1. peatükk ÜLDSÄTTED
§ 1. Seaduse reguleerimisala
Käesoleva seaduse ülesanne on põhiseadusega igaühele tagatud usuvabaduse teostamiseks sätestada kirikute, koguduste, koguduste liitude, kloostrite ja usuühingute liikmeks astumise kord ning nende tegevuse reguleerimine.
Käesolevas seaduses ettenähtud haldusmenetlusele kohaldatakse haldusmenetluse seaduse sätteid, arvestades käesoleva seaduse erisusi.
§ 1. Scope of application of Act
(1) The purpose of this Act is to provide the procedure for membership of churches, congregations, associations of congregations, monasteries and religious societies and the regulation of their activities in order for freedom of religion as ensured for everyone by the Constitution to be exercised.
(2) The provisions of the Administrative Procedure Act apply to administrative proceedings prescribed in this Act, taking account of the specifications of this Act.
§ 2. Usulised ühendused
Usulised ühendused on kirikud, kogudused, koguduste liidud ja kloostrid ning välislepingu alusel tegutseva kiriku institutsioonid.
Kirik käesoleva seaduse mõistes on episkopaalse struktuuriga ja kolme üldkirikliku usutunnistusega õpetuslikult seotud vähemalt kolme vabatahtlikult liitunud koguduse ühendus või on jaotatud vähemalt kolmeks koguduseks ja kes tegutseb põhikirja alusel, valitud või nimetatud juhatuse juhtimisel ning kantakse registrisse käesoleva seadusega ettenähtud juhtudel ja korras.
Kogudus käesoleva seaduse mõistes on ühte usku tunnistavate füüsiliste isikute vabatahtlik ühendus, kes tegutseb põhikirja alusel ja valitud või nimetatud juhatuse juhtimisel ning kantakse registrisse käesoleva seadusega ettenähtud juhtudel ja korras.
Koguduste liit käesoleva seaduse mõistes on vähemalt kolme vabatahtlikult liitunud ja ühte usku tunnistavate koguduste ühendus, kes tegutseb põhikirja alusel ja valitud või nimetatud juhatuse juhtimisel ning kantakse registrisse käesoleva seadusega ettenähtud korras.
Klooster käesoleva seaduse mõistes on ühte usku tunnistavate füüsiliste isikute vabatahtlik ühiseluline ühendus, kes tegutseb vastava kiriku või iseseisva põhikirja alusel ja valitud või nimetatud kloostriülema juhtimisel ning kantakse registrisse käesoleva seadusega ettenähtud juhtudel ja korras.
Välislepingu alusel tegutseva kiriku institutsiooni suhtes kohaldatakse käesolevat seadust sarnaselt kirikusse kuuluva koguduse kohta sätestatuga.
Kogudus võib kuuluda ühte kirikusse või koguduste liitu.
§ 2. Religious associations
(1) Religious associations are churches, congregations, associations of congregations and monasteries as well as institutions of a church operating on the basis of an international agreement.
(2) For the purposes of this Act, a church is an association of at least three voluntarily joined congregations which has an episcopal structure and is doctrinally related to three ecumenical creeds or is divided into at least three congregations, which operates on the basis of its statutes, is managed by an elected or appointed management board and is entered in the register in the cases and pursuant to the procedure prescribed by this Act.
(3) For the purposes of this Act, a congregation is a voluntary association of natural persons who profess the same faith, which operates on the basis of its statutes, is managed by an elected or appointed management board and is entered in the register in the cases and pursuant to the procedure prescribed by this Act.
(4) For the purposes of this Act, an association of congregations is an association of at least three voluntarily joined congregations which profess the same faith, which operates on the basis of its statutes, is managed by an elected or appointed management board and is entered in the register pursuant to the procedure prescribed by this Act.
(5) For the purposes of this Act, a monastery is a voluntary communal association of natural persons who profess the same faith, which operates on the basis of the statutes of the corresponding church or independent statutes, is managed by an elected or appointed superior of the monastery and is entered in the register in the cases and pursuant to the procedure prescribed by this Act.
(6) This Act shall apply to an institution of a church operating on the basis of an international agreement similarly to the provisions concerning congregations which belong to a church.
(7) A congregation may belong to a single church or to an association of congregations.
§ 3. Usulise ühenduse põhitegevus ja tegevuspiirangud
Kiriku, koguduse, koguduste liidu ja kloostri põhitegevus on oma usu tunnistamine ja viljelemine, eeskätt jumalateenistuste, usuliste koosolekute ja talituste vormis, ning usutunnistusekohane või oikumeeniline moraali-, eetika-, haridus-, kultuuri-, diakoonia-, sotsiaalse rehabilitatsiooni alane või muu tegevus väljaspool kirikule või kogudusele iseloomulikke usuliste talituste ja teenistuste vorme.
Kiriku, koguduse, koguduste liidu ja kloostri eesmärk või põhitegevus ei või olla majandustegevuse kaudu tulu saamine.
Kirik, kogudus, koguduste liit ja klooster ei või olla põhikirja või tegevuse aluseks oleva muu dokumendi alusel või majanduslikult seotud välisriigis asuva vaimuliku keskuse, juhtorgani, usulise ühenduse või vaimuliku juhiga, kes kujutab ohtu Eesti riigi julgeolekule või põhiseaduslikule või avalikule korrale.
Käesoleva paragrahvi lõikes 2¹ nimetatud oht Eesti riigi julgeolekule või põhiseaduslikule või avalikule korrale võib muu hulgas esineda siis, kui samas lõikes nimetatud vaimulik keskus, juhtorgan, usuline ühendus või vaimulik juht õhutab, toetab või rahastab tegevust, mis on suunatud Eesti Vabariigi iseseisvuse, territoriaalse terviklikkuse või põhiseadusliku korra vägivaldsele muutmisele, või toetab või on toetanud sõjalist agressiooni või kutsunud üles sõjale, terrorikuriteole või mõnel muul viisil relvajõu õigusvastasele kasutamisele või vägivallale.
Kiriku, koguduse, koguduste liidu ja nende asutuse juhatustel ning kloostriülemal on õigus anda usulise ühenduse tegevust puudutavaid akte vastavalt põhikirjas sätestatud korrale.
§ 3. Main activities and restrictions on activities of religious associations
(1) The main activities of churches, congregations, associations of congregations, and monasteries include professing and practising their faith, primarily in the form of religious services, meetings and rites, and confessional or ecumenical activities relating to morals, ethics, education, culture, and confessional or ecumenical diaconial and social rehabilitation activities and other activities outside the traditional religious rites and services of the churches or congregations.
(2) The objective or main activity of churches, congregations, associations of congregations and monasteries shall not be the earning of income from economic activity.
(2¹) Churches, congregations, associations of congregations and monasteries may not, on the basis of the statutes or any other document governing their activities, be economically linked to a spiritual centre, governing body, religious association or religious leader situated in a foreign state which constitutes a threat to the security or constitutional or public order of the Estonian state.
(2²) The threat to the security or constitutional or public order of the Estonian state specified in subsection 2¹ of this section may, among other things, arise where a spiritual centre, governing body, religious association or religious leader specified in the same subsection incites, supports or finances activities aimed at changing the independence, territorial integrity or constitutional order of the Republic of Estonia by force, or supports or has supported military aggression, or has called for war, a terrorist offence or the unlawful use of armed force or violence in any other manner.
(3) The management boards of churches, congregations and associations of congregations and the agencies thereof and the superiors of monasteries have the right to issue legal instruments relating to the activities of the religious associations pursuant to the procedure provided for in the statutes.
§ 4. Usuühing
Usuühing on mittetulundusühing või sihtasutus, kelle põhitegevus on usutunnistusekohane või oikumeeniline moraali-, eetika-, haridus-, kultuuri-, diakoonia-, sotsiaalse rehabilitatsiooni alane tegevus väljaspool kirikule või kogudusele iseloomulikke usuliste talituste vorme ning kes ei pea olema seotud konkreetse kiriku, koguduste liidu või kogudusega.
Usuühing ei või olla põhikirja või tegevuse aluseks oleva muu dokumendi alusel või majanduslikult seotud välisriigis asuva juhtorgani või ühendusega, mis kujutab ohtu Eesti riigi julgeolekule või põhiseaduslikule või avalikule korrale.
Käesoleva paragrahvi lõikes 1¹ nimetatud oht Eesti riigi julgeolekule või põhiseaduslikule või avalikule korrale võib muu hulgas esineda siis, kui samas lõikes nimetatud juhtorgan või ühendus õhutab, toetab või rahastab tegevust, mis on suunatud Eesti Vabariigi iseseisvuse, territoriaalse terviklikkuse või põhiseadusliku korra vägivaldsele muutmisele, või toetab või on toetanud sõjalist agressiooni või kutsunud üles sõjale, terrorikuriteole või mõnel muul viisil relvajõu õigusvastasele kasutamisele või vägivallale.
Usuühing kantakse mittetulundusühingute ja sihtasutuste registrisse mittetulundusühingute seaduse või sihtasutuste seadusega ettenähtud korras. Usuühingu põhikirja või kandeavaldusele lisatud asutamislepingu, asutamisotsuse ja muu tegevust reguleeriva alusdokumendi või lepingu seaduses sätestatud nõuetele vastavuse kindlakstegemiseks pöördub Tartu Maakohtu registriosakond (edaspidi registripidaja) seisukoha saamiseks ministeeriumi poole, kelle valitsemisalas on usuliste ühendustega seotud küsimused, ning vajaduse korral pikendab kandeavalduse läbivaatamise tähtaega kuni kolme kuuni. Vajaduse korral kaasab ministeerium seisukoha koostamisse eksperte.
§ 4. Religious society
(1) A religious society is a non-profit association or a foundation the main activities of which include confessional or ecumenical activities relating to morals, ethics, education, culture and confessional or ecumenical diaconial and social rehabilitation activities outside the traditional forms of religious rites of a church or congregation and which need not be connected with a specific church, association of congregations or congregation.
(1¹) A religious society may not, on the basis of the statutes or any other document governing its activities, be economically linked to a governing body or association situated in a foreign state which constitutes a threat to the security or constitutional or public order of the Estonian state.
(1²) The threat to the security or constitutional or public order of the Estonian state specified in subsection 1¹ of this section may, among other things, arise where a governing body or association specified in the same subsection incites, supports or finances activities aimed at changing the independence, territorial integrity or constitutional order of the Republic of Estonia by force, or supports or has supported military aggression, or has called for war, a terrorist offence or the unlawful use of armed force or violence in any other manner.
(2) A religious society is entered in the non-profit associations and foundations register pursuant to the procedure prescribed by the Non-profit Associations Act or the Foundations Act. In order to determine compliance of the statutes of a religious society or the memorandum of association, foundation resolution or any other underlying document governing its activities added to the petition for entry with the requirements of the law, the registration department of Tartu County Court (hereinafter registrar) requests the opinion of the ministry whose area of government includes management of issues relating to religious associations and, where necessary, extends the deadline for reviewing the petition for entry by up to three months. Where necessary, the ministry involves experts in the preparation of its opinion.
§ 5. Õigusvõime
Usuline ühendus on eraõiguslik juriidiline isik, kelle suhtes kohaldatakse mittetulundusühingute seadust, kuivõrd käesolevast seadusest ei tulene teisiti.

Usulise ühenduse õigusvõime tekib tema kandmisega usuliste ühenduste registrisse (edaspidi register) ning lõpeb tema kustutamisega registrist, kui usulisel ühendusel puudub vara.

§ 5. Passive legal capacity
(1) A religious association is a legal person in private law with regard to whom the Non-profit Associations Act applies in so far as this Act does not provide otherwise.
(3) Transformation of a religious association into a legal person of a different type is prohibited.
(4) The passive legal capacity of a religious association commences as of entry of the religious association in the register of religious associations (hereinafter register) and terminates as of deletion of the religious association from the register, if the religious association has no assets.
§ 6. Asukoht
Kiriku, koguduse ja koguduste liidu asukohaks on koht, kus asub kiriku, koguduse ja koguduste liidu juhatus, kui põhikirjaga ei ole ette nähtud teisiti. Kloostri asukohaks on koht, kus asub kloostri hoone või hoonete kompleks.
Usulise ühenduse juhatus asub Eestis, olenemata tema vaimuliku keskuse asukohast.
§ 6. Registered office
(1) The registered office of a church, congregation or association of congregations is the place where the management board of the church, congregation or association of congregations is located unless the statutes prescribe otherwise. The registered office of a monastery is the place where the building or complex of buildings of the monastery are located.
(2) The management board of a religious association is located in Estonia regardless of the location of its spiritual centre.
§ 7. Nimi
Usulise ühenduse nimi peab olema kirjutatud ladina tähtedega ja sisaldama sõna „kirik”, „kogudus” või „klooster” või sõnu „koguduste liit” ning selgelt erinema teistest mittetulundusühingute ja sihtasutuste registrisse kantud juriidiliste isikute nimedest ega või olla eksitav tegevuse eesmärgi, ulatuse ega õigusliku vormi osas ega näida teisi usulisi ühendusi nende tahet omamata usutunnistuselt ühendavana. Usuline ühendus võib oma nimes kasutada sõnade «kogudus» või «koguduste liit» asemel vastavat omanimetust, kui see tuleneb usulise ühenduse ajalooliselt väljakujunenud nimekasutustavast.
Koguduste liidu nimes võib sisalduda registrisse kantud kiriku nimi, kui see võimalus tuleneb kiriku põhikirjast või koguduste liidu ja kiriku vahel sõlmitud lepingust.

§ 7. Name
(1) The name of a religious association must be written in Latin letters and include the word “kirik” [church], “kogudus” [congregation] or “klooster” [monastery] or the words “koguduste liit” [association of congregations] and must clearly differ from the names of other legal persons entered in the non-profits associations and foundations register and must not be misleading with regard to the objectives, scope of activities or legal form, and must not give the impression of uniting other religious associations on the basis of religion without their consent. A religious association may instead of the words “kogudus” [congregation] or “koguduste liit” [association of congregations] use a corresponding own designation in its name, where such a designation derives from the historically established practice of name use of the religious association.
(1¹) The name of an association of congregations may include the name of a church entered in the register, provided that this is permitted under the statutes of the church or an agreement concluded between the association of congregations and the church.
(3) A religious association whose interests are damaged by the unauthorised use of its name may, in civil proceedings, demand termination of the unauthorised use thereof and compensation for damage caused thereby.
2. peatükk ÜKSIKISIKU USUVABADUS
§ 8. Üksikisiku õigused
Igal isikul on õigus vabalt valida, tunnistada ja kuulutada oma usulisi veendumusi, kui see ei kahjusta avalikku korda, tervist, kõlblust ega teiste inimeste õigusi ja vabadusi.
Keegi ei ole kohustatud andma andmeid oma usutunnistuse või kogudusse kuulumise kohta, välja arvatud kriminaalmenetluse käigus kahtlustatav, süüdistatav, kohtualune ja kannatanu.
Igal isikul on õigus lahkuda kogudusest, teatades enne oma otsusest koguduse juhatusele. Igal isikul on õigus lahkuda kloostrist, teatades enne oma otsusest kloostriülemale.
Piiratud teovõimega isiku usutunnistust või kuulumist kogudusse ei ole tema eestkostjal õigus muuta.
Õigus osaleda kiriku, koguduse või koguduste liidu juhatuse ja ametiisikute valimistel on vähemalt 18-aastastel teovõimelistel liikmetel, kui põhikiri ei sätesta teist vanusemäära.
Igale isikule on tagatud õigus saada maetud vastavalt oma usutunnistusele.
Sugulaste, eestkostjate või hooldajate puudumisel viib usutunnistusekohase matusetalituse läbi lahkunu kogudus, kui on teada surnu kuuluvus kogudusse.
§ 8. Rights of individual
(1) Every person has the right to freely choose, profess and declare his or her religious beliefs unless it damages public order, health, morals, or the rights or freedoms of others.
(2) No one is required to provide information on his or her religion or membership in congregations, except a suspect, accused, accused at trial or victim in the course of criminal proceedings.
(3) Every person has the right to leave a congregation if he or she notifies the management board of the congregation of his or her decision beforehand. Every person has the right to leave a monastery if he or she notifies the superior of the monastery of his or her decision beforehand.
(4) The guardian of a person with restricted active legal capacity does not have the right to change the religion or membership in a congregation of the person.
(5) Members with active legal capacity who are at least 18 years of age have the right to participate in the election of the management board and officials of a church, congregation or association of congregations, unless a different age limit is provided for in the statutes.
(6) Every person has the right to be buried according to his or her religion.
(7) In the absence of relatives, guardians or curators, and if it is known that a deceased person was a member of a congregation, the congregation of the deceased person shall perform the confessional funeral service.
§ 9. Usuliste talituste täitmine ravi-, õppe-, hoolekande- ja kinnipidamisasutustes ning kaitseväe struktuuriüksustes
Ravi-, õppe-, hoolekande- ja kinnipidamisasutustes viibijal ning kaitseväelasel on õigus täita usulisi talitusi vastavalt oma usutunnistusele, kui see ei kahjusta avalikku korda, tervist, kõlblust, nendes asutustes kehtestatud korda ega teiste seal viibivate isikute õigusi.
Jumalateenistusi ja usulisi talitusi ravi-, õppe- ja hoolekandeasutustes korraldab usuline ühendus omaniku või asutuse juhi, kinnipidamisasutustes vangla direktori, kaitseväes struktuuriüksuse ülema ning Kaitseliidus maleva pealiku loal.
§ 9. Performance of religious rites in medical institutions, educational institutions, social welfare institutions, custodial institutions and structural units of Defence Forces
(1) Persons staying in medical institutions, educational institutions, social welfare institutions and custodial institutions and members of the Defence Forces have the right to perform religious rites according to their religion unless this violates public order, health, morals, the rules established in these institutions or the rights of others staying or serving in these institutions.
(2) A religious association shall conduct religious services and religious rites in a medical institution, educational institution or social welfare institution with the permission of the owner or the head of the institution, in a custodial institution with the permission of the director of the prison, in the Defence Forces with the permission of the commander of the structural unit and in the National Defence League with the permission of the chief of the unit.
§ 10. Lapse kuulumine kogudusse
Iga isik, kes on vähemalt 15-aastane, võib iseseisvalt astuda koguduse liikmeks või lahkuda kogudusest vastavalt põhikirjas ettenähtud korrale.
Noorem kui 15-aastane laps võib kuuluda kogudusse oma vanemate või eestkostja loal.
§ 10. Membership of child in congregation
(1) Every person of at least 15 years of age may independently become a member of a congregation or leave a congregation pursuant to the procedure prescribed by the statutes.
(2) A child who is less than 15 years of age may be a member of a congregation with the permission of his or her parents or guardian.
3. peatükk USULISTE ÜHENDUSTE ASUTAMINE, REGISTRISSE KANDMINE NING ÜHINEMINE, JAGUNEMINE JA LÕPETAMINE
§ 11. Usulise ühenduse asutamine
Kiriku, koguduste liidu, kirikusse või koguduste liitu mittekuuluva koguduse ning kirikusse mittekuuluva kloostri asutamiseks sõlmivad asutajad asutamislepingu.
Asutamislepingus tuleb märkida:
asutatava kiriku, koguduse, koguduste liidu või kirikusse mittekuuluva kloostri nimi, asukoht, aadress ja tegevuse eesmärk;
asutajate nimed ja elu- või asukohad, samuti asutajate isiku- või registrikoodid;
asutajate kohustused;
juhatuse liikmete nimed, isikukoodid ja elukohad.
Asutamislepingu sõlmimisega kinnitatakse selle lisana kiriku, koguduste liidu, koguduse või kirikusse mittekuuluva kloostri põhikiri.
Kirikusse või koguduste liitu kuuluda sooviv kogudus asutatakse ja tema juhatus valitakse vastava kiriku või koguduste liidu põhikirja alusel, kui nimetatud põhikiri ei näe ette koguduse iseseisva põhikirja vastuvõtmist. Asutamiskoosoleku käik protokollitakse. Protokollile lisatakse koguduse asutajate nimekiri, milles on näidatud nende elukohad ja isikukoodid, koos asutajate allkirjadega.
Kirikusse või koguduste liitu mittekuuluva koguduse või kirikusse mittekuuluva kloostri asutamislepingule kirjutavad alla kõik asutajad.
Kiriku või koguduste liidu asutamisleping ja sellega kinnitatud põhikiri peavad olema notariaalselt tõestatud, kinnitatud või digitaalselt allkirjastatud. Asutamislepingule võib alla kirjutada asutaja esindaja.
Kirikusse kuuluv klooster asutatakse vastava kiriku põhikirjaga ettenähtud korras, asutamiskoosoleku käik protokollitakse. Protokollile lisatakse kloostri asutajate nimekiri, milles on näidatud nende elukohad ja isikukoodid, koos asutajate allkirjadega.
§ 11. Foundation of religious associations
(1) In order to found a church, an association of congregations, a congregation which does not belong to a church or association of congregations or a monastery which does not belong to a church, the founders shall enter into a memorandum of association.
(2) A memorandum of association shall set out:
1) the name, registered office, address and objectives of the activities of the church, congregation, association of congregations being founded or monastery which does not belong to a church and which is being founded;
2) the names and residences or registered offices, and the personal identification codes or registry codes of the founders;
3) the obligations of the founders;
4) the names, personal identification codes and residences of the members of the management board.
(3) Upon entry into a memorandum of association, the statutes of the church, association of congregations, congregation or monastery which does not belong to a church shall also be approved as an annex to the memorandum of association.
(4) A congregation which wishes to belong to a church or association of congregations shall be founded and the management board thereof shall be elected pursuant to the statutes of the corresponding church or association of congregations unless the specified statutes prescribe adoption of independent statutes for the congregation. Minutes shall be taken of the foundation meeting. The list of founders of the congregation which sets out the residences and personal identification codes of the founders together with the signatures of the founders shall be appended to the minutes.
(5) All founders shall sign the memorandum of association of a congregation which does not belong to a church or association of congregations or a monastery which does not belong to a church.
(6) The memorandum of association of a church or association of congregations and the statutes approved thereby must be notarially authenticated, certified or digitally signed. A representative of a founder may sign the memorandum of association.
(7) A monastery which belongs to a church shall be founded pursuant to the procedure prescribed by the statutes of the corresponding church and minutes shall be taken of the foundation meeting. The list of founders of the monastery which sets out the residences and personal identification codes of the founders together with the signatures of the founders shall be appended to the minutes.
§ 12. Põhikiri
Usulise ühenduse põhikiri peab sisaldama järgmisi andmeid:
nimi ja asukoht;
tegevuse eesmärk ja õpetuslik alus;
kohustuslikud usulised talitused;
juhtimis- ja järelevalveorganite struktuur, nende moodustamise kord, pädevus ja volituste tähtaeg;
juhatuse liikmete valimise või nimetamise kord ja esindusõigusega seotud piirangud;
vaimulike staatus, hierarhia, teenistussuhted ja teenistusriietus;
vara moodustumise, kasutamise ja käsutamise kord;
põhikirja vastuvõtmise, muutmise, täiendamise alused ja kord;
tegevuse lõpetamise alused ja kord;
usulise ühenduse liikmeks vastuvõtmise ning liikmeskonnast väljaastumise ja väljaarvamise tingimused ja kord;
liikmete õigused ja kohustused või kord, kuidas võib liikmetele kohustusi kehtestada.
Usulise ühenduse põhikirjas võib ette näha erisusi mittetulundusühingute seaduses liikmete ja juhtimise kohta sätestatust, kui need tulenevad usulise ühenduse ajalooliselt väljakujunenud õpetusest ja struktuurist ning erisused on kooskõlas käesoleva seaduse § 3 lõikes 2¹ sätestatuga.
Käesoleva paragrahvi lõikes 1 nimetatud andmetega seotud otsuse tegemise või otsuse tegemisel osalemise õigust ei või põhikirjaga anda välisriigis asuvale juhtorganile, vaimulikule keskusele, vaimulikule juhile ega ühendusele, kes kujutab ohtu Eesti riigi julgeolekule või põhiseaduslikule või avalikule korrale. Eespool nimetatud ohu hindamisel kohaldatakse käesoleva seaduse § 3 lõiget 2².
Kui kirik või koguduste liit muudab oma põhikirja, millega kaasneb kiriku muutumine koguduste liiduks või koguduste liidu muutumine kirikuks, peavad nimetatud otsuse poolt olema ja selle allkirjastama kõigi vastavasse kirikusse või koguduste liitu kuuluvate koguduste esindajad. Allkirjad otsusel peavad olema notariaalselt kinnitatud.
Usulise ühenduse põhikirja muudatus jõustub vastava kande tegemisel registrisse.
Usulisel ühendusel võivad olla osakonnad ja asutused, kui see on ette nähtud põhikirjaga. Osakonnad ja asutused ei ole juriidilised isikud. Osakonna või asutuse organid ja nende pädevus nähakse ette põhikirjas.
§ 12. Statutes
(1) The statutes of a religious association shall contain the following information:
1) the name and registered office;
2) the objective and doctrinal bases of the activities;
3) obligatory religious rites;
4) the structure of management bodies and supervisory bodies and the procedure for the foundation, competence and terms of authority thereof;
5) the procedure for the election or appointment of members of the management board and restrictions on the right of representation;
6) the status, hierarchy, service relationships and professional attire of the ministers of religion;
7) the procedure for the formation, use and disposal of assets;
8) the bases and procedure for the adoption and amendment of the statutes;
9) the bases and procedure for termination of activities;
10) the conditions and procedure for membership in the religious association and for leaving and exclusion from the religious association;
11) the rights and obligations of members or the procedure for the establishment of obligations for members.
(1¹) The statutes of a religious association may prescribe differences from the provisions of the Non-profit Associations Act concerning members and management where such differences arise from the historical teaching and structure of the religious association and are in compliance with the provisions of subsection 2¹ of § 3 of this Act.
(1²) The right to make decisions relating to the information specified in subsection 1 of this section or to participate in the making of such decisions may not be granted by the statutes to a governing body, spiritual centre, religious leader or association situated in a foreign state which constitutes a threat to the security or constitutional or public order of the Estonian state. Subsection 2² of § 3 of this Act is applied upon the assessment of the abovementioned threat.
(2) If a church or an association of congregations amends the statutes thereof and such amendment involves transformation of the church into an association of congregations or transformation of the association of congregations into a church, representatives of all congregations which belong to the corresponding church or association of congregations must be in favour of the specified decision and sign the decision. The signatures on the decision shall be notarised.
(3) An amendment of the statutes of a religious association enters into force as of the making of a corresponding entry in the register.
(4) A religious association may have departments and agencies if this is prescribed by the statutes. Departments and agencies are not legal persons. The bodies of departments and agencies and their competence shall be prescribed by the statutes.
§ 13. Registrisse kandmise avaldus
Registrisse kantakse kogudus, kuhu kuulub vähemalt 12 täisealist teovõimelist liiget.
Usulise ühenduse kandmiseks registrisse esitab usulise ühenduse juhatus avalduse, milles näidatakse käesoleva seaduse § 15 lõikes 1 nimetatud andmed, ja sellele kirjutavad alla kõik juhatuse liikmed.
Avaldusele lisatakse:
asutamisleping ja sellega kinnitatud põhikiri või asutamiskoosoleku protokoll ja vastava kiriku või koguduste liidu juhatuse poolt kinnitatud põhikiri;

sidevahendite (telefon, faks vms) numbrid;
tõend riigilõivu tasumise kohta.
Välislepingu alusel tegutseva usulise ühenduse puhul esitab registripidajale avalduse välislepingu alusel tegutseva kiriku juhatus, lisades avaldusele põhikirja ja asutamislepingu asemel välislepingu teksti.
Käesoleva paragrahvi lõigetes 2 ja 3 nimetatud dokumendid kirikusse kuuluva kloostri või kirikusse või koguduste liitu kuuluva koguduse kohta, kes on juriidiline isik vastavalt oma põhikirjale või kiriku või koguduste liidu põhikirjale, esitab registrile vastava kiriku või koguduste liidu juhatus.

§ 13. Petition for entry in register
(1) A congregation with at least 12 adult members with active legal capacity shall be entered in the register.
(2) In order to enter a religious association in the register, the management board of the religious association shall submit a petition which sets out the information specified in subsection 1 of § 15 of this Act and which is signed by all members of the management board.
(3) The following shall be appended to the petition:
1) the memorandum of association and the statutes approved thereby, or the minutes of the foundation meeting and the statutes approved by the management board of the corresponding church or association of congregations;
3) telecommunications numbers (telephone, facsimile, etc);
4) proof of payment of the state fee.
(3¹) In the case of a religious association operating on the basis of an international agreement, the management board of the church operating on the basis of an international agreement shall submit a petition to the registrar, adding the text of the international agreement to the petition instead of the statutes and the memorandum of association.
(4) The documents specified in subsections 2 and 3 of this section, concerning a monastery which belongs to a church or a congregation which belongs to a church or association of congregations and which is a legal person pursuant to the statutes thereof or the statutes of the church or association of congregations shall be submitted to the register by the management board of the corresponding church or association of congregations.
§ 14. Registrisse kandmise menetluse peatamine ja registrisse kandmata jätmine
Usulise ühenduse asutamislepingu, põhikirja või selle muudatuste seaduses sätestatud nõuetele vastavuse või juhatuse liikme suhtes, kes ei ole Eesti Vabariigi kodanik, käesoleva seaduse § 23 lõikes 2¹ sätestatud takistuste puudumise kindlakstegemiseks pöördub registripidaja seisukoha saamiseks ministeeriumi poole, kelle valitsemisalas on usuliste ühendustega seotud küsimused, ning vajaduse korral pikendab kandeavalduse läbivaatamise tähtaega kuni kolme kuuni. Vajaduse korral kaasab ministeerium seisukoha koostamisse eksperte.
Registripidaja päringule usulise ühenduse juhatuse liikme suhtes käesoleva seaduse § 23 lõikes 2¹ sätestatud takistuste puudumise kohta vastab käesoleva paragrahvi lõikes 1 nimetatud ministeerium kolme tööpäeva jooksul päringu saamisest arvates.
Registripidaja ei kanna usulist ühendust registrisse, kui:
usulise ühenduse põhikiri või muud dokumendid ei vasta seaduse nõuetele;
usulise ühenduse tegevus kujutab ohtu riigi julgeolekule või põhiseaduslikule või avalikule korrale või kahjustab tervist, kõlblust või teiste inimeste õigusi ja vabadusi.
Registrisse kandmise avalduse tagasilükkamisel peab registripidaja ära näitama tagasilükkamise põhjuse.
§ 14. Suspension of proceedings for entry in register and refusal to enter in register
(1) In order to determine compliance of the memorandum of association, statutes or amendments thereto of a religious association with the requirements provided by law or, in the case of a member of the management board who is not a citizen of the Republic of Estonia, to determine the absence of the obstacles provided in subsection 2¹ of § 23 of this Act, the registrar requests the opinion of the ministry whose area of government includes management of issues relating to religious associations and, where necessary, extends the deadline for reviewing the petition for entry by up to three months. Where necessary, the ministry involves experts in the preparation of its opinion.
(1¹) The ministry specified in subsection 1 of this section replies to the request of the registrar in respect of a member of the management board of a religious association concerning the absence of the obstacles provided in subsection 2¹ of § 23 of this Act within three working days from receipt of the request.
(2) A registrar shall not enter a religious association in the register if:
1) the statutes or other documents submitted by the religious association are not in compliance with the requirements of law;
2) the activities of the religious association constitute a threat to national security or to constitutional or public order, or damage health, morals, or the rights and freedoms of others.
(3) Upon refusal to enter a religious association in the register, the registrar shall indicate the reason for the refusal.
§ 15. Registrisse andmete kandmine ja nende muutmine

Kiriku, koguduste liidu, kirikusse kuuluva kloostri ja kirikusse või koguduste liitu kuuluva koguduse registrisse kantud andmete muutumisel esitab avalduse muudatuste registrisse kandmiseks vastava kiriku või koguduste liidu juhatus.
Kirikusse mittekuuluva kloostri ja kirikusse või koguduste liitu mittekuuluva koguduse registrisse kantud andmete muutumisel esitab avalduse muudatuste registrisse kandmiseks vastava kloostri või koguduse juhatus.

Koguduse või kloostri liitumisel kiriku või koguduste liiduga ja koguduse või kloostri väljaastumisel või väljaarvamisel sealt esitab vastava kiriku või koguduste liidu juhatus registrile dokumendid käesoleva seaduse § 13 lõikes 4 toodud korras.
Avaldusele lisatavale protokolli väljavõttele ei pea lisama koosolekust osavõtnute nimekirja või muud dokumenti usulise ühenduse liikmeskonna kohta.
Registrisse kantud andmete muutmise avalduse läbivaatamisel kohaldab registripidaja käesoleva seaduse §-s 14 sätestatut.
§ 15. Entry of information in register and change thereof
(1) The following shall be entered in the register:
1) the name of the religious association;
2) the registered office and address of the religious association;
3) the date of the first mention or foundation of the religious association;
4) the date of entry into force of the statutes;
5) the names and personal identification codes of the members of the management board;
7) other information provided by law.
(2) Upon changes in the information of a church, an association of congregations, a monastery which belongs to a church and a congregation which belongs to a church or an association of congregations entered in the register, the management board of the corresponding church or association of congregations shall submit a petition for entry of the changes in the register.
(2¹) Upon changes in the information of a monastery which does not belong to a church and a congregation which does not belong to a church or an association of congregations entered in the register, the management board of the relevant monastery or congregation shall submit a petition for entry of the changes in the register.
(3) If a congregation or monastery joins a church or an association of congregations or if a congregation or monastery leaves or is excluded therefrom, the management board of the corresponding church or association of congregations submits to the register documents pursuant to the procedure provided in subsection 4 of § 13 of this Act.
(4) A list of participants in the meeting or any other document concerning the membership of the religious association need not be appended to the excerpt from the minutes appended to the petition.
(5) Upon reviewing a petition for entry of the changes in the information entered in the register, the registrar applies the provisions of § 14 of this Act.
§ 16. Ühinemine, jagunemine ja lõpetamine
Usulise ühenduse ühinemine, jagunemine ja lõpetamine toimub mittetulundusühingute seaduses mittetulundusühingute kohta ettenähtud korras, kui põhikiri või käesolev seadus ei sätesta teisiti, ning sellest teatatakse registrile vastavalt käesoleva seaduse § 13 lõikele 4.
Usulise ühenduse lõpetamine ja likvideerimine toimub:
põhikirjaga ettenähtud alusel ja korras;
usulisse ühendusse kuuluvate koguduste või liikmete arvu vähenemisel alla seaduses või põhikirjas sätestatud suuruse;
usulise ühenduse pankroti väljakuulutamisel;
käesoleva paragrahvi lõikes 3 sätestatud alusel ja korras.
Minister, kelle valitsemisalas on usuliste ühendustega seotud asjade korraldamine, taotleb kohtult usulise ühenduse sundlõpetamist, kui:
usulise ühenduse tegevus või põhikiri on vastuolus seaduse või põhiseadusega;
usulise ühenduse tegevuses ilmnevad käesoleva seaduse § 14 lõike 2 punktis 2 nimetatud tunnused;
usulise ühenduse tegevus ei vasta tema põhikirjalistele eesmärkidele;
usulise ühenduse põhitegevuseks saab majandustegevus.
§ 16. Merger, division and dissolution
(1) Merger, division and dissolution of a religious association shall be effected pursuant to the procedure prescribed for non-profit associations by the Non-profit Associations Act, unless otherwise provided by the statutes or this Act, and the register shall be notified thereof pursuant to subsection 4 of § 13 of this Act.
(2) A religious association shall be dissolved and liquidated:
1) on the basis and pursuant to the procedure prescribed by the statutes;
2) if the number of congregations or members of the religious association falls below the number specified by this Act or the statutes;
3) upon the declaration of bankruptcy of the religious association;
4) on the basis and pursuant to the procedure provided for in subsection 3 of this section.
(3) The minister whose area of government includes management of issues relating to religious associations shall request compulsory dissolution of a religious association from a court if:
1) the activities or statutes of the religious association are contrary to law or the Constitution;
2) facts specified in clause 2 of subsection 2 of § 14 of this Act become evident in the activities of the religious association;
3) the activities of the religious association are not in compliance with the objectives set out in the statutes;
4) economic activity becomes the main activity of the religious association.

§ 17. Registri pidamine
Usuliste ühenduste register on mittetulundusühingute ja sihtasutuste registri osa, mille suhtes kohaldatakse mittetulundusühingute ja sihtasutuste registri kohta õigusaktides sätestatut, kui käesolevast seadusest ei tulene teisiti.
Usuliste ühenduste registrit peetakse Eestis asuvate usuliste ühenduste kohta.

§ 17. Maintenance of register
(1) The register of religious associations is a part of the non-profit associations and foundations register with regard to which the provisions of legislation concerning the non-profit associations and foundations register apply unless otherwise provided for in this Act.
(2) The register of religious associations shall be maintained on the religious associations located in Estonia.
5. peatükk VAIMULIK JA JUHATUS
§ 20. Vaimulik
Usulise ühenduse vaimulik võib olla täisealine teovõimeline isik, kellel on Eestis viibimiseks seaduslik alus. Eestis viibimiseks seadusliku aluse olemasolu nõuet ei kohaldata usulise ühenduse vaimuliku juhi või vaimuliku suhtes, kelle tegutsemiskoht asub selle usulise ühenduse põhikirjaga seonduvalt väljaspool Eestit.
Vaimulikule esitatavad muud nõuded kehtestab usuline ühendus.
Usulise ühenduse vaimulik ei saa olla isik:
kellele on viimase kümne aasta jooksul keeldutud elamisloa andmisest või kelle elamisloa pikendamisest on keeldutud või kelle elamisluba on kehtetuks tunnistatud alusel, et isik kujutab või võib kujutada ohtu riigi julgeolekule;
kellele on viimase viie aasta jooksul keeldutud viisa andmisest või kelle viisa pikendamisest on keeldutud või kelle viisa on kehtetuks tunnistatud või tühistatud alusel, et isik kujutab või võib kujutada ohtu riigi julgeolekule.
Usulise ühenduse juhi või vaimuliku ametinimetus peab olema kirjutatud ladina tähtedega ja see ei või olla eksitav tegevuse eesmärgi ega ulatuse osas. Usuline ühendus, kelle huve on kahjustatud juhi või vaimuliku ametinimetuse õigustamatu kasutamisega, võib tsiviilkohtumenetluses nõuda selle õigustamatu kasutamise lõpetamist, samuti tekitatud kahju hüvitamist.
§ 20. Minister of religion
(1) An adult with active legal capacity who has a legal basis for stay in Estonia may be a minister of religion of a religious association. The requirement of the existence of a legal basis for stay in Estonia does not apply to the religious leader or a minister of religion of a religious association whose place of activity is outside Estonia in connection with the statutes of that religious association.
(2) Other requirements for a minister of religion are established by the religious association.
(3) The following persons may not be ministers of religion of a religious association:
1) a person who, within the last ten years, has been refused a residence permit or extension of a residence permit or whose residence permit has been revoked on the grounds that the person constitutes or may constitute a threat to national security;
2) a person who, within the last five years, has been refused a visa or extension of a visa or whose visa has been revoked or annulled on the grounds that the person constitutes or may constitute a threat to national security.
(4) The official title of the head or a minister of religion of a religious association must be written in Latin letters and must not be misleading with regard to the objectives or scope of activities. A religious association whose interests are damaged by the unauthorised use of the official title of its head or minister of religion may, in civil proceedings, demand termination of the unauthorised use thereof and compensation for damage caused thereby.
§ 21. Vaimuliku teenistusriietus
Usulise ühenduse põhikirjas ettenähtud vaimuliku teenistusriietust on õigus kanda ainult isikul, kellele usuline ühendus on selleks loa andnud. Nimetatud piirang ei laiene juhul, kui vaimuliku teenistusriietuseks on üldlevinud riietus.
Usuline ühendus, kelle huve on kahjustatud tema vaimuliku teenistusriietuse õigustamatu kasutamisega, võib tsiviilkohtumenetluses nõuda vaimuliku teenistusriietuse õigustamatu kasutamise lõpetamist, samuti sellega tekitatud kahju hüvitamist.
§ 21. Professional attire of minister of religion
(1) Only a person to whom a religious association has granted the corresponding permission has the right to wear the professional attire of a minister of religion prescribed by the statutes of the religious association. The specified restriction does not apply if ordinary clothing is the professional attire of the minister of religion.
(2) A religious association whose interests are damaged by the unauthorised use of the professional attire of its minister of religion may, in civil proceedings, demand termination of the unauthorised use of the professional attire of the minister of religion and compensation for damage caused thereby.
§ 22. Pihisaladus
Vaimulik ei või avaldada temale erapihil või hingehoidlikul vestlusel usaldatut, samuti isikut, kes erapihil või hingehoidlikul vestlusel käis.
§ 22. Confessional secret
A minister of religion shall not disclose information which has become known to him or her in the course of a private confession or pastoral conversation or the identity of a person who makes the private confession to or has a pastoral conversation with the minister of religion.
§ 23. Juhatus
Kirikul, kogudusel ja koguduste liidul peab olema juhatus. Juhatuse liikmete minimaalne ja maksimaalne arv nähakse ette põhikirjas.
Vähemalt poolte juhatuse liikmete elukoht peab olema Eestis, mõnes teises Euroopa Majanduspiirkonna liikmesriigis või Šveitsis.
Juhatuse liige ei saa olla isik:
kellele on viimase kümne aasta jooksul keeldutud elamisloa andmisest või kelle elamisloa pikendamisest on keeldutud või kelle elamisluba on kehtetuks tunnistatud alusel, et isik kujutab või võib kujutada ohtu riigi julgeolekule;
kellele on viimase viie aasta jooksul keeldutud viisa andmisest või kelle viisa pikendamisest on keeldutud või kelle viisa on kehtetuks tunnistatud või tühistatud alusel, et isik kujutab või võib kujutada ohtu riigi julgeolekule.
Kloostri puhul käsitatakse juhatusena käesoleva seaduse mõttes kloostriülemat.
Usulise ühenduse põhikirja kohaselt ametikohajärgselt usulise ühenduse juhatusse kuuluva vaimuliku või kloostriülema suhtes ei kohaldata seaduses sätestatud juhatuse liikme ametiaja piirangut. Usuline ühendus esitab sellekohase informatsiooni registrile käesoleva seaduse § 13 lõikes 2 või 3¹ või § 15 lõikes 2 või 2¹ nimetatud avalduses.
Usulise ühenduse juhatusse kuuluva vaimuliku või kloostriülema puhul kantakse usulise ühenduse taotlusel registrisse ka tema kiriklik nimi. Usuline ühendus esitab kirikliku nime ja informatsiooni selle nime vaimulikule või kloostriülemale omistamise kohta registrile käesoleva seaduse § 13 lõigetes 2 ja 3¹ ning § 15 lõigetes 2 ja 2¹ nimetatud avalduses.
§ 23. Management board
(1) A church, congregation and association of congregations shall have a management board. The minimum and maximum number of members of the management board shall be prescribed by the statutes.
(2) The residence of at least one half of the members of the management board must be in Estonia, in another Member State of the European Economic Area or in Switzerland.
(2¹) The following persons may not be members of the management board:
1) a person who, within the last ten years, has been refused a residence permit or extension of a residence permit or whose residence permit has been revoked on the grounds that the person constitutes or may constitute a threat to national security;
2) a person who, within the last five years, has been refused a visa or extension of a visa or whose visa has been revoked or annulled on the grounds that the person constitutes or may constitute a threat to national security.
(3) Within the meaning of this Act, the superior of a monastery is deemed to be the management board of the monastery.
(4) The restriction on term of office of a management board member established by law shall not be applied to a minister of religion or the superior of a monastery included in the management board of a religious association by position in accordance with the statutes of the religious association. A religious association shall submit the relevant information to the register in the petition specified in subsection 2 or 3¹ of § 13 or subsection 2 or 2¹ of § 15 of this Act.
(5) The religious title of a minister of religion or a superior of a monastery included in the management board of a religious association is also entered in the register at the request of the religious association. The religious association submits the religious title and information on awarding the minister or religion or the superior of a monastery with the title to the register in the petition specified in subsections 2 and 3¹ of § 13 and subsections 2 and 2¹ of § 15 of this Act.
§ 24. Juhatuse esindusõigus ja juhatuse liikme vastutus
Juhatuse esindusõiguse ja juhatuse liikme vastutuse suhtes kohaldatakse mittetulundusühingute seaduses sätestatut.
§ 24. Right of representation of management board and liability of members of management board
The provisions of the Non-profit Associations Act apply to the right of representation of the management board and the liability of members of the management board.
6. peatükk USULISE ÜHENDUSE VARA
§ 25. Varalised õigused ja kohustused
Kirikul, kogudusel ja koguduste liidul on õigus võtta oma liikmetelt liikmemaksu põhikirjas ettenähtud korras.
Usulisel ühendusel on õigus võtta tasu usuliste talituste eest, korraldada sihtotstarbelisi korjandusi, vastu võtta annetusi ja pärandvara ning saada sissetulekuid oma varadest.
Usulise ühenduse vara hulka kuuluvaid kultuurimälestisi võib usuline ühendus pantida, anda kasutusse või võõrandada juhatuse otsuse alusel, arvestades muinsuskaitseseadusega kehtestatud nõudeid. Kirikusse või koguduste liitu kuuluvad kogudused teostavad seda õigust kiriku või koguduste liidu juhatuse loal põhikirjas ettenähtud või põhikirja alusel kehtestatud korras.
Kiriku või koguduste liidu põhikiri võib sätestada, et kirikusse või koguduste liitu kuuluvad kogudused võivad kinnisasju anda kasutusse, koormata piiratud asjaõigustega või võõrandada kiriku või koguduste liidu juhatuse loal põhikirjas ettenähtud või põhikirja alusel kehtestatud korras.
Usuline ühendus korraldab raamatupidamise vastavalt raamatupidamise seaduses sätestatule ja oma põhikirjale.
§ 25. Proprietary rights and obligations
(1) Churches, congregations and associations of congregations have the right to charge a membership fee from their members pursuant to the procedure provided for in the statutes.
(2) A religious association has the right to charge a fee for religious rites, organise fund-raising for specific purposes, accept donations and estate and receive income from its assets.
(3) A religious association may pledge, grant use of or transfer cultural monuments which belong to the assets of the religious association on the basis of a resolution of the management board, taking account of the requirements established by the Heritage Conservation Act. Congregations which belong to a church or association of congregations shall exercise such right with the permission of the management board of the church or association of congregations pursuant to the procedure prescribed by or established on the basis of the statutes.
(4) The statutes of a church or association of congregations may provide that the congregations which belong to a church or association of congregations may grant use of immovables, encumber immovables with limited real rights or transfer immovables with the permission of the management board of the church or association of congregations pursuant to the procedure prescribed by or established on the basis of the statutes.
(5) A religious association shall organise the accounting pursuant to the provisions of the Accounting Act and its statutes.
§ 25¹. Majandusaasta aruanne
Registrisse kantud usuline ühendus ja usuühing esitab majandusaasta aruande mittetulundusühingute seaduse § 36 lõigete 5 ja 5¹ kohaselt ilma põhitegevusala andmeteta elektrooniliselt äriregistri seaduse § 7 lõike 2 punkti 1 alusel kehtestatud korras.
§ 25¹. Annual report
Religious associations and religious societies entered in the register submit an annual report pursuant to subsections 5 and 5¹ of § 36 of the Non-profit Associations Act pursuant to the procedure established on the basis of clause 1 of subsection 2 of § 7 of the Commercial Register Act without the data concerning the principal activity.
§ 26. Järelevalve
Põhikirjas kehtestatud korra kohaselt määratakse revisjon või audiitorkontroll.
Juhatuse ja muu organi liikmed peavad võimaldama revidendil või audiitoril tutvuda kõigi revisjoni või audiitorkontrolli läbiviimiseks vajalike dokumentidega ning andma vajalikku teavet.
Revidendid või audiitorid koostavad revisjoni või audiitorkontrolli tulemuste kohta aruande, mille esitavad revisjoni või audiitorkontrolli määranud organile.
§ 26. Supervision
(1) A review or audit may be called for pursuant to the procedure established in the statutes.
(2) The members of the management board and of other bodies shall allow controllers or auditors to examine all documents necessary for conduct of a review or audit and shall provide necessary information.
(3) Controllers and auditors shall prepare a report concerning the results of a review or audit and present the report to the body which called for the review or audit.
§ 27. Usulise ühenduse tegevuse lõpetamisel järelejäänud vara kasutamine
Kirikusse või koguduste liitu kuuluva koguduse või kloostri lõpetamisel läheb pärast võlausaldajate nõuete rahuldamist järelejäänud vara vastavale kirikule või koguduste liidule.
Kiriku, koguduste liidu, kirikusse või koguduste liitu mittekuuluva koguduse või kloostri põhikirjalise tegevuse lõpetamisel läheb pärast võlausaldajate nõuete rahuldamist järelejäänud vara üle riigile ning seda võib kasutada ainult heategeval või hariduslikul otstarbel.
§ 27. Use of assets remaining upon termination of activities of religious association
(1) Upon dissolution of a congregation or monastery which belongs to a church or association of congregations, the assets remaining after satisfaction of the claims of creditors are transferred to the corresponding church or association of congregations.
(2) Upon termination of the activities, as specified in the statutes, of a church, an association of congregations, a congregation or monastery which does not belong to a church or association of congregations, the assets remaining after satisfaction of the claims of creditors are transferred to the state and may be used only for charitable or educational purposes.

§ 28. Käesoleva seaduse kohaldamine usulistele ühendustele
Enne 2002. aasta 1. juulit asutatud usulistele ühendustele kohaldatakse nende usuliste ühenduste registrisse kandmiseni käesoleva seaduse §-des 1–3, 5–10, 16 ja 20–27 sätestatut.
Siseministeeriumi juures peetavasse kirikute, koguduste ja koguduste liitude registrisse kantud usulised ühendused saavad registrisse kantud andmeid muuta, täiendada ja kustutada enne käesoleva seaduse jõustumist kehtinud korras kuni 2005. aasta 1. jaanuarini.
§ 28. Application of this Act to religious associations
(1) The provisions of §§ 1–3, 5–10, 16 and 20–27 of this Act apply to religious associations founded before 1 July 2002 until entry of the religious associations in the register.
(2) Religious associations entered in the register of churches, congregations and associations of congregations maintained by the Ministry of Internal Affairs may amend and delete data entered in the register pursuant to the procedure in force before the entry into force of this Act until 1 January 2005.
§ 29. Registrisse kandmise avaldus
Enne 2002. aasta 1. juulit asutatud ning Siseministeeriumis registreeritud usuline ühendus, kes vastab käesoleva seaduse nõuetele, kantakse registrisse tema avalduse alusel.
Registrisse kandmise avalduses tuleb märkida käesolevas seaduses sätestatud andmed ning avaldusele tuleb lisada tema Siseministeeriumis registreerimise tunnistus ja seaduses sätestatud dokumendid, välja arvatud asutamisleping või asutamiskoosoleku protokoll.
Usulise ühenduse põhikiri peab registrisse kandmiseks olema viidud kooskõlla käesolevas seaduses sätestatuga.
Registrisse kandmise avaldus vaadatakse läbi kahe kuu jooksul, arvates avalduse ja kõigi muude ettenähtud dokumentide esitamisest.
§ 29. Petition for entry in register
(1) Religious associations which were founded before 1 July 2002 and are registered with the Ministry of Internal Affairs and which comply with the requirements of this Act shall be entered in the register on the basis of their petition.
(2) A petition for entry in the register shall set out the information provided for in this Act, and the certificate of registration of the religious association with the Ministry of Internal Affairs together with documents provided for in this Act, except the memorandum of association or the minutes of the foundation meeting, shall be appended to the petition.
(3) In order for a religious association to be entered in the register, the statutes of the religious association shall be brought into conformity with the provisions of this Act.
(4) A petition for entry in the register shall be reviewed within two months as of submission of the petition and all other prescribed documents.
§ 29¹. Registripidajale esitatud dokumentide säilitamine
Registripidajale edastatud dokumendid, mis sisaldavad andmeid usulise ühenduse liikmeskonna kohta, viiakse avalikust toimikust registritoimikusse. Kui usuline ühendus on esitanud registripidajale avalduse, mis on ühiselt e-allkirjastatud koos dokumendiga, mis sisaldab andmeid usulise ühenduse liikmeskonna kohta, siis viiakse registritoimikusse kõik ühiselt e-allkirjastatud dokumendid.
§ 29¹. Maintenance of documents submitted to registrar
Documents which are sent to the registrar and contain information about the membership of a religious association shall be transferred from the public file to the registry file. If the religious association has submitted an application to the registrar which has been electronically signed together with a document containing information about the membership of the religious association, all documents which have been jointly electronically signed shall be transferred to the registry file.
§ 30. Märked registrites
Siseministeeriumis registreeritud usulise ühenduse registrisse kandmisel tehakse registripidaja teate alusel kirikute, koguduste ja koguduste liitude registrisse sellekohane märge.
Enne käesoleva seaduse jõustumist asutatud usulise ühenduse registrisse kandmisel tehakse registrisse märge varasema registreerimise kohta Siseministeeriumis, näidates ära endise registrinumbri.
§ 30. Notations in registers
(1) Upon entry of a religious association registered with the Ministry of Internal Affairs in the register, a corresponding notation shall be made in the register of churches, congregations and associations of congregations on the basis of a notice from the registrar.
(2) Upon entry of a religious association founded before the entry into force of this Act in the register, a notation concerning the earlier registration with the Ministry of Internal Affairs shall be made in the register, indicating the former registration number.
§ 31. Lõpetamine
Siseministeeriumis registreeritud usulised ühendused, kelle registrisse kandmiseks ei ole 2005. aasta 1. jaanuariks avaldust esitatud või kelle nimetatud tähtaja jooksul esitatud registrisse kandmise avaldus on jäetud rahuldamata, loetakse sundlõpetatuks.
Käesoleva paragrahvi lõikes 1 märgitud põhjustest tuleneval sundlõpetamisel kohaldatakse mittetulundusühingute seaduse §-s 95 sätestatud korda.
§ 31. Dissolution
(1) Religious associations registered with the Ministry of Internal Affairs for the entry of which in the register no petition has been submitted by 1 January 2005, or whose petition for entry in the register submitted within the specified term has been dismissed are deemed to have undergone compulsory dissolution.
(2) Upon compulsory dissolution resulting from the reasons set out in subsection 1 of this section, the procedure provided for in § 95 of the Non-profit Associations Act applies.
§ 31¹. Teate esitamine juhatusse kuuluva vaimuliku või kloostriülema kohta
Enne käesoleva seaduse § 23 lõike 4 jõustumist juhatuse liikmena registrisse kantud selle lõike esimeses lauses nimetatud vaimuliku või kloostriülema kohta võib usuline ühendus esitada registrile sellekohase teate § 15 lõikes 2 või 2¹ sätestatud korras.
§ 31¹. Submission of notice concerning minister of religion or superior of monastery included in management board
Before the entry into force of subsection 4 of § 23 of this Act concerning a minister of religion or the superior of a monastery entered in the register as a management board member specified in the first sentence of the specified subsection, a religious association may submit a relevant notice to the register pursuant to the procedure provided for in subsection 2 or 2¹ of § 15.
§ 31². Käesoleva seaduse § 3 lõike 2¹, § 4 lõike 1¹, § 12 lõike 1² ja § 23 lõike 2¹ rakendamine
Usuline ühendus või usuühing, mille põhikiri, juhatuse koosseis või tegevus ei ole vastavuses käesoleva seaduse § 3 lõikes 2¹, § 4 lõikes 1¹, § 12 lõikes 1² või § 23 lõikes 2¹ sätestatud nõuetega, peab oma põhikirja, juhatuse koosseisu ja tegevuse viima eespool nimetatud nõuetega vastavusse ning esitama avalduse muudatuste mittetulundusühingute ja sihtasutuste registrisse kandmiseks kuue kuu jooksul nimetatud sätete jõustumisest arvates.
Registripidaja ei käsita käesoleva paragrahvi lõikest 1 tulenevalt esitatud kandeavalduse lahendamisel kande tegemist takistava puudusena usulise ühenduse või usuühingu registrisse kantud põhikirja rakendamata jätmist selles osas, mis nõuab käesoleva seaduse § 3 lõikes 2¹, § 4 lõikes 1¹, § 12 lõikes 1² või § 23 lõikes 2¹ nimetatud isiku või juhtorgani osalemist otsuse vastuvõtmises, heakskiitmises või kinnitamises.
Registripidaja ei käsita kirikusse kuuluva koguduse või kloostri või koguduste liitu kuuluva koguduse kandeavalduse lahendamisel kande tegemist takistava puudusena käesoleva seaduse § 15 lõike 2 järgimata jätmist, samuti käesolevas lõikes eespool nimetatud koguduse või kloostri põhikirja rakendamata jätmist selles osas, mis nõuab kiriku või koguduste liidu juhtorgani osalemist otsuse vastuvõtmises, heakskiitmises või kinnitamises, kui:
kandeavalduse esitanud kogudus või klooster kuulub kirikusse või koguduste liitu, mille põhikiri, juhatuse koosseis või tegevus ei ole vastavuses käesoleva seaduse § 3 lõike 2¹, § 4 lõike 1¹, § 12 lõike 1² või § 23 lõike 2¹ nõuetega, või
on jõustunud kohtuotsus selle kiriku või koguduste liidu sundlõpetamise kohta käesoleva seaduse § 16 lõikes 3 nimetatud alusel.
§ 31². Implementation of subsection 2¹ of § 3, subsection 1¹ of § 4, subsection 1² of § 12 and subsection 2¹ of § 23
(1) A religious association or religious society whose statutes, composition of the management board or activities do not comply with the requirements provided in subsection 2¹ of § 3, subsection 1¹ of § 4, subsection 1² of § 12 or subsection 2¹ of § 23 of this Act, must bring its statutes, composition of the management board and activities into compliance with the abovementioned requirements and submit a petition for entry of the amendments in the non-profit associations and foundations register within six months of the entry into force of the said provisions.
(2) When deciding on a petition for entry submitted pursuant to subsection 1 of this section, the registrar does not regard the failure to implement the statutes of a religious association or religious society entered in the register as an obstacle preventing entry in the register in so far as it requires the participation of a person or governing body specified in subsection 2¹ of § 3, subsection 1¹ of § 4, subsection 1² of § 12 or subsection 2¹ of § 23 of this Act in the adoption, approval or confirmation of a decision.
(3) When deciding on a petition for entry of a congregation belonging to a church, a monastery or a congregation belonging to an association of congregations, the registrar does not regard the failure to comply with subsection 2 of § 15 of this Act as an obstacle preventing entry in the register, nor does the registrar regard the failure to implement the statutes of the congregation or monastery specified above in this subsection as an obstacle preventing entry in the register in so far as it requires the participation of the governing body of the church or the association of congregations in the adoption, approval or confirmation of a decision, provided that:
1) the congregation or monastery that has submitted the petition for entry belongs to a church or an association of congregations whose statutes, composition of the management board or activities are not in compliance with the requirements of subsection 2¹ of § 3, subsection 1¹ of § 4, subsection 1² of § 12 or subsection 2¹ of § 23 of this Act, or
2) a court judgement on the compulsory dissolution of that church or association of congregations has entered into force on the grounds specified in subsection 3 of § 16 of this Act.
