Court fees rise on 01.01.2027: 310 euros for a divorce claim, 75 euros for an administrative court appeal

From 01.01.2027 several court fees increase under the State Fees Act (riigilõivuseadus, RLS). A statement of claim for divorce or for terminating a registered partnership agreement costs 310 euros [1] instead of the previous 100 euros [2], and an appeal to an administrative court costs 75 euros instead of the previous 20 euros [3] [4].

What changes

Civil proceedings (RLS § 59):

• RLS § 59 lg 2: previously „Hagiavalduse esitamisel abielu lahutamiseks või kooselulepingu lõpetamiseks tasutakse riigilõivu 100 eurot.“ (translation: a state fee of 100 euros is paid on filing a statement of claim for divorce or for terminating a registered partnership agreement) [2] → now „Hagiavalduse esitamisel abielu lahutamiseks või kooselulepingu lõpetamiseks tasutakse riigilõivu 310 eurot.“ (translation: … a state fee of 310 euros) [1]
• RLS § 59 lg 4: the fee for a claim with a non-proprietary demand under § 132 subsection 4 of the Code of Civil Procedure was 420 euros [2]; the new fee is 630 euros [1].
• RLS § 59 lg 17: previously „Hagi tagamise või eeltõendamismenetluse taotluse esitamisel tasutakse riigilõivu 70 eurot.“ (translation: a fee of 70 euros is paid on applying for securing a claim or for pre-trial taking of evidence) [2] → now „Hagi tagamise avalduse või eeltõendamismenetluse taotluse esitamisel tasutakse riigilõivu 150 eurot. Esialgse õiguskaitse taotluse esitamisel tasutakse riigilõivu 70 eurot.“ (translation: a fee of 150 euros is paid on applying for securing a claim or for pre-trial taking of evidence; a fee of 70 euros on applying for interim relief) [1]
• RLS annex 1 (the fee based on the value of the claim, payable under RLS § 59 lg 1 [1]): from the same day this table is also replaced, and the fees rise by roughly one and a half times, for example from 100 to 150 euros for a claim of up to 350 euros. The new table is in the amending act published in Riigi Teataja (RT I, 11.07.2026, 9).

Administrative court proceedings (RLS § 60):

• RLS § 60 lg 1: previously „Halduskohtule kaebuse esitamisel tasutakse riigilõivu 20 eurot.“ (translation: a fee of 20 euros is paid on filing an appeal with an administrative court) [3] → now „Halduskohtule kaebuse esitamisel tasutakse riigilõivu 75 eurot.“ (translation: … 75 euros) [4]
• RLS § 60 lg 2: for an appeal seeking compensation for damage or the return of unjust enrichment, the fee is still three percent of the amount claimed, but instead of „mitte alla 20 euro ja mitte üle 1050 euro“ (translation: not less than 20 euros and not more than 1050 euros) [3] it is now „mitte alla 75 euro ja mitte üle 2500 euro“ (translation: not less than 75 euros and not more than 2500 euros) [4].
• RLS § 60 lg 3: the fee for an appeal seeking just compensation without stating an amount was 350 euros [3]; the new fee is 830 euros [4].
• RLS § 60 lg 4: for an appeal against the tax authority or another administrative authority the fee is three percent of the contested amount, now „mitte alla 75 euro ja mitte üle 2500 euro“ (translation: not less than 75 euros and not more than 2500 euros) [4] (previously not less than 20 and not more than 1050 euros [3]). The provision now expressly also covers appeals relating to „rahalise toetuse andmisega“ (translation: the granting of financial support) [4].
• RLS § 60 lg 6 and lg 8: the fee for applying for interim relief in an administrative court rises from 20 to 75 euros, and the fee for an appeal in cassation or a petition for review to the Supreme Court in an administrative case from 50 to 100 euros [3] [4].

Who is affected

People divorcing or ending a registered partnership [1], claimants with monetary claims (RLS annex 1), claimants with non-proprietary demands and those applying for securing a claim or evidence [1], and everyone challenging decisions of administrative authorities, including the tax authority, in an administrative court [4].

What to do

1. The previous rates apply until 31.12.2026 [2] [3]; under the provisions the fee is paid on filing the claim or appeal [1] [4]. If you plan to go to court, take the new rates into account from 01.01.2027.
2. For a monetary dispute in an administrative court, calculate the fee as three percent of the contested amount within the new limits (75–2500 euros) [4].
