolevate kontodena. Nimetatud kontode käsitamisel ettevõtte olemasolevate kontodena ei kohaldata neile FATCA kokkuleppe I lisa IV osa punktis A sätestatud hoolsusmeetmete võtmise edasilükkamise võimalust.
§ 13. Specification of application of FATCA Agreement
(1) An Estonian financial institution does not have the right specified in subsection 7 of Article 4 of the FATCA Agreement.
(2) The accounts of a company opened during the period of 1 July to 31 December 2014 may be considered as the pre-existing company accounts by an Estonian financial institution. Upon treating these accounts as the pre-existing company accounts the possibility of the postponement of taking due diligence measures provided in clause A of Part VI of Annex I of the FATCA Agreement is not applied to these accounts.
§ 14. Hoolsusmeetmete kohaldamise erisus
Hoolsusmeetmete võtmisel ei kohaldata FATCA kokkuleppe I lisa:
I osa punkti C;
II osa punkti A alapunkti 3;
Repealed
V osa punkti A.
Aruandekohustuslik Eesti finantsasutus võib hoolsusmeetmete võtmisel kohaldada FATCA kokkuleppe I lisa II osa punkti A alapunktides 1, 2 ja 4 ning IV osa punktis A sätestatud erisusi. Erisusi kohaldatakse Eesti aruandekohustusliku finantsasutuse kõigile finantskontodele ühetaoliselt.
§ 14. Specification of application of due diligence measures
(1) Upon taking due diligence measures, Annex I of the FATCA Agreement is not applied as provided in:
1) clause C of Part I;
2) subclause 3 of clause A of Part II;
4) clause A of Part V.
(2) The reporting Estonian financial institution may apply the specifications provided in subclauses 1, 2 and 4 of clause A of Part II of Annex I and subclause A of Part IV of Annex I of the FATCA Agreement upon taking due diligence measures. The specifications are applied in a uniform manner to all the financial accounts of a reporting Estonian financial institution.
§ 15. Eesti finantsasutuse üldised kohustused
Eesti finantsasutus hoidub tegevusest, mille eesmärk on FATCA kokkuleppega seotud teabe kogumisest kõrvalehoidumine.
Kui Eesti finantsasutusel on FATCA kokkuleppe artikli 4 lõikes 5 kirjeldatud tingimustele vastav seotud ettevõte või filiaal, täidab Eesti finantsasutus FATCA kokkuleppe artikli 4 lõike 5 alapunktides a–c sätestatud tingimusi.
§ 15. General obligations of Estonian financial institutions
(1) An Estonian financial institution refrains from any action aimed at evasion of the collection of information related to the FATCA Agreement.
(2) In case an Estonian financial institution has an affiliated company or branch corresponding to the conditions specified in subsection 5 of Article 4 of the FATCA Agreement, the Estonian financial institution complies with the conditions provided in subclauses a–c of subsection 5 of Article 4 of the FATCA Agreement.
§ 16. Aruandekohustusliku Eesti finantsasutuse andmete kogumise kohustus
Aruandekohustuslik Eesti finantsasutus kogub:
2014. ja järgnevate aastate kohta FATCA kokkuleppe artikli 2 lõike 2 punktis a nimetatud andmeid samas punktis nimetatud tingimustel artikli 3 lõike 3 punktis a, artikli 3 lõikes 4, artikli 6 lõikes 4 ja FATCA kokkuleppe II lisas toodud erisustega;
2015. ja 2016. aastal mitteosalevatele finantsasutustele tehtud maksete andmeid.
Käesoleva paragrahvi lõikes 1 sätestatud andmete kogumisel kohaldab aruandekohustuslik Eesti finantsasutus FATCA kokkuleppe I lisas toodud hoolsusmeetmeid, arvestades käesoleva seaduse §-des 13 ja 14 sätestatut.
Käesoleva paragrahvi lõike 1 punktis 1 nimetatud andmete hulka kuuluvate summade liik ja suurus eurodes määratakse kindlaks, arvestades tulumaksuseaduses sätestatut.
Käesoleva paragrahvi lõike 1 punktis 2 nimetatud andmete hulka kuuluvate summade suurus määratakse kindlaks eurodes, arvestades tulumaksuseaduse § 36 lõikes 5 sätestatut.
Käesoleva paragrahvi lõikes 1 nimetatud andmed eelmise kalendriaasta kohta kogutakse hiljemalt 30. juuniks.
§ 16. Data collection obligation of reporting Estonian financial institution
(1) A reporting Estonian financial institution collects:
1) data specified in clause a of subsection 2 of Article 2 of the FATCA Agreement for 2014 and subsequent years under the conditions specified in the same clause with the specifications given in clause a of subsection 3 of Article 3, subsection 4 of Article 3, subsection 4 of Article 6 and Annex II of the FATCA Agreement;
2) the data on payments made to the non-participating financial institutions in 2015 and 2016.
(2) Upon the collection of data provided in subsection 1 of this section the reporting Estonian financial institution applies the due diligence measures given in Annex I to the FATCA Agreement, taking into account the provisions of §§ 13 and 14 of this Act.
(3) The type and amount in euros of the amounts included in the data specified in clause 1 of subsection 1 of this section are determined, taking into account the provisions of the Income Tax Act.
(4) The type and amount of the amounts included in the data specified in clause 2 of subsection 1 of this section are determined in euros, taking into account the provisions of subsection 5 of § 36 of the Income Tax Act.
(5) The data specified in subsection 1 of this section for the previous calendar year are collected at the latest by 30 June.
§ 17. Aruandekohustusliku Eesti finantsasutuse täiendavad kohustused
Lisaks käesoleva seaduse §-des 15 ja 16 nimetatud kohustustele täidab aruandekohustuslik Eesti finantsasutus FATCA kokkuleppe artikli 4 lõike 1:
punktis c nimetatud registreerimisnõudeid;
punktis d nimetatud nõudeid, kui ta vastab samas punktis toodud Eesti finantsasutuse tingimustele;
punktis e nimetatud nõudeid, kui ta vastab samas punktis toodud Eesti finantsasutuse tingimustele.
Aruandekohustuslik Eesti finantsasutus registreerib end viivitamata Ameerika Ühendriikide Riigitulude Ametis.
§ 17. Additional obligations of reporting Estonian financial institution
(1) In addition to the obligations specified in §§ 15 and 16 of this Act a reporting Estonian financial institution complies with subsection 1 of Article 4 of the FATCA Agreement as follows:
1) registration requirements specified in clause c;
2) requirements specified in clause d in case it meets the requirements for the Estonian financial institutions set out in the same clause;
3) requirements specified in clause e in case it meets the requirements for the Estonian financial institutions set out in the same clause.
(2) A reporting Estonian financial institution immediately registers with the State Revenue Service of the United States of America.
§ 18. Teabe kogumine ja teabevahetus
Aruandekohustuslik Eesti finantsasutus esitab maksuhaldurile elektroonselt deklaratsiooni käesoleva seaduse § 16 lõike 1:
punkti 1 kohaselt kalendriaasta kohta kogutud andmetega järgmise aasta 30. juuniks;
punkti 2 kohaselt kogutud andmetega vastavalt 2016. aasta 30. juuniks ja 2017. aasta 30. juuniks.
Maksuhaldur edastab käesoleva paragrahvi lõike 1 alusel saadud teabe Ameerika Ühendriikide pädevale ametiasutusele elektroonselt hiljemalt sama aasta 30. septembril.
Käesoleva paragrahvi lõikes 1 nimetatud deklaratsioonide vormid ning nende esitamise ja täitmise korra kehtestab valdkonna eest vastutav minister määrusega.
§ 18. Collection and exchange of information
(1) A reporting Estonian financial institution submits a declaration to the tax authority electronically in accordance with subsection 1 of § 16 of this Act:
1) with the data collected for the calendar year by 30 June of the following year in accordance with clause 1;
2) with the data collected in accordance with clause 2 by 30 June 2016 and 30 June 2017 respectively.
(2) The tax authority communicates the information received based on subsection 1 of this section to a competent authority of the United States of America electronically at the latest by 30 September of the same year.
(3) The forms of declarations specified in subsection 1 of this section and the procedure for the submission and completion thereof are established by a minister in charge of the policy sector.
§ 19. Maksuhalduri õigused ja kohustused
Maksuhaldur täidab Eesti pädevale ametiisikule FATCA kokkuleppest tulenevaid ülesandeid, kui valdkonna eest vastutav minister ei otsusta teisiti, arvestades käesolevas seaduses sätestatut.
Maksuhaldur võtab viivitamata meetmed Eesti või Eesti finantsasutuse poolt toime pandud FATCA kokkuleppe artiklis 5 kirjeldatud rikkumise kõrvaldamiseks ja pöördub Ameerika Ühendriikide pädeva ametiisiku poole, kui tekib kahtlus, et Ameerika Ühendriigid või Ameerika Ühendriikide finantsasutus on toime pannud FATCA kokkuleppe artiklis 5 kirjeldatud rikkumise.
Maksuhalduril on õigus sõlmida Ameerika Ühendriikidega FATCA kokkuleppe II lisa muutmise kokkuleppeid samas sätestatud tingimustel ja korras.
§ 19. Rights and obligations of tax authority
(1) The tax authority performs the functions of a competent authority under the FATCA Agreement unless a minister in charge of the policy sector decides otherwise, taking into account the provisions of this Act.
(2) The tax authority immediately takes measures to eliminate a violation specified in Article 5 of the FATCA Agreement committed by Estonia or an Estonian financial institution and approaches a competent authority of the United States of America in case there is any doubt that the United States of America or a financial institution of the United States of America has committed a violation described in Article 5 of the FATCA Agreement.
(3) The tax authority has the right to enter into agreements with the United States of America for amendment of Annex II of the FATCA Agreement under the terms and in accordance with the procedure provided therein.
§ 20. Soodsamate tingimuste kohaldamine
FATCA kokkuleppe artikli 7 lõikes 2 nimetatud soodsamate tingimuste kohaldamise heakskiitmise või sellest keeldumise otsustab valdkonna eest vastutav minister ning teavitab sellest Ameerika Ühendriikide Rahandusministeeriumit.
§ 20. Application of more favourable conditions
The minister in charge of the policy sector approves the application of more favourable conditions specified in subsection 2 of Article 7 of the FATCA Agreement or refuses to approve them and notifies the Treasury Department of the United States of America thereof.
2¹. peatükk Eelotsuste alane automaatne teabevahetus Euroopa Liidus
§ 20¹. Teabevahetuse objekt
Eelotsuste alase automaatse teabevahetusega võivad olla hõlmatud andmed sellise maksukorralduse seaduse §-s 91¹ sätestatud maksuhalduri siduva eelotsuse kohta, mis käsitleb piiriülese toimingu maksustamist või välisriigis või muus jurisdiktsioonis püsiva tegevuskoha tekkimisega seotud küsimust (edaspidi eelotsus).
Käesoleva paragrahvi lõike 1 tähenduses käsitatakse piiriülesena sellist toimingut või toimingute kogumit, mille:
osalistest vähemalt üks on muu riigi või jurisdiktsiooni maksuresident;
osalistest vähemalt üks on samal ajal mitme riigi või jurisdiktsiooni maksuresident;
osalistest vähemalt üks tegeleb majandustegevusega mõnes teises riigis või jurisdiktsioonis püsiva tegevuskoha kaudu ning toiming või toimingute kogum moodustab osa või terviku selle püsiva tegevuskoha majandustegevusest;
mõju on piiriülene.
Automaatse teabevahetusega ei ole hõlmatud andmed sellise eelotsuse kohta, mis käsitleb üksnes füüsiliste isikute vaheliste toimingute maksustamist, välja arvatud käesoleva paragrahvi lõigetes 4 ja 5 sätestatud juhtudel.
Automaatse teabevahetusega on hõlmatud andmed ühe või enama füüsilise isiku maksustamist kirjeldava sellise eelotsuse kohta, milles viidatud tehingu või tehingute kogumi summa ületab Maksu- ja Tolliametile teadaolevalt 1 500 000 eurot või samaväärset summat muus vääringus. Ilma et see mõjutaks piiriüleses eelotsuses osutatud summat, koosneb eelotsuse summa eri kaupade, teenuste või varadega seotud tehingute kogumi puhul alusväärtuse kogusummast. Summasid ei liideta, kui samade kaupade, teenuste või varadega tehakse tehinguid mitu korda.
Automaatse teabevahetusega on hõlmatud andmed sellise eelotsuse kohta, millega määratakse kindlaks, kas füüsiline isik on Eesti resident tulumaksuseaduse § 6 tähenduses. Teavet ei vahetata sellise eelotsuse kohta, mis käsitleb mitteresidendist töötajatele ja juhtidele makstavaid tasusid või mitteresidentide pensionide maksustamist tuluallika riigis.
§ 20¹. Object of exchange of information
(1) The automatic exchange of information on preliminary rulings may include data concerning such binding preliminary ruling of the tax authority specified in § 91¹ of the Taxation Act that deals with taxation of a cross-border operation, or an issue related to the creation of permanent establishment in a foreign state or another jurisdiction (hereinafter preliminary ruling).
(2) For the purposes of subsection 1 of this section such an operation or set of operations are cross-border in which:
1) at least one of the parties is a tax resident of another state or jurisdiction;
2) at least one of the parties is simultaneously a tax resident of several states or jurisdictions;
3) at least one of the parties is engaged in business activities in another state or jurisdiction through a permanent establishment and an operation or set of operations forms a part or the whole of the business activities of such permanent establishment;
4) the impact is cross-border.
(3) Automatic exchange of information does not cover information on such a preliminary ruling which concerns only the taxation of transactions between natural persons, except in the cases provided in subsections 4 and 5 of this section.
(4) Automatic exchange of information covers information on such a preliminary ruling describing the taxation of one or more natural persons in which the total amount of the specified transaction or set of transactions exceeds 1,500,000 euros or an equivalent amount in another currency, to the best knowledge of the Tax and Customs Board. Without prejudice to the amount specified in the cross-border preliminary ruling, the amount in the preliminary ruling consists of the total amount of the underlying value in the case of a set of transactions relating to different goods, services or assets. The amounts are not added in case transactions are made several times with the same goods, services or assets.
(5) Automatic exchange of information covers information on the preliminary ruling determining whether a natural person is a resident of Estonia for the purposes of § 6 of the Income Tax Act. Information is not exchanged on the preliminary ruling concerning the remuneration paid to non-resident employees and managers or the taxation of the pensions of non-residents in the country of the source of income.
§ 20². Eelotsuse kohta edastatav teavechanges 31.12.2027
Maksuhaldur võib edastada kõikidele Euroopa Liidu liikmesriikide pädevatele ametiasutustele eelotsuse kohta järgmist teavet:
maksukohustuslast tuvastada võimaldavad andmed ning vajaduse korral andmed isikute grupi kohta, millesse isik kuulub;
sisukokkuvõte, sealhulgas asjakohase äritegevuse või tehingu või tehingute kogumi kirjeldus ja muu maksuriski hindamiseks oluline teave, juhindudes ärisaladuse hoidmise kohustusest;
eelotsuse andmise kuupäev;
eelotsuse võimaliku kehtivuse alguse ja lõpu kuupäev;
eelotsuse liik;
asjassepuutuva toimingu või toimingute kogumi rahaline väärtus, kui sellele on eelotsuses või kokkuleppes viidatud;
viide Euroopa Liidu teisele liikmesriigile, keda eelotsus tõenäoliselt mõjutab;
viide Euroopa Liidu teises liikmesriigis asuvale või tegutsevale isikule, keda eelotsus tõenäoliselt puudutab.
Eelotsuses käsitletud toimingutega seotud füüsiliste isikute kohta automaatselt teavet ei vahetata.
Euroopa Komisjonile võib maksuhaldur eelotsuse kohta edastada käesoleva paragrahvi lõike 1 punktides 3–7 märgitud teavet, välja arvatud käesoleva seaduse § 20¹ lõigetes 4 ja 5 sätestatud juhtudel.
§ 20². Information communicated with regard to preliminary ruling
(1) The tax authority may communicate to all the competent authorities of the Member States of the European Union the following data with regard to the preliminary ruling:
1) data enabling identification of the taxable person and, where necessary, data concerning the group of persons into which the person belongs;
2) a summary, including a description of the relevant business activity or transaction or set of transactions and other information relevant for tax risk assessment, guided by the obligation to maintain business secrecy;
3) date of issue of the preliminary ruling;
4) date of beginning and end of the potential duration of validity of the preliminary ruling;
5) type of the preliminary ruling;
6) monetary value of the relevant operation or set of operations in case it is referred to in the preliminary ruling or agreement;
7) reference to another Member State of the European Union likely to be affected by the preliminary ruling;
8) reference to a person, resident or operating in another Member State of the European Union likely to be affected by the preliminary ruling.
(2) Information is not automatically exchanged regarding natural persons related to the acts dealt with in the preliminary ruling.
(3) The tax authority may forward to the European Commission information regarding a preliminary ruling specified in clauses 3–7 of subsection 1 of this section, except in the cases provided in subsections 4 and 5 of § 20¹ of this Act.

§ 20³. Riikidepõhine aruannechanges 31.12.2027
Käesoleva seaduse tähenduses on riikidepõhine aruanne selline hargmaiste ettevõtete kontserni puudutav aruanne, mis sisaldab:
koondteavet hargmaiste ettevõtete kontserni tulude summa, tulumaksueelse kasumi või kahjumi, tasutud ja kogunenud tulumaksu, osa- või aktsiakapitali, jaotamata kasumi, töötajate arvu ning materiaalse vara, välja arvatud raha või raha ekvivalentide kohta iga sellise riigi ja jurisdiktsiooni kaupa, kus hargmaiste ettevõtete kontsern tegutseb, ning
hargmaiste ettevõtete kontserni liikmete tuvastamist võimaldavat teavet, sealhulgas teavet riigi või jurisdiktsiooni kohta, mille maksuresident kontserni liige on või mille õigusaktide alusel ta on moodustatud, kui see erineb maksuresidentsuse jurisdiktsioonist, ja teavet kontserni liikmete põhitegevusalade kohta.
Käesoleva paragrahvi lõikes 1 nimetatud hargmaiste ettevõtete kontsern on direktiivi lisa 3 1. jao punktis 3 määratletud kontsern, mille liikmetest vähemalt üks on muu jurisdiktsiooni maksuresident, sealhulgas püsiva tegevuskoha kaudu (edaspidi kontsern).
Riikidepõhine aruanne võib olla hõlmatud teabevahetusega.
Riikidepõhise aruande vormi ning selle esitamise ja täitmise korra kehtestab valdkonna eest vastutav minister määrusega.
§ 20³. Country-by-country report
(1) For the purposes of this Act the country-by country report is such a report concerning multinational enterprise groups which includes:
1) aggregate information on a group of multinational companies relating to the amount of revenue, profit or loss before income tax, income tax paid and accrued, share capital, retained earnings, number of employees and tangible assets other than cash or cash equivalents by each such state and jurisdiction in which the group of multinational companies operates, and;
2) information enabling identification of the members of the group of multinational companies, including information relating to the state or jurisdiction of tax residency of the member of the group or on the basis of the legislation of which it is formed in case it is different from the jurisdiction of tax residency, and information on the main business activities of the members of the group.
(2) A group of multinational companies specified in subsection 1 of this section is a group defined in clause 3 of Subchapter 1 of Annex III to Directive, at least one member of which is a tax resident of another jurisdiction, including through permanent establishment (hereinafter group).
(3) The country-by country report may be included in the exchange of information.
(4) The form of a country-by country report and the procedure for submission and performance thereof are established by a regulation of the minister in charge of the policy sector.
§ 20⁴. Teabeandja
Teabeandja käesoleva peatüki tähenduses on direktiivi lisa 3 1. jao punkti 6 määratlusele vastav Eesti maksuresidendist aruandekohustuslik üksus, kelleks võib olla:
Eesti maksuresidendist lõplik emaüksus, nagu see on määratletud direktiivi lisa 3 1. jao punktis 7;
Eesti maksuresidendist asendusemaüksus, nagu see on määratletud direktiivi lisa 3 1. jao punktis 8 või
direktiivi lisa 3 2. jao punktis 1 nimetatud asjaolude esinemise korral Eesti maksuresidendist muu aruandekohustuslik üksus, kes ei ole kontserni emaüksus.
§ 20⁴. Information provider
An information provider for the purposes of this chapter is a reporting entity that is a tax resident in Estonia in compliance with the definition of clause 6 of Subchapter 1 of Annex III to Directive, who may be:
1) an ultimate parent entity that is a tax resident in Estonia, as defined in clause 7 of Subchapter 1 of Annex III to Directive;
2) a surrogate parent entity that is a tax resident in Estonia, as defined in clause 8 of Subchapter 1 of Annex III to Directive or
3) in the case of occurrence of facts specified in clause 1 of Subchapter 2 of Annex III to Directive, other accounting entity that is a tax resident in Estonia, which is not a parent entity of the group..
§ 20⁵. Teabeandja kohustused
Eesti maksuresidendist aruandekohustuslik üksus kogub käesoleva seaduse § 20³ lõikes 1 nimetatud riikidepõhise aruande esitamiseks vajaliku teabe ning esitab maksuhaldurile riikidepõhise aruande aruandeaastaks olevale majandusaastale järgneva kalendriaasta 31. detsembriks.
Eesti maksuresidendist muu aruandekohustuslik üksus, kes ei ole kontserni emaüksus:
taotleb kontserni lõplikult emaüksuselt kogu käesoleva paragrahvi lõikes 1 sätestatud aruandekohustuse täitmiseks vajaliku teabe edastamist;
esitab riikidepõhise aruande ka juhul, kui tal ei ole kogu aruandekohustuse täitmiseks vajalikku teavet;
teavitab maksuhaldurit kontserni lõpliku emaüksuse keeldumisest edastada mis tahes aruandekohustuse täitmiseks vajalikku teavet.
Kui kontserni nimel esitab riikidepõhise aruande kontserni lõplik emaüksus või direktiivi lisa 3 2. jao punkti 2 kohaselt kontserni asendusemaüksus oma maksuresidentsuse riigi või jurisdiktsiooni maksuhaldurile, ei teki Eesti maksuresidendist kontserni liikmel aruandekohustust.
§ 20⁵. Obligations of information provider
(1) The reporting entity that is a tax resident in Estonia collects the information necessary for submission of the country-by-county report specified in subsection 1 of § 20³ of this Act and submits the country-by-county report to the tax authority by 31 December of the calendar year following the financial year that is a reporting year.
(2) Other reporting entity that is a tax resident in Estonia, who is not the parent entity of the group:
1) requests the ultimate parent entity of the group to communicate all information required for the performance of the reporting obligation provided in subsection 1 of this section;
2) submits the country-by country report also in the case of a failure to obtain all the information required to perform the reporting obligation;
3) notifies the tax authority of the refusal of the ultimate parent entity of the group to communicate any information required for the performance of the reporting obligation.
(3) In case the ultimate parent entity of the group or the surrogate parent entity of the group in accordance with clause 2 of Subchapter 2 of Annex III to Directive submits the country-by-country report on behalf of the group to the tax authority of the residency state or jurisdiction of the group, a member of the group that is a tax resident in Estonia does not have the reporting obligation.
§ 20⁶. Kontserni liikme teavitamiskohustus
Direktiivi lisa 3 2. jao punktis 1 nimetatud asjaolude esinemise korral ning juhul, kui kontsernil on rohkem kui üks liige, kes vastab aruandekohustusliku üksuse määratlusele, võib kontsern teatada maksuhaldurile ühe kontserni liikme määramisest kontserni nimel riikidepõhise aruande esitajaks. Sellisele kontserni liikmele peab olema kontsernisiseselt tagatud juurdepääs kogu teabele, mis on vajalik riikidepõhise aruande esitamiseks.
Iga Eesti maksuresidendist kontserni liige teatab maksuhaldurile, kas ta on käesoleva seaduse §-s 20⁴ nimetatud aruandekohustuslik üksus. Käesolevas lõikes sätestatud kohustus ei ole kohustus käesoleva seaduse § 2 punkti 5 tähenduses.
Kui Eesti maksuresidendist kontserni liige ei ole aruandekohustuslik üksus, teatab ta maksuhaldurile, kes kontserni liikmetest on aruandekohustuslik üksus ning sellise üksuse maksuresidentsuse.
Käesolevas paragrahvis sätestatud teavitamiskohustus tuleb täita kuue kuu jooksul kontserni aruandeaastaks oleva majandusaasta lõppemisest arvates.
Käesolevas paragrahvis sätestatud teavitamiskohustuse täitmata jätmisel võib maksuhaldur nõuda käesoleva seaduse § 20⁵ lõikes 1 sätestatud kohustuse täitmist ükskõik milliselt Eesti maksuresidendist kontserni liikmelt.
§ 20⁶. Notification obligation of member of group
(1) In the case of occurrence of the facts specified in clause 1 Subchapter 2 of Annex III to Directive and in the case the group has more than one member that comply with the definition of the reporting entity, the group may notify the tax authority of the appointment of one member of the group to submit the country-by-country report on behalf of the group. Such member of the group must be ensured access within the group to all the information that is required for submission of the country-by-country report.
(2) Each member of the group that is a tax resident in Estonia notifies the tax authority whether it is a reporting entity specified in § 20⁴ of this Act. The obligation provided in this subsection is not an obligation for the purposes of clause 5 of § 2 of this Act.
(3) In case a member of the group that is a tax resident in Estonia is not a reporting entity, it notifies the tax authority of which of the members of the group is a reporting entity and of the tax residency of such entity.
(4) The notification obligation must be performed within six months as of the end of the financial year which is the reporting year of the group.
(5) Upon failure to perform the notification obligation provided in this section the tax authority may require the performance of the obligation provided in subsection 1 of § 20⁵ of this Act from any member of the group that is a tax resident in Estonia.
§ 20⁷. Maksuhalduri kohustused
Maksuhaldur teavitab kõiki teisi Euroopa Liidu liikmesriike kontserni lõpliku emaüksuse keeldumisest edastada Eesti maksuresidendist aruandekohustuslikule üksusele riikidepõhise aruande esitamiseks vajalikku teavet.
Maksuhaldur avaldab oma veebilehel käesoleva seaduse §-de 20⁵ ja 20⁶ kohaselt esitatud andmed maksukorralduse seaduse § 27 lõikes 8 sätestatud korras.
§ 20⁷. Obligations of tax authority
(1) The tax authority notifies all the Member States of the European Union of the refusal of the ultimate parent entity of the group to communicate to the reporting entity that is a tax resident in Estonia information that is required for the submission of the country-by country report.
(2) The tax authority publishes on their webpage the data submitted according to §§ 20⁵ and 20⁶ of this Act in accordance with the procedure provided in subsection 8 of § 27 of the Taxation Act.
2³. peatükk Piiriüleste skeemide alane automaatne teabevahetus Euroopa Liidus
§ 20⁸. Piiriülene skeem
Piiriülene skeem käesoleva peatüki tähenduses on tehing või tehingute ahel, millel on seos Euroopa Liidu liikmesriigi (edaspidi käesolevas peatükis liikmesriik) või kolmanda riigiga ning mis võib mõjutada maksustamist, finantskontodealast teabevahetust või tegeliku kasusaaja tuvastamist.
Maksustamist võib mõjutada piiriülene skeem, mille puhul on täidetud vähemalt üks järgmistest tingimustest:
skeemis osalevad isikud on erinevate riikide või jurisdiktsioonide residendid;
vähemalt üks skeemis osalevatest isikutest on samal ajal rohkem kui ühe riigi või jurisdiktsiooni resident;
vähemalt üks skeemis osalevatest isikutest tegutseb riigis või jurisdiktsioonis, mille resident ta ei ole.
Finantskontodealast teabevahetust võib mõjutada piiriülene skeem, mis häirib või takistab käesoleva seaduse §-s 4¹ ning 1¹. ja 2. peatükis sätestatud finantskontode maksualase teabe kogumist või vahetamist.
Tegeliku kasusaaja tuvastamist võib mõjutada piiriülene skeem, millega on raskendatud või muudetud võimatuks rahapesu ja terrorismi rahastamise tõkestamise seaduse kohaselt määratletava tegeliku kasusaaja tuvastamine.
Loetelu piiriüleste skeemide kriteeriumidest, mis viitavad maksustamise, finantskontodealase teabevahetuse või tegeliku kasusaaja tuvastamise vältimise ohule, kehtestab valdkonna eest vastutav minister määrusega.
§ 20⁸. Cross-border arrangement
(1) For the purposes of this Chapter, a cross-border arrangement is a transaction or chain of transactions involving a Member State of the European Union (hereinafter in this Chapter Member State) or a third country and which may affect taxation, exchange of information on financial accounts or identification of the beneficial owner.
(2) Taxation may be affected by a cross-border arrangement which meets at least one of the following conditions:
1) the persons participating in the arrangement are residents in different states or jurisdictions;
2) at least one of the persons participating in the arrangement is a resident in more than one state or jurisdiction at the same time;
3) at least one of the persons participating in the arrangement operates in a state or jurisdiction in which they are not resident.
(3) The exchange of information on financial accounts may be affected by a cross-border arrangement which disturbs or impedes the collection or exchange of tax information on financial accounts provided in § 4¹ and Chapters 1¹ and 2 of this Act.
(4) The identification of the beneficial owner may be affected by a cross-border arrangement which makes it difficult or impossible to identify the beneficial owner as defined in the Money Laundering and Terrorist Financing Prevention Act.
(5) The list of criteria for cross-border arrangements which refer to the risk of avoiding taxation, exchange of information on financial accounts or identification of the beneficial owner is established by a regulation of the minister in charge of the policy sector.
§ 20⁹. Aruandekohustusega skeem
Aruandekohustusega skeem on teabevahetusega hõlmatud skeem, mis puudutab ka teist liikmesriiki või kolmandat riiki ja mille puhul esineb vähemalt üks käesoleva seaduse § 20⁸ lõike 5 alusel antavas valdkonna eest vastutava ministri määruses nimetatud kriteerium.
§ 20⁹. Reportable arrangement
A reportable arrangement is an arrangement covered by exchange of information, which also concerns another Member State or a third country and for which is present at least one of the criteria specified in the regulation of the minister in charge of the policy sector issued on the basis of subsection 5 of § 20⁸ of this Act.
§ 20¹⁰. Teabeandja
Teabeandja käesoleva peatüki tähenduses on aruandekohustusega skeemi väljatöötamise, turustamise, kättesaadavaks tegemise või selle rakendamise korraldamise või juhtimise teenust osutanud isik.
Teabeandja käesoleva peatüki tähenduses on ka isik, kes on aruandekohustusega skeemi väljatöötamise, turustamise, kättesaadavaks tegemise või selle rakendamise korraldamise või juhtimisega seoses isiklikult või teiste isikute kaudu abi, tuge või nõu andnud.
Teabeandjaks ei ole isik, kelle puhul saab eeldada, et ta ei teadnud ega pidanud teadma, et osutatud teenus või teenuse osutamisel antud abi või nõu oli seotud aruandekohustusega skeemiga.
Aruandekohustuslik on teabeandja, kes vastab vähemalt ühele järgmistest tingimustest:
ta on Eesti resident tulumaksuseaduse § 6 tähenduses;
temale kuuluva Eestis asuva püsiva tegevuskoha kaudu osutatakse aruandekohustusega skeemiga seonduvaid teenuseid;
ta on Eestis asutatud või tema tegevus on reguleeritud Eesti õigusaktidega;
ta on sellise Eesti kutseühenduse liige, mis ühendab õigus- või maksunõustamisteenust osutavaid isikuid.
§ 20¹⁰. Information provider
(1) For the purposes of this chapter, an information provider is a person who has provided the service of developing, marketing, making available or organizing or managing the implementation of a reportable arrangement.
(1¹) For the purposes of this chapter, an information provider is also a person who has personally or through other persons provided assistance, support or advice related to the developing, marketing, making available or organizing or managing the implementation of a reportable arrangement.
(2) The information provider is not a person for whom it may be presumed that the person did not know and should not have known that the service provided, or the assistance or advice provided upon the provision of service was related to a reportable arrangement.
(3) An information provider who meets at least one of the following conditions is accountable:
1) the information provider is a person resident in Estonia for the purposes of § 6 of the Income Tax Act;
2) the services related to the reportable arrangement are provided through a permanent establishment in Estonia owned by the person;
3) the information provider has been founded in Estonia or its activities are regulated by the Estonian legislation;
4) the information provider is a member of an Estonian professional association which unites persons providing legal or tax advisory service.
§ 20¹¹. Asjaomane maksukohustuslane
Asjaomane maksukohustuslane käesoleva peatüki tähenduses on isik, kellele aruandekohustusega skeem on tehtud rakendamiseks kättesaadavaks või kes on valmis seda rakendama või on rakendanud selle esimese etapi.
§ 20¹¹. Taxable person concerned
For the purposes of this Chapter, the taxable person concerned is a person to whom the reportable arrangement has been made available for implementation or who is ready to implement it or has implemented its first stage.
§ 20¹². Seotud isikud
Seotud isik käesoleva peatüki tähenduses on isik, kes osaleb teise isiku juhtimises sellises positsioonis, mis annab võimaluse teise isiku tegevust olulisel määral mõjutada, ning isik, kellele kuulub kas üle 25 protsendi ühe juriidilise isiku aktsia- või osakapitalist või häälte koguarvust või vähemalt 25 protsenti kasumi saamise õigusest.
Seotud isikutena käsitatakse kõiki isikuid, kes on samal ajal sama isikuga seotud käesoleva paragrahvi lõikes 1 nimetatud mis tahes viisil.
Isikule, kes tegutseb hääleõigusest või osaluse omamisest tulenevate õiguste teostamisel ühiselt teise isikuga, omistatakse ka selle teise isiku eelnimetatud õigused.
Kaudse osaluse suurus määratakse kindlaks, korrutades osaluse suuruse ettevõtjas osaluse suurusega iga järgneva astme tütarettevõtjas. Isikut, kelle omandis on üle 50 protsendi hääleõigustest, käsitatakse 100 protsendi hääleõiguste omanikuna.
Käesolevas peatükis käsitatakse füüsilist isikut, tema abikaasat või elukaaslast ning tema otseseid alanejaid ja ülenejaid sugulasi ühe isikuna.
§ 20¹². Related persons
(1) For the purposes of this Chapter, a related party is a person who participates in the management of the other person in a position that provides an opportunity to significantly influence the activities of another person and the person who holds more than 25 per cent of the share capital or stock or of the total number of voting rights of one legal person or at least 25 per cent of the right to receive profit.
(2) Related persons are all persons who are at the same time related to the same person in any manner specified in subsection 1 of this section.
(3) A person who acts jointly with another person upon exercising the rights arising from voting rights or the rights arising from shareholding is also granted the rights of that other person specified above.
(4) The amount of indirect holding is determined by multiplying the size of the holding in the undertaking by the amount of holding in each successive subsidiary. A person who holds more than 50 per cent of the voting rights is considered to be the holder of 100 per cent of the voting rights.
(5) For the purposes of this Chapter, a natural person, their spouse or partner and their direct descendants and ascendants are treated as a single person.
§ 20¹³. Teabeandja kohustusedchanges 31.12.2027
Teabeandja esitab aruandekohustusega skeemi kohta järgmise talle teadaoleva teabe:
teabeandjaid ja asjaomaseid maksukohustuslasi tuvastada võimaldavad andmed, sealhulgas nimi, füüsilise isiku puhul sünniaeg ja -koht, residentsus, isiku- või registrikood ning maksukohustuslasena registreerimise number, kui see on olemas;
käesoleva lõike punktis 1 nimetatud isikutega seotud isikuid tuvastada võimaldavad andmed;
kriteeriumid, mis muudavad piiriülese skeemi aruandekohustusega skeemiks;
skeemi nimetus, kui see on olemas;
skeemi sisu kokkuvõte ja kirjeldus ning selline muu teave, mis võiks aidata pädeval asutusel hinnata võimalikku maksuriski, ilma et avaldataks äri-, tööstus- või kutsesaladust, turundusprotsessi ega teavet, mille esitamine oleks vastuolus avaliku korraga;
skeemi rakendamise alguse kuupäev;
skeemi õiguslikud üksikasjad;
skeemi rahaliselt hinnatav väärtus;
liikmesriik, millega asjaomane maksukohustuslane on seotud või mida aruandekohustusega skeem tõenäoliselt puudutab;
muu isik, keda aruandekohustusega skeem tõenäoliselt mõjutab, ning liikmesriik, millega isik on seotud;
täiendava teabe esitamise korral skeemi või skeemiosa viitenumber.
Käesoleva seaduse § 20¹⁴ lõike 2 teises lauses nimetatud teabeandja kohta teavet ei esitata.
Käesoleva paragrahvi lõikes 1 nimetatud teabe esitab teabeandja maksuhaldurile 30 kalendripäeva jooksul alates aruandekohustusega skeemi rakendamiseks kättesaadavaks tegemise päevale järgnevast päevast, aruandekohustusega skeemi rakendamiseks valmisoleku päevale järgnevast päevast või päevast, kui tehti esimene toiming aruandekohustusega skeemi rakendamiseks, sõltuvalt sellest, milline päev saabub varem. Käesoleva seaduse § 20¹⁰ lõikes 1¹ nimetatud teabeandja esitab maksuhaldurile teabe 30 päeva jooksul alates päevast, kui ta andis piiriülese skeemiga seoses otse või teiste isikute kaudu abi, tuge või nõu.
Sellise aruandekohustusega skeemi kohta, mis on välja töötatud, turustatud, rakendamiseks valmis või kättesaadav kujul, mida ei ole rakendamiseks vaja olulisel määral kohandada, esitab teabeandja käesoleva paragrahvi lõike 1 punktides 1, 2, 6, 9 ja 10 nimetatud uut või täiendavat teavet iga kolme kuu tagant.
Teabeandjal on õigus jätta aruandekohustusega skeemi kohta teave esitamata, kui see süüstaks teda ennast või maksukorralduse seaduse § 64 lõike 1 punktis 5 nimetatud isikut väärteo või kuriteo toimepanemises.
Maksuhaldur annab igale esmakordselt esitatud skeemile või skeemiosale unikaalse viitenumbri. Teabeandja teatab eelnimetatud viitenumbri kõigile teistele sama skeemi või skeemiosaga seotud teenust, abi või nõu pakkunud isikutele.
Aruandekohustusega skeemi kohta esitatavate andmete koosseisu kehtestab valdkonna eest vastutav minister määrusega.
§ 20¹³. Obligations of information provider
(1) The information provider provides the following information known to them with regard to the reportable arrangement:
1) data enabling identification of the information providers and taxable persons concerned, including the name, in case of a natural person the date and place of birth, residence, personal identification code or registry code and the number of registration as a taxable person, where available;
2) data enabling to identify persons related to the persons specified in clause 1 of this subsection;
3) criteria that convert a cross-border arrangement into a reportable arrangement;
4) name of the arrangement, where available;
5) a summary and description of the content of the arrangement and such other information that could help the competent authority assess the potential tax risk without disclosing any commercial, industrial or professional secrets, marketing processes or information the disclosure of which would be contrary to public policy;
6) date of commencement of the implementation of the arrangement;
7) legal details of the arrangement;
8) monetary value of the arrangement;
9) a Member State to which the taxable person concerned is related or which is likely to be affected by the reportable arrangement;
10) another person who is likely to be affected by the reportable arrangement and a Member State to which the person is related;
11) reference number of the arrangement or part of the arrangement upon provision of additional information.
(1¹) Information is not submitted about the information provider specified in the second sentence of subsection 2 of § 20¹⁴ of this Act.
(2) The information provider submits the information specified in subsection 1 of this section to the tax authority within 30 calendar days as of the day following the day on which the reportable arrangement is made available for implementation, the day following the day on which the reportable arrangement is ready for implementation, or the day on which the first action was taken to implement the reportable arrangement, dependent on which day arrives earlier. The information provider specified in subsection 1¹of § 20¹⁰ of this Act submits the information to the tax authority within 30 days as of the day on which the information provider provided, directly or through other persons, assistance, support or advice relating to the cross-border arrangement.
(3) Every three months the information provider submits new or additional information specified in clauses 1, 2, 6, 9 and 10 of subsection 1 of this section with regard to such reportable arrangement that has been developed, marketed, ready for implementation or available in a form that does not require significant adjustment for implementation.
(4) The information provider has the right not to provide information with regard to the reportable arrangement in case it would incriminate the information provider, or a person specified in clause 5 of subsection 1 of § 64 of the Taxation Act in the commission of a misdemeanour or a criminal offense.
(5) The tax authority assigns a unique reference number to each arrangement or part of the arrangement submitted for the first time. The information provider communicates the abovementioned reference number to all other persons who have provided service, assistance or advice in relation to the same arrangement or part of the arrangement.
(6) The composition of the data to be submitted regarding a reportable arrangement is established by a regulation of the minister in charge of the policy sector.
§ 20¹⁴. Teabeandja kohustuste üleminek
Teabeandjal on õigus jätta käesoleva seaduse §-s 20¹³ sätestatud kohustused täitmata, kui nende täitmine tähendaks seadusest tuleneva kutsesaladuse hoidmise kohustuse rikkumist.
Käesoleva seaduse §-s 20¹³ sätestatud kohustuste täitmata jätmisest teavitab teabeandja teist aruandekohustusega skeemiga seotud teabeandjat või sellise teabeandja puudumisel asjaomast maksukohustuslast. Kui teabeandja kutsesaladuse hoidmise kohustus tuleneb advokatuuriseaduse §-st 45, teavitab ta kohustuste täitmata jätmisest üksnes oma kliendiks olevat teist asjaomast teabeandjat või sellise teabeandja puudumise korral asjaomast maksukohustuslast.
Käesoleva seaduse §-s 20¹³ sätestatud kohustuste täitmata jätmise korral lähevad teabeandja kohustused üle sellest teavitatud teisele asjaomasele teabeandjale või sellise teabeandja puudumise korral asjaomasele maksukohustuslasele.
§ 20¹⁴. Transfer of obligations of information provider
(1) An information provider has the right not to perform the obligations provided in § 20¹³ of this Act in case performance of the obligations would constitute a violation of the obligation to keep professional secrecy arising from the law.
(2) The information provider notifies another information provider who is related to the reportable arrangement, or in the absence of such an information provider, the relevant taxable person, of a failure to perform the obligations provided in § 20¹³ of this Act. In case the obligation of the information provider to maintain professional secrecy arises from § 45 of the Bar Association Act, the information provider notifies of a failure to perform the obligations only to the other relevant information provider who is its client or, in the absence of such an information provider, to the relevant taxable person.
(3) Upon failure to comply with the obligations provided in § 20¹³ of this Act, the obligations of the information provider are transferred to the other information provider concerned who has been notified thereof or, in the absence of such information provider, to the taxable person concerned.
§ 20¹⁵. Teabeandja aruande esitamise riik
Kui teabeandjal tekib aruandekohustus rohkem kui ühes liikmesriigis, millest üks on Eesti, ja seos Eestiga esineb allolevas loetelus esimesena, esitab ta käesoleva seaduse § 20¹³ kohase teabe Maksu- ja Tolliametile. Teabeandja seos liikmesriigiga võib olla järgmine:
ta on selle resident;
tal on seal püsiv tegevuskoht, mille kaudu ta osutab aruandekohustusega skeemiga seotud teenuseid;
ta on seal asutatud või tema tegevus on reguleeritud selle riigi õigusaktidega;
ta on selle riigi õigus- või maksunõustamisteenust osutavaid isikuid ühendava kutseühenduse liige.
Kui teabeandjal tekib käesoleva paragrahvi lõike 1 kohaselt aruandekohustus rohkem kui ühes liikmesriigis, on tal õigus jätta käesoleva seaduse §-s 20¹³ sätestatud kohustused täitmata, kui tal on tõendid selle kohta, et kohustused on täidetud teises liikmesriigis.
§ 20¹⁵. Reporting country of information provider
(1) In case the information provider becomes liable for reporting obligation in more than one Member State, one of which is Estonia, and the connection to Estonia comes first on the list below, the information provider submits the information in accordance with § 20¹³ of this Act to the Tax and Customs Board. The connection between the information provider and the Member State may be the following:
1) the information provider is a resident thereof;
2) the information provider has a permanent establishment there through which it provides services related to the reportable arrangement;
3) the information provider is established there or its activities are subject to the legislation of that state;
4) the information provider is a member of a professional association uniting persons who provide legal or tax advisory services of that state.
(2) In case the information provider becomes liable for reporting in more than one Member State in accordance with subsection 1 of this section, the information provider has the right to disregard the obligations provided in § 20¹³ of this Act in case the information provider has evidence that the obligations have been performed in another Member State.
§ 20¹⁶. Teabeandjate paljusus
Kui käesoleva peatüki kohaselt on sama aruandekohustusega skeemi kohta aruandekohustuslikke teabeandjaid rohkem kui üks, on teabeandjal õigus jätta käesoleva seaduse §-s 20¹³ sätestatud kohustused täitmata, kui tal on tõendid selle kohta, et kohustused on täitnud teine aruandekohustuslik teabeandja.
§ 20¹⁶. Multiplicity of information providers
Where, in accordance with this Chapter, there are more than one reporting information providers with regard to the same reportable arrangement, the information provider has the right to disregard the obligations provided in § 20¹³ of this Act in case the information provider has evidence that the obligations have been performed by another reporting information provider.
§ 20¹⁷. Asjaomase maksukohustuslase aruandekohustus
Käesolevas peatükis sätestatud teabeandjaks on asjaomane maksukohustuslane, kui aruandekohustusega skeemi väljatöötamisega, turustamisega, kättesaadavaks tegemisega või selle rakendamise korraldamise või juhtimisega seotud teenust osutaval isikul ei ole üheski liikmesriigis kohustust selle skeemi kohta teavet esitada või kui selline isik puudub. Asjaomasele maksukohustuslasele ei lähe üle käesoleva seaduse § 20¹³ lõikes 3 sätestatud kohustus.
§ 20¹⁷. Reporting obligation of taxable person concerned
The information provider provided in this Chapter is the taxable person concerned, where the person who has provided the service related to development, marketing, making available for organization or implementation or management of a reportable arrangement, has no obligation to provide information on such arrangement in any of the Member States or in case there is no such person. The obligation provided in subsection 3 of § 20¹³ of this Act does not transfer to the taxable person concerned.
§ 20¹⁸. Asjaomase maksukohustuslase aruande esitamise riik
Kui maksukohustuslane on aruandekohustuslik rohkem kui ühes liikmesriigis, millest üks on Eesti, ja seos Eestiga esineb allolevas loetelus esimesena, esitab ta käesoleva seaduse § 20¹³ lõike 1 kohase teabe Maksu- ja Tolliametile. Maksukohustuslase seos liikmesriigiga võib olla järgmine:
ta on selle resident;
tal on seal püsiv tegevuskoht, mis saab aruandekohustusega skeemist kasu;
ta saab seal tulu või teenib kasumit, kuid ta ei ole selle resident ning tal ei ole seal püsivat tegevuskohta;
ta tegutseb seal, kuid ta ei ole selle resident ning tal ei ole seal püsivat tegevuskohta.
Kui asjaomasel maksukohustuslasel on käesoleva paragrahvi lõike 1 alusel aruandekohustus rohkem kui ühes liikmesriigis, on tal õigus jätta käesoleva seaduse §-s 20¹³ sätestatud kohustused täitmata, kui tal on tõendid selle kohta, et kohustused on täidetud teises liikmesriigis.
§ 20¹⁸. Reporting country of taxable person concerned
(1) In case a taxable person is required to report in more than one Member State, one of which is Estonia, and the connection to Estonia is presented first in the list below, the taxable person submits the information in accordance with subsection 1 of § 20¹³ of this Act to the Tax and Customs Board. The connection of a taxable person to a Member State may be as follows:
1) the taxable person is a resident thereof;
2) the taxable person has a permanent establishment there, which benefits from a reportable arrangement;
3) the taxable person receives income or earns profits there, but is not resident and has no permanent establishment there;
4) the taxable person is active but is not resident and has no permanent establishment there.
(2) In case the taxable person concerned is subject to reporting obligations in more than one Member State in accordance with subsection 1 of this section, the taxable person is entitled to disregard the obligations provided in § 20¹³ of this Act in case the taxable person has evidence that the obligations have been performed in another Member State.
§ 20¹⁹. Asjaomaste maksukohustuslaste paljusus
Kui käesoleva peatüki kohaselt on aruandekohustuslikke asjaomaseid maksukohustuslasi rohkem kui üks, esitab käesoleva seaduse § 20¹³ lõike 1 kohase teabe maksuhaldurile see asjaomane maksukohustuslane, kes on aruandekohustusega skeemi väljatöötamises teabeandjaga kokku leppinud, või kui sellist isikut ei ole, siis see asjaomane maksukohustuslane, kes juhib skeemi rakendamist.
Asjaomasel maksukohustuslasel on õigus jätta käesoleva seaduse §-s 20¹³ sätestatud kohustused täitmata, kui tal on tõendid selle kohta, et kohustused on täitnud teine asjaomane maksukohustuslane.
§ 20¹⁹. Multiplicity of taxable persons concerned
(1) Where there is more than one accountable taxable person concerned in accordance with this Chapter, the information in accordance with subsection 1 of § 20¹³ of this Act is submitted to the tax authority by the taxable person concerned, who has agreed with the information provider to develop the reportable arrangement or, in the absence of such a person, by such taxable person concerned who manages the implementation of the arrangement.
(2) The taxable person concerned has the right not to perform the obligations provided in § 20¹³ of this Act in case the taxable person has evidence that the obligations have been performed by another taxable person concerned.

§ 20²⁰. Platvorm
Platvorm käesoleva peatüki tähenduses on tarkvara, mis võimaldab müüjal olla ühenduses teiste kasutajatega aruandekohustusega hõlmatud tegevusega tegelemiseks, samuti moodustis sellise tegevusega seonduva tasu kogumiseks ja maksmiseks.
Platvormina ei käsitata sellist tarkvara, mis võimaldab kasutajatele üksnes:
maksete töötlemist;
kaupade või teenuste loetlemist või reklaamimist;
nende ümbersuunamist või üleviimist platvormile.
§ 20²⁰. Platform
(1) For the purposes of this chapter a platform is software that enables the seller to be in contact with other users to engage in activities covered by the reporting obligation, as well as an arrangement for collection and payment of the fees related to such activities.
(2) A platform is not considered to be the software that only allows users:
1) the processing of payments;
2) the listing or advertising of goods or services;
3) their redirection or transfer to the platform.
§ 20²¹. Aruandekohustusega hõlmatud tegevus
Aruandekohustusega hõlmatud tegevus käesoleva peatüki tähenduses on tasu eest tehtav järgmine tegevus:
kinnisasja või selle osa rendile või üürile andmine;
aja- või ülesandepõhise teenuse osutamine;
asja võõrandamine;
transpordivahendi rendile või üürile andmine.
Käesoleva paragrahvi lõikes 1 nimetatud tasu tähendab mis tahes vormis tasu, mis on aruandekohustusega hõlmatud tegevusega seoses müüjale makstud või krediteeritud ja millest on maha arvatud kõik platvormihalduri kinni peetud või sisse nõutud platvormil tegutsemisega seotud teenustasud, vahendustasud või maksud ning mille suurus on platvormihaldurile teada või peaks talle mõistlikult eeldades teada olema.
Aruandekohustusega hõlmatud tegevuseks ei loeta sellist käesoleva paragrahvi lõikes 1 sätestatud tegevust, mida teeb müüja, kes on platvormihalduriga seotud üksus direktiivi lisa 5 1. jao C jaotise punkti 1 tähenduses (edaspidi seotud üksus) või platvormihalduri töötaja.
§ 20²¹. Activity covered by reporting obligation
(1) For the purposes of this chapter, an activity covered with the reporting obligation is the following activity performed for a fee:
1) renting or leasing immovable property or part thereof;
2) provision of time- or task-based service;
3) transfer of a thing;
4) leasing or renting out a means of transport.
(2) The fee specified in subsection 1 of this section means any form of the fee that has been paid or credited to the seller relating to the activity covered by the reporting obligation, and from which all service fees, commissions or taxes relating to operating on the platform, withheld or collected by the platform manager, have been deducted, and the amount of which is known to the platform manager or should reasonably be expected to be known.
(3) An activity covered by the reporting obligation is not considered to be such activity provided in subsection 1 of this section which is performed by a seller that is an entity related to the platform manager for the purposes of clause 1 of Division C of Subchapter 1 of Annex 5 of the Directive (hereinafter related entity) or an employee of the platform manager.
§ 20²². Müüja
Müüja käesoleva seaduse tähenduses on isik või õiguslik moodustis, kes on platvormil registreeritud ja tegeleb aruandekohustusega hõlmatud tegevusega või kellele makstakse või krediteeritakse selle tegevusega seonduvalt tasu.
Aruandlusega hõlmatud müüja on liikmesriigi residendist müüja või müüja, kes annab rendile või üürile liikmesriigis asuvat kinnisasja või selle osa. Samuti on aruandlusega hõlmatud müüja Maksu- ja Tolliameti veebilehel avaldatud loetelus oleva Euroopa Liidu välise riigi või jurisdiktsiooni residendist müüja või müüja, kes annab rendile või üürile sellises riigis või jurisdiktsioonis asuvat kinnisasja või selle osa.
Aruandlusest välistatud müüja on:
valitsusüksus direktiivi lisa 5 1. jao C jaotise punkti 2 tähenduses;
äriühing, kelle aktsiatega kaubeldakse reguleeritud väärtpaberiturul korrapäraselt, samuti temaga seotud üksus, mille aktsiatega kaubeldakse reguleeritud väärtpaberiturul korrapäraselt;
juriidiline isik või õiguslik moodustis, kes on jooksval kalendriaastal osutanud enam kui 2000 korral rendi- või üüriteenust seoses kinnisasjade või nende osadega, mis asuvad samal aadressil ning mis kuuluvad samale omanikule;
isik või õiguslik moodustis, kes on jooksval kalendriaastal sõlminud platvormi kaudu vähem kui 30 tehingut asja müügiks ja kellele makstud või krediteeritud tasu kogusumma ei ületa 2000 eurot.
§ 20²². Seller
(1) For the purposes of this Act, a seller is a person or legal arrangement that is registered on the platform and is engaged in activities covered by a reporting obligation or to whom a fee is paid or credited relating to this activity.
(2) A seller covered by reporting is a seller who is a resident of a Member State or a seller that leases or rents out immovable property or a part thereof located in a Member State. Also, the seller covered by reporting is a seller who is a resident of a third country or jurisdiction listed on the webpage of the Tax and Customs Board, or a seller who leases or rents out immovable property or a part thereof located in such a country or jurisdiction.
(3) A seller excluded from reporting is:
1) a government entity for the purposes of clause 2 of Division C of Subchapter 1 of Annex 5 to the Directive;
2) a company whose shares are regularly traded on the regulated securities market, as well as an entity related thereto, whose shares are regularly traded on the regulated securities market;
3) a legal person or legal arrangement that has provided, more than 2,000 times in the current calendar year, rental or lease services related to immovables or parts thereof located at the same address and belonging to the same owner;
4) a person or legal arrangement that has concluded less than 30 transactions for the sale of things through the platform in the current calendar year, and the total amount of the fee paid or credited to whom does not exceed 2,000 euros.
§ 20²³. Platvormihaldur
Platvormihaldur käesoleva peatüki tähenduses on juriidiline isik või õiguslik moodustis, kes sõlmib müüjaga lepingu platvormi või selle osa müüjale kättesaadavaks tegemiseks.
Teabeandja käesoleva peatüki tähenduses on Eesti residendist platvormihaldur. Kui platvormihaldur ei ole Eesti resident, käsitatakse teda teabeandjana, kui tema juhtimise koht on Eestis või kui tal on Eestis püsiv tegevuskoht või kui ta on õiguslik moodustis, mis on asutatud Eesti õiguse alusel.
Teabeandjana käsitatakse ka sellist platvormihaldurit, kes ei ole ühegi liikmesriigi resident, kes ei ole loodud ühegi liikmesriigi õiguse kohaselt, kellel ei ole üheski liikmesriigis juhtimise kohta ega püsivat tegevuskohta, kuid kes vahendab käesoleva seaduse § 20²² lõike 2 esimeses lauses sätestatud müüja tegevust (edaspidi ka liiduväline platvormihaldur) ja kes on Eestis § 20²⁸ lõike 1 kohaselt registreeritud.
§ 20²³. Platform manager
(1) For the purposes of this chapter, the platform manager is a legal person or a legal arrangement that enters into a contract with the seller in order to make the platform or a part thereof available to the seller.
(2) For the purposes of this chapter, an information provider is a platform manager that is an Estonian resident. Where the platform manager is not an Estonian resident, they are considered information providers in case their place of management is in Estonia or in case they have a permanent place of business in Estonia or in case they are a legal arrangement established based on the Estonian law.
(3) A platform manager that is not a resident of any Member State, that is not established in accordance with the law of any Member State, that does not have a place of management or a permanent place of business in any Member State, but mediates the activities of the seller provided in the first sentence of subsection 2 of § 20²² of this Act, is also considered an information provider (hereinafter also a non-Union platform manager) and who is registered in Estonia in accordance with subsection 1 of § 20²⁸.

§ 20²⁴. Hoolsusmeetmete rakendamine
Platvormihaldur tuvastab hoolsusmeetmeid rakendades jooksva kalendriaasta 31. detsembriks tema platvormil tegutsevad aruandlusega hõlmatud müüjad.
Juriidiline isik või õiguslik moodustis rakendab platvormihaldurina tegevuse alustamise kalendriaasta kohta käivad hoolsusmeetmed sellele järgneva kalendriaasta 31. detsembriks.
Platvormihaldur võib hoolsusmeetmete rakendamisel tugineda eelmiste kalendriaastate hoolsusmeetmetele, kui:
müüja kohta käiv teave on kogutud ja kontrollitud või kinnitatud viimase 36 kuu jooksul ning
platvormihalduril ei ole põhjust arvata, et müüja kohta või tema poolt rendile või üürile antud kinnisasja või selle osa kohta kogutud teave on ebausaldusväärne.
Platvormihaldur võib hoolsusmeetmeid rakendada kolmanda isiku kaudu, kuid vastutus nende nõuetekohasuse eest lasub platvormihalduril.
Platvormihaldur ei ole kohustatud koguma teavet ega rakendama muid hoolsusmeetmeid sellise müüja suhtes, kes ei ole jooksval kalendriaastal tegelenud aruandekohustusega hõlmatud tegevusega ega saanud tasu selle tegevusega seoses.
§ 20²⁴. Implementation of due diligence measures
(1) By applying due diligence measures the platform manager identifies the sellers operating on their platform covered by reporting, by 31 December of the current calendar year.
(2) A legal person or legal arrangement implements due diligence measures for the calendar year of commencing operations as a platform manager by 31 December of the following calendar year.
(3) The platform manager may rely on the due diligence measures for previous calendar years upon implementing due diligence measures, where:
1) the information about the seller has been collected and verified or confirmed within last 36 months and
2) the platform manager has no reason to believe that the information collected about the seller or about the immovable property or a part thereof, leased or rented out by the seller, is unreliable.
(4) The platform manager may implement due diligence measures through a third party, but the responsibility for their compliance lies with the platform manager.
(5) The platform manager is not obliged to collect information or implement other due diligence measures in relation to a seller who has not been engaged in an activity covered by the reporting obligation in the current calendar year nor has received payment related to this activity.
§ 20²⁵. Aruandlusega hõlmatud müüja ja kinnisasja või selle osa kohta teabe esitamine
Teabeandja esitab aruandlusega hõlmatud müüja kohta ja asjakohasel juhul tema poolt rendile või üürile antud kinnisasja või selle osa kohta käiva teabe maksuhaldurile hiljemalt hoolsusmeetmete rakendamisele järgneva kalendriaasta 31. jaanuaril.
Käesoleva seaduse § 20²⁴ lõikes 2 sätestatud juhul esitab teabeandja platvormihaldurina tegevuse alustamise kalendriaasta kohta käiva teabe maksuhaldurile hiljemalt ülejärgmise kalendriaasta 31. jaanuaril.
Teabeandja ei pea maksuhaldurile teavet esitama, kui:
ta hoolsusmeetmete rakendamisel ei tuvastanud oma platvormil aruandlusega hõlmatud müüjaid ja teavitab sellest maksuhaldurit hiljemalt 31. jaanuaril;
ta esitab või on esitanud teabe nõuetekohaselt teise liikmesriigi pädevale ametiasutusele ja teavitab sellest maksuhaldurit hiljemalt 31. jaanuaril;
sama teave on teise platvormihalduri poolt maksuhaldurile, teise liikmesriigi või käesoleva seaduse § 20³⁰ lõikes 1 sätestatud Euroopa Liidu välise riigi või jurisdiktsiooni pädevale ametiasutusele juba esitatud ja teabeandjal on tõendeid selle kohta.
Käesoleva paragrahvi lõike 3 punktis 2 sätestatud alusele ei saa tugineda liiduväline platvormihaldur, kes on ennast käesoleva seaduse § 20²⁸ lõike 1 kohaselt Eestis registreerinud.
Teabeandja esitab teabe enne maksuhaldurile esitamist aruandlusega hõlmatud müüjale, kelle kohta see käib.
§ 20²⁵. Submission of information about seller covered by reporting and immovable property or part thereof
(1) The information provider submits information about the seller covered by reporting and, in a relevant case, about the immovable property or part thereof leased or rented out by the seller, to the tax authority at the latest on 31 January of the calendar year following the implementation of due diligence measures.
(2) In the case provided in subsection 2 of § 20²⁴ of this Act, the information provider submits the information regarding the calendar year of the commencement of activities as a platform manager to the tax authority at the latest on 31 January of the calendar year after the next calendar year.
(3) The information provider does not have to submit information to the tax authority where:
1) during the implementation of due diligence measures, they have not identified on their platform the sellers covered by reporting, and inform the tax authority thereof at the latest on 31 January;
2) they submit or have submitted information properly to the competent authority of another Member State and inform the tax authority thereof at the latest on 31 January;
3) the same information has already been submitted by another platform manager to the tax authority, the competent authority of another Member State or a non-Union country or jurisdiction, as provided in subsection 1 of § 20³⁰ of this Act, and the information provider has evidence thereof.
(4) A non-Union platform manager who has registered themselves in Estonia in accordance with subsection 1 of § 20²⁸ of this Act cannot rely on the basis provided in clause 2 of subsection 3 of this section.
(5) Before submitting the information to the tax authority, the information provider submits information to the seller covered by reporting to whom it applies.
§ 20²⁶. Hoolsusmeetmed ja esitatava teabe loetelu
Käesoleva seaduse § 20²⁴ kohased hoolsusmeetmed, samuti § 20²⁵ kohaselt maksuhaldurile esitatava teabe loetelu kehtestab valdkonna eest vastutav minister määrusega.
§ 20²⁶. Due diligence measures and list of information to be submitted
Due diligence measures in accordance with § 20²⁴ of this Act, as well as the list of information to be submitted to the tax authority in accordance with § 20²⁵, are established by a regulation of the minister in charge of the policy sector.
§ 20²⁷. Platvormihalduri vabastamine käesolevas peatükis sätestatud kohustustest
Kui platvormi ärimudelist tulenevalt ei saa sellel tegutseda käesoleva seaduse § 20²² lõike 2 esimeses lauses sätestatud müüjad, võib maksuhaldur platvormihalduri tema taotlusel vabastada jooksva kalendriaasta suhtes käesolevas peatükis sätestatud kohustuste täitmisest eelnimetatud müüjatega seoses.
Maksuhaldur teavitab teiste liikmesriikide pädevaid ametiasutusi igast platvormihaldurist, kes on käesoleva paragrahvi lõike 1 kohaselt vabastatud käesolevas peatükis sätestatud kohustuste täitmisest.
Platvormihaldur loetakse jooksva kalendriaasta suhtes käesolevas peatükis sätestatud kohustuste täitmisest vabastatuks ilma käesoleva paragrahvi lõike 1 kohase taotluseta, kui teise liikmesriigi pädev ametiasutus, kellele ta oleks pidanud teavet esitama, on ta samaväärsel viisil juba vabastanud.
§ 20²⁷. Exemption of platform manager from the obligations provided in this Chapter
(1) In case, due to the business model of the platform, the sellers provided in the first sentence of subsection 2 of § 20²² of this Act cannot operate on it, the tax authority may exempt the platform manager, at their request, from fulfilling the obligations provided in this Chapter regarding the current calendar year in relation to the above-mentioned sellers.
(2) The tax manager informs the competent authorities of other Member States about each platform manager who is exempted in accordance with subsection 1 of this section from fulfilling the obligations provided in this Chapter.
(3) The platform manager is deemed to be exempted from fulfilling the obligations provided in this Chapter with regard to the current calendar year, without a request in accordance with subsection 1 of this section, in case the competent authority of another Member State to which they should have submitted information has already exempted them in an equivalent manner.

§ 20²⁸. Liiduvälise platvormihalduri registreerimiskohustus
Liiduväline platvormihaldur on kohustatud ennast viivitamata registreerima maksuhalduri juures, kui ta tuvastab hoolsusmeetmete rakendamisel, et tema platvormil tegutsevad käesoleva seaduse § 20²² lõike 2 esimeses lauses sätestatud aruandlusega hõlmatud müüjad. Liiduväline platvormihaldur ei saa taotleda maksuhalduri juures registreerimist, kui ta:
on samaväärselt juba registreeritud teises liikmesriigis;
taotleb samaväärset registreerimist teises liikmesriigis.
Maksuhaldur teavitab teiste liikmesriikide pädevaid ametiasutusi liiduvälise platvormihalduri registreerimisest.
Liiduvälist platvormihaldurit ei registreerita maksuhalduri juures, kui ta varasem registreering maksuhalduri või teise liikmesriigi pädeva ametiasutuse juures on tunnistatud kehtetuks platvormialase teabe nõuetekohaselt esitamata jätmise tõttu ja kõnealune teave on jätkuvalt nõuetekohaselt esitamata.
Liiduvälise platvormihalduri registreerimise korra kehtestab valdkonna eest vastutav minister määrusega.
§ 20²⁸. Registration obligation of non-Union platform manager
(1) A non-Union platform manager is required to register themselves immediately with the tax authority, in the case where they establish upon the implementation of due diligence measures that the sellers covered by the reporting provided in the first sentence of subsection 1 of § 20²² of this Act, operate on their platform. A non-Union platform manager cannot apply for registration with the tax authority in the case where they:
1) have already been equivalently registered in another Member State;
2) apply for equivalent registration in another Member State.
(2) The tax manager informs the competent authorities of other Member States about the registration of the non-Union platform manager.
(3) A non-Union platform manager is not registered with the tax authority in the case where their previous registration with the tax authority or the competent authority of another Member State has been declared invalid due to a failure to properly submit platform-related information and the relevant information is still not properly submitted.
(4) The rules for registration of a non-Union platform manager are established by a regulation of the minister in charge of the policy sector.
§ 20²⁹. Liiduvälise platvormihalduri registreeringu kehtetuks tunnistamine
Maksuhaldur tunnistab liiduvälise platvormihalduri registreeringu kehtetuks, kui:
liiduväline platvormihaldur ei täida nõuetekohaselt maksuhaldurile teabe esitamise kohustust vaatamata maksuhalduri korduvatele meeldetuletustele;
liiduväline platvormihaldur teavitab maksuhaldurit, et ta ei vahenda oma platvormil enam aruandlusega hõlmatud müüjaid;
maksuhalduril on alust arvata, et liiduväline platvormihaldur on lõpetanud oma tegevuse platvormihaldurina või ei ole enam käsitatav liiduvälise platvormihaldurina;
liiduväline platvormihaldur vabaneb registreerimise kohustusest käesoleva seaduse § 20³⁰ lõike 1 kohaselt;
liiduväline platvormihaldur esitab selleks taotluse ning taotluse esitamisele eelnevate kalendriaastate kohta käiv platvormialane teave on nõuetekohaselt maksuhaldurile esitatud.
Käesoleva paragrahvi lõike 1 punktis 1 nimetatud juhul tunnistatakse registreering kehtetuks hiljemalt 90 päeva möödumisel teabe esitamise tähtpäevast, kuid mitte enne 30 päeva möödumist viimasest meeldetuletusest.
Käesoleva paragrahvi lõike 1 punktis 5 nimetatud juhul peab platvormihaldur taotlusele lisama käesoleva seaduse alusel esitamisele kuuluva jooksva kalendriaasta kohta käiva olemasoleva platvormialase teabe.
§ 20²⁹. Repeal of registration of non-Union platform manager
(1) The tax authority declares the registration of a non-Union platform manager invalid in the case where:
1) a non-Union platform manager does not properly fulfil the obligation to submit information to the tax authority despite the repeated reminders by the tax authority;
2) a non-Union platform manager informs the tax authority that they no longer mediate on their platform the sellers covered by reporting;
3) the tax authority has a reason to believe that a non-Union platform manager has terminated their activities as a platform manager or are no longer considered a non-Union platform manager;
4) a non-Union platform manager is exempt from the obligation to register in accordance with subsection 1 of § 20³⁰ of this Act;
5) a non-Union platform manager submits an application for that purpose and the platform-related information has been duly submitted to the tax authority for the calendar years prior to the submission of the application.
(2) In the case specified in clause 1 of subsection 1 of this section, the registration is declared invalid at the latest 90 days after the expiry of the due date for submitting the information, but not before 30 days have passed as of the last reminder.
(3) In the case specified in clause 5 of subsection 1 of this section, the platform manager must add to the application the existing platform-related information to be submitted for the current calendar year based on this Act.
§ 20³⁰. Liiduvälise platvormihalduri vabastamine registreerimis- ja teabe esitamise kohustusest
Liiduväliselt platvormihaldurilt ei nõuta teabe esitamist selle aruandlusega hõlmatud müüja kohta, kelle suhtes on juba ette nähtud samaväärse teabe automaatne vahetamine liikmesriigiga selle riigi või jurisdiktsiooni poolt, kus liiduväline platvormihaldur on resident või kus ta on asutatud või kus on tema juhtimise koht, ega selle müüja puhul enda registreerimist.
Teabe samaväärsust kinnitab Euroopa Komisjon direktiivis sätestatud alusel ja korras rakendusmäärusega.
§ 20³⁰. Exemption of non-Union platform manager from obligation to register and submit information
(1) The non-Union platform manager is not required to submit information about the seller covered by reporting with regard to whom the automatic exchange of equivalent information with the Member State has already been prescribed by the country or jurisdiction where the non-Union platform manager is resident or where they are established or where their place of management is located and in the case of this seller, upon self-registration.
(2) The European Commission confirms the equivalence of information based on and according to the rules provided in the directive, by an implementing regulation.
3. peatükk Järelevalve
§ 21. Järelevalveasutus
Käesoleva seaduse ja selle alusel antud õigusaktide täitmise üle teostab järelevalvet maksuhaldur maksukorralduse seaduses sätestatud korras.
§ 21. Supervisory authority
The tax authority exercises supervision over the compliance with this Act and the legislation issued on the basis thereof in accordance with the procedure provided in the Taxation Act.
§ 22. Sunniraha
Käesolevast seadusest tulenevate teabeandja kohustuste täitmata jätmise korral võib maksuhaldur määrata kohustuste täitmiseks täiendava tähtaja ja teha maksukorralduse seaduse § 136 kohase sunniraha rakendamise hoiatuse.
Kui teabeandja või seaduses sätestatud juhul asjaomane maksukohustuslane ei ole hoiatuses märgitud tähtpäevaks kohustusi täitnud, peab ta tasuma hoiatuses märgitud sunniraha. Maksuhaldur esitab kohustatud isikule sunniraha tasumise nõude korraldusega, määrab selle tasumise tähtaja ning teeb hoiatuse, et sunniraha tähtaja jooksul tasumata jätmise korral nõue sundtäidetakse vastavalt maksukorralduse seaduse §-dele 128–132.
Kohustuse täitmisele sundimiseks ei tohi sunniraha kokku ületada 3300 eurot, sealjuures ei tohi see esimesel korral ületada 1300 eurot ja teisel korral 2000 eurot.
Käesolevas paragrahvis sätestatut kohaldatakse ka Eesti maksuresidendist kontserni liikme suhtes käesoleva seaduse §-s 20⁶ sätestatud teavitamiskohustuse täitmata jätmise korral.
§ 22. Non-compliance levy
(1) In the case of a failure to perform the obligations of the information provider arising from this Act, the tax authority may set an additional term for the performance of obligations and issue a warning of imposing non-compliance levy in accordance with § 136 of the Taxation Act.
(2) The non-compliance levy specified in the warning must be paid in the case of a failure of the information provider or, in the case provided by law, of a taxable person concerned to perform the obligations by the due date specified in the warning. The tax authority submits a claim for payment of non-compliance levy to the obligated person by an order, determines the term of payment and issues a warning that in case of a failure to pay non-compliance levy within the time limit, the claim is subject to compulsory execution in accordance with §§ 128-132 of the Taxation Act.
(3) In order to enforce the performance of the obligations the amount of non-compliance levy may not exceed 3,300 euros, whereas it may not exceed 1,300 euros in the first event and 2,000 euros in the second event.
(4) The provisions of this section are applied also to a member of the group that is a tax resident in Estonia upon a failure to perform the notification obligation provided in § 20⁶.
§ 22¹. Platvormile juurdepääsul hoiatuse kuvamine ja juurdepääsu piiramine teabe esitamata jätmise tõttu
Maksuhaldur võib infoühiskonna teenuse osutajalt ettekirjutusega nõuda platvormile juurdepääsul kasutajatele hoiatuse kuvamist, kui teabeandja ei ole maksuhalduri määratud täiendava tähtaja jooksul teavet esitanud.
Maksuhaldur võib internetiteenust osutavalt üldkasutatava elektroonilise sideteenuse osutajalt nõuda platvormile juurdepääsu piiramist ja ettekirjutuses nimetatud domeeninime blokeerimist talle kuuluvates nimeserverites, kui rikkumise kõrvaldamiseks puuduvad muud tõhusad võimalused.
Käesoleva paragrahvi lõigetes 1 ja 2 sätestatut kohaldatakse ka liiduvälisele platvormihaldurile, kes ei ole täitnud käesoleva seaduse § 20²⁸ lõike 1 kohast registreerimiskohustust või on sama paragrahvi lõikes 3 sätestatud põhjusel registreerimata.
Maksuhalduril on õigus teha käesoleva paragrahvi lõikes 2 nimetatud ettekirjutus, kui ta on teabeandjat blokeerimise hoiatusel kohustanud teavet esitama täiendava tähtaja jooksul, mis peab olema vähemalt 90 päeva.
Maksuhaldur teavitab infoühiskonna teenuse osutajat hoiatuse kuvamise ja üldkasutatava elektroonilise sideteenuse osutajat blokeeringu põhjuse äralangemisest, misjärel hoiatus või blokeering kõrvaldatakse teavitamisele järgneval tööpäeval.
§ 22¹. Display of warning and restriction of access upon access to platform due to failure to submit information
(1) The tax authority may, by a precept, require the information society service provider to display a warning to users upon access to the platform where the information provider has failed to submit information within the additional term set by the tax authority.
(2) The tax authority may require the provider of publicly available electronic communications service providing internet service to restrict access to the platform and block the domain name specified in the precept in the name servers belonging thereto, where there are no other effective opportunities to eliminate the violation.
(3) The provisions of subsections 1 and 2 of this section also apply to a non-Union platform manager who has not complied with the registration obligation in accordance with subsection 1 of § 20²⁸ of this Act or has failed to register for the reason provided in subsection 3 of the same section.
(4) The tax authority has the right to issue a precept specified in subsection 2 of this section, where they have obligated the information provider, based on a warning of blocking, to submit information within an additional term, which must be at least 90 days.
(5) The tax authority informs the information society service provider of the lapse of the reason for the display of the warning, and the publicly available electronic communication service provider of the lapse of the reason for the display of blocking, after which the warning or blocking is removed on the working day following the notification.
4. peatükk Rakendussätted
§ 23. Teabe töötlusest teavitamine ja maksukohustuslaste identifitseerimisnumbrite kogumine
Teabeandja teavitab kirjalikku taasesitamist võimaldavas vormis kõiki kliente, kellega ärisuhe rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses on loodud enne käesoleva seaduse jõustumist, käesoleva seaduse alusel toimuvast teabe kogumisest, teabevahetusest ning teabe automaatsest edastamisest hiljemalt 2015. aasta 30. märtsil. Käesoleva lõike esimeses lauses sätestatut ei kohaldata teabeandja suhtes, kellel puudub teabevahetuseks kogutava teabe maksuhaldurile esitamise kohustus käesoleva seaduse 2. peatüki alusel.
Käesoleva paragrahvi lõikes 1 nimetamata teabeandja, kes on klientidega loonud rahapesu ja terrorismi rahastamise tõkestamise seaduse tähenduses ärisuhteid ajal, kui talle ei kohaldunud käesoleva seaduse § 6 lõige 2, teavitab kirjalikku taasesitamist võimaldavas vormis neid kliente käesoleva seaduse alusel toimuvast teabe kogumisest, teabevahetusest ning teabe automaatsest edastamisest kolme kalendrikuu jooksul alates ajast, kui teabeandjale kohaldub käesoleva seaduse § 6 lõige 2.
Käesoleva seaduse § 16 lõike 1 punktis 1 sätestatud nõuete täitmiseks teavitab aruandekohustuslik Eesti finantsasutus hiljemalt 2016. aasta 30. juunil kliendiandmete puudulikkusest kontoomanikku, kes on või keda kontrolliv isik on hoolsusmeetmete võtmise tulemusena tuvastatud kindlaksmääratud USA isikuna, kelle Ameerika Ühendriikide maksukohustuslase identifitseerimisnumber ei ole teada. Nimetatud kontoomanik esitab aruandekohustuslikule Eesti finantsasutusele Ameerika Ühendriikide maksukohustuslase identifitseerimisnumbri hiljemalt 2016. aasta 31. detsembril.
§ 23. Notification of information processing and collection of identification numbers of reporting persons
(1) The information provider informs, in a form reproducible in writing, all the customers with whom a business relationship for the purposes of the Money Laundering and Terrorist Financing Prevention Act was created before the entry into force of this Act, of the collection, exchange and automatic communication of information in accordance with this Act at the latest on 30 March 2015. The provisions of the first sentence of this subsection are not applied to the information provider who has no obligation to submit information for the exchange of information to the tax authority based on Chapter 2 of this Act.
(1¹) The information provider not specified in subsection 1 of this section, who has created business relationship with customers for the purposes of the Money Laundering and Terrorist Financing Prevention Act during the time when subsection 2 of § 6 of this Act had not been applied thereto, notifies such customers in a form reproducible in writing of the collection, exchange and automatic communication of information on the basis of this Act within three calendar months as of the time when subsection 2 of § 6 of this Act was applied to the information provider.
(2) In order to enforce compliance with the obligation provided in clause 1 of subsection 1 of § 16 of this Act, the reporting Estonian financial institution notifies, at the latest on 30 June 2016, the account holder who, as result of the taking of due diligence measures, has been identified or the controlling person of whom has been identified as a US person whose Taxpayer Identification Number of the United States of America is not known, of the deficiency of the customer data established. The specified account holder submits the Taxpayer Identification Number of the United States of America to the reporting Estonian financial institution at the latest on 31 December 2016.
§ 23¹. Käesoleva seaduse 1¹. peatüki rakendamine
Aruandekohustuslik Eesti finantsasutus kohaldab käesoleva seaduse 1¹. peatükis nimetatud aruandlus- ja hoolsusmeetmeid ning kogub esmakordselt teabe 2016. aastal avatud finantskontode kohta 2016. aasta 31. detsembriks.
Aruandekohustuslik Eesti finantsasutus kohaldab aruandlus- ja hoolsusmeetmeid ning kogub teabe olemasolevate finantskontode kohta esmakordselt järgmiselt:
füüsilise isiku olemasolevate kõrge väärtusega, direktiivi lisa 1 8. jao C jaotise punktis 15 sätestatud tingimustele vastavate finantskontode kohta 2016. aasta 31. detsembriks;
füüsilise isiku olemasolevate madalama väärtusega, direktiivi lisa 1 8. jao C jaotise punktis 14 sätestatud tingimustele vastavate finantskontode kohta 2017. aasta 31. detsembriks;
direktiivi lisa 1 5. jao E jaotise punktis 1 sätestatud tingimustele vastavate ettevõtte olemasolevate finantskontode kohta 2017. aasta 31. detsembriks.
Direktiivi lisades 1 ja 2 sätestatud aruandlus- ja hoolsusmeetmete kohaldamisel võib aruandekohustuslik Eesti finantsasutus:
kohaldada uutele finantskontodele ette nähtud hoolsusmeetmeid kõigi olemasolevate finantskontode suhtes, samuti kõrge väärtusega finantskontodele ette nähtud hoolsusmeetmeid kõigi madalama väärtusega finantskontode suhtes;
tugineda olemasoleva madalama väärtusega finantskonto füüsilisest isikust omaniku maksuresidentsuse tuvastamiseks tema kehtivale elukoha aadressile, kui aruandekohustuslikul Eesti finantsasutusel ei ole alust kahelda andmete õigsuses;
kohaldada ettevõtte olemasolevate finantskontode suhtes hoolsusmeetmeid ja edastada nende kohta teavet pärast seda, kui finantskontode kogujääk või -väärtus ületab direktiivi lisa 1 5. jao E jaotise punktis 1 nimetatud piirmäära;
käsitada olemasolevana sellist finantskontot, mille avab mis tahes ajal samas finantsasutuses olemas oleva konto omanik ning mida finantsasutus käsitab koos selle isiku teiste finantskontodega ühe finantskontona, millele laienevad rahapesu ja terrorismi rahastamise tõkestamise seaduse alusel kohaldatavad hoolsusmeetmed ning mille avamisel peab konto omanik esitama vaid direktiivis nimetatud teavet;
koguda esmakordselt finantsvara müügist või lunastamisest saadud brutotulu kohta teabe käesolevas paragrahvis sätestatud vastavast tähtajast ühe aasta võrra hiljem.
Finantskonto kindlaksmääramisel käesoleva paragrahvi lõike 3 tähenduses kohaldab aruandekohustuslik Eesti finantsasutus direktiivi lisa 1 7. jao C jaotises sätestatud kontojääkide liitmise ja vääringutega seotud eeskirju. Nimetatud eeskirjade kohaldamise tulemusena saadud negatiivne konto kogujääk või -väärtus loetakse nullväärtuseks.
Käesoleva paragrahvi lõikes 3 sätestatud erisusi kohaldatakse kõigile aruandekohustusliku Eesti finantsasutuse peetavatele finantskontodele ühetaoliselt.
Käesoleva seaduse § 8¹ lõike 5 punktis 2 sätestatud teabevahetusest välistamata jäetud täiendava kogumispensioni kindlustuslepingu suhtes kohaldab aruandekohustuslik Eesti finantsasutus käesoleva seaduse 1¹. peatükis nimetatud aruandlus- ja hoolsusmeetmeid ning kogub teabe esmakordselt 2020. aasta 31. detsembriks.
Direktiivi lisast 1 tulenevaid muudatusi kohaldatakse käesoleva seaduse § 4¹ lõike 1 ja 1¹. peatüki rakendamisel alates 2026. aasta 1. jaanuarist.
§ 23¹. Implementation of Chapter 1¹ of this Act
(1) A reporting Estonian financial institution applies the reporting and due diligence measures specified in Chapter 1¹ of this Act and collects information concerning financial accounts opened in 2016 for the first time by 31 December 2016.
(2) A reporting Estonian financial institution applies reporting and due diligence measures and collects information on existing financial accounts for the first time as follows:
1) on the existing high value financial accounts of a natural person in accordance with the conditions provided in clause 15 of Division C of Subchapter 8 of Annex 1 of the Directive by 31 December 2016;
2) on the existing lower value financial accounts of a natural person in accordance with the conditions provided in clause 14 of Division C of Subchapter 8 of Annex 1 of the Directive by 31 December 2017;
3) on the existing financial accounts of a company in accordance with the conditions provided in clause 1 of Division E of subsection 5 of Annex 1 of the Directive by 31 December 2017.
(3) Upon application of reporting and due diligence measures provided in Annexes 1 and 2 to the Directive the reporting Estonian financial institutions may:
1) apply due diligence measures prescribed for new financial accounts to all pre-existing financial accounts, as well as the due diligence measures prescribed for high value financial accounts to all lower value financial accounts;
2) rely on the current address of the place of residence of an account holder of lower value financial account, who is a natural person, upon identification of their tax residency in case the reporting Estonian financial institution has no grounds to doubt the accuracy of the data;
3) apply due diligence measures with regard to the pre-existing financial accounts of a company and submit information about them after the total balance or value of the financial accounts exceeds the maximum rate specified in clause 1 of Division E of Subchapter 5 of Annex 1 of the Directive;
4) consider as pre-existing such financial account which is opened at any time in the same financial institution by the account holder of the pre-existing account and which is treated by the financial institution as one financial account together with other financial accounts of such a person, to which due diligence measures applicable on the basis of the Money Laundering and Terrorist Financing Prevention Act are extended and upon opening of which the account holder is required to submit only information specified in the Directive;
5) collect information concerning gross proceeds from the sale or redemption of financial assets for the first time by one year later than the term provided in this section.
(4) Upon identification of the financial account for the purposes of subsection 3 of this section a reporting Estonian financial institution applies rules related to account balance aggregation and currency rules provided in Division C of Subchapter 7 of Annex 1 of the Directive. The negative account balance aggregation or value received as a result of applying the specified rules are deemed as a zero value.
(5) The specifications provided in subsection 3 of this section are uniformly applied to all financial accounts kept by a reporting Estonian financial institution.
(6) With regard to an insurance contract which is not precluded from the exchange of information provided in clause 2 of subsection 5 of § 8¹ of this Act, a reporting Estonian financial institution applies the reporting and due diligence measures specified in Chapter 1¹ of this Act and collects information for the first time by 31 December 2020.
(7) The amendments arising from Annex 1 to the Directive are applied upon the implementation of subsection 1 and Chapter 1¹ of § 4¹ of this Act as of 1 January 2026.
§ 23². Käesoleva seaduse 2. peatüki rakendamine
Aruandekohustuslikul Eesti finantsasutusel on käesoleva seaduse § 23¹ lõike 3 punktis 4 nimetatud õigus ka käesoleva seaduse 2. peatükist tulenevate kohustuste täitmisel kooskõlas FATCA kokkuleppega.
Käesoleva seaduse § 8¹ lõikes 5 ja § 23¹ lõikes 6 sätestatut kohaldatakse ka käesoleva seaduse 2. peatükist tulenevate kohustuste täitmisel.
§ 23². Implementation of Chapter 2 of this Act
(1) A reporting Estonian financial institution has the right specified in clause 4 of subsection 3 of § 23¹ of this Act also upon performance of the obligations based on Chapter 2 of this Act in accordance with the FATCA agreement.
(2) The provisions of subsection 5 of § 8¹ and subsection 6 of § 23¹ of this Act are also applied upon the performance of obligations arising from Chapter 2 of this Act.
§ 23³. Käesoleva seaduse 2¹. peatüki rakendamine
Maksuhaldur võib edastada Euroopa Liidu liikmesriigi pädevale ametiasutusele ja Euroopa Komisjonile teavet selliste eelotsuste kohta, mis on antud alates 2012. aasta 1. jaanuarist.
Ajavahemikul 2012. aasta 1. jaanuarist kuni 2013. aasta 31. detsembrini antud eelotsus on hõlmatud automaatse teabevahetusega juhul, kui see on 2017. aasta 1. jaanuari seisuga kehtiv.
Andmed käesoleva paragrahvi lõikes 1 nimetatud eelotsuste kohta, mis on antud enne 2017. aasta 1. jaanuari, edastab maksuhaldur igale Euroopa Liidu liikmesriigile ning Euroopa Komisjonile 2017. aasta 31. detsembriks.
Käesoleva seaduse § 20¹ lõikeid 4 ja 5 kohaldatakse sellisele eelotsusele, mis on tehtud või mida on muudetud või uuendatud pärast 2026. aasta 1. jaanuari.
§ 23³. Implementation of Chapter 2¹ of this Act
(1) The tax authority may communicate information to a competent authority of a Member State of the European Union and the European Commission concerning such preliminary rulings which have been issued since 1 January 2012.
(2) The preliminary ruling issued during the period from 1 January 2012 to 31 December of 2013 is included in the automatic exchange of information in case it is valid as at 1 January 2017.
(3) The tax authority communicates the data concerning the preliminary rulings specified in subsection 1 of this section, which have been issued before 1 January 2017, to each Member State of the European Union and the European Commission by 31 December of 2017.
(4) Subsections 4 and 5 of § 20¹ of this Act are applied to such a preliminary ruling which has been made, amended or renewed after 1 January 2026.
§ 23⁴. Käesoleva seaduse 2². peatüki rakendamine
Käesoleva seaduse 2². peatükis sätestatut kohaldatakse sellist majandusaastat puudutavate andmete kohta, mis algab 2016. aasta 1. jaanuaril või sellest hilisemal kuupäeval.
Aruandekohustuslik üksus, kes ei ole kontserni emaüksus, esitab riikidepõhise aruande esimest korda majandusaasta kohta, mis algab 2017. aasta 1. jaanuaril või sellest hilisemal kuupäeval.
Käesoleva seaduse § 20⁷ lõiget 2 kohaldatakse andmete kohta, mis puudutavad majandusaastat, mis algab 2024. aasta 22. juulil või sellest hilisemal kuupäeval.
§ 23⁴. Implementation of Chapter 2² of this Act
(1) The provisions of Chapter 2² of this Act are applied to data concerning such financial year that begins on 1 January 2016 or at a later date.
(2) A reporting entity that is not a parent entity of the group submits the country-by country report for the first time for the financial year that begins on 1 January 2017 or at a later date.
(3) Subsection 2 of § 20⁷ of this Act is applied to the data relating to the financial year that begins on 22 July of 2024 or at a later date.
§ 23⁵. Käesoleva seaduse 2³. peatüki rakendamine
Käesoleva seaduse 2³. peatükis sätestatut kohaldatakse selliste aruandekohustusega skeemide suhtes, mis tehakse rakendamiseks kättesaadavaks, mis on rakendamiseks valmis või mille rakendamiseks tehakse esimene toiming 2021. aasta 1. jaanuaril või sellest hilisemal kuupäeval.
Teabeandja esitab maksuhaldurile käesoleva seaduse § 20¹³ lõikes 1 nimetatud teabe esmakordselt 2021. aasta 28. veebruariks selliste aruandekohustusega skeemide kohta, mille rakendamisega alustati ajavahemikul 2018. aasta 25. juunist kuni 2020. aasta 30. juunini.
Selliste aruandekohustusega skeemide puhul, mis olid rakendamiseks valmis või mille rakendamisega alustati ajavahemikul 2020. aasta 1. juulist kuni 31. detsembrini, hakatakse käesoleva seaduse § 20¹³ lõikes 2 sätestatud teabe esitamise tähtaja kulgemist lugema 2021. aasta 1. jaanuarist. Käesoleva seaduse § 20¹³ lõikes 3 nimetatud skeemide puhul esitab teabeandja esimest korda uut või täiendavat teavet 2021. aasta 30. aprilliks.
§ 23⁵. Implementation of Chapter 2³ of this Act
(1) The provisions of Chapter 2³ of this Act are applied to such reportable arrangements which are made available for implementation, which are ready for implementation or for the implementation of which the first act is made on 1 January 2021 or on a date later thereof.
(2) The information provider submits information specified in subsection 1 of § 20¹³ of this Act for the first time by 28 February 2021 for such reportable arrangements the implementation of which was commenced within the period of 25 June 2018 until 30 June 2020.
(3) In the case of such reportable arrangements which were ready for implementation or the implementation of which was commenced within the period of 1 July until 31 December 2020, the term for submission of information provided in subsection 2 of § 20¹³ of this Act begins to run from 1 January 2021. In the case of arrangements specified in subsection 3 of § 20¹³ of this Act the information provider submits new or additional information for the first time by 30 April 2021.
§ 23⁶. Käesoleva seaduse 2⁴. peatüki rakendamine
Platvormihaldur rakendab käesoleva seaduse 2⁴. peatükis nimetatud hoolsusmeetmeid nende müüjate suhtes, kes on platvormil 2023. aasta 1. jaanuari seisuga registreeritud, hiljemalt 2024. aasta 31. detsembriks ning esitab nende ja asjakohasel juhul nende poolt rendile või üürile antud kinnisasja või selle osa kohta käiva 2023. aasta teabe hiljemalt 2025. aasta 31. jaanuaril.
§ 23⁶. Implementation of Chapter 2⁴ of this Act
The platform manager applies due diligence measures specified in Chapter 2⁴ of this Act to the sellers that are registered on the platform as at 1 January 2023, at the latest by 31 December 2024, and submits information for 2023 about them and, in relevant cases, information about immovable property or part thereof leased by them at the latest by 31 January 2025.
§ 23⁷. Käesoleva seaduse § 4¹ lõike 3 rakendamine
Käesoleva seaduse § 4¹ lõikes 3 nimetatud nimekirja lisatud riigi või jurisdiktsiooni maksuresidenti puudutava maksualase teabe esitab teabeandja maksuhaldurile iga aasta 30. juuniks arvates selle riigi või jurisdiktsiooni nimekirja lisamise aastale järgnevast aastast.
§ 23⁷. Implementation of subsection 3 of § 4¹ of this Act
The information provider submits tax information concerning a tax resident of a country or jurisdiction added to the list specified in subsection 3 of § 4¹ of this Act to the tax authority by 30 June of each year as of the year following the year in which the country or jurisdiction was added to the list.
§ 23⁸. Käesoleva seaduse 1². peatüki rakendamine
Käesoleva seaduse 1². peatükis sätestatud krüptovara aruandlusega seotud õiguste ja kohustuste rakendamise korral tuginetakse direktiivi artiklis 8ad ja lisas 6 sätestatule.
Aruandekohustuslik krüptovarateenuse osutaja kohaldab esimest korda käesoleva seaduse 1². peatükis nimetatud aruandlus- ja hoolsusmeetmeid, et koguda teavet 2026. aasta kohta, ning esitab aruandekohustusega hõlmatud krüptovara teabe esimest korda 2027. aasta 30. juuniks.
Nende krüptovara kasutajate hulgast, kellega on aruandekohustuslikul krüptovarateenuse osutajal sõlmitud kliendisuhe 2025. aasta 31. detsembri seisuga, tuvastab krüptovarateenuse osutaja aruandekohustusega hõlmatud krüptovara kasutajad hiljemalt 2027. aasta 1. jaanuariks.
§ 23⁸. Implementation of Chapter 1² of this Act
(1) In case of implementation of the rights and obligations related to the reporting of crypto-assets provided in Chapter 1² of this Act, the provisions of Article 8ad and Annex 6 to the Directive are based on.
(2) A reporting crypto-asset service provider applies the reporting and due diligence measures specified in Chapter 1² of this Act for the first time to collect information for 2026 and submits the information on crypto-assets subject to the reporting obligation for the first time by 30 June 2027.
(3) From among the crypto-asset users with whom the reporting crypto-asset service provider has entered a client relationship as at 31 December 2025, the crypto-asset service provider identifies the users of crypto-assets subject to the reporting obligation by 1 January 2027 at the latest.
